miller. that's actually -- i like both of them. it's 11:00 a.m. on the east coast. there's the statue of liberty, ladies and gentlemen. it is monday, august 28th. i am david asman in for stuart varney, and it is a good market day all though it's lost a little bit of luster. the dow is up 218 points and nasdaq up about 70, s&p up about 20. show me big tech. let's look at big names in big tech. we see them all in the green except for amazon, which is down just slightly. and the 10-year treasury yield down as well. it is still down all though not as much down 1.6 basis points. now this, nikki haley is trying to make the case that republicans are really running against kamala harris in 2024, not joe biden. watch this. >> my concern is that we cannot have kamala harris as president. we cannot chance this and have to make sure we have a new generational leader that's going to bring in not only republicans, but we're going to pull back the independence and

bring back in the suburban women and bring in hispanics and the asian community. we have to make sure we win this because the thought of kamala harris being president should send a chill up every american spine. david: mike h huckabee, the foreigner governor of aver is joining -- arkansas is joining me now. what do you think about focusing on kamala harris? >> i think she's half right. there's a real good chance we may need to worry about kamala harris but the real issue is we're not running against her or even joe biden. we're running against the corruption that's permeated this administration. we're running against a double justice system, against an open border, against a failed policy in the middle east, we're running against an administration that has jacked up inflation to the point that the average american family is losing $700 a month. that's $8400 a year. that's money out of the pockets of an american family.

we're running against a philosophy that the democrats have brought to power that is destroyed this country and destroying the kitchen tables of american families from east to west coast. david: you're talking -- >> focus only on the personals, we're in trouble. david: that's what i was saying, focus on the policies and not on the personalities, but at the same time you know how americans are, they do -- going back to jfk, who they just liked and voted for because they like -- or ronald reagan who they liked and liked his personality, personal -- there's a place for personality in politics accident there? >> absolutely and it's incredibly important that we focus on the fact that kamala harris can't put a sentence together. we'll have plenty of opportunities if she's the nominee or the vp nominee to biden. we'll have plenty of vi videos d outdoor owe examples of -- audio examples of why they're

incompetent but these are the two people that gave us these policies that are failing america and american families and their ability to put gas in their car, food on their table, and money in the bank. when it gets down to it, americans have to ask themselves, do i want four more years of this? and i would like to think the answer is not just no but you know what no. david: by the way, i got to throw another personality into this, who partly won on her personality, that's your daughter. sarah has a wonderful personality and you could see it and she was honest and has a lot of integrity and see it when she was working for the previous administration. didn't that help her get elected governor of the state of arkansas? >> oh, i think without a doubt it did. you know, she's very warm and friendly and kind and people meet her in person, they find her to be very approachable. so of course it has does, let me be fair, i'm as objective about

sarah has the new york times is about donald trump. david: that was a softball question and i want to bring out the point and ask whether there's any personality that showed up in the last debate last week that you thought had a winning political personality on the republican side? >> you know, i think a lot of people have talked about vivek. he was energetic and showed youth and policy issues he'll have to hone up on particularly israel but overall he presented himself well, and i thought he comported himself especially well against chris christie who tried to attack him. he said that great line, i thought it was the line of the debate, would you like to come over and hug me like you did obama. that was a killer line. david: it was a killer line. we're getting close to the second debate. fox business debate on septembe. what do you think the candidates learned from the first debate they may change their tactics somewhat for the second debate?

>> tell consultants to go to you know where and go out and be who they are. quit letting a consultant fill their heads with a bunch of index cards. go out with authenticity. david: did that happen to you? fertiforgive me for interruptint when you were running for president, did that happen to you or did you say to your assistants and those advising you just f off? >> i didn't use that exact language but basically i told them from the beginning, don't try to make me something i'm not. i am who i am, i will win or lose by my own answers and i want to go out there and be very candid, transparent, but i want to be authentic. it's very important that people hear a canned take into consideration not some con -- candidate and not a consultant that's almost channeling through the candidate's mouth and brain. so, you know, i saw some of that in the last debate and you could almost see these people reading off the back of their head, something that had been impresented there. forget that stuff.

imprinted there: be relaxed. forget that. david: isn't that the biggest problem desantis has and it's the first time running for president and seems like he's being directed in too much of a mechanical way by outsiders. >> yeah, he didn't have a bad night, but it was not the breakthrough night and that was true of the overall debate. nobody completely catapulted ahead, but nobody collapsed either. the closest thing i thought was a missed opportunity, maybe an unforced error when asa hutchinson, who's my friend and maybe the most qualified on the stage in terms of resume but when he called january 6 insurrection and coopted the lapping of liz cheney and other democrats, that was a very unfortunate move on his part to call it that. it was not an insurrection. a protest that became a riot, yeah. horrible? yeah. insurrection? not a chance. david: mike huck by, great to see you -- huckabee, great to see you and givous best to

sarah. thank you for being here. appreciate it. >> thanks. david: second primary republican debate is september 27 and here on fox business. don't miss it. check the markets and they are doing quite well today all though again they've lost a little bit from their high. the dow is down 173 right now. i say down two, it is still in the plus category but at 1 # 3 and earlier it was 125250 on the plus side. 250 on the plus side. jason katz joining me now. jason, how much is the fed going to influence this market going forward? >> david, the fed doesn't want to snatch defeat in the jaws of victory. they might have just pulled off this soft landing. whether they were conscious of it or not, they might have threaded the needle. so knowing that the fate of the economy, and the market for that matter rests on their shoulders, think they're going to tread lightly. like as soon as they say they're not going to raise rates, that's when everyone starts to think about when they're going to cut.

then long term rates begin to slide and that provides a boost to the economy, that's not what they want. so the more time they leave open the possibility of raising rates, the more likely the economy cools at a moderate pace. so at best, david, we get a one and done with respect to rate hikes. we even get a done and done. david: when you look at certain extraneous factors. for example what's happening with oil and stuff. that does have an effect. i know they're interested in the core inflation where you take out energy and so forth, but we saw when inflation first really raising it ugly head in the beginning of the biden administration or sort of a year after biden came into power, energy seemed to be upward mobility of the most -- coming into power, energy was the most important inflation and that had nothing to do with the fed. what do you think about the affect of energy on the inflation factor?

>> energy is a contributing factor and we have this soft landing and an oil landing under supply and oil prices could go higher here and that very much is out of the fed's control. look, i think productivity gains are not getting their due credit and that's why inflation is coming off the boil. by the way, i get long oil here. low multiples, high dividend yields, flat returns year-to-date and if we get a softish landing or expanding economy, we're going to need energy to fuel that economy and i looked to energy as a place to put money to work. david: very good stuff, jason katz, thank you. eric appreciate it. lauren, you're taking a look at crowd strike. what's the deal? lauren: morgan stanley downgraded cybersecurity company to equal weight to overweight and price target interesting at 167 and means despite the downgrade, the share price can go up 11%. morgan stanley cautious heading into crowd strikes earnings wednesday and this call this a more difficult environment for the company to operate in.

david: president bind returned to the white house from another vacation though he's going back to the beach for labor day and facing mounting question about his economic policy and peter doocy is at the white house and seems to have been avoiding questions more than usual recently or am i wrong? >> well, can't get a question to him if you can't get to him, period. so there's something to that, david. and now that he's back, the campaign has their top surrogates fanning out and trying to put the word out that the economy is great. >> three-fourths of americans are satisfied with their financial bell being and over three-fourths of americans are satisfied with their current employment. david: he didn't give a source for that three-fourths satisfied with financial well being but that is not consist with recent

moines register poll from likely republican caucus goers in iowa. part of the reason there's still so much enthusiasm behind what is currently the front runner donald trump right now is people are exhausted with politics, they're disgruntled with government. 77% of respondents would describe themselves as that. they don't like what's happening right now. only thing i would add to what i just heard from doug burgum is there that the gop needs to step up and have an optimistic message. we know inflation is bad, we know the average american family is struggling with finances right now, but what is the message? what is the republican party promising to voters right now? how do they make it better and what will like be like? david: specifically add to younger people. ronald reagan was at that time the oldest person to run for president, all though he's much younger than what president biden is. he got 60% in '84. 60% of young people between

18-24 went for ronald reagan. age doesn't necessarily. it's how you talk about the future that is important. i don't think biden is doing it well, and it's -- vivek is the best. he's young himself. but of all the people running perhaps the best -- >> vivek's message has been people want to stand for something; right. we have to fill that void he continues to say of people who are going other avenues, wokism, to fill that void and an optimistic message of putting america back to work. you know, improving this inflation situation that's for some reason the white house is touting as a major success right now. it's not. it's really still very brutal out there. buy a car, buy a house. david: people know it. people know it. you're telling people they've got lying eyes essentially, and that doesn't work. >> how do you fix the problem? solutions need to be offered and that's what people will vote for. david: very quickly, trump fundraising off of his mug shot. what's interesting is that both the democrats and republicans are fundraising off of this mug

shot, but he got $7 million since he came out. >> since he was bobbed in the atlanta jail on thursday evening, the former president raised $7.1 million. that's a lot of cash. there's no doubt. when i reference that nbc des moines poll, i think it plays into what you're seeing happen there among likely republican caucus goers in iowa. when asked if this would describe them, pro life: 80% said yes. afraid for the constitution, 77%. traditional conservative, 71%, capitalist 68%, anti-woke -- 61%. half of respondents would describe themselves as maga republican. you can't ignore that's the reality out there right now. david: it is. >> in iowa that's very telling. david: i'm glad you took time out from the kudlow show and you have a show of your own by the way. >> i missed you and lauren, david, thanks have inviting me

by. david: your show is at 1:00 p.m. eastern time. there's john robertn the background. it's not the worst way to mispronounce my name. thank you, sandra. >> thank you. david: check the markets and they're still doing well. they've done better over the course of the day. they were up about 250 at one point. now the dow is up 166, the s&p is up about 70. excuse me, the nasdaq about 70 and s&p about 15. take a look at airlines if you can. they're all positive today, not by a great margin but that is good news. there's some very bad news that we've been talking about. thousands of pilots being investigated now for falsifying medical records. lauren, what were they trying to hide? lauren: a medical condition for which they are receiving disability benefits. so 4800 commercial and passenger pilots trying to hide these conditions that could have

deemed them unfit to fly. of that 4800, 60 are deemed a clear danger to aviation safety. they've been ordered by the faa to stop flying. the issue is with the way the faa screens them. self-reporting, what are your health conditions. here's the rub, many pilots are veterans and they learn to fly in the military. they receive benefits from the va and they exaggerate their medical and physical health conditions to bolster their disability benefits so they tell the faa they're fine and then tell the va the exact opposite. so now the faa is hiring experts to comb through the conflicting data. 60 of those deemed can't be flying. david: not very good. if you have kids, this is also bad news. the airlines are offering child-free zones on their planes. lauren: i love it. this is a great idea. so the name of the airline is out of turkey. and it's the first in europe to

david: it's a good day and half a percent gain on the dow jones industrial average and nasdaq. lauren: yeah, dow stock and up it goes, 4.5% and 5.5 billion settlement on the table over the military ear plugs that 3m makes and sounds like a lot of money but only half of the expectation hence the stock goes up. years of complaints about the ear plugs, several service members sued hundreds of thousands have sued saying they lost their hearing as a result of defects. david: virgin galactic. lauren: september 8 around the corner and flight window for third commercial space flight sending paying passengers to the edge of space september 8 for galactic 03 and stock up almost 2%. david: closer to earth, jetblue. lauren: down 20% this month, ouch. and ever core isi upgrades them, stock's up 1% to in line but a

in and got an emergency appellate division to hear the case, and t appellant division overturned our judge and moved back in. david: won one and then almost immediately lost another. this is kind of affiliated with this. over the weekend, we discover that had new york city, and it's not a surprise to those of us who live here, is the most expensive city in which to live in the united states of america right now. the most. at the same time, new york city taxpayers are paying for tens of thousands of migrants to live in the most expensive city in america. paying some of the most expensive hotel costs, food costs, medical care, et cetera. it's just not fair to the taxpayers, and there are other places in the country in which it should be a lot cheap cheaper to house them and politician

haves these incentives to draw migrants in. it makes no sense at all. >> david, new york is the most expensive place in the whole world to live. not only that, we have our own homeless here. we have our own veterans here that don't have shelter. to make it a priority to put people from another country in homes before them is just disgraceful. i mean, look at the screen right now, not only are they putting people in homes, they're welcoming them and patting them on the back for being here. one of the most crazy parts of this whole thing is there's no end in sight. where is the end? if the city turned around to us and said, you know, counselor, we're going to put them in there for 90 days and that's going to be the end of it and there's ab end to this and we have an end to this and they'll be stopped at the border, then we say, okay, that's reasonable, but there's no end in sight. what do we take in millions and millions and maybe billions from around the world before it ends?

it's insanity. david: lou, very quickly the. the mayor of new york, it was one of his predecessors that declared it an open city, sanctuary city for. myograns s and the mayor has the right overturn that designation for new york city and take away that declaration for new york as a sanctuary city. he could do that tomorrow. couldn't he? >> david, he can do that right now. this sanctuary, this notion of a sanctuary city is a fiction. it's not a law that's been passed, it's not in our state constitution or american constitution. it's a fiction. one day one of these politicians woke up and i don't know if it was i de blasio or somebody in city and said we're a sanctuary city now and we're going to accept everybody from across the world no matter who they are. they opened the door to this by declaring this fiction and you're right, it could be ended

david: if you think this is crazy, the next one is worse. tourists visiting the big apple are looking for authentic experience and that actually includes rats? lauren: i don't think this is funny. i think it's ken polcari tear on what -- commentary on what new york city has become and only a new york experience, come see our rats. they're so popular, they're like celebrities. the rats are celebrities in new york city. tour guides are live streaming places where you'll see a lot of rats and they're getting like $10,000 participants per stream. if you look at rat complaints when you call the city, i saw a lot of rats and they doubled in the past year. they're gross. they spread disease. david: bubonic plague game from rats. okay, fox business report, donald trump federal trial, we have a date, it's on march 4 in washington dc. now keep in mind, that is the day before super tuesday, that collection of primaries on one

day. georgia has also proposed a march 4 trial start date. clearly they both happen on the same day and the question is how they're going to work that out. maybe that somehow the feds take over the local case, we'll have to see how it works out but both dates in march right in the middle of primary season. it's been two years since 13 service members were killed during the botched withdraw from afghanistan. one republican congressman wants defense secretary lloyd austin to be held accountable and impeached. we're on that. chicago is the latest city to sue hyundai and kia over a rise in car thefts. they're blaming the car makers instead of the criminals. jeff flock has that report right after this. ♪david: national price of gas

city because of those videos. remember those tiktok videos and facebook videos that show just how easy it was to steal certain hyundai and kia models between the years 2015 and 2019. could do with usb and so chicago says you needed to make your car as little harder to steal because other cars are harder to steal. in their filing they said, "chicago is bearing the cost of defendant's unlawful conduct as is pays for property damage, law enforcement strategies and striving to keep the public safe from harm, defendants could have prevented it". look at numbers, it's true. car thefts up big time, 104er and in chicago alone this year and in their filing, they had these numbers, david, in the first half of last year before those videos were out there, 500 car thefts in chicago. the second half of the year, 8,000 car thefts, and they say, you know, you just didn't make your cars good enough and safe enough not to be stolen.
