as the hunter biden special counsel, but weiss has gone weak on the case already, lawmakers say, in order to protect joe biden. and now what could counteract all of that? congressman greg steube today files inpeachment charges to launch a probe and inquiry there, and trump hammers special counsel jack smith for scheduling the trial on 2020 before the iowa caucuses, calling it election interference. this backlash too, reports that special counsel smith stopped twitter are from telling trump that smith was secretly probing trump's twitter account, and twitter didn't like it either. also biden undercuts bidenomics, admits the inflation reduction act won't cut inflation at all. i'm liz mac donald, "the evening edit" starts right now. ♪ ♪ elizabeth: okay, let's go right at it from house judiciary and house oversight, congressman russell fry and former federal

president andrew ya cow key. congressman fry, what is the fighting going on right now in your committees? is weiss being brought in to stop the house gop probe so the biden family corruption allegations? >> well, i think all signs seem to point to that. i mean, this is the same u.s. attorney that wouldn't allow irs investigators to look at or question joe biden or hunter biden. this is the same u.s. attorney that tipped off, that tipped off the secret service about seeking tax documents in the storage facility. this is the same u.s. the attorney that has changed his story about his ability to prosecute, who has slow-walked investigations allowing things, statute of limitations to run and who was about to give hunter biden the sweetheart deal of a lifetime. this, to me, all points to, you know, we're going to continue to reward incompetence and favoritism, so it's deeply troubling, where we're headed right now. elizabeth: so what congressman fry just said, ann andrew, the

question is, why now? why did david weiss can ask for special counsel substitute now? >> it's really too little, too late at this point. it's unclear why the timing is at this point. appointing the special counsel. but i think what we have to look at is the idea that there are all sorts of pressures by congress for weiss to testify before congress, and i think that the appointment as special counsel is going to be one more hurdle that congress is going to have in order to put weiss in front of the congressional panels in order to ask tough questions about why the investigation has gone on for song so long and why weiss thought that it was wise to cut a deal that a federal judge shot to down in a matter of minutes. so there's a lot of questions here, and i think the special counsel appointment is going to be one more hurdle in the way of us getting those answers. elizabeth: yeah. this is the same david weiss accused of giving that sweetheart plea deal to hunter biden which would have immunized him from future felonies. so this is a major separation of

powers fight because the executive branch oversees the justice department, and then, you know, congress has been talking about impeachment of, you know, biden. we've got congressman greg steube filing impeachment articles today. congressman, will this ramp up the impeachment inquiry in. >> i think it could, and and i think it's certainly going to sharpen, you know, our investigations. i mean, you've already seen the focus really hone in over the last couple months, in particular about joe biden and his interactions with hunter biden this in these transactions. but today the certainly is a step back particularly for those of us who care about transparency because it doesn't look, it doesn't smell right either. elizabeth: we've got a major fight breaking out. government regulations say, andrew, special counsels are supposed to come from if outside the government. both a.g. garland and wise, they told congress weiss had total charging authority or in the hunter biden case, but now he

needs special counsel status and why? and who does he now report to? andrew, these are are major problems exploding right now in d.c.. >> there's always been ambiguity about the authority that weiss had to investigate both hunter biden and people closely affiliated with hunter biden to include joe biden. the appointment of weiss as special counsel is improper under the federal regulations because it's supposed to be somebody with who actually the is outside of the government. and when you're outside of the government, that gives you the autonomy to be able to investigate things fairly. weiss remains an employee of the department of justice, remains subordinate to merrick garland and to the president of the united states. this isn't the independence that you think of when you assign a special counsel, and it's just plain wrong. les. elizabeth: yeah. we have, you know, david weiss also separate from all of this in a court filing saying that the hunter biden tax evasion case could go to trial.

either in d.c. or in the central district of california. so there's also problems though with that case. let's watch irs whistleblowers testifying about the political meddling you talked about. we're going to talk also about what they're saying about what hunter biden -- they did not charge hunter biden with. he should have been charged with. watch this. >> that was not the case. it appeared to me based on what i experienced that the u.s. attorney in delaware in our investigation was constantly hamstrung the, limited and marginalized by doj officials as well as other u.s. attorneys. >> the justice department allowed the president's political appointees to weigh many on whether to charge the president's son after matthew graves, appoint if by president biden, refused to bring charges in march 2022, i watched weiss tell a room full of irs and fbi senior leaders on october 7th, 2022, that he was not the deciding person on whether charges were filed. that was my red line.

elizabeth: so, congressman fry, here's the issue. the irs whistleblower, shapley, testified that they didn't, thes should have brought tax evasion charges for 2014, that hunter biden didn't file a lot of personal income on those tax returns from burisma, that he filed a false return for 2019. those two counts were 2017 and 2018. so already we have, it's seemingly misfeasance in the charging out of the doj, out of the irs against hunter biden. >> i think you're exactly right. and the only thing that has remained consistent in this entire saga is the irs whistleblowers' testimony, both of them. and in that room where u.s. attorney weiss said that he didn't have any authority, since then his story has changed that he was limited to delaware, that he had ultimate authority. this also flies in direct

contradiction to merrick garland who testified that he had full authority. but now, now all of a sudden he really has that authority. if after the statute of limitations has run, after you've tipped off the secret service about tax documents in a storage locker, after you have really impeded this investigation and in the allow these investigators -- elizabeth: well, what are you guys going to do about it in what are you going to do to counteract this? i mean, because seemingly this is going to affect house probes. andrew, i'm going to get to you in just a second. james comer is getting more bank records on shell companies. is this -- if weiss steps in, it could block all that. i mean, jordan wants 11 transcribed interviews with hunter biden, doj, fbi, irs and secret service officials. weiss still has to testify. are you guys going to call all those guys in a potential impeachment probe. >> >> i think at least with the 11 people and the transcribed interviews and u.s. attorney wise himself, we still expect

him to come testify -- weiss -- we want him to come testify, and if he won't, that confirms our worst suspicions which is where, in my opinion, these things ramp up dramatically. we don't know his stance right now, but weiss has already anticipated prior to this appointment as special counsel that he would come in and talk. so i'm at least hoping right now that he's going to continue to do that. and if not, then that's going to guide our next steps -- elizabeth: andrew -- >> that would be deeply concerning to me where this thing is headed. elizabeth: so, andrew, wrap it all together because now the 2024 race, now we have reports coming in that joe biden is negotiating with terms of how he's going to talk to his special counsel on his classified documents case. that's robert hur. we have a hunter biden special counsel, and we have trump indictments. this might be the wildest u.s. 2024 race in u.s. history. so, andrew, wrap this all together. where does this, where do you

think this is going to go? >> well, we have to take it day by day, and i think what we see today is that weiss is compromisedded. weiss is compromised because several weeks ago he virtually skip into the courthouse hand in hand with hunter biden's legal team, cutting a sweetheart deal that eliminated, basically, all of the major investigations here. so until we get real investigation into the real crimes, we have real problems. elizabeth: this sounds like, you know, a lot of gop lawmakers -- final word, russell -- that this is basically just a cover-up to blockade the house gop getting closer and closer to corruption involving the president. that's the allegation. final word. >> no, i think you just hit the nail on the head. i mean, we've done more in six months than news law enforcement agencies have done -- than these law enforcement agencies have done in the six years. and finally when you start to see the full picture, a u.s. attorney who is either incompetent or corrupt or both is appointed as special counsel

in violation really of u.s. law from what we're seeing. so it is deeply troubling and, again, to andrew's point, we're going to the take this day by day -- elizabeth: not just day by day, are you going to fight it? is. >> oh, yeah. elizabeth: okay. we'll fine out more in the coming days. congressman, andrew, hanks for joining us. good to see you. okay, viewers, we're wondering, do you remember this? watch. >> this is the strongest bill you can pass to lower inflation, cut the deficit, reduce health care costs, tackle the climate crisis and promote energy security. elizabeth: okay. whoa, wait a second. we've got news on this. let's bring in economist peter st. only with the heritage foundation. now president biden admits in utah that his inflation reduction act doesn't cut inflation? saying he, quote, wished he hadn't called it that? what do you think? >> you know, i wish he hadn't called it that either, because it was a lie. this was a crony handout of a

trillion dollars overwhelmingly to, you know, the between lobby. -- green lobby. there was nothing in this that was ever going to reduce inflation. even the cbo, who works for congress, said it was going to have no impact on inflation, and now we're seeing that c pix, you know, it's been coming down, inflation's been coming down for a number of months now, now it's on the upswing again because what was bringing it down in the first place was energy. and a lot of that joe biden bought it by draining the strategic petroleum reserve. now, that is not supposed to be used for buying, you know, political polls or for buying an election. that's suppose to be used in an emergency, but joe biden has been draining it. now he's done draining it, saudi arabia's cutting production, now energy prices are coming up, that's bringing inflation back up. so so much for the miracle bill of joe biden there. elizabeth: you know, clinton and obama official larry summers, treasury official, he says it's premature to take a victory lap

on inflation. he also slammed bidenomics as increasingly dangerous. it folks -- doesn't do enough focus on global trade in order to bring, you know, money into the u.s. you know, so when you look at all this, we have republicans at the iowa state fair, you know, going after joe biden. we've got a lot of voter polls saying the u.s. is on the wrong track. he wants four more years. we've got columnists like victor davis hansen saying stop the madness. voter polls, voters say it's time to to restore the rule of law, stop the crime wave, balance the budget, stop the bureaucratic state, reestablish civic education teaching students to love america. that -- so it seems like voters are saying they want to go back to that time. >> yeah. voters want biden to roll up his sleeves and do the hard work, the actual stuff that will bring back american jobs, american manufacturing. you know, what this administration is focused on so far is these billion dollar sort of headline pr opportunities

certainly is a free speech issue. and the fact that you have, expect fact that donald trump is not just running for public office, he's running for the highest public office in the land, and he's the front-runner for his party far and away, by double-digit margins is absolutely a free peach issue. but -- speech issue. but it sort of, in a lot of ways whether they manage to muzzle president trump or not, it almost doesn't matter because, you know, he does such a good job of winning people over when he is being persecuted. and i think that whatever they throw at him and whatever judges and whatever cases in cahoots with whatever prosecutors go after donald trump, it's going to help him in the public eye not only among republicans, but also among regular voters who have real concerns about their lives and real concerns about the direction of the country right now. and this is not one of their top concerns. it's not even among their top

hundred concerns. elizabeth: yeah. >> they're more concerned about a how to pay the bills. elizabeth: you know what's interesting, the fight about this, special counsel jack smith had 28 months, more than 2 years, to do all this. now he's asking the trial for a rocket docket, he wants the trial to start january 2nd right before the iowa caucuses. and it's going to -- and he wants it to enbefore super tuesday in march. i mean, trump's saying that's election interference, and it's also a due prostitutional issue for trump to be -- constitutional issue for trump to be able to prepare for these special indictments. >> in the first place, a speedy trial is something that is afforded to the accused, not the state. secondly, although the i do sort of, you know, i get the point that, you know, if you're a prosecutor, you don't want these things to drag on forever. but waiting this after the election is not letting it drag on forever. the only reason jack smith wants to do this in january is because he is so terrified that donald

trump is going to go on and become president of the united states, and jack smith want wants to do everything in his power to either prevent that from happening or damage trump so badly that in jack smith's twisted mind donald trump won't be able to win the election. and if that's not election interference, i don't -- then there's no such thing as election interference. and the idea that he wants to take that decision out of the hands of the people and put it in his hands and try to confine it to a jury of, you know, in d.c. in order to prevent the rest of america from making this important decision, i think, tells you all you immediate to know about jack smith. elizabeth: here's the other thing too, the reports that special counsel jack smith secretly probed trump's twitter account, getting twitter to not tell trump he was doing that. he hit twitter with a gag order, got a judge to fine twitter $350,000 for not complying. you know, the trump team is saying this is a government fishing expedition into my

twitter messages. smith raises none of this in his indictment. how come twitter could not tell trump the government was seizing his twitter info? this is private activity. reports that twitter for months argued that they wanted to tell trump, but this violated trump's first amendment and the stored communications act. >> right. elizabeth: but then you've got d.c. circuit courts ruling in favor of the justice department, and then jack smith is admitting, reports that he admitted that he included inaccurate information for the secret gag order, that he, quote, errantly used as a predicate that trump would be a flight risk. >> and the flight risk thing is so absurd, it's ridiculous on its face. but what we have seen from the beginning is prosecutors and the dojing pulling out all the stops and using all of these crazy ways of going after trump. and when i say from the beginning, i mean from back in 20216, even before he won the first election. they've been going after him like this with this crazy stuff

elizabeth: okay, let's take a break from the action in d.c. joining us now from house energy, it's congressman buddy carter. congressman, it's great to see you. you know, the white house is increasingly getting involved in debates about biden calling a climate emergency. let's watch this. >> we've seen the president this week focusing on climate. we've seen how it has devastated our country, especially this summer people are feeling it. well -- will the president declare a national emergency on climate, john? >> the president hasn't made a decision yet on declaring a national emergency on climate, poppy, but for all intents and purposes, he's treating this with all the due gravity and the seriousness that the climate crisis zephyrs. elizabeth: congressman, what are you hearing? they're talking about hawaii is on fire, maui, 55 dead. moaa scientists warning record hot ocean temperatures going to trigger hurricanes. so so what would happen in a climate emergency? >> well, i don't know what would

happen, but instead of a climate emergency what joe biden should be doing is signing h.r. 1, lowering the energy costs bill. that's what we need. look, i believe in climate change, i believe it's cyclical, i believe we're going through one of those cycles now. i'm old enough to remember the early '70s when we thought we were in another ice age. yes, this is sick hi call, and, yes, we need to address it in certain way, but to declare a climate crisis, you know, i think is shortsighted. look at our economy right now. you can make the argument, and i think legitimately, that what has happened in our economy is a direct result of the biden administration declaring war on fossil fuels day one into this administration causing an increase in gas prices, causing an increase in inflation, causingen increase in interest rates, the mess we have in our economy right now. elizabeth: people and economists and market watchdogs have said natural gas is why our gses, carbon emissions went down, that

the u.s. does clearance energy with natural gas. cleaner energy with natural gas. i with bev ceded our -- but we've ceded control back to opec +, and now we're producing more than 2 million barrels a day less than we used to, and the u.s. needs to be energy independent as it was under trump. the energy department saying, it projects production's going to go up, but we're not there yet. >> right. and, you know, look, we all understand that energy independence is necessary for our national security. just like pharmaceutical independence, just like food independence. all of those are necessary for our national security. we all understand that. and we should be subscribing to an all of the above type energy strategy. i'm very proud, by the way, of the state of georgia. we just a couple weeks ago, we started up the first nuclear reactor in this country in over 30 years.
