time. you are giving me all the cheats i need. i'm david asman in for stuart varney. it's 10:00 eastern, let's get to your money, the market is doing well today. dow jones industrial average up one hundred 50. i will skip the s&p. look what's happening to the nasdaq. we have good numbers on inflation as it came down to, core inflation, it takes out food and energy and those are important to everybody but the fed looks at core and it might be with more to come. 10 year treasury yield is down to 3.972. let's look at oil if we can. that had been ticking up, was up $80 a barrel before the market opened. it's coming down a little bit from that.

dave: at the very least, i am for term limits. archbishop in portland pushing back against the green flowing, the gender identity issue in catholic schools saying they must use names, pronouns and your forms that correspond to their gender at birth. he's getting pushback by teachers and students. how do you think this ends? >> i am a catholic. you may have a smaller group of more faithful people but good for the church, good for the archbishop. we are not going to play the woke game. we will speak the truth and if people want to leave because we speak truth to gender, not by the end of this radical leftism good for the church. i saw the story, thank god we have some bishops standing up for what is right. the flock is the kids. if you can't get in the church or anywhere else --

were received by his colleagues. the experiences with classified programs, not my personal objectives. dave: how does it differ? >> reporter: the uap task force had a report from pilots that they couldn't explain. in the course of the investigation he came across various pieces of information and witnesses and other whistleblowers the testified before congress for in wednesday's hearing. dave: he was the one who talked about beings from outer space, they may have remains of extraterrestrial beings flying these spacecraft? >> he stated biologics were recovered. dave: what do you think of that?

>> it's a big claim, not my personal experience but he seemed confident he could provide pieces of evidence to congress in closed session and congress seemed interested in receiving that information. i suggested is in congress's hands. dave: he also claimed they had pieces of spacecraft themselves. your experience, you have a lot of flying experience coming your experience with watching these things, did they do stuff that is impossible for any spacecraft on earth to do? >> we don't have an explanation for how they are behaving that way. we would see objects with no wings, no exhaust coming out, no obvious propulsion signs and they would be able to be stationary and high winds, category 4 hurricane winds and accelerate to mock to. these are spherical objects, very non-aerodynamic shapes.

i was an aerospace engineer before i joined the navy. that is the not the shape of a supersonic aircraft. we don't know what they are or how they are performing and they are doing it all day. very aggressive, high-energy maneuvers. dave: a lot of times you see them over water. some people say they go in the water as well. did you have any experience of that? >> that's what we call trans media and behavior. from space to air or air to water. fat is not equipped with sensors to accurately see that transition. we would see objects near the water and they would be gone but to say what happened during the transition, we don't have the tools to do this. 10% of our operations when doing air combat, utilizing sensors to correlate targets. dave: incredible stuff. i hope it all comes out.

the unions are closely tied to politicians. they give politicians a lot of money and support. is that all a political connection? >> heidi political. that is the driving force behind resistance to opportunity and choice. it takes a lot of their power away from being able to lobby and put people into positions of leadership that they can wield at their discretion. dave: it is so -- wealthy parents can send their kids where they want to because they've got the money. lower-class parents don't have that choice, they have to deal with what they've got. this provides them with an opportunity, it levels the playing field, something that a lot of the democrats who

one. 5%. now this. the white house wants to shut down talk of the possibility of president biden pardoning his son hunter. what did the white house have to say? lauren: we've not heard from president biden yet. he took question that two events yesterday. the white house insists the case involving the first son remained a private matter but on wednesday the plea agreement between federal prosecutors and hunter's legal team shockingly fell apart after a trump appointed judge questioned if the agreement would give hundred immunity from potential further prosecution. there are open investigations. then in a surprising twist the white house also ruled out pardoning hunter. >> from a presidential perspective, is there any possibility of the president pardoning his son. >> no. i just said no. i just answered.

lauren: the house oversight committee is expected to hear from former business partner of hunter's and in the meantime house speaker kevin mccarthy says his caucus is still considering whether it will launch a larger investigation into the biden administration. watch. >> i said impeachment inquiry. there's a big difference, let me explain. maybe not everybody understands that. what impeachment inquiry does is gives you the apex power of congress. >> gather evidence to build your case, to see if there is indeed a case. you gather your evidence. dave: i don't want to hit beyond rank but your too young to remember the nixon impeachment inquiry. it was the increase, nixon was never impeached. it was the inquiry that led to his resignation. impeachment inquiry is a powerful thing. he was pulling back from that but powerful enough to cause richard nixon to resign. it is big news.

>> i'm reading between the lines what you're saying, for him to step down. dave: hunter biden admitted to a federal judge that he received more than $600,000 from a chinese infrastructure investment company. i emphasize china because that directly contradicts president biden's claim that nobody in their family made money from china. role tape. >> president biden: my son has not made money in terms of china. i've not had -- the only guy that made money from china is this guy, he's the only one. nobody else' is made money from china. dave: attorney bret tallman joining me now. the fact is democrats keep saying there's no evidence, nobody did anything wrong. clearly there is. the evidence just keeps mounting up despite the fact that democrats say there is none.

>> exactly right. thanks for having me on. i wish i had this lack of evidence when i presented cases to a grand jury. it would have been the quickest indictment i ever secured. this is, you have not -- and i have not heard an honest discussion from the white house, from the bidens about what is going on. i think they got themselves caught. i don't think they ever intended to even discuss the issue of apartment because they had a sweetheart deal but when that falls apart, and it fell apart, let's be clear, it fell apart because there were actually two deals on the table. there was the written one, the sweetheart deal, but there was a verbal unspoken one between the department of justice and hunter biden, really aimed at protecting hunter from any prosecution going forward. when you start to deal like that in deception and arrogance all it takes is a few questions by a reasonable judge to uproot

that kind of corruption. dave: let's talk about that. she obviously is going to be getting a lot more criticism over the next couple days, people will say because she was appointed by trump, she is a partisan, you can't trust what she says. she was a registered democrat for 20 years. in 2,020 she changed that to an independent, contributed money to both republicans and democrats. it will be hard to labral her as a partisan. >> it is. keep in mind it is the home senators who select these judges and the process of -- dave: we should mention both senators from delaware are democrats and they approved her nomination. >> that is right. politics is thrown out the window with most judges that are district court judges, these are trial judges and the

questions she's asking are so routine, so basic, they are asked in every single case. for these prosecutors to go in there, what happened is they got caught. they got caught trying to run roughshod over a court and the reason they got caught they do that in 99% of cases. they are able to push through whatever plea agreement they need because they have so much unbridled power. dave: there's also the question whether they were caught colluding with the people they were supposed to be prosecuting, whether the fix was in because this was the president's son, prosecutors were working almost as though he was their client. >> think about this dynamic. they have said that there's an ongoing investigation of hunter biden so they can protect their records. now they get into court questions start coming, they

have to acknowledge there's an ongoing investigation and they can't rule out bringing a prosecution, otherwise they look dishonest to the judge and congress, this throws defense into a tailspin and you saw it blow up in the judge simply said get your act together. stuart: i'm getting a wrap but i have to ask quickly, what happens after they have a chance to talk this thing out, the prosecution and hunter's lawyers, is there going to be a plea deal at the end or will she throw the whole thing out again? >> both sides are intensely going to try to renegotiate a plea deal. otherwise my he has artie been arraigned on two charges that this judge is going to require the prosecution to pursue. dave: great to see you, thank you very much for that, appreciate it. house progressive chair pramila jayapal was asked if she has concerns about coming testimony from hunter biden's for business partner devon archer planned for monday, what did

she say? >> he said nobody cares. watch. >> i think very small percentage of the country cares about hunter biden and the republicans continue to try to make it an issue, and try to make the plea deal an issue. there's a small percentage of people that care about that. more people care, what are republicans doing to help working people across this country. >> many democrats dismiss, deny and deviate to what republicans are or are not doing. americans should care for two reasons. hunter biden has benefited from the political interference of his father. you can say that financially with foreign business deals, getting money for policy essentially and the court room, while it was scrapped, the plea deal was pretty sweet. dave: it's not about hunter, it's about president biden, what he did as vice president to change policies the dealt
