thank you so much. biden's justice department unleashes an unprecedented three indictments of trump in just four months. former doj prosecutors say the latest looks just as weak and if specious as the manhattan d.a. indictment that stretches the constitution and the law. now, the histrionics and overheated rhetoric do not make up for the weakness of this case. you just have to look at the facts. special counsel smith could not find evidence to charge trump for inciting an insurrection. there was incitement nowhere to to be found in the indictment. through the -- plus, we've got sound of biden saying they would do all they could to stop trump from running again. fox news' griff jenkins live outside the u.s. district court in d.c. with the latest. griff. >> reporter: hey, good evening, liz. three indictments in four months. if you add it up, liz, it's 78 criminal counts that he's facing. special counsel smith made remarks briefly yesterday after the indictment.

some felt it was politically charged. watch. >> the attack on our nation's capitol on january 6th, 2021, was an unprecedented assault on the seat of american democracy. as described in the indictment, it was fueled by lies. lies by the defendant targeted at obstructing a bedrock function of the u.s. government. >> reporter: trump faces four counts in this indictment, they are -- three are conspiracy charges. you see one is an obstruction charge. former u.s. attorney andy mccarthy says smith has a pretty high bar to meet prosecuting this case. >> can can he prove that trump believed the things that he was saying notwithstanding all the evidence to the contrary. but even if he could get over that hurdle which i think is daunting, i do think you have the problem that he has extravagantly stretched these

statutes. >> reporter: and, liz, we're learning more about the judge who will preside over this trial. her name is tanya chudkin, a 2014 obama appointee to the bench and handled several january 6th cases, delivering some of the hasherrest sentences. finally -- harshest sentences. local law enforcement are ramping up security ahead of the former president's appearance here tomorrow the at 4 p.m. liz, back to you. elizabeth: griff jenkins, thank you so much. let's welcome back former federal prosecutor andy -- and monica crowley. thank you so much for joining us tonight. monica, let's first talk about the timing of the trump indictments. there's a lot of discussion about this. larry kudlow has covered it. it comes immediately, a lot of these indictments come immediately after news breaks about biden family corruption and allegations of bribery. look at the timeline. do you see any evidence voters are are now starting to think

these legal actions are driven can by politics, monica? >> yeah, absolutely. we've certainly seen a pattern over the last four months that every time a big story the drops about biden family corruption leading directly to the oval office and the current occupant of that office, joe biden, literally the next day, within 24 hours, liz, you get another indictment of donald trump, and it began with alvin bragg in new york and the most recent one, of course, just this week, yesterday, with jack smith. so there is pattern that shows a direct political line from the exposure of joe biden's crimes to indictments of donald trump. and and what i think the american people are clear about now, liz, is that donald trump is actually being indicted for the crimes of joe biden and his family. i think they're waking up to it. we've seen recent polling showing upwards of 60% and climbing of the american people now believe that these

indictments of donald trump are political in nature and have nothing to do with the law. elizabeth: well, you know, that's the fight, right, andrew? what monica just said. we have mike pence, a 2024 contender, you know, he says anyone who puts himself over the constitution should never be president. there's that fight, right in you can disagree with what trump was doing around the time of the capitol riots which should never happen, again. we're sticking to the law, we're sticking to what biden and people are saying in d.c. biden said they would make sure that that trump would not become the next president again. listen to this. >> we just have to demonstrate that he will not take power by, if we, if he does run, making sure he, under legitimate everetts of our constitution, does not become the next president again. elizabeth: andrew, but federal prosecutors say this latest indictment is not constitutional, hat proper remedy is impeachment which the house brought.

>> it's one thing to condemn the behavior of donald trump post-election 2020 the, it's another to use the criminal code to attack him for what he did. in fact, i think that the charges are so tenuous that we have to start with a review of the jurisdiction that applies here. you know, jurisdictionally, you have to question whether will a president can be prosecuted for the acts that he committed while in office. this is unprecedented. the supreme court has never weighed in on this. and we have to remember the executive wields extensive and substantial authority. so it really is unbelievable at this point to see them prosecuting donald trump for what he did the in office. and i don't think that there's a good case to make that a he was acting outside of the scope of his office. it's absolutely within the power of the executive to put a check and balance on congress to make sure that they are engaging in their actions lawful any and correctly, and one of those actions is elections.

elizabeth: so we've got lawmakers calling this prosecutorial abuse. monica, a take in this on -- take this on. the trump indictment states allies tried to impanel a slate of electors, falsely stating that biden, not trump, had won those states. what do you make of that part of the indictment? >> yeah, that's what jack smith, explained the basis for fraud against the united states. but, look, president trump and his team at the time were raising legitimate questions about this highly controversial the election which was really determined by a razor thin margin of 44,000 vote ises across 3 states. and so what trump was trying to do was lay a contingency plan, liz, by while he was taking the case to the courts to have it adjudicated, he was also laying the groundwork for a contingency plan of alternative lek or to haves if and when -- electors if and when the judges who were

reviewing this case said his request, actually gave the green light to go ahead. now, the judges ruled against him throughout all of this, so the plan was never triggered. is so for jack smith to make that as one of the bases, one of the counts here is really, really outray juice, and it's not -- elizabeth: so that's a weakness as well. that's weakness in this indictment as well. i mean, the indictment, andrew, to what monica just said, the indictment also says trump does have free speech rights. it's saying he broke the law when he acted on lies, contested the 2020 results. that's a broad theory of conspiracy to defraud the united states. "the wall street journal" says special counsel smith just might have criminalized democrats contesting election results. they did that in 2000, 2004, 2016. look at these democrats to who contested prior election results. we've got to get to the sound of what federal prosecutor, former federal prosecutors and legal analysis of this case. watch this. >> since the attack on our

capitol, the department of justice the has remained committed to insuring accountability for those criminally responsible for what happened that day. >> these are not strong criminal cases against anybody leapt alone a former president who, by the way, was impeached for conduct that was relating to this anticipated indictment which is the remedy that the constitution calls for. impeachment is the remedy in the constitution for presidential misconduct in office. and they look like they're pursuing him out of office. >> that was one of the most demagogic presentations i've ever seen in a high profile criminal case. any normal person reacting to that would assume that trump was alleged to have carried out the capitol riot. and then you turn to his indictment, he's not charged with the capitol riot. elizabeth: andrew, final word. >> impeachment is the path. they tried it -- [audio difficulty]

this news coming in, congresswoman -- it's a pleasure having you on tonight -- can reports based on hunter biden's laptop e-mails that hunter used burner phones, told biden insider devon archer to get a burner phone before they started to do their work with ukraine's burisma. if everything is so legit, my what -- why are they using burner phones? >> that's a perfectly great question that i wish somebody from the doj would be asking hunter biden to get this information. again, what we have seen is time and time that they have not pursued a legitimate cause of complaint against hunter biden, against the president's son for political reasons. we have uncovered in ways and means just from the irs whistleblowers that we heard from the fact that they were lying when they said that joe biden did not have contacting with hunter biden about his business dealings of the people he was working with. we have shown through proof that the biden family has gotten tens of millions of dollars,

sometimes -- as a result of this pay for play, and, you know, part of my concern is the compromise that this has had in government officials, specifically biden policies toward china. elizabeth: yeah, you know, when we just showed the e-mail from hunter biden to devon archer, devon archer was about to work with hunter on the board of burisma, and hunter was talking and referring in an e-mail to biden as, quote, my guy. and there's also word that, you know, hunter was using private messaging apps, 16 of them, many of them heavily encryptedded. so how are you guys to going to find out what was really going on? >> we're going to keep investigating it, we're going to force through a congressional inquiry, through congressional investigations, we're going to force the doj and the fbi to do the job that they should have been doing all of these years. and quite honestly, if they want to have a shred of credibility, they had better indict hunter biden soon, because what we have

seen is by them not indicting him even though they know they have enough evidence right now to show he has committed these crimes, they have given him a pass. the problems that he had had back in 20213, 2014, that statute of limitations now has been, has been extended. we can't even9 prosecute him from criminal or civil penalty positions. so in order to be able to prosecute him on these climbs, they have got to indict him -- crimes indict him now. elizabeth: more republican lawmakers talking hunter biden committed foreign lobbying violations with the help of his father. is that an impeachable offense? i mean, critics are saying the media has limited interest in the biggest political corruption scandal since watergate, and we're supposed to believe since beau biden passed away which was tragic and awful, that joe biden decided to randomly get on a speakerphone 20 the times with hunter biden's oligarch business partners to talk about the weather? you're talking all oil and gas

power titans from places like ukraine and china. so they're just talking about the weather 20 times? >> how stupid do they think we are? how many grown adult businessmen that are being paid millions of dollars are going to call their daddy during a business dinner? it doesn't happen. this is obvious, what has happened. and the fact is you can prove that hunter biden is compromised by foreign nations. and the fact that they were sharing banking accounts, sharing money, 50% of what he was making was going to pay off joe biden's bills, you can say joe biden was involved in this as well with. i think it's necessary to be able to use the tools to get down to the investigation. right now we have seen nothing at the doj and fbi level. and when you start thinking about this, the long-term consequences of that, i would say that proof is just in his policies alone. policies that are benefiting china from our energy, where we're buying our solar panels to the fact that they're not holding hair feet to the fire on covid, they seem to not be

interested at all in the hundreds of thousands of people who have died as a result of fentanyl being made in china. the number of policies that are benefiting china at the expense of the u.s., and yet we have biden who is apparently compromised and is continuing -- elizabeth: well, the danger is that if the obstruction had doj officials are blockading, you know, investigations into what's going on. i mean, we have irs whistle blower gary shapley now says the fbi intimidated a retired fbi supervisory agent into not testifying about what he knows about an alleged cover-up in the criminal investigation of hunter biden. listen to this. >> well, i think there's lots of people with information that that can shine light on this, and houses ways and means committee has requested those names. we provided those names. hay need to talk to all these people. they can't just allow doj to not give access to people. i mean, for example, the fbi ssa that testified for house ways

and means committee, he was given a letter the sunday before from doj basically telling him not to talk. and, you know, i know that he could have confirmed additional material facts on this investigation. elizabeth: congresswoman with, your final word. >> we need to investigate. i'm so glad that we actually have a republican majority in congress that is able to go through that. i'm so thankful that we've got people like chairman comer and chairman jordan that are asking the right questions and jason smith who's' opened up a whistle blower hotline to get this testimony in and make it public for the rest of the americans to see. we have got to continue to investigate -- elizabeth: your word on the silence of nancy pelosi on this, the silence of chuck schumer on this, on putting a for sale sign on the obama white house. by the biden -- by vice president biden. >> they've been complicit. they know what they've been doing. they've been doing it for years because they've been able to benefit. elizabeth: got it.

standard aaa credit rating. this is humiliating for them. it's right as they're pushing bidenomics and massive government spending. are you still bullish on the stock market? where do you come down on and how this is hitting bidenomics? >> well, let's separate the politics and is just talk about the economics for a second, because the politics will take care of itself. you have plenty of other guests for that. let's be very clear about what's going on and what isn't. we have record peacetime debt, a record peacetime deficit, and those are problems. but we have those problems yesterday and last week and last year and long before that when donald trump was president is and before that. if one and only thing -- the one and only thing that is new today is that some british ratings agency said what everyone has known for years. no actual reality has changed. in fact, all they did was the same thing some other rating agency did 12 years ago. so seriously, why panic? at least why panic now i if you

weren't passengerring yesterday and last year and -- elizabeth: well, we could be put in a hyperinflationary environment where the dollar is taking hits. stocks took hits today. biden is making history, he's the only white house president to have presided over two downgrades of the u.s., this one and the first one under obama by s&p in 2011. >> well, the world didn't end in august 2011 after that downgrade. took a couple weeks for the stock market to digest it. that turned out to be an historic buying opportunity. what i'm trying to tell you here is it doesn't matter what these darn rating agency do, it doesn't matter who's in the white house. the debt in the united states is a problem. it's a problem we've lived with for a long time, and we've had tremendous bull market inequities throughout that time. someday we're going to have to deal with that. 's ox is going to get gored. something's going to have to happen, but i'm e telling you, nothing about that happened today. elizabeth: i understand, but, you know -- >> today is important.

these damn rating agencies, these are the people who gave aaa to the toxic assets issued by bear stearns and lehman brothers. i don't care what they say. elizabeth: got it. interest rates have hit their highest level in more than two decades. wage growth is slowing since the spring and over the last -- actually, real wages are down 3% under this white house. food, fuel, rent still climbing. we've got that. the issue is biden inherited a better economy than reagan did or even obama did. they had higher jobless rates. but, you know, you had a recovering economy, and it pounded a lot of hot money, trillions of dollars,9 into the economy coming out of shutdowns. and that's what's causing rapid inflation now veering toward 17% cumulatively under this biden white house. so it's a worry about king dollar, and it's the worry about a hyperinflationary environment that the fed may not be able to control with rate hikes.

they may do another rate hike by september, in september, and that's going to add more pressure on credit ratings and the treasury market. >> oh, yeah, or absolutely. i mean, that'll only make it worse. i'm 100% on that. look, i'm not telling you we don't have problems. what i'm telling you is for people in your audience who are trying to figure out what to do with their equity holdings, don't think you should do anything differently today -- elizabeth: yeah, you're talking about the stock market. >> everything you just said has been true and obvious for a very long time. elizabeth: you're talking about the stock market, don, right? -- donald, right? so the democrats are complaining about companies price gouging. companies are are doing price resetting because of inflationary environment. so that's the fear, the vicious cycle of a loop that you've been expert on and how it's going to hit the u.s. consumer and u.s. voter. final word with, donald. >> well, hook, that's real easy. i mean, i think you've got the story pretty right. the reason we've got this

they continue to do things like burn coal and natural gas. the truth is, not surprisingly, not quite so nefarious. i used to be a state energy regulator. each one of our six electric utilities would come and sit with the public utilities commission, lay out their plans for generation. and together in public settings there would be decisions about what kind of power plants would be built, how they would run and how they would get paid for. this is not a conspiracy led by a cabal even if bernie sanders thinks that it is. it is decisions being made by men and women who are trying to keep the lights on. elizabeth: yeah. you know, when you look at the inflation rate for june, why it came in at 3% which feels pretty low, it's, it was driven can by nearly 17% drop in energy prices. i mean, you strip out energy prices, inflation is still running at 5%.

women's prison in the state of oklahoma. no men in women's domestic shelterers in the sate of oklahoma. no men in women's locker rooms. no men in women's bathrooms. no men in women's sports. elizabeth: got it. wow. joining us now, riley gaines, former university of kentucky swim orer. you competed against transgender athlete lia thomas. riley, it's great to have you on the show. you were there when oklahoma governor kevin stitt, now the first governor to sign this women's bill of rights, defining people by their biological sex at birth. talk to us about how this is a fight to protect women's sports, and you see this as an equal opportunity fight for women, right? >> absolutely. and, look, this is a lot broader than just women's sports. you heard or the governor, this is something that encompasses -- really what this does, what the women's bill of rights does is it codifies the term woman which this oklahoma alone is used 584 in oklahoma statute. so this means there are 584 times for unelected bureaucrats

and officials to go in and redefine this word, woman, really sex-based terms, male, female, man, woman, and redefine it to fit their radical agenda. but governor stitt9 has said, no. he says enough is enough, and he's defining this. it's a common sense law. but, yes, being inpacted in the way as it pertains to sports and swimming, i see what's at stake if we don't do this. if leaders don't follow the example that governor stitt9 has so perfectly exemplified, and what's at stake is the truth. elizabeth: do politics -- politicians want their own daughters or granddaughters to be in locker rooms where they're faced with indecent exposure? let's be blunt. after signing the bill, governor stitt said that he did this to are protect women. watch. >> i have three daughters, my wife and i have been married for 25 years. i did that -- i did this for them, i did it for riley gaines, i did it for all the young girls in the state of oklahoma that --

it's just absolutely wrong for them to be forced to change and undress in a, what should be a safe locker room as they're competing. forget the fact that they're having to compete against a biological male, but hen to change in the locker room, i mean, this is just craziness. it's not going to happen in oklahoma. elizabeth: riley, what do you think? what's the status of legislative battles about all this around the country? >> so oklahoma was the third state to get this through with governor stitt being the first governor to sign it. kansas has done the same, tennessee has done the same and now oklahoma. and we're going to keep pushing this. we're boeing to keep pushing this -- going to keep pushing this in every state. of course we have target states to which we think will be effective in passing this, but we're going to continue moving forward. and let me be clear, this is not anti-trans legislation. this legislation doesn't even use the term transgender. i don't know why people assume when you're protecting women immediately that stands for trans. i think that says a lot about

their argument in general. but this is a pro-woman bill. this is a pro-truth bill. t it's not anti anything. elizabeth: okay. riley, so here's the thing, where does this lead us? where are we headed down the road along this major fight? it seems like a battle that it's just three states right now. how far are you going to take this? >> as far as we can. we have dinah harsh barringer and debbie lesko at the federal level who have taken on the women's bill of rights which is huge. and, again, this is bigger than just sports. it really is. we're seeing these cultural issues, we're seeing them play into academia. we're seeing it in the media, we're seeing it in corporate america. it's bigger than just sports. and again, i can't reiterate enough, it's about denying truth. in the nearly 250 years that we have been established as a country, we haven't had a problem defining terms such as woman, and now we have a sitting supreme court justice who can't even do so. elizabeth: got it. riley gaines, thanks for joining

got "the washington post" fact checker, glenn kessler, giving joe biden a big four pinocchios over claiming hunter never made any money from china, pointing out hunter in court directly contradicted that. hunter saying he earned, like, $2.4 million in 2017, $# #.2 million in 2008, most of that came from china and ukraine. >> yeah, it's really fascinating how this is all playing out right now because when you look at how people are reacting right now, about half of americans, a little bit more than half, 51 percent of americans believe hunter biden is receiving favorable treatment because his father is the president. a majority of americans, two-thirds of americans, believe that this is legitimate, that there's something really to see here. a third, only a third think this is politically motivated. that's very, very different than what's happening with donald trump. more than half of americans think what's happening with donald trump is politically motivating. a lot of people think there's something to see here, and they want to see it explored. now, the interesting part of all of this is even though all of that is true, about 51% also

believe that, about half of them believe that this has nothing to do with biden's presidency. they're not yet convinced there's a connection here. so still to be determined what's going to happen here. we haven't seen a huge impact on the polls on joe biden on this as of yet, but certainly it's a very different reaction for people the more they're learning than you're seeing the same kind of thing happening with donald trump. elizabeth: got it. you're saying two-thirds of voters say or think that, yes, there's some -- where there's smoke, there's fire. that the biden corruption scandals should be looked at, they just don't know how it connects to trying to do things like impeach this president over it. is that it? >> that's absolutely right. two-thirds are not sure if that implicates joe biden or not at this point. but they want to see it explored, and they're not saying that it's a political witch hunt. two-thirds of americans are saying it's legitimate exploration of what's happening. elizabeth: okay, a legitimate exploration of what happened. so what do they want to know? to do they want to know how this

connects to maybe biden changing policy as congresswoman beth van duyne and other congressmen have told us, that it's hitting, it's hitting u.s. policy, what the biden family was doing in cashing in on biden's government job, that they want to see that connection, is that the story? >> well, you don't want to see if there is or is not a connection, hay want to know what the ruth is. they believe that hunter biden did something wrong. they absolutely, 100% believe that, but they're not sure whether or not that impacts joe biden and whether that means that joe biden was necessarily connected. they want to understand if there is something to see there, and that's what they're waiting to hear. but they pretty much decided that they believe that hunter biden did something wrong. elizabeth: okay. so we've got this too, you know, 2024 is going to be about biden's stewardship, the corruption scandal already hitting his polls, it's also about the kitchen table what did you make about that brutal cbs poll saying people are not

buying, the majority of americans are not buying into bidenomics, saying they feel worse under biden's economy, inflation is worse under him, they're giving him really negative ratings here in that new with cbs poll? enter yeah, we've seen this continuously. and the biden administration has been trying to convince us that recently things are a lot better, that inflation the levels are coming down, bidenomics is working, he's talking about jobs numbers, that is not the reality of the american people. 80% of americans believe that biden is responsible for this economy, and they believe that a it's a bad economy. 70% of americans right now feel like their income is not keeping pace with inflation. he only gets a 34% job approval. so bidenomics to them equals bad economics. it doesn't e-mail good economics. his messaging on this is not working, and the majority of americans don't feel good about where they are today. elizabeth: lee carter, thank you for joining us on the, it's good to see you. coming up, we've got former u.s. attorney guy lewis with more on the trump indictment.
