and we've got top house lawmakers meaning in -- subpoenaing the bank records of hunter biden, james biden and their companies for the impeachment inquiry. we're going to dig into what they're looking at. and this story coming in, outraged lawmakers demand the biden administration fix squall will lid and filthy living conditions for u.s. troops here in the u.s. it's worse than what we reported. and we've got new reports that top democrat allies urged president biden to ditch campaigning on bidenomics as a, quote e, serious misstep. but we've9 got their reaction to that. and democrat senator elizabeth warren with slams a biden nominee over serious conflicts of interest. we're going to explain. i'm elizabeth macdonald, "the evening edit" starts right now. ♪ elizabeth: let's get right to david spunt live in d.c. with

that story about an irs contractor charged with leaking trump's tax return information to the new york times. david spunt, it's good of you on. >> reporter: thank you for having me. his name is charles littlejohn, and according to this information packet, it's not technically called an indictment because we believe that there is a guilty plea that's going to happen at some point toon -- soon. we're told he was an irs contractor that worked for the internal revenue service from 2018-2021, leaked tax information from donald trump and some of the other ultra-wealthy people in the united states. this does not mention those names. to not only "the new york times," but a source also confirms propublica received some of this information. this happened during the trump presidency. we checked online, "the new york times" did several stories about donald trump's taxes during the height of the covid pandemic. so the actual allegations say that the defendant, meaning littlejohn, worked on contracts that that he had obtained with

the u.s. treasury's irs returns and return information, and from 2018-2020 while he was working as a contractor, he tole tax returns -- stole tax returns, return information associated with donald trump, gave request it to the new york times and also gave it to propublica. now, as far as charges are concerned, liz, we don't know what charges or punishment, we don't know what may actually happen because it appears that a guilty plea is in order. we reached out to doj for comment, comment is declined, but this explains a little bit more according to the government about why we were able to find out some stuff about donald trump's tax information back during the height of the pandemic that appeared in "the new york times" and propublica. elizabeth? elizabeth: david spunt, great reporting. thank you so much. let's bring in former federal prosecutor katie cherkasky and former deputy attorney general john yoo.

he disclosed trump's tax returns and the are -- returns of thousands of upper-bracket taxpayers. just one count. what do you think, katie? >> well, it sounds like he's in the process of cutting some sort of deal here. now, obviously, we don't know about the trent of the evidence that supports -- strength of the evidence that supports the allegation, so perhaps the prosecutor thought this was the cleanest way to dispose of the case. sounds very favorable based on the report that we just heard but, again, this doesn't seem like it's a final deal but very favorable, it's true. elizabeth: yeah, favorable. john, what's your reaction? i mean, thousands of tax returns. this is a breach of privacy. just one down. count. >> first of all, we should remember what the penalties are for just a single count, up to five years in jail and a fine of up to a quarter million dollars per leak. so if this person leaked thousands of tax returns, that's thousands of -- each one of

those is a violation according to federal law. so if this kauai's cutting a deal for just one single charge, he's getting away lucky. i think it's probably pretty easy to prove based on the retension of e-mails and document documents -- retention of e-mails and documents. i'm surprised that doj would consider this a difficult case to improvement i think this guy should actually be made an example of, because if we don't have taxpayer confidentiality, why should you, me, biden, trump, anyone tell the truth on our tax returns if we it's going to be disclosed to our neighbors and the newspapers the very next day? elizabeth: the irs would slam us if we didn't tell the truth on our returns, but your point's well taken, john. the irs should be fort knox when it comes to our private tax returns. this is a serious breach. we're going the to stay on this story. we've got to move on to this. katie, let's move on to house law a makers subpoenaing the bank records for hunter and james biden and their businesses. i mean, democrats and the media, katie, keep saying there's no evidence of joe biden profiting

off of this. yes, that's understood. but it's about building a money trail of biden family companies and and shells taking in at least $24 million from overseas, talking at least 20 the shell companies, then they send that money to the bank accounts of biden family members. that could possibly include the president. they have been stonewalled and obstructed every step of the way trying to get this information, katie. >> yeah. and i think it's very disingenuous to claim that there's no evidence here. there is more circumstantial evidence in this case than i've seen in cases that have been criminally indicted. the question of whether you can connect all of the dots to show exactly who got what money where especially when you're not going to have any enforcement power behind these subpoenas for all intents and purposes because the doj would have to make that decision, it's quite ridiculous to me. even just based upon what we have seen so far, i think that there's significant question about the corruption of joe biden directly. and that's based upon what we already know. now, i think it's worthwhile to pursue trying to get into those

records and actually connecting more of those dots, but the circumstantial case here is very strong. david: elizabeth: john, you and katie are brilliant working minds. you've been working on serious, deep, intense cases. john, there's a serious legal debate over whether the president can be impeach9 for -- inpreached for crimes and misdemeanors in -- while holding prior offices. is the constitution silent about that? what does it say? >> nobody knows. it seems to me, if i were to make a guess -- because, first of all, no president has ever been impeached for conduct that occurred before the president was with in office. so i have to make a guess. it says treason, bribery or the other high crimes and misdemeanors. maybe you could make a case if someone committed treason or bribery before they were president, they might be able to be um peached. could you commit other high crimes and misdemeanors before you were president and still be

removed from office, nobody knows. two judges have been impeached and removed from office for things they did before they were federal judges, so that's the only precedent we have with, but they weren't president either. so it's an unknown question. one last thing, it's up to the house to decide what's impeachable, and it's up to the senate to decide what to remove someone from office for. the supreme court has said federal courts are not to get involved, this is really up to the congress. elizabeth: you know, documents show hunter biden made nearly $5 million from his china deals. chinese nationals sent wire transfers of more than a quarter million bucks to joe biden's main home address in delaware, listing that home as a beneficiary. that's what the documents show. watch joe biden claim hunter never made any money from china, and watch hunter deny that too. watch. >> my son has not made money in terms of this thing about, what are you talking about the, china. if. >> the president has repeatedly said that you received $1.5

media getting snowed, getting yelled at, bullied and and yelled at by the president when they're asking canning about this? >> joe biden has made common travelly false statements with regard to receipt of funds by his son from foreign countries. and i think when we're talking about whether pre-office acts could be the basis for impeachment, if a president is compromised or corrupt and is in office, i think that that would absolutely be a basis to look into whether they're fit to continue in office. elizabeth: got it. katie, john, we're so sorry we ran out of time. we both appreciate your brilliance and legal minds. we appreciate you coming on. we hope you come back again soon. thank you so much. >> thank you. elizabeth: joining us now from house oversight and house judiciary, congressman andy biggs. let's get an update on the government shutdown. it's at an impasse. you just voted today with 20 other lawmakers no on an interim budget bill. what's happening now? >> a lot of meetings going on, a

lot of people talking about what they want to do in the next step. i personally wish that we were taking that time and actually trying to pass the other six bills that have already been passed so so we can get those bills out and to the floor and start debating those. but right now everybody's wringing their hands instead of acting. elizabeth: okay. so then there's this, let's move on to the impeachment kind -- inquiry. documents released out of ways and means. now we see a july 2016 letter hunter biden cosigned with officials from burisma to ukraine's top prosecutor demanding that he back off from, quote, making allegations of criminal activities against burisma. that was after hunter was e-mailed talking about getting $5 million from sitting on the board of ukraine's burisma. >> yeah, that's right, liz. so when you start looking at this whole pattern, you'll see obviously hunter is facilitating

the brand, wes -- which is joe biden and he's facilitating, he's kind of a liaison between the ceo of burisma who's being investigated by viktor shokin, the ukrainian prosecutor, and what the ukrainian ceo wants is he wants that prosecution stopped, and he has said in one of our, one of the documents that we have that's why he got hunter biden on the board in the first place, to get access to joe biden to stop this. so you start looking at all of these things, they add up to joe biden knows what's going on, and it adds up to joe biden acting, taking action on behalf of burisma and effectively a quid pro quo. elizabeth: quid pro joe is what the critics are calling him. and then this, ways and means releasing a hunter biden text message to his business partner in chai -- can china's oil giant indicating joe biden would join

them for a meeting in august of 2017. quote, my uncle will be here with his brother when would like to say hello to the chairman. what do you think? >> yeah. there's a reason that they had to deliver the goods. it wasn't an illusion of influence peddling here, this is actual influence peddling. is hunter has to deliver the goods. he's going to bring joe there, then-vice president. he's going to bring him not just to the chinese meeting, he's going to take him to the russian oligarch meeting. he's going to arrange a telephone the finish the call and later a statement to the media that he was able to get ukraine out. so the point is all over the world hunter biden is facilitating the meetings of these well hawaii people who are transferring money to the -- wealthy people who are transferring money to the biden businesses to get access to joe biden. elizabeth: got it. congressman biggs, thanks for joining us. it's good to see you. is and joining us tonight, congresswoman kat cammack, former u.s. treasury official

the week. >> yeah. sadly, i think your assessment that it's much bigger than what's being reported is, sadly, probably accurate and, from my experience, probably checks with what i experienced as well in my 20 plus years in the navy. it's unacceptable, it's certainly requiring leadership's engagement, and i'm talking senior uniformed leadership's engagement. as a senior officer, even as a mid-grade officer, i would visit my junior enlisted and june officers' barracks and quarters to the make sure it was up to standards. the same thing needs to be held to all of the senior leaders, that they need to check on how their soldiers, sailors and airmen are living. elizabeth: we just showed a bed with bedbugs, sue war -- it's a hair on fire moment. fix it now. please bear with us, again, it's worse than what we reported. inspections of a dozen military installations, bedbugs, rodents,

cockroaches. talking a precursor to legionnaire back tier what, a respiratory illness associated with black old, education pose you -- exposure to methane gas, brown water that's undrinkable, broken security systems, windows, door locks, fire alarms, air conditioners all broken. heating systems where rooms hit more than 90 degrees fahrenheit. brent, can you e please explain to the viewer what our troops go through in their, you know, conditioning, their a daily routines observe our country in and then they have to come home to that. >> absolutely. i mean, they all are patriots, they all sign up to put their lives at risk. they live in very spartan conditions, but where they have their stuff, their gear and with where they go to rest and relax, their home shouldn't be a -- should be a place that they're comfortable. and in a competition for people in a tight market for bringing people in and recruiting that stinks, quite frankly, this is

not how you treat them if you want to win that fight to keep them. elizabeth: lawmakers are outraged. it's a cities grace. they sent a letter to the pentagon, fix it now. white house, fix it now. our troops do not deserve this. they're demanding answers on why they live in squalor. again, it's a total disgrace. and now the pentagon asked for about a $15 billion for overall facility sustainment. they couldn't identify how much of this total would be pent on the bare rocks though -- barracks though. your final word. >> a couple years ago we had a string of suicides in norfolk, virginia, because the conditions there were so horrific and so pressing that you had a string of suicides. and yet still it's only been in the last several weeks that we've actually seen any movement on a barracks barge actually coming to deliver some relief to these sailors that live down there. so that type of timeline, inadequate. leadership needs to get involved and leads to be -- needs to be

seen in the barracks and the housing, and i'm talking, like, secretary secretary of army a, secretary of the navy, air force, they these to be down there. the last time i saw this, in my experience it turned around quickly, when the secretary of navy's wife toured the barracks in pearl hard harbor, and they turned it around in several years. elizabeth: my family doesn't like it when we talk about our family. my mother never knew her father. he died from mustard gas complications, getting hit with husband standard gas in world war i. you know, so she was 1 when he died. my grandmother was pregnant during the great depression, world war, you know, 193 -- 19332. a year later she loseses her brother, fire department, fdny, pneumonia. my sister-in-law lost her husband on nerve. we know what men and women like you who serve our country have to put up with. we understand loss and sacrifice, brent. we understand you served 25

elizabeth: okay, welcome back. the government estimates u.s. gdp growth slowed down to 2.1% for the second quarter and more wall street economists were looking are through the reports, they warn we could be in stagflation if right now under this white house. edward lawrence has the story at the white house. edward. >> reporter: well, liz, inflation moving in the wrong direction. the latest report out today shows that overall inflation actually increasing .4% month over month and 3.5% year over year with core inflation falling for the first time since may. this is not what the federal reserve wants to see as i asked the chicago fed president about the situation yesterday. is that mission accomplished for that month then, if you see, you know, overall going up but core staying where it is? >> i wouldn't call it mission accomplished because we're still above the target inflation the rate. so inflation still has to come down. but if you take a step back and you look at the last three months, we got on the cpi side

core inflation is down to 2.4%. that's come down far faster than anyone predicted. >> reporter: still, the white house ignores the fact that starting this march of last year the federal reserve raised rates 11 of the past 13 meetings to try and fight inflation that spiked under president biden. yet the white house wants you to focus on its spin. >> the president in the last two years has been able to get our economy back on track, right? we've talked about the 13.5 million jobs, unemployment being under 4%. >> reporter: a recent washington post/abc poll shows only 30% of americans approve of the president's handling of the economy, that's his lowest marks of his presidency for that. back to you. elizabeth: edward lawrence, thank you so much. let's welcome back former treasury department official michael faulkender. you heard all that, michael, and then what is your take on this new political report, top biden allies and democrats thousand say the president's got to ditch his bidenomics term, that this is, quote, a serious misstep, a

mistake, but politico reporting the white house is dismissing these democrat fears as, quote, premature and overblown? what do you think? >> you know, liz, it's a amusing to listen to karine jean-pierre from the white house podium declare that biden inherited a mess and that he's been spending the last two years bringing back the economy when, in fact, the economy that he inherited was one where we had regained almost all of the economic output that was lost during the pandemic and the inflation rate was less than 2%. but then biden went on a tear with massive amounts of government spending, he stopped -- he declared war on oil and natural a gas here in the united states and as a result created 40-year-high inflation. and then goes out and tries to think that the american people only care about jobs and tries to tout his re-election campaign as a built on bidenomics. well, but what the american people know is that bidenomics is biden-flation.

by shutting down oil and natural gas, by throwing trillions of dollars extra into the economy, running massive budget deficits, it's no wonder that we get these massive price increases, and that's why most of the american people have such an accurately poor opinion of the economy and the president's handling of it. why the white house seems to want to continue reminding the american people of the economy that joe biden caused that is looked upon so disfavorably, i can understand why other democrats want the white house to scrap that term. elizabeth: okay. but the president is instead doubling down. he's going to double down on bide how manics, and he's demon ifizing -- demonizing tens of millions of voters, calling them maga republicans. the first democratic primary, this is his take right now, he's going to say maga-nomics is bad? >> this is the problem, the american people remember what

you. we've heard from a number of republicans, even a handful of democrats who have criticized the president's border policies, but so far the white house showing no sign of changing strategy and, of course, we're looking to see whether or not that changes in the days and weeks ahead. the president was out west earlier in the week making stops in arizona and california. political fundraisers on the agenda as well as a speech honoring the late senator john mccain. the president chose not to visit any border facilities. an abc/washington post poll showing 632% disaproof -- 622 percent disawe proof of the handling of the southern border. house speak wear kevin mccarthy posted, 30,000 illegal border crossings in 3 days isn't a talking point, it's the record-breaking reality that is turning every community in america into a border city, and president biden is deliberately letting it happen. that's e the speaker's comments. the white house pushing back, insisting it's up to congress to come up with a comprehensive immigration reform.

thanks for joining us this friday night. okay, the boondoggle, the insider cronyism in spending for the border crisis, it's very real. america first legal got freedom of information documents, the biden white house gave a no-bid contract to a company that hired a former biden insider and, congresswoman, that that contract quickly quadrupled to $2 billion. it was originally about $530 billion. what's going on here? >> this is typical of the biden administration. they are pay to maker as we know, and unless there's a dollar sign with it, they'll go existence it. in this case, they found a way to enrich their friends and family members and, of course, they're not only going to take advantage, but they're going to double, triple, quadruple the price of what it should been as a matter of getting rich. this is the hypocrisy and double standard of the biden administration that all republicans, all democrats, all independents are sick and tire of. we need to get very serious

he'll resign from the board of clover health, an insurance company. senator warren points out that insurance company makes a ton of money from medicare advantage. what's going on here? >> well, this is $100,000 salary that this nominee makes, so it's not like he's raking in millions. and if you watch this testimony is and you watched this back and forth between senator warren and the nominee, it seems like we don't have lawmakers at this point, liz, we have performance artists. senator warren, you know, if if she wants to object to this nominee, that's fine. but she did so in such a way where she was playing to the media, traditional, social, doesn't matter to put on big show to draw attention to herself to show you she cares so much about issue. elizabeth warren's net worth is $80 million, so whenever she goes up on this very, very high moral pedestal and starts lecturing about somebody making $100,000, i see her as hypocritical. elizabeth: yeah, but, joe, he should resign. he shouldn't be sitting as a trustee in medicare and at the
