political world, not affecting the markets at this point, dell started in the negative, now fully in the positive. it is up 46, 47 points, the s&p is up 20 and the nasdaq is a full percentage point, up 123 points, big tech doing pretty well. we see the big ones in the green, microsoft, amazon, apple, met are all green on the screen, the 10 year treasury if we can switch to that is up a little bit but it's not affecting the tech stocks. tech stocks end, the yields are up for a change, oil is down a little bit, still concerns about whether the economy is slowing but let's get back to our top story because there will be economic implications. i suggest about the story, donald trump has been indicted on 7 charges in relation to the

mar-a-lago classified documents investigation. he will appear in federal court tuesday. that is when we see all the details. we have a pretty good idea what he will be invited for. i wonder if the same thing that happened after the new york indictment, his poll numbers went up, fundraising went up. will the same thing happened with this indictment? >> i think so. it's a very unusual environment that it confirms what he's been saying for a decade and what we saw in his first term, we saw afterwards is that the system is unfair. there is forgotten men and women, two tiered dynamic of justice, they pick winners and losers. we've seen that throughout. while it is a horrible situation, no one would want it. we see this, the fbi's own actions have confirmed that

they are willing to fake it, make things up, the durham report is confirmed, the nature of not just a political nature of the fbi and the doj but they are willing to work with hillary clinton campaign and live to the pfizer court and push hard dossier -- dave: a lot of people say durham didn't get anything, he proved and got a plea deal on the fact that they were doctoring documents to the pfizer court to spy americans. >> we are not going to get indictments in that regard just because of the way the system is, just like trump being indicted seems so absurd, normally i would never think that would even be possible, this must be real abnormal but after we saw with the fbi and donald trump, now we see and i would say there's a lot of lawyering and analysis of this coming from the perspective of the average person. this is shocking. people are beginning to look at it and even if you don't like

you are an extremist on the other end where you think this is fine. independents don't want to belong to either of those sides. this is a clear dynamic that's not partisan at all. this is a crushing of the order that we expect. i don't think independents will like it, donald trump as an opportunity to show a kind of steadiness we've seen in the past in this framework, trusting in the american people. dave: he operates well under pressure. president biden once again defended medical treatments for transgender children. come in here, what's he saying? >> it's wrong that 16 states have banned children's gender affirming care. >> president biden: it is wrong but extreme officials are pushing hateful bills to transgender children, terrifying families, criminalizing doctors. these are our kids, these are our neighbors.

fed and wait for it, we have the makings of what looks like a hot ipo like the olden days. haven't seen that in quite some time. dave: the fed is very concerned about political instability, they've always shown that in the past and they are unlikely, i think, to do anything that could shock the markets because of the political and civility we have with the trump indictment, what do you think? they will decide next week whether to raise rates. >> we have a lot of p macro events in the rearview mirror, crisis of confidence and the fed debt ceiling but looking ahead, inflation is abating and i think some think the fed should continue to move forward and increase rates because if we don't get inflation under control it will cost more in the future but as equity markets are telling us, they are hoping for a pause and there's a lot of signs of the consumer is in good shape, the

consumers healthy but there's a pullback in terms of spending from consumers. we see in credit card spend and other factors. i'm hopeful, i think we are in the bell jar. people are putting too much focus on what the fed is going to do. dave: i want to focus on something you said and give you kudos for that about amazon, april 4th, you were here. put amazon on the screen if you can. you said when it was one hundred $2 on april 4th that it was going to go to 124. you see amazon their? it is now one hundred 25, you made it, good for you. where do you think it goes from here. >> amazon's great company. i continue to hold the shares i own, we will see a pullback. i think despite the fact we see the consumer pullback, amazon is such a great proxy for this country for consumers spend, business spend with cloud computing. might be a little perverse to say i think the stock will go

ahead because you might be saying if consumers are pulling back they won't spend money on amazon but what i think is going to happen, you see dry earnings release, they are going to begin to manage profitability better and better. we are going to see that this is going to become a massive problem. dave: wasn't making a profit for years. >> we could see this blow through, 52 week cuts. we could see the stock in the 40s. don't know if they will get to one hundred 80s. dave: april 4th until now. we will see if that happens. you are looking at market movers. start with target. lauren: the third downgrading two weeks, city goes to neutral, sales likely to fall further. it accelerated in may. there was a big deceleration. dave: what happened to netflix?

dave: check the markets. let's start with nasdaq, now over 1%. we started trading at 9:30, markets esauing between red and green, the dow is up 95, nasdaq up 138 points, over one percentage point and the s&p is up over half of one person. half of one%. the north carolina gop convention kicked off, donald trump, mike pence and ron desantis all expected to speak at the event. how big a role will trump's indictment play? >> it will be the talk at the gop convention, not just voters talking about this but other gop hopefuls and opponents of donald trump, many who are reacting and some reacted

moments ago including mike pence breaking his silence in a radio interview as what he talked about an hour or so again, telling hugh hewitt he's troubled the indictment moved forward and it will be divisive for the country. south carolina senator tim scott says this shows the scales of justice are weighted. >> our nation is the greatest nation on earth because lady justice has a blindfold on. that means republicans are not hunted and democrats are not protected. what we have seen in the last several years is the weaponization of the department of justice against a former president. >> reporter: florida governor ron desantis will tweet that is administered will big accountability to the doj, asa hutchinson called on trump to drop out of the race saying this is a huge distraction. republican presidential candidate vivek ramaswami promised to pardon the former

those races, pour money into one candidate and you can when it. could conservatives take a page from his book in terms of their funding? >> i think they should. what should the message be? minors any right-wing billionaires do this for free? we don't have a right wing equivalent to soros. many -- they are fiscal and economic issues but not in the social sphere. dave: soros prosecutors haven't been winning all over the place. in san francisco the da was a soros guy, very far to the left, got picked out. is that happening more often? >> yes. initially if you go back 5 years ago to today, their success story is in excess of 90% but we are getting a phenomenon where you can be too far left even for san francisco or these other cities. i don't have much faith to replace and for people much better but there's a breaking

point for that insanity. dave: thank you for being here. the mayor of new york city, eric adams could complicate plans to retake the house next year. how could that happen? >> is not on message. some democrats say mayor adams is responsible for four republican lawmakers flipping blue seeds mostly in long island. he's a local critic of crime and immigration because we are getting so many of the illegal migrants in new york city and it's very dangerous to live in the city now. the party wants to sink their message with theirs because his vohe is vocally could call of president biden's handling. dave: this city has been getting dangerous long before the migrant started to come in but it is it is a fiscal issue primarily, billions of dollars on housing. lauren: we literally can't afford it and he's asking churches and people to put them up in their homes.

education or civil service as a requirement in order to earn your right to vote and to his credit he managed to garner headlines and engage with criticism. i give him quite a bit of credit for letting me share his campaign for the day. dave: i was surprised at that. anyone who makes that much money and does so well and is a brainiac of a guy, his mind is extraordinary but why would he do that? he's focusing, the youngest candidate in history for the republican party it he would be willing to dismiss all those voters from 18 to 25, that doesn't make a lot of sense. >> what he's trying to do is raise patriotism which my generation is very unpatriotic, we know very little about this country, 22% of eighth graders have fundamental civics education, to me that's an indictment of the education system and not young people. i feel this proposal is more

punitive than restorative. dave: last night's announcement of an indictment against trump changes things. some people say people like vivek ramaswami who are in single digits, not in double digits he had a lot of republican saying it's time to surround trump and say we are for this guy because of what happened, the prosecution is so politically in orientation. what do you think vivek ramaswami would say? >> is right to campaign, trump voters would be sympathetic to the fatty wants to pardon him but we need more options for young voters and young republicans who are pretty alienated by trump. someone who can put one foot in and appeal to young voters, might be a little more independent, by saying i will support trump if i become president, that's a nice way to balance it. dave: alienated towards biden,

not just because of the age thing but his policies. has policies have been destructive with economic views of the future particularly those in the elderly population who are worried about their retirement, some have to take two jobs, come out of retirement to make ends meet. what about jen's hes for biden? >> a misconception that we mindlessly go. down the ticket no matter who and if you look at the approval ratings the biggest drop was among jen's thes. we are not just mindlessly saying we like the democrats and this is who we like and who we are good with. we want more options and are more independent than the average voter and that the result of growing up in the lesser of two evil 0. >> reporter: a lot of people say aoc is more millennial but is young and that socialist perspective appeals to jen's hes. >> there's a faction certainly

that is very progressive but we are more politically diverse than people give us credit for. there are a lot of us that we want a restorative positive unifying message from politicians because thanks giving tables were torn apart for partisanship for entire upbringing. some one who can bring us together and make us feel proud of our country and love our fellow americans would be very inspiring. dave: is at the education fact, that young people because of the radicalization of schooling in america don't know enough about the history of socialism, the violent history of socialism? >> there's an education component. our standardized testing nevers are dismal and only promise to get worse in the post pandemic era but i also think there's a lot of disaffection with the system as it is because a lot of our parents feel compromised by the voting to consent options they had in the last few election cycles and young people saying the system is not serving them. we don't want this area of red and blue.

dave: they connect the policies of biden with the inflation we are seeing and other problems causing real pain? >> i think a lot of young people, part of why his approval ratings have dropped so much is we feel inflation more than anyone else because we are starting our careers and starting to think forward and what is a down payment look like and where will my starting salary take me? economic ramifications of the biden administration are resonating. dave: thank you for being here, appreciate it. a self-proclaimed liberal woman went viral on tiktok for venting about her dating life. what did she say? >> chivalry is dead for progressive men. watch. >> as a liberal woman it is really hard to find a man who's willing to play the more traditional masculine role in the relationship in today's day

document case of which judicial watch was the number one critic of the abuse of trump. on top of that as i said previously, the prosecutor asked three times am i going to talk about it, this grand jury proceeding outside the grand jury room, i kept saying i don't know. why get me to swear under oath on one end? dave: what was his implication about your tweet? what was he trying to imply about you? >> there are three prosecutors who were interested in my tweets on this topic and topics related to disputing the 2020 election? on the tweets, was he channeling trump.

dave: the controversial 1619 project pushing a new curriculum called reparations math. jeff flock is in philadelphia. what is this? jeff: the 1619 project is a re-examination of us history asking whether the us would be where it is today if it wasn't for the use of enslaved labor at its founding. this curriculum is online, 1619 project, much better than the small summary i can give you here. the curriculum asked the question should reparations be paid for the united states use of slave labor? if so what's the basis of those payments? as part of the curriculum students will apply math

skills, research into historical wealth gaps in the us and investigation into whether reparations should be paid to the sentence of enslaved people, giving students a notion to determine if there should be reparations and how much it should be. as you know, multiple communities around the country are considering this notion of paying reparations. 11 cities we are aware of right now and two states, new york and california. california was not a slave state but there are many descendents of slaves that now live here. we don't know how many school districts are using the curriculum, the 1619 project says it's online. check it out yourself out yourself, people can download it. the last report is the 16th 19 curriculum, 3500 classrooms across the country using 1619 in some form.

dave: governor newsom was in favor of reparations until he realized the state had a big deficit. now he is against it. thank you very much. there's the math for you. my next guest filed a civil rights lawsuit against missouri state university william jacobson, founder of the equal protection project, joined me now. on what ground are you suing? >> we have filed a civil rights complaint with the us department of education challenging the program at missouri state university, it's a business boot camp. it was only open to nonwhites and females so people excluded from it were white males, that violates not only missouri state's own policies but federal and state law. they feel discriminating against white males is somehow okay so we filed that challenge. dave: where they just come in aiding against asian males?

>> no, because the program is open to what they call black indigenous people of color and females so the only ones excluded by this program, white males and when challenging that they said we didn't mean to do that but they said the president of missouri state said publicly that we don't think we did anything wrong. that's why we are continuing to pursue this. if they think that was not wrong, who knows what else is going on. dave: reason i asked about asian males, there are asians suing big colleges because they feel just committed against because they do so well generally speaking on a lot of tests and feel discriminated against. the whole question is about meritocracy, whether we are going to get on this issue of

using race as a determinant ability and whether or not this country would suffer as a result of getting rid of any idea of meritocracy in our school system or the country generally. >> you are seeing the destruction of standards. and equity instead of equality. and the using the color of someone's skin to justify giving them favor or disfavor. that's the opposite with the american civil rights movement was about, equal protection project we stand side-by-side with the american civil rights movement which did not do what missouri state and other colleges are doing now which is judge people based on the color of their skin. dave: thank you for explaining, appreciate it.
