sol, what do you think of the merits of the trump indictment in there's prolots of talk about government -- there's lots of talk about government abuse of power. what do you make of it now, sol? >> well, even people who are anti-former president trump and have been clamoring for an indictment talk about and recognize the, quote, novel approach of a lot of these charges. they have the, they pose the threat of criminalizing a tremendous amount of protected free speech activity. and keep this in mind. when you prosecute somebody based on a microsoft e approach in the law -- novel approach in the law, you run the risk that even if your interpretation of the law is ultimately upheld, there's a due process problem because the defendant hasn't received notice that what he or she is doing is even criminal. elizabeth: that's it. what sol just said, yeah. so there's a due process violation of the constitution, is that what you're saying, so to l?

>> there is a potential due process problem in using a novel approach that no criminal defendant could have ever been put on notice about. elizabeth: got it. andrew mccarthy, let's bring him in. prosecutors along with what sol is saying, they're going to have to prove beyond a reasonable doubt that trump had corrupt intent saying the election was stolen, but where's the smoking gun audiotape of trump saying i know i lost, but we've got to go ahead and do in anyway? >> yeah. well, i think, liz, i would hop on to sol's point, because i think all the stuff about trump's intent is very interesting. what's in the indictment is smith's version of what trump was told by people that smith thinks were authoritative which means that if it comes to it, trump is going to bring in the hundred people who were telling him something else and make the same argument that, you know, you could deduce his mindset from that as well. but to me, you don't even get to the question of criminal intent

unless what they've charged is actually a crime. and, you know, sol just mentioned putting the defendant on notice of what's charged. my -- i have a slightly different take on it. what i think is that they're charging something that's not actually a crime on the fact pattern that's here. so, for example, if i'm right that the in federal law fraud means a deceptive scheme to bilk somebody out of money or property, then the government's not at liberty to stretch that into, you know, criminalizing somebody's idea of what good government looks like. elizabeth: what do you make of that, sol? what andrew just said e? >> oh, i agree. there's a whole separate problem, there's a huge statutory reach in this indictment. and like i said, there's a constitutional problem of taking what looks like protected speech and turning it into a crime. now, he says in the indictment -- well, of course

he's got a constitutional right, former president trump, to lie. but apparently not if he does it in a particular way that jack smith has charge. and i think, i think there's just a number of problems with this, and he's throwing a bunch of things on the wall and hoping that one of them sticks. and i think everybody should be worried. there's a great op-ed piece by kim strassel in the journal today, "wall street journal," that gives several examples of political episodes we're aware of that under the theory of this indictment you could prosecute somebody. when president obama -- when president biden canceled student debt after saying a year before that he didn't have the power to do that, are you going to call his advisers in, indict him and call his advisers in and have them say, well, we told him it's illegal for him to do it? i mean, the implications of this indictment are enormous for protected speech. elizabeth: yeah.

so, what sol and andrew, what you're both saying, this feels like a stretch. and oregon how they're going to do a speedy trial before 2024 given the ramifications can consequences of serious questions you both are raising. mine, lots of critics and watchdogs say the trump indictment, it's just the latest in a 6-year track record of democrat abuses of government power. impeach trump just months after he took office, democrats funding and igniting trump-russia, the hunter biden laptop coffer-up, doj officials stonewalling robes into hunter biden and the plea deal giving him blanket immunity for future crimes. andrew, how are they going to do a speedy trial before the 2024 election? this indictment literally lists election issues in at least seven states. >> yeah. and, obviously, what they're trying to do is push it, the whole point is to litigate the days case close to the time of the election. but i think, liz, they've put themselves in a real box here. if you're myth and you really

want to get -- smith and you really want to get this case to trial, you indict this one first. so what he's done is he indicted the mar-a-lago case first. he got a judge to set a may trial date because he's hammering for a trial in that case too. and is now he's going to try to push another judge in a jurisdiction far away to set a trial date in this as well. and i think no matter how unfavorable the court may seem, i think trump has a powerful due process argument that he's being deprived what every defendant is entitled to, which is the right to mount a defense. when is he supposed to get ready for trial? when is he supposed to investigate this case if he's in florida? elizabeth: that's a good point. sol, take this on, the fight over the charge that trump pushed a slate of electors in seven battleground states, the special counsel's saying these were fake electors. pence said trump and his lawyers asked pence to return the vote back to the states or literally reject votes. trump's lawyers saying, no,

trump asked that the states could either audit or recertify whether the vote count was correct and put forward their slate of electors. what do you make of this charge, sol? >> well, like a lot of things in the indictment even assuming that it's a crime, you could have charged it much more narrowly. i would have expected to see some counts under 18usc1001 is, the martha stewart or statute of lying to the government. part of my problem with this indictment is it's the breadth, the interfering with government functions, you know? it's very similar to other things that he has charged, that jack smith charged governor mcdonald with in virginia, and the supreme court just said it's way too broad. so i've got a problem with all of it. i don't approve in any way of what former president trump did leading up to january 6thon january 6th. but i also agree with andy,

absolutely, he's now going to be indicted -- he's indicted already in this three different cases, in three different parts of the country, and he has an absolute right to prepare for trial. i don't think, i don't think any of these cases are going to trial before the election. elizabeth: that's an interesting call, what sol just said, andrew. and there's also this, andy. is this just a coincidence, the timeline of the biden scandals and the shoes that are dropping in those scandals and then the trump indictments coming right when the biden corruption controversies erupt. and now also democrats trying to claim the prosecution of trump is all about the law, that it has nothing to do with their 7-year push to go of after trump. what do you think of all of this, andy? >> yeah,ing i think, liz, that that it would be easier for them to argue that this was just hanen stance and coincidence -- happenstance and coincidence if it wasn't so blatantly political. so, for example, jack smith's existence as a special counsel is political. there's no conflict of interest

between the biden justice department and former president trump. in fact, they were investigating trump for 18 months before they named, before garland named smith as a special counsel. if there is a proprofound conflict of interest with the biden justice department supposedly investigating the biden family, but there's no special counsel there. so he brought smith in order to set up the the fiction that smith9 is like this independent actor and biden and garland don't have anything to do with the case. and then when smith brings the indictment that they fully expected he would bring all along, he gives a press conference the other day where he speaks for three minutes, and two and a half of the three minutes were about the capitol riot which is not charged in the indictment. let's elizabeth yeah, that's why would stuff. yeah. there's no seditious conspiracy charge or incitement to insurrection charges at all in the indictment. that's the important point you just made, andrew mccarthy. and, sol, you had great stuff too. appreciate your insights,

gentlemen. thanks for joining us. >> thank you. >> thanks forking having me. elizabeth: back with us now, congressman byron donald from house oversight. congressman, we've got new details, these bombshells, china paying millions of dollars for the biden family brand. just the news reporting the fbi did have text messages that show hunter biden in 2015, during the obama white house, worked with china to buy u.s. oil and gas assets. what do you think of this story? >> this is just more fuel to the proverbial fire. this is what we've all been knowing, is that hunter biden was the bagman for joe biden. everybody needs to dismiss this stuff that, oh, he just cares about his son or even that hunter was smoking crack which is a terrible thing to do and he was. the truth is, is that hunter biden is a bagman. his job was to help sell the brand, as devon archer testified to. sell the brand which is access to joe biden.

and through that brand, the biden family would make millions of dollars. and is, with by the way, america, they would conceal that money from the american people because they would route that money through 20 the different shell companies and llcs all for the benefit of the bidens to get rich. and, by the way, i don't think the bidens paid their fair share either. elizabeth: but this is affecting u.s. foreign policy, congressman, right? i mean, so u.s. energy independence, u.s. energy is foreign policy. it's national security policy. i mean, house oversight chair james comer has sent a letter to treasury secretary janet yellen about hunter demanding why hunter tried to help sell to china u.s. nat gas from five u.s. states back in 2017. and then china sent hunter nearly a 40-page, detailed plan with maps of u.s. states and their nat gas reserves. and then china pays the biden family $5 million in anticipation of these deals.

>> yeah. no, you're absolutely correct. this is a shot to our national security. and our energy security as well. and there's more than that. hunter biden helped facilitate the sale of a cobalt mine in africa to a chinese front company for the ccp. he was a part of that as well. "the new york times" reported on that, i believe it was back in 2017 or 2018. they reported on that sale. and so you've got to understand this is what's been occurring. last piece of this is what has joe biden's energy plan been? solar panels, electric batteries. well, who does that favor? that only a favors the chinese because they have dominated, they dominate the globe when it comes to these minerals that are purchased and that are dug up for the entire creation of solar panels and electric batteries. elizabeth: yeah, so -- >> we are being set up as a country while the bidens get rich. elizabeth: that would make the united states dependent, dependent on china, right? energy dependent on china. that's one part of it. also, you know, the devon archer

testimony basically are, he was i saying that hunter and devon archer were working with burisma to help ukraine become energy incompetent. it's all the ironies -- independent. as joe biden's energy policies are making the u.s. less energy independent. we want to turn to this: a whistleblower who worked the cefc transaction. this is china's cefc. told house oversight republicans that joe biden would be a, quote, obfuscated partner, a hidden partner, in the deals with china, that hunter biden would hold the the $10% of the joint venture on behalf of joe biden. also joe biden met with officials in d.c. despite all of his denials that he didn't know anything about what hunter was doing. >> listen, it's all bombshell information. hunter biden has been lying, joe biden has definitely been lying, and the whole purpose is to cover it up. it's a tragedy, but the cefc documentation is true. we can see the money flow going

from them to one of hunter biden's holding companies and so on and so fort. everybody remembers the moniker hold the 10% back for the big with guy maniesome what'd you think they were talking about? it wasn't skittles, it was cefc ownership and all these other transactions that have been going on. what i believe is pretty clear at this point is that joe biden knows that hunter biden was an unregistered foreign agent, he encouraged him to be an unregistered foreign agent. in my view, that makes him a co-conspirator to that fact, and those are grounds for impeachment, in my view. elizabeth: congressman, it really comes forward here in this story how hunter biden was working. and we understand his issues, we understand the problems. we have sympathy the and compassion for it. but you do not put a for sale sign on the white house. you do not try to to deflect and distract from what you were doing in your own corruption scandal by trying to play on the sympathies of the united states, congressman, because hunter biden was working with corrupt

officials in ukraine. in china. there were individuals charged with corruption in other nations as well. so isn't that in and of itself a national security risk to the united states? >> it absolutely is, but i will add one thing to this. they didn't put one white house up for sale, they put up two white houses up for sale because the beginning of this this saga was when barack obama was president and joe biden was vice president. that's when they set up all the shell companies, that's when they set up all the accounts, when joe biden would be on air force two going to the countries that barack obama gave him oversight over, where was hunter biden? he was right next to his daddy selling influence. elizabeth: where was obama? >> it happened in the obama administration and now it's happening under the biden administration. and our adversaries are being paid off while the bidens get rich are. elizabeth: former president obama's silence, what do you make of it? where is he coming in on this?

down 49,000. 187,000 jobs is lower than what was expected. it's the lowest payroll gain since december 2020. >> yeah, it turns out that the very high numbers that have been reported, liz, are not real, and a lot of people on the street were expecting these downward revisions. don't forget in the june report they revised downward april and may numbers by 110,000 jobs. so we're practically going request backyards -- backwards now. obviously, there are many signs the job market is slowing, there are many signs the economy is slowing. so they can talk about bidenomics, it was kind of funny to see kamala harris laughing hysterically about it. she must know it's kind of a joke too. elizabeth: what liz just said. nancy, edward lawrence reports the 3-month average for manufacturing jobs gained is exactly 0. food and groceries are up, kitchen tables, you know,

families out there the really feeling the pain. inflation up 17% all in under biden. what do you think, nancy? >> well, so, liz, you know i've been pretty optimist in, and so far that's been a good decision in the stock market. but now i think one of the risks that's not being priced in is that we may see a pick-up in inflation. and that is base effect. all these numbers are phony bologna, like liz just pointed out. they get constantly reviseed. we lean in to see what the number is, and next month it's revised down. but with inflation we've seen energy prices tick back up, housing is starting to pick back up, and i think that's going to filter through, and we may see an increase in inflation between now and the end of the year. i don't think the market's pricing that in, and i don't think the average consumer's pricing that in. elizabeth: got it. and now we've got saudi arabia extending their oil production cut too. and, liz, let's get your reaction to joy behar on all of this. watch this.

>> can i just say something about joe biden? i'm observing, the economy is booming, inflation is down, the stock market is doing well. people having an easier time putting bread on the table, etc. he doesn't seem to be getting the credit for that. only 41% approval. is it because they think he's old? because i don't see anything else they can point to with him. elizabeth: what do you think, liz? is. [laughter] >> well, i don't think she's looking at all the information, liz. i don't think she's a very informed voter. look, in the last couple of months, yeah, real wages have actually gone up, finally, but the average family is still tenses of thousands of dollars behind where they were two and a half years ago when joe biden came into office. all this talk of bidenomics is kind of ludicrous because what most people think, what most people see is their paycheck simply doesn't go as far. you know, it's not just -- nancy's right, oil prices are beginning to go up, so the news

♪ elizabeth: we're so excited to have on the show actor dean cain. dean, it's a pleasure to see you. thank you so much for joining us. dean, we've got breaking news, there's a riot breaking out in union square in new york city. we had a youtube and twitch influencer who gave away video game consoles. teenagers jumping on cars, attacking cop cans, attacking property, multiple injuries. thousands of teens fighting and clashing with cops. so, you know, more more people, you know, the synchronicity of this, dean, we wanted to talk to you about more and more people seeing the appeal of small town america. can you talk about this? >> well, you certainly wouldn't see this happening in small town america because people are held accountable for their actions there. you're going to know who everybody is, you can't get away

with that kind of behavior. if i saw my child participating in this riot, which is what it is, there would be some serious accountability when he got home. i wouldn't let him go to begin with. the idea to go get this computer or the game console turns into a rye carrot, it's a very -- riot, maybe he should have worked with the authorities on this. in a small town, again, people are held accountable. here it's about nameless, faceless people who can run off x these mobs and riots that are going on -- and they're everywhere, they're happening in chicago, just happened yesterday, it's very, very dangerous and it's going to lead to the a lot more violence and bloodshed. elizabeth: people have to stand up and say enough is enough, you know? these flash mobs, again, we look atta footage of what's happening in new york city, you point out that it's about accountability. and we've got david brooks, he's a columnist in "the new york times," dean. he wrote a column, what if the bad guys are us? and that's getting a lot of debate and attention.

it's about a boiling up of decades of working class frustration out there in middle and small town america with what they're seeing happening in d.c. and in big cities. you know, it's about, you know, or elites talking like cultural conflicts are far more important than economic alienation. what do you think of this? >> well, i didn't realize that the whole article -- read that whole article because it's by the missouri times, and it's behind a -- "the new york times" and it's behind a pay wall, but maybe there's some self-reflection going on. i would argue very much that these policies and these heats that are putting these policies in place and supporting them through the major media outlets are allows this, they're come missit in letting this stuff -- complicit in encouraging lawlessness and all this other stuff. it used to be it was the working class people in the newsrooms. now it's people who i went to finish i'm a princeton grad, you know? it's a bunch of ivy leaguers, it's a bunch of people who come

from that elite society, and they're telling everybody else from down high what they should be doing or what they should be offended by. and the truth is, yeah, i think david brooks has his finger on the pulse. i think they are the bad guys, and they need to clean up their act. elizabeth: irs and government data show we've got the blue states, right? we're talking california, new york, illinois, they continue to and continue to bleed and have residents leaving their states to go to tennessee, to go to small towns in texas, the carolinas, florida. even fitch ratings said 17 states are doing it better than the u.s. government in terms of how they're running their books and their shop. so, you know, you wonder if the country's shifting, it's just changing. and when you see the constant head ryans coming in of that -- headlines coming in of what's going on like we just reported in new york city and the backlash from jason aldean

saying, hey, you know what? we wouldn't have these massive cultural clashes and is riots like you in the cities allowed. the fact that he even had a backlash against that tells you that people are sitting up and listening to what people like you are saying about what's really going on in america. >> jason aldean's song now is number one after the video came out, they created all this controversy about it, but it's about accountability. you know your neighbors. if you know your neighbors, that kind of behavior won't be there. they are not allow that kind of behavior, so people are paying attention to what you're doing. and it's funny that a song like that creates such a backlash when i think the number four song was by somebody called gunna and talking about explicit sex things. that whole controversy about baby it's cold outside, they wanted to ban those lyrics, and the number one song at the time was wop. i think jason did a great job, it's crazy, and small towns -- i prefer -- i left california for nevada, so here i am as an

>> good to see you. elizabeth: sorry there was that riot to welcome you. can you give us an update on the probe into the biden family can corruption scandal? >> yeah, i was just talking to one of the oversight senior staff members. we've been at this for seven to months, and we've subpoenaed bank records six time it is of biden business associates, and every single time, six out of six times we've found more foreign money paid to the bidens. so, and this is the really the tip of the iceberg. we're continuing to dig, we're continuing to investigate. and really the sad thing is every time that we find out another piece to the puzzle, it fits in perfectly with the greater picture. they never contradict each other, it's always more intriguing and more fascinating many a very dark sense. and to me i'm already at the point where we're above the preponderance of the evidence including that the biden family's corrupt. it's our duty, it's our constitutional duty as members

of congress, to continue to look into this -- elizabeth: are you talking about impeachment? >> yes. and conviction. and so i think, again, it's more likely than not that joe biden was deeply involved in hunter biden's business, more likely than not that he benefited financially personally, and can we wet to that reasonable doubt standard -- can we get to the reasonable doubt standard. elizabeth: are you going to see more records coming out? is it deal making in russia, ukraine, kazahkstan and other nations you're going to see? >> we very well may, and that's why we just i talked to devon archer who i'd love to talk to rob barker, get him in to oversight and continue to ask questions. when you have irs whistleblowers, and these are -- collectively, they had 27 years of experience, and they said that they weren't allowed to ask who the big guy was, they were not allowed to ask who dad was. georgia shapley, agent shapley, was not allowed to conduct an interview with hunter biden unless if hunter initiated the
