have to go back to this president. january 1987 was last time the dow jones advanced 10 straight days. that is with the market expecting another rate hike from the federal reserve today. and when he talks to the press shortly after today's announcement. so far so good on a lucky 13 for investors. we will talk about what he makes of all this and whether he's worried about the fraud behind this. that and susan lee on tech stocks and their remarkable and incredible run. they are still rocking and rolling too and so are we starting now. we are on top of a lot including this potentially historic day, the dow, 13 in a row. we are getting word a plea deal

from hunter biden appears to be unraveling in wilmington, delaware, and the degree to which additional charges would be allowed. and the president's son immunized against future possible charges, and and saying, we want to meeting of the minds. what this could mean, some interpreted as a wrist slap for hunter biden. could involve more. urging both sides to spend more time talking and in hopes they could get a guilty plea that might be salvaged. some saying not to the degree hunter biden would like. he would agree to admitting

drug use and weapons charge. suffice it to say, other developments happened in the interim to which prosecutors say there are additional charges that could be coming down the pike. the upshot from that is that might not cover everything. part of what's going on with hunter biden is a plea deal was canceled because of something else called the foreign agents restriction act and whether he violated that. and any future type of punishment. and both sides could agree to the limitations are. and this deal is falling apart. and to the market and what is happening, the dow, 43 points. would be the 13th day in a row.

quarter point extends to a host of other rates. do you think the fed can still coordinate this? >> it is very tough. it's a matter of time before something pops. when you look at mortgages, affordability struggled but what happens if you don't purchase a home? you rent something and rents are through the roof. we see a reduction in rent. and the inflation, and and stocks tank. and between meetings or out of meetings. there's an interesting chart to show. markets go down on that. that is his intention. to sober up the markets.

i don't know what he will say after a presumed hike today. markets might not receive that because they think he is about done. it might not go down well later today. >> i think he has done a fairly good job in these press conferences, but you have to think, at some point higher you go up on the mountain, will he get some altitude, and so far everybody -- you i would say -- with how resilient the market has been. neil: thank you very much. we are keeping an eye on technology stocks. the run up in the dow, and not the other way.

the bank statements, millions of dollars in unrecorded or unreported revenue to the biden family and tax charges that go with it, that the authorities slow walked and major didn't occur. the indictments didn't come and the biden team was tipped off before searches were made. these are unprecedented. not only hunter should be under scrutiny but individuals in federal agencies that looked like they stood in the way of justice, if we have any credibility for the justice system, if people believe justice is blind, we can't have officials standing in the way of these proceedings and that is what it looks like. look looks like obstruction to me. kelly: look like a mess right now. always good seeing you, thank you very much. we are going to take a quick break. are getting wind, this is a

wall street journal alert the prosecutors are now saying the investigation into hunter biden's activities remains ongoing. response to a question that the judge, there could be additional foreign lobbying charges. that was not part of the original plea agreement that was going to come to misdemeanor tax charges. by refusing to pay taxes. millions of dollars of that. separate weapon charge and that is what he was supposed to agree to and plead guilty to today. and then prosecutors separately started hammering these other revelations that came through a couple of those whistleblowers. and other things that have come up that he was lobbying foreign governments to get to the bottom of that, that is still out there, the judge wanted to get a sense how big this wasn't how intrusive they were and

according to biden's people, hunter biden's people should be part of the plea agreement and none of that should matter. the judge was saying that is seemingly bowing to prosecutors looking into this that it will matter and then settle their differences. prosecutors now saying those allegations are enough to make this plea agreement no and avoided. the judge is in this is position of saying you are both right. a message from both sides. no we can't, not yet. stay with us. you are watching fox business. dad, we got this. we got this. we got this. we got this. we got this.

the revelations of the whistleblowers last week and other things that have come up about payment from other foreign governments, china, all that stuff that materialized since. now we are learning a limited deal could be back on track. the former deputy assistant attorney general of the united states, what to make of all this, what do you think? >> normally these plea agreements are open and shut and rubberstamped in no time. today it is different. a lot of drama unfolding in the delaware courtroom. my perspective, the surprising thing is this is not an issue the justice department and hunter biden's lawyers worked out in advance. how could they not have reached an agreement whether to be prosecuted on other charges. the fact that there is not a meeting of the mines, massive communication breakdown between the sides until the district judge called them on it today.

neil: obviously hunter biden's own lawyers would not entertain the possibility of additional charges down the road which these two minor charges with pale by comparison so naturally they wouldn't ones that. prosecutors would. if this comes up here is what we do. the conversation never happened and that is what the judge is calling upon. >> this underscores the effect at these hearings on the hill have had on this process. that i suspect made the judge ask these obvious questions. are you contemplating prosecuting hunter biden on other charges at some point in the future. why ask those questions before approving this agreement, the answer is only attention brought by congress, by the media on this investigation, other charges, the whistleblower tests, all that

was in the atmosphere and i suspect that led this judge to ask those questions. neil: i can't imagine, what hunter biden would agree to the possibility of something that could expand the guilty charges he's making today but that seems the only way out of this, to settle this for the time being leaving him open to additional charges for foreign governments and all of that, bringing his father into this. there is a new can of worms there. >> to say the least. from hunter biden's perspective, the way his lawyers are portraying this, this is the closest chapter in his life, that's the whole narrative that this will follow this. and today's hearing put a period at the end of that long

sentence. that may be a chapter or multiple chapters yet to be written in this saga. neil: what does your gut tell you? you agree to these minor charges with the understanding that potentially you have to look at this mess because you are not absolved from that though we don't know the particular's. >> there will be typical choices on both sides. from hunter biden's side the difficult choice is that when you identified. are you willing to take these charges off the table but leave your self open to potentially more serious charges down the road that could loop in. lauren: 1 why would he even entertain doing that? no upside for him. >> if he thinks he can get these charges put to rest with only a misdemeanor plea and no time served, maybe he's willing to take that deal even if he could be exposed down the road to other things. he might want to get these

charges behind him. the justice department, i think there's the question of if the deal does blow up will they move forward with the prosecution of hunter biden on these tax charges and the gun charge or are they going to say let's back burner these charges and put the case on hold until we figure out if we are going to bring other charges so the justice department will face that moment of truth too. >> could they have control -- that is hunter biden's lawyers, how quickly agreeing to these misdemeanor charges much earlier before any of this hullabaloo with the whistleblowers broken knowing full well that that could potentially implode? >> they could have handled it differently. the question, they struck a good deal. he was facing criminal jeopardy, potential incarceration, they look like they will get him out of this

misdemeanor real-time serving but one of the errors may be in not moving this had quicker. putting this deal to rest before the congressional engines revved up, before the whistleblowers testify, before congress got interested in exercising its oversight function of what the doj is doing. we could have put this to bed months ago. we find ourselves in a better position. neil: bottom line, this is not going away, doesn't sound like it is going away. >> i think we will see more action on the prosecution side of this case start revving up again. we will see action on the oversight side. people on the hill are interested in what is going on. looks like special prosecutor himself and us attorney himself may come into testify to explain his decisions, no question the judge through everyone a curveball. neil: i appreciate it, former deputy assistant attorney

do you think the markets are getting ahead of themselves? >> definitely. for quite some time. certainly. the more we have to come down, yes. neil: let me ask how this works out with future rate increases. if we get the quarter point today, i know you are not setting monetary policy, very astute businessman. would you leave it at that? would you stop it with a rate hikes? what you say that is it, job done? >> no. i would like -- i think when there's a real interest rate of 1% to 2%. people are more responsible. economic actors more responsible. they plan better with interest rates.

politics, governor youngerkin in virginia, past the opportunity. he hasn't slammed the door on it but it comes amid disappointment over the rates for ron desantis in florida, he fired a third of his staff, trying to write that ship. what do you think? >> i think governor youngerkin would be an ideal candidate for the republican party. i very much hope he's going to enter the race. all in favor of being inclined towards him. if he entered it would be tremendous enthusiasm and he could win the general election which i think the other republican candidates we have, that includes trump, somebody

certainly will win the nomination, in the primaries, i doubt that they could win the general election because they are too extreme. neil: are you saying donald trump is too explain more others are too extreme? >> donald trump has many negatives. neil: you would not support him as the nominee if he were the nominee? >> i would support whoever the nominee is except maybe the no labels movement. i don't know if that can pick up speed and pick up followers, it is a possibility. i am undecided. neil: you are open to a third-party candidate? >> i am but my favorite outcome

aaron gibbs joins us. we are seeing ai, not minimizing it, netflix is begging for $900,000 a year, what do you make of that and the reality of this that to get this ramped up its going to cost. >> a lot of shifts and technology advancements you've got to put in the money on the research side. neil: amazon expanding its stores. >> and infrastructure. we can see some tips over the earnings growth in those areas. with regard to the stock market looking at the prices those companies are highly valued. neil: did we get ahead of ourselves with tech stocks?

with the mega being -- >> with google and they were the ones that led the market for the first half of the year and it has been since the beginning of july we see a bit of a shift, a little more value farther ahead of how companies do that. neil: how do you advise your folks who hang on your every word. is this real? some ai etfs, the nasdaq 100 is fine. how do you play it? >> i am advising that you look for jobs so this is not the time they are very expensive. most of the gains have already happened. i looked at small and mid-cap companies, they tend to be lower value, underperforming for the past year and a half.

that's where you get potential gains. at higher risk, potentially more opportunity than these mega names. neil: mega names. neil: nvidia and all the rest. >> one of the few chip companies, and that is all. they more than doubled their expectations more than doubled, the mega caps, and -- but again, you see these companies, during the dot.com era, underperformance even if they are achieving those earnings gains because valuations are so high.
