with more. ashley? ashley: yeah, good afternoon, and evening to you, liz. it's remarkable isn't it? the more legal challenges donald trump faces the more money he takes in for his campaign and higher he goes in the polls. right now, he's at the trump national doral resort now about 25 minutes west of here, meeting with his advisors and his new legal team. we know now he's facing 37 counts of illegally happened el ing what they call top secret documentation, but, he continues to dispute that and over the weekend telling the party faithful in georgia that you know what? these charges they are simply baseless. take a listen. >> they are ridiculous and base less indictment of me by the biden administration' weaponized injustice will go down as among the most horrific abuses of power in the history of our country. many people have said that. democrats have even said it. this vicious persecution is a travesty of justice.

ashley: travesty of justice so i can tell you we've seen the security become tighter and tighter here outside the courthouse in downtown miami earlier today, the city of miami police department and miami's mayor francis suarez addressed the media saying they are prepared for whatever may happen tomorrow. they say they are prepared for crowds from five to 50,000. not that they are expecting that many people but they say whatever happens tomorrow, especially with regard to protesters, the mayor said his best advice to those people is remain peaceful. now, as for the actual initial hearing tomorrow, around 3:00 is scheduled to happen. he will be seen, we believe, by a federal magistrate judge by the name of john goodman. it hasn't been confirmed. he will handle the initial hear ing for this , but overall federal judge aileen cannon will oversee the trial as it stands. she could recuse herself. she was appointed to the federal bench by donald trump so we'll have to wait and see how that

plays up but after the initial hearing tomorrow, liz, he goes straight back to new jersey. straight back to bed minster to host a fundraiser and get back on the campaign trail, and as you said earlier, will address the charges that he's facing and he will have the latest comments on those and i think we know what his comments are going to be. liz: we've heard all weekend thank you so much ashley webster let's bring back to the show former fbi special agent nicole parker, former congressional investigator sam dewey. thank you both for joining us tonight. nicole first to you. what do you make of the fact that former president trump is being charged under the espionage act, not the presidential records act. the indictment makes no mention of that. >> you know, these are very serious charges. the indictment is 37 counts against president trump, and, you know, tomorrow be his initial appearance, his arraignment. he will plead not guilty. he will demand trial by jury and there will be a standing

discovery order at that point there will be a 70 days for a speedy trial which i'm sure the defense will wave rights to speedy trial. liz: so there's no presidential records act claims in the indictment, sam. where's the special counsel in joe biden having classified documents taken when he was a senator? he was not covered by the presidential records act. where's that case, sam? >> nowhere, and i think that's the broader overarching question of regardless of what you think on the merits of the trump indictment, the department of justice has been weaponized. one side is being treated completely differently than the other and it's just flaberga sting to see a segment of society celebrate that fact. liz: go ahead, sam, finish your point. >> to see them celebrate that fact, because this is supposed to be the united states, not some third world dictator where there's a different system of

justice. liz: nicole, voters have been dealing with democrats who say they are all about the rule of law, when house democrats lead by jamie raskin, maxine waters, immediately challenged trump's victory results in 2016. democrats lead by al green literally tried to impeach trump just four months after he sat down in the oval office in 2017. protesters rioted the day trump was inaugurated, 67 democrats boycotted his inauguration and then the debunk russia collusion probe so you can understand why the trump voter is very upset. we understand nobody should take classified documents. it's wrong to do that, but people are very angry about the double standard in d.c., nicole. >> absolutely, and as a former fbi special agent i was here in the southern district of florida and as an agent, we ran into that over and over and over where americans we try to work with them on investigations and cases and they just don't trust the fbi. they don't trust the department of justice and that is very very dangerous for the foundation of our democracy when it appears

the criminal justice system has been politicized. it makes the difficult because when you have a real case, they don't trust you on violent crime cases. they don't trust you on human trafficking cases. it takes the entire agency and drive them through the mud. it needs to be fair and equal regardless of your last name and political persuasion . it has to be unbiased and apolitical. liz: you don't want to undercut the credibility of fbi agents tries to do the right thing, sam. democrats are fundraising off of trump's indictment including adam schiff. hillary clinton with the baseball cap, what about the e-mails? but you know, the issue too is what's damaging are pages 15 & 16 of the trump indictment. he was recorded in 2021 talking about how he kept secret military documents without first declassifying them about a plan to attack iran, and special counsel also said, sam, he had classified documents about u.s. nuclear weapons capabilities and vulnerabilities of the u.s. and allies and he kept these documents all over

mar-a-lago. >> yeah, i mean, the indictment lays out a case. we'll have to see what comes. there has been in the past a lot of selective quotation against the president, failure to mention exculpatory facts so forgive me if i take it with a grain of salt. i think we'll see what happens. there are a lot of legal issues. the inner play of the presidential records act. they're complicated and we'll see how that comes out. liz: okay let's watch the media reaction and more weighing in. watch this. >> every time i fly over a blue state i get a subpoena. >> [laughter] >> we want him before the grand jury! >> [laughter] >> and we stand up to the fake news media, which is seriously bad. >> they gave him every opportunity to return those documents. they acted with restraint. they were very differential to

them and very patient. they finally went to a subpoena and what did he do? according to the government, he lied and obstructed that subpoena. i do think we have to wait and see what the defense says and what proves to be true, but i do think that even half what andy mccarthy said if even half of it is true, then he's toast. >> espionage charges are absolutely ridiculous. whether you like trump or not, he did not commit espionage. he did not disseminate, leak, or provide information to a foreign power or the news organization that damaged this country. he is not a spy. liz: nicole? the obstruction charge. is that what lead to the unraveling on the trump side of the aisle, that that's why he was indicted that he just, for a year obstructed he's accused of obstructing for a year and not turning over classified document s, nicole. was that it for trump here? >> i mean, definitely appears

to be the case because when you look at, you know, hillary clinton doing something very similar to president trump and not she's not being charged but yet former president trump has been charged, you really have to look at the indictment very closely. when you testify before a grand jury, there is no defense. you just present the evidence. there's probable cause that then when that case goes to trial you have to prove it beyond a reasonable doubt and the defense will have a chance to review the discovery and ounce of evidence the government has and then really it will be up to the jury at the end of the day. liz: nicole parker, sam dewey, thanks for joining us. more media and legal experts join in pointing out the double standard with how federal authorities handle investigation s in d.c. we've got chad pergram live in washington with more. fox news senior congressional correspondent. chad good to see you. reporter: liz good evening republicans are drilling down on what is two tiers of justice. the gop argues the feds should also charge president biden for how he handled secret

documents he stored in his garage with his corvette. >> if you're charging one and not charging the other, you raid one house but you don't raid the other? that's a little different and that's not fair and i think the one thing people will see in america, they believe in the rule of law and it should be fair to everybody. right now it really seems that it's not fair. reporter: house speaker kevin mccarthy said the documents that mr. trump's home were more secure because they were kept in a bathroom with locks. congress has the power of the purse. some republicans hope to penalize the fbi in this years spending bills for how it's handled both investigations but mccarthy says the house will not be punitive. >> i'm going to punish you because you're doing something. that's what democrats do and now we're watching they become more centralized and they are focused more on americans themselves and i think a restructuring there be a real debate that we should have inside appropriations. reporter: today is the first day

congress meets since the fed's indicted former president trump on friday. democrats are defending president biden of wrongdoing regarding his document and an allegation that he took a bribe. they are watching the indictment of the former president. >> my expectation that the core effects with the law by the constitution is the information to a jury and to the american people and we'll see what happens from there. reporter: republicans contend fbi paperwork presented to the oversight committee late last week shows evidence that president biden allegedly accepted a bribe. mccarthy says he would like to hear from special counsel jack smith. he's investigating mr. trump. liz: got it. chad pergram thank you so much. back with us now from the federalist, senior legal correspondent margot cleveland. you've been watching everything. what do you make of this whole story? >> well, i think the whole story is actually two prong.

we have the documents and how trump was treated different than hillary and joe biden but also, barack obama who when he left the white house, they worked with him to get all of the documents there unclassified but the bigger deal to me is the double standard with biden and the allegations of bribery. that is a much bigger deal, and now it's being suffocated by the trump indictment. liz: so when we talk about that house oversight chair comer says more fbi documents spelling out potentially more bribery involving the president exists at the fbi. here is the thing. the latest bribery allegation has hunter biden again talking about selling u.s. oil & gas to ukraine's burisma where hunter was paid a million bucks areaer to sit on the board. it's a biden family again trying to score millions of dollars in "consulting fees" off of energy and infrastructure deals around the world. that's the back story to what's going on with the biden family

allegations. >> absolutely, and right before you went on the air, there was more breaking news. senator grassley on the floor said that the foreign national bragged of having 17 audio tapes 15 of conversations that he had with hunter biden and two with joe biden, and that is what was in that fd 1023 buried by the fbi. that's why i'm saying this is a much bigger deal. they buried that to change the outcome of the election. liz: how can the fbi bury it as disinformation when there are audio tapes? >> right. so, the audio tapes were what the owner of burisma said he had in his possession, and told that to the confidential u.n. source but according to all the evidence that we have so far , and what the whistleblowers have said, that confidential human source and that 1023 which was supposed to have been handl

ed by delaware, was buried by the fbi at headquarters in d.c. liz: okay. let's watch this cnn analyst and also see joe rogan weighing in watch this. >> this has been pending according to our reporting at cnn since 2018. five years and this , by the way , this investigation is not the laptop. this investigation is a tax issue. did hunter biden declare his income, and sort of obscure gun law, did he possess a gun while addicted to drugs which you aren't allowed to do under federal law and this spans the trump administration and the biden administration. someone has got to make a call on this kay. i don't know what's going on but it's beyond anything i've seen before. >> all the stuff with his son and the ties to ukraine and china and the money, the family, they got paid millions of dollars and everyone is trying to obscure because it's better than trump, better than trump. if that guy was a republican they be up him to the microscope i mean, it's wild stuff, man.

your offices where you work, we're going to do reputational risk to the insurer s. what do you think of this story? >> this narrative is going to be challenged in this next presidential election. it doesn't matter if you want to chain yourself to a fence or do a protest. our country needs energy security and independence. everybodies now figured that out , particularly since we've watched what's happened in europe after the ukrainian war started, and so it's a top three election issue. its never been as much an issue as it is today because we need to find ourselves in a place where we're independent and that's the only way you get secure, so i guess they feel threatened by that, but the majority of americans figured out you can not have prosperity without energy. it doesn't matter what side of the political fence you are, how progressive or how conservative energy is the core anchor to prosperity and we're going to have to start focusing on that over the next 18 months for new policy on energy and that's what

i plan on investing in. that's the new focus, because i now feel the time has come that we're going to be definitely investing in energy here in america. liz: okay so here is the deal. the biden white house ramped up liquid natural gas exports to europe to replace lost exports out of russia into europe and then we've got to take the other side of what the coin is, what they are saying. the activists, they are saying the insurers are helping the oil & gas industry to do extensive property loss, pollution, erosion of beachfront, damage to coastal habitats and more. what do you make of that side of the argument? >> so we have to start bringing a new narrative to the market. making claims like that are base less, and they just aren't factual. you can have your own opinion but you can't have your own facts. now here are some facts. we haven't built a new refinery because there's no good just taking oil out of the ground. have you to refine it into useable products.

we haven't built one in america since 1977. fact two. the new technologies in refineries many are carbon neutral. fact three. until we stop importing oil, from foreign countries we will never have energy security or secure prosperity. fact four. we can now build new refineries with really good returns that are attracting investors from all around the world in states like west virginia, north dakota , oklahoma, and texas. i am planning on investing in those states and building refineries under the 50,000 per- day barrels per-day, that are from the epa which in other words we can get them permitted and right now on the air i'm going to invite alex sorros to invest right beside me. he should support these green initiatives. this is good for america. i'll make room for him in the table so he can be part of this initiative to make our country secure and with a green mandate.
