>> welcome to the program that analyzes the week that was an helps position you for the week ahead. i am jackie deangelis and for maria bartiromo. the clock is ticking for hunter biden as a special counsel david weiss is expected to indict the president son on gun charges by the end of the month according to a new court filing. charges that could land him in prison for up to ten years. hunter biden's attorney is pushing back saying his client has been investigated for years and the only thing that has changed are the politics. >> they know everything they know about the gun possession. hunter had a gun for 11 days, it was never loaded it was never used, there has never been a standalone gun charge brought by this office ever so what changed, not the facts, not the law but we've seen over the last six weeks, the politics have certainly influence the outcome be one as house oversight committee chairman jane james comer is unrestricted access for archived records involving communications between then vice president joe biden's office and
10:02 am
hunter biden's business associates. >> we know that hunter biden was communicating and we believe more that the archives are showing us that the hunter biden legal team the hunter biden dear people, the hunter biden shady characters who were paying him were communicating through him to his father back and forth, there was no wall between joe biden and his son hunter biden in the shady business dealings. jackie: joined me from the house oversight committee congressman byron donalds. great to have you on the program. thank you for being here. let's talk about the significance of the possible indictment, theories are being floated that special counsel david weiss is using this as a ploy to go back to the sweetheart deal that he presented before that not necessarily is this an example of justice being served.
10:03 am
>> first of all it's good to be with you, let's unpack a couple of things. number one david weiss should not even be the special counsel, is the department of justice regulations that a special counsel should come from outside of the government. his office already screwed up the original indictment and they are the ones and put together the sweetheart deal that merrick garland signed off on. they are the ones that screw that up and they get a second bite at the apple, that is complete the wrong. number two the fact of the matter to abbe lowell, what is changed is transparency not politics. the fact that people of our country now understand that hunter biden was getting the sweetest deal known to man because his daddy is president of the united states. it is that simple. when you bring sunlight to that
10:04 am
that's what he has been held accountable to get the other citizen of a country would be held accountable. i'm very concerned that because david weiss is a special counsel and he was the original counsel on this case that there will not be at the role look on the lack of the investigation that occurred with respect to hunter biden and they're going to try to clean up the original deal that they had so they can sweep this under the rug and move on. jackie: a lot of moving parts to this we will be watching as the news develops. i also want to get your take on the work that the house is doing with respect to joe biden and hunter biden's business dealings overseas. it is impossible that promise made forward on the hunter act but joe biden could face impeachment himself. >> 100% th believe that this is possible. here is why these account set up originally, the core of the tax evasion the hunter biden did to the tunes of millions of dollars, the account set up was
10:05 am
when joe biden was vice president of the united states in joe biden was in business meetings with hunters client, joe biden was on the phone. now we find out 5400 e-mails that the national archives has had this entire time where joe biden is using fake names in the e-mails. fake e-mail accounts so he can communicate with business partners on the side. all the while joe biden has consistently said he never knew anything what hunter was doing and then they had to change the story to say he never benefited from what hunter was doing but there was a text message from hunter biden to his daughter saying at least you don't have to pay half of your salary to me the way i have to do it to my father, this is a joke it's public corruption and i believe when we have these e-mails it will demonstrate what we all know which is what hunter biden and joe biden have been in cahoots the entire time. jackie: when it comes to the bottom of the issue the e-mails are important it exposes that the president has lied to them or give people time and time
10:06 am
again on this issue and as you mentioned changing the story first it was i did not know we never discussed it now as i never benefited but the bank records are to be crucial as well and the president made a sarcastic comment about that, where is the money but the bank records of the shell company would show where the money trail is. i know it's more complicated in the forensics to get to the bottom but is any progress being made there? >> there is a lot of progress being made on the front we've been subpoenaing records about the very thing because is not just that joe biden had to take money into his account. if hunter biden was pain-free thanks for the benefit of joe biden that is more than enough and i'll add something us hunter biden is in violation of the foreign agents registration act. he is in violation of that.
10:07 am
if joe biden knew or understood that he was representing foreign entities without being licensed to do so or registered to do so he is a co-conspirator in a violation of the fair regulation and statute under the united states law. jackie: the roles have to apply equally to everybody in this country that is a citizen. while you were here i would get your take how the presidential race is shaping up the second republican debate going to be held right here on fox business. we also have a new cnn poll that shows former president trump is head-to-head with president biden and a hypothetical matchup and trump is still expanding the primary lead over other gop candidates despite recent changes and a looming trial, the recent charges rather this is coming is nikki haley steam is blasting desantis and ramaswamy as being trump light saying that they copy trump on everything it other candidates argue that the gop needs a more electable candidate than the former

president. how do the arguments hold up what can we expect to hear and see from the former president over the next few weeks. what i see the more he gets out there, the more the charges piled up the more people are supporting him. >> let me talk specifically to republicans in the summary brakes on take the commanding position as the number two person in this race, this thing is over he of three candidates who are all basically tied talk about governor desantis, governor haley and vivek ramaswamy. if this continues to hold this is done because donald trump is over 50% and basically every poll in the first couple of states he has a massively 20 - 30 points in early states so somebody has to break there i don't know who's going to do it, frankly i don't expect it to occur, donald trump is going to be our nominee. let's shift to the general, joe biden is a terrible president and everybody knows that. call that with the facts that he does look feeble and he doesn't look like he has the stature to stand up to world leaders on the
