putin invade and knocked out the communications and musk supplied star link system and it was a wild success. the russians couldn't jam it. then the ukrainians launched submarine drones to attack the russian naval fleet based and that's in crimea. the drones were guided by star link. musk realized what was at stake. suddenly he was in contact with the russian ambassador who told him an attack on the fleet would lead to new clear response. musk pulled the plug. he told star link to disable around crimea and they did. the drones couldn't navigate and missed targets and crisis eberthed and zelensky and putin, by elon musk, a private citizen. think about this, musk decided who would win and who would lose. he's not subject to any vote. he's not answerable to anyone and yet in that moment, he exercised an extraordinary level of power. are we okay with this?

third hour of varney starts right now. ♪ stuart: are we okay with a single individual albeit a multibillionaire exercising that kind of power in the middle of a war? are you okay with that? >> there's an old saying, believe, from spiderman with great power comes great responsibility. in this case, look, star link is an amazing product, and i'm confident it'll bring more good than bad to the world and innovation and all those things. these th things are morally agnostic and tools used for good or evil. i'm generally confident elon musk as a leader is an ally of the western world and free speech and those values in general, but i do think because it is a great responsibility, it might be a good idea to show the

world, world leaders, et cetera, regular citizens how you're making these decisions that you may have folks advising you and what that looks like. transparency is helpful for that to ole concerns from the rest of us. stuart: look, i think the guy is great. the man is a genius and extremely wealthy and done so many things in american business and yet holding that kind of power in a war. a little troubling for some. move o. governor desantis, florida, criticizing efforts to bring back covid restrictions. roll tape, please. >> in the state of florida, we've ensured this is a free state, and we've worked very hard to do that. we cannot let this happen to our country again. it's not just me saying that. it's not just me promising that. we've delivered the protections that guarantee that for each and every floridean.

>> i think people need to be ready to push back, particularly if you live in a blue area or major metro area and there's attempts to lock -- get these things moving again. the left will tell you they're fake and you're losing your mind. it's not true. there's an elementary school where kids are being masked in third grade because of a small outbreak of covid in the classes. you need to be ready to fight and tell leaders, we're an outlier on the world stage, no one does this to kids except and yous no one did it to the extent we did ever including europe's cdc. the equivalent is like you shouldn't mask any primary school children, but we did something entirely different and had damages to kids and they've never shown us that it's effective for stopping these outbreaks. stuart: what's behind it? is it fear or in my opinion is it the desire to control? >> i think there's a lot of power hungry stuff going on and

lauren: it is, i'm almost positive. stuart: get free money if you vote for me. another one, in california no less, there is one city that's banning mask and covid vaccine mandates. tell me more. lauren: huntington beach. so huntington beach is just south of los angeles. very narrow vote but they have voted to ban mask mandates and mandatory covid vaccinations. they do still have rules in place if anyone tests positive that you need to mask up in certain situations but the acting mayor said the original mask mandates from back in the day unnecessarily limited the freedoms of their citizens. stuart: say that again. lauren: even the folks in huntington beach, california saying stop telling me what to co. maybe they'll get money next. stuart: 11:08 and a look at markets and looking at them now, apple is up a buck at 178, jonathan hoenig with me now. is this time to buy apple? not your normal kind of

on what legal grounds can they do this? >> stu, good morning. the lawsuit alleges because of the 14th amendment trump cannot be legally on the ballot and the candidate himself says this is a trick to stop his campaign. on wednesday, six republican unaffiliated voters backed by dc-based ethics group filed a lawsuit arguing colorado secretary of state should disqualify president trump on next year's ballot based on section 3 of the 14th amendment. they said they're bringing in case because it's necessary to defend the republic today and in the future. the group says its filed a lawsuit in colorado based on state law and the calendar, but that more lawsuits are coming and more states and now colorado's secretary of state says she wants the courts to weigh in. >> in colorado law, how do we consider potential disqualification for ballot access? those are all really big questions, and i'm helpful that the court will provide guidance

stuart: well, business on wall street and we have a lot of green too. the dow is up 100 and nasdaq up 68 and s&p up 17 to close out the week. we're not closing the market just yet. there's one high school that's in queens, new york, that had to take in migrants and it filled up the school completely. what did the school do, ashley? ashley: not a lot of options and newcomer high school in long island had lines around the block before class began and that's because they had to be forced to send some of the students to a facility across the street. thousands of these migrant

students flooded the classroom and bear in mind only two-thirds of the students show up and it could get worse if they all attend schools and it's impossible to know how many asylum seeker students showed up because the department of education doesn't keep the records and doesn't track the immigration status of students, but it is estimated and the number being use second-degree 21,000 new myo-- use second-degree 21,000 new migrant students in the big apple and the chaos upset students and teachers and the like with many complaining that the districts should have done a much better job of setting this up and trying to plan beforehand because what happened yesterday was chaos, stu. stuart: ashley, you and i have talked a lot about the federal judge that forced texas governor abbott to take down those border buoys along the rio grand river there, but now he doesn't have to take them down? what happened? ashley: well, a temporary stay
