smoggy air stop? it's now hitting millions in 18 states from wildfires in canada. we have the latest. i'm elizabeth macdonald, the "evening edit" starts right now. joining us now from house oversight, andy biggs and legal- legal sam dooey. gentlemen, good to see you. comment, today your committee released a resolution holding fbi director wray in contempt of congress for not physically handing over the fbi document alleging then-vice president was involved in a $5 million bribery scream in ukraine. congressman, where does this go? congressman bigs? we are having technical difficulties. sam, where do you think this goes? >> well, procedurally, the resolution is going to be

introduced and voted on in the morning and i would expect that shortly before the resolution is voted on, the biden administration would invoke executive privilege , because unless they invoke executive privilege director wray has then committed a criminal offense, contempt of congress. doj says if there is invocation of executive privilege you haven't committed contempt of congress. at that point i would expect the committee to consider that claim. i think that claim be extraordinarily weak, given this doesn't involve presidential communications. there's no deliberation here. this isn't classified, and congress gets information related to ongoing investigation s all the time. they almost certainly reject that assertion, properly in my view and then there be a committee vote and then it would go to the full floor for a vote. so that's the legislative process. liz: so i think congressman bigs is back with us. congressman, you know, the fbi even refused to admit the

document was real. only up until about a week ago. i mean, also the democrat narrative, congressman, is quickly falling apart. attorney general bill barr, former attorney general bill barr, congressman, he now says no, democrat jamie raskin is wrong here. democrats are wrong to say that under barr, the doj, the fbi probe on this was dropped. it was not dropped. a.g. barr says it was sent to the u.s. attorney' office in delaware for further investigation. what do you think of that? >> yeah, i'm not surprised because mr. raskin was kind of working on a fiction novel there , but i think what we know now is that the document exists, whereas you pointed out they said it didn't exist, number two , i'm not sure an investigation was ever opened but it was referred to the delaware a.g.'s office and so it was sitting there. third thing is as we're moving forward here, the fbi now is coming in trying to negotiate the last minute letting us have

access to that document, and additional negotiations are going on with regard to other pieces of evidence as well. liz: so that's the news coming in that the fbi is now after all this saying we'll show the fbi document to the entire house oversight committee. this , you know, sam, this is coming under threats though of contempt of congress. the fbi is only acting after those threats, sam. i mean, the fbi first got this bribery allegation about vice president biden at the time back into 2017. that's way before rudy giuliani. this is like three years before rudy giuliani was bringing forward information to law enforcement. sam? >> absolutely. there's zero indication this is linked to mr. guiliani and there's a lot of disclosures that show the liable informant paid, used in other cases pre- dated and as to the negotiations, it's pretty clear doj was enacting in good faith.

this is about a single document. they didn't even acknowledge it existed for almost a month. this is not a good faith negotiation. this is last minute stonewalling on the breaking news, i don't think anything other than production is acceptable. i think chairman comer has it exactly right, because as an investigator, the in dashcam rail entitlement review they are offering will not allow the committee to know the names of the people mentioned in that memo, to consider those , to draft their own subpoenas, and really investigate the allegations, because it's pretty clear that the fbi and the u.s. attorney in delaware hasn't done so. liz: so, you know, what sam just said. there is this development too, congressman. house oversight chair comer says the footnotes in the document make it clear that this fbi informant made multiple allegations to the fbi alleging vice president biden engaged in bribery. this is, we're counting at least

three times. first in 2017, then again another time, and then the third time in june 2020 report, so congressman bigs, there are multiple instances, allegations here. >> yeah, that's right, liz, and that's why i think we have to get the document and get hands-on, so we can actually expand the investigation out to find out what happened to this other allegations. this is serious stuff. if this is accurate, and by the way, the person that gave us this information and gave them that information, that person was considered to be credible, reliable, and had been previously used as a source, so we've got to be able to get the documents so we can actually expand the investigation out a little bit further and if this is accurate, like it seems to be, contrary to what my democrat friend said the other day, this actually is probably one of the biggest scandals in the united states history, and

so we can't short change it. we're going to have to give it everything we have and we've got to demand that he give us that document. liz: congressman andy biggs and sam dewey, thanks for joining us tonight. turning to this story. the update on that wild brawl between participants and activists outside a california school. fox news william la jeunesse is live in los angeles with the latest. william? reporter: well, liz, the agenda last night was about bringing lgbtq awareness into the classroom during pride month , june, but parents say the problems are much bigger than that. they have zero input on how sexual and gender studies are taught. they are not informed when they are and students cannot opt out. here, you'll see those opposing groups, activists in pink bandan as squaring off against armenian and hispanic parents. >> they need to stop asking little children what they sexual ly identify as. children are not sexual beings nor should they be. reporter: parents also say children must share bathrooms

with transgender students. >> anybody could come to the principal and say, you know what i'm transgender and walk in the girls bathroom. >> what makes their child more important than a trans girl who when she goes into the male bathroom gets beat up. reporter: so, the school board claims it's only following state law, which says curriculum must include lgbtq studies and feature prominent lesbian, gay sexual and transgender americans , and participants may not opt out of any of those classes. schools must refer to a student by the name or pronoun of their choice, and that information cannot be disclosed to parents, and all transgender students have access to a locker or restroom of their chosen gender identity. >> where is the consent form that gives this school district or any other school district permission to discuss, diagnose, or affirm my child's sexual orientation or gender identity.

informing parents. you know what i mean? what's your reaction to the story? >> well, thanks for having me, elizabeth. this is a really good sign, right? the fact that parents are up in arms, that they are protesting and actually have the courage to speak out, finally, about what's been going on in our schools for the past decade or so. it's a very good thing, and let's be very clear. there is an all-out assault against the innocence of our children. i tell my kids all the time and i tell other participants that no one should talk to other children, other people's children about sex. those are the types of people that should be kept more than 500 feet away from a school. these are inappropriate conversations and no one in these schools is equipped to handle them. liz: it's unfortunate it had to come to cuffs and blows. terry, also this story. house judiciary chair jim jordan , he sent another letter to white house chief of staff yesterday, terry. he's threatening a subpoena of the white house if it does not turnover by june 20, e-mails and

text messages, in how the white house coordinated with the national school board association and the justice department to target school board parents as domestic terrorists. this probe looks like they are expanding it. >> they are and rightfully so. what we are seeing, what's being alleged, elizabeth, just to be very clear, is one of the most egregious violations and over steps of government power we've ever seen. what we have is the federal government through the biden administration is being accused of creating this entire controversy out of whole. it was the biden administration that's being accused right now. they went to the national school board association and they solicited a letter so that they could investigate and shutdown these parents as domestic terrorists. this was not an organic thing. this did not come from the national school board association. this came from the biden administration and jim jordan is going to get to the bottom of it liz: he's saying that the justice department and education department still not

cooperating with house judiciary and he is zeroing in on a senior advice for to president biden, person by the name of mary wall. this person was a conduit between the white house, multiple agencies and the national board association and we have government whistleblowers talking to lawmakers too about this. what do you think? >> that's exactly right and listen. there's one reason why they wanted to shutdown these school board protests, is because once parents figure out what's happening to their kids in schools, they're going to put a stop to it. they want the minds of our children. that is the entire point of what the progressive movement and these woke activists within the biden administration want, is they want to corrupt their minds and indoctrinate them into their regime so that in five to 10 years they have a whole huge majority of woke american citizens that will vote for the democrats. liz: but then you have the southern poverty law center equating parent represent all rights organizations with the k

liz: well look whose back with us. he is from house ways and means congressman jason smith the chair of that committee. congressman good to see you. you've been working on cutting spending. you've been working on cutting back government and fixing things down there, but we've got this report that still is nearly half of government workers are working remotely from home, even though the pandemic is over. martha stuart is saying people need to get back to the office. >> you know, it's unacceptable. that's why we passed a bill called the show-up act to actually get federal employees back to work. the first major piece of legislation that joe biden and nancy pelosi and chuck schumer passed was the american rescue plan which paid $400 billion to people not to work, and that's

why you've seen help wanted signs go all over the country. so we definitely have a labor shortage but we just moved legislation enforcing work requirements for snap and welfare benefits. that should hopefully be a little bit helpful. i would have liked for it to have gone much further but it's a step in the right direction but these federal employees need to show up, just at social security, they are behind by more than a million cases, because people are working from home. they need to get back to work and i have wished the white house would see the light of the day there. liz: it's interesting you say that. martha stuart is saying she doesn't want america to "go down the drain" and saying we don't want to turn into france. u.s. worker productivity year-over-year congressman you've seen this decline for five straight quarters. we've got average office occupancy still at half of pre- pandemic levels. this is what happens when you put government spending on just basically a trigger going

with it for a little while. we got up to very unhealthy is what the purple color indicates yesterday but now we jumped up to the hazard us level in last several hours, that's continuing overnight and into tomorrow. i can show you a little bit of that in just a couple minutes but this is new york city on a typical day, beautiful. today, looks like something out of the movie from mars. that's what it looks like outside today. absolutely incredible just how thick and dense this fog is. visibility is down to a mile or less. not just in new york city but stretching back up to the north where this is ultimately coming from up in canada, so you're looking at pennsylvania, parts of up state new york. all dealing with this very heavy smoke. philadelphia is getting in on the action also as we're looking at really bad conditions, now this deep maroon color is where it's the worst, and you do not want to be outside in this. even when you get over to the oranges that could be dangerous for the elderly and young children, so everything in the red, purple, maroon, these are really bad conditions that

we're currently dealing with. it's all kind of following the wind you're seeing moving off towards the coast so that's funneling this into the city. our smoke tracker will show you and this has done a really good job the last couple days where the smoke be. it'll show you by the time we get to friday, you begin to breakup so think it's going to be bad tonight. it's still bad tomorrow morning. you start to see it maybe fall apart as you get into friday. then the worst of it shifts off towards the west, so p.i.t. pittsburgh, cleveland, detroit, indianapolis, along east coast by friday starting to breakup just a little bit all because of these winds we're paying attention to and this is the final thing i'll show you. the winds consistently the last couple of days, liz, have been coming out of the north. i run this the time stamps up into the corner eventually by the time we get into the weekend friday, saturday, sunday winds shift and then suddenly, yes, the wildfires will still be going but the smoke will no longer be going in united states it's actually pushing backup to the north so we do have a couple more days of pretty nasty conditions outside.

liz: okay, the senate today taking new steps to try to get a grip on artificial intelligence and regulate it. this is now moving fast around the world. fox news senior congressional correspond entertainment chad pergram has the latest on capitol hill. chad? reporter: liz, good evening. the goal of senate majority leader chuck schumer is to take on a.i. before it takes on us. schumer plans a series of bipartisan briefings on a.i. this summer. >> the senate and all leaders have an obligation to deepen our expertise in a.i. because if we do our jobs correctly, we can ensure a.i. becomes a remarkable force for human prosperity, while mitigating its very real potential risks.

by these tech companies. the upside of course is that our lives might be easier. we might have access to information that's useful in better ways. the downside is that it is a threat to our entire existence. the way we think through things. the way we control things, and, you know, you mentioned chad mentioned social media companies are involved. social media companies do not want the government to put parameters on them because they like to try to create societies in their own image. artificial intelligence will be the greatest tool, whether we're talking about members of congress, the biden administration or these tech companies, the greatest tool they have ever had to socialize america. liz: well that's not good. i mean, how do you combat that because experts are saying this is shaping up to be the next space race between u.s. and china for a.i. dominance and going to dictate the future. we have experts noting the chinese military and government and tech companies

are all working together to advance chinese a.i. but in the u.s. it's the tech companies taking charge. go ahead. >> yeah, this is the trick. we cannot allow the chinese to beat us. we have to win the a.i. race. at the same time, the companies in america that are supposed to be leading this , they are sort of bought and sold by the democrat party and vice versa, so i can not tell you how happy i am that senator josh haw ley is taking this seriously. he is the first republican in congress to take this seriously and recommended five guiding principles. most of those principles i think are good, but we need to go deeper. we've got to protect us from these tech executives who really do not have our interest at heart. liz: you know, open a.i. ceo sam altman, he even said, you know, we need something like the united nations nuclear watchdog as an example of how you have to come together to oversee what he is saying dangerous technology. your final word. >> yeah, well, we've seen how

liz: joining us now from house oversight is congressman pat fallon. congressman, good to see you. okay the democrat narrative is immediately falling apart on this story, on the allegations that president biden when he was vice president engaged in bribery this is about that document at the fbi. what did you make of former u.s. attorney general william barr saying democrats led by jamie raskin is wrong, that he did not shut down the doj probe on this. that instead this bribery allegation went over to the u.s. attorney's office in delaware? this is gaslighting is not working out. >> well you've got fiction, perpetuated by jamie raskin and democrats, you have reality, i'm

glad former attorney general barr shared the truth with us and the american people. first and foremost this investigation was not shut down by the attorney general under president trump. secondly rudy giuliani had nothing to do with this. this fd-1023 was generated by using the fbi's words, liz, a highly credible human source that they have used for over 10 years, given and paid to this person, hundreds of thousands of dollars, and he had direct contact with the person making the allegation that said they paid five million dollars to joe biden for policy decisions. this could, it starts to smell like a major scandal. liz: congressman, house oversight chair comer says that these allegations came to the fbi starting in, way back in 2017. that's three years, three years before rudy giuliani in 2020 came forward with information, any information about the biden families. also house oversight chair comer

is making clear the i am informant to the fbi made allegations three times at least. 2017 he provided bribery allegations to the fbi. one more time. then a third time in june of 2020. >> well what's even more troubling is apparently a fbi supervisory agent, brian auton put it in subfile with restricted access. when it was referred to delaware by then attorney general barr, the fbi agents that were tasked to investigate by the u.s. attorney wouldn't be able to ask the fd-1023 which is the basis of the allegation! this is starting to smell worse and worse by every bit of information we find, every new bit of information. this is beginning to be far worse for the president. liz: you're hearing that fbi officials purposely buried this bribery charge in their system, is that what you're hearing?

>> that's what i'm hearing. that is, and that is highly troubling because what i was hoping for, liz, when director wray brought this to, brought the fd-1023 the form over yesterday hoped he also brought a file about this thick showing all how the fbi, what does it stand for, federal bureau of investigation, did their investigation and they did all of this work to find these allegations were either credible or not but they did their job. it is our job on the oversight committee to do their job. liz: entire panel, this committee will be able to view the document. this new development came out couple hours ago, what do you make of that story? >> well we better. i'm subcommittee chair on the oversight committee and the fbi didn't want me directly to see the document. i don't know why. i have top security clearance. i get briefings all the time that are highly sensitive on the
