and the other side of the argument about whether gates and his group no what to do is they didn't have an alternative in january. if you remember 15 ballots, they were all over the place. a few of them voted, vote by mcdonald's and then somebody else for a while. there is no candidate they were united behind. steve scalise number two basically skillfully stayed out of it. obviously he might have benefited had mccarthy lost at that time but he stayed out of it and did not challenge mccarthy for speaker. there's no guarantee at all that they would have supported him them. the sea do something different now than mccarthy has been ousted? my guess is he's going to wait to see what mccarthy does because we could see a replay.

house speaker fight, kevin mccarthy breaking this as ousted. your take on what we just reported? >> this is extraordinary because it finally admits they have new clothes. i've been to ukraine and interacted with senior government officials and staff over there, there are a lot of good people but they will tell you this country has a serious corruption problem on the broader spending issue, i'm not saying who's right in this fight but gates is certainly correct on broader structural issues, congress power. until you get that single subject spending bills, until you get back to the way congress was intended to function, i don't think you will fix this i think another part of this is the d.c. culture, congress doesn't work like it used to. i do think a lot of this could have been avoided if congress dayton instead of going out over august and september but the problem is a lot of members

what this has caused, causing damage to the republican party. we have done structural changes and had restored regular order and now we are faced with chaos due to matt gaetz and a small handful of republicans. >> where do we go from here? what happens next? >> we will have vote for speaker of the house and my vote will be with kevin mccarthy and we have the vast majority of confidence with kevin mccarthy. again, seven or eight republicans, they voted with the democrats to oust the republicans, speaker of the house. if you listen to matt gaetz at his closing argument, he talked about a coalition. what is this coalition? is going to have to include the democrats so i got serious issues with matt gaetz and what he did. not only to the republic and party but this nation because the republican party is standing

speaker of the house. the house recessed subject to the call of the chair because there is no speaker and what this does is take this back to january 3 you might remember we were here five days and 15 consecutive local with a low house floated over and over and over until kevin mccarthy finally secured speakership. it took him or anyone five days then in 15 rounds, imagine how long it will take now. this is why i say it's about the math. there are 433 members of the house of representatives and in order to be elected speaker, he must have an outright majority of the entire house for members voting for somebody by name. it's not the most votes that win, you have to have an outright majority of all members voting for someone by name so if all 433 members vote you need to 17. kevin mccarthy was never able to get anywhere close to the and his number was lower because not all members of the house floated

in january so kevin mccarthy is not the speaker now, he's a representative from california. he's able to get more now and get into the speakership is going to be hard to see how that happened. if they coalesce around someone else, the names i've heard, steve sleaze, the majority leader and republican from louisiana, tom republican from minnesota. i heard mchenry's name mentioned to a few people. i also heard mike johnson, republican from louisiana. if you don't have all republicans there and maybe you wind up eventually, this goes on a couple of weeks with a coalition, somebody whose name is not mentioned and nobody can figure out who that person is, you have a coalition of just enough democrats and just enough publicans who come together and that is the speaker. don't think this necessarily get solved in the next five minutes or tonight for the next couple of days. i will give you a couple of

doomsday scenarios and how long speaker's race is connected we have to go way back to the 19th century in 1849, it took two weeks before they elected a representative from georgia as speaker of the house. the record was 133 pallets, this was starting in 1855 and lasted all the way into 1856, two months before they elected nathaniel thanks, republican from massachusetts as speaker of the house so we are not on completely uncharted territory where it takes a long time to elect a speaker but we are where you don't have a speaker of the house, never had a speaker removed in the middle of congress. we've had speakers died, john weiner resigned and in the fall of 2015 but never a speaker ousted and i've compared this to a parliamentary system like you have in europe a no-confidence vote in their prime minister or something and usually what happens is that person resigns

because the math works there and the writing is on the wall and they elect somebody else or the coalition falls and they have just reassemble the coalition. you could have something more akin to a parliamentary vote happening where they develop a coalition to run and govern the speaker of the house. there's something else i did didn't -- i left out that i should have mentioned. they have to fund the government in about five and half weeks so they have to elect a speaker and get over that tobacco and fund the government which they narrowly avoided over the weekend and keep in mind, as part of the reason why we are here, you have republicans, eight republicans proposed kevin mccarthy because they didn't like the fact that he didn't do individual spending bills and work with democrats over the weekend pass a bill with 335 votes, super majority of the house of representatives to fund the government. elizabeth: thank you so much, appreciate it. a jampacked hour. we will stay on breaking news,

>> attorney general james pushed back on claims that 80% of the case should be thrown out because of the statute of limitations. the judge allowed testimony about financial statements from 2011 but instructed the state they must connect those statements to recent alleged crimes. the state first witness continued testimony today, donald bender. he's former president terms old accountant, former president trump did not speak as he left the courtroom after proceedings saying he will be back tomorrow. >> was terrific, from back in from a congressional investigator sam dewey and former white house -- this is the crux of the matter. trump set banks went off on fraud, they didn't find fraud. trump is his legal team that 80% of the case could be tossed out, the judge conceded the statute

of limitations are expired on transactions that closed prior to the date in 2014 but now the judge is saying doesn't knockout evidence, they can still use the evidence from prior to 2014 and use it to go after president trump, what you make of this. >> at times you can use evidence that predates the statute of limitations to prove something like intent or something like that and i take it the judge was saying we will allow it for now but you have to connect it back so i think we'll have to see what happens. connect connect evidence back or is this situation where they can't? the other., that's why this case is so hard to prove even under the attorney general siri because no one was harmed. elizabeth: do you think truck could take it to appeal? this is the judges, the jury on this. chuck is saying the judge made up his mind. do you think trump could appeal

this? >> there will be an appeal regardless and from what i have seen and read, i think some of the judge's conduct does raise questions whether or not it's enough to warrant a reversal or recusal. i don't know yet but i certainly think some of the actions were not well advised. elizabeth: you mentioned the judge, prior conduct you've got sound of the judge in this case in 2015, he basically is saying if juries get it wrong, he can overrule juries on his own based on his quote own emotions about the case. watch this. >> i'm going to say something controversial even though i'm being taped juries get it wrong a lot. that's my own opinion but i've had situations where i'm like oh my heavens psaki. how could they have blocked that? i have a tool i can deal with

cold jury notwithstanding -- judgment notwithstanding. i can say there's no way a reasonable jury would have reached that conclusion. i'm following law, i'm in partial referee but it's hard to factor out my own emotions. elizabeth: let's ring and build mcgurn, did you hear that? i'm an impartial juror, a judge. i talked my own emotions, do you trust this judge in this case? >> i don't because he's not giving me any reason to. he already, he had all these findings. i'm not sure by the way, there's anything that can be done about it because judges have immense power in the courtrooms but i think it's unfortunate the way he is proceeding. i don't think he's building confidence this is a fair

eight republicans voted with democrats to oust speaker mccarthy. what was your reaction? >> it is a stunning turn of events. the speaker's office kind of knew where things were going a few hours before the vote was taken, they were prepared to lose this boat. it was only a few republicans who joined with democrats to do this but there has been discontent in the republican conference. kevin mccarthy have a difficult situation, it's an extremely small majority he's working with. the democrats showed nancy pelosi had small majorities and was able to accomplish much more from their perspective speaker mccarthy was able to during this period of time leaving the situation. for a lot of republican members recognize mccarthy is better than what a lot of speakers and leaders have been but they think the situation in the country is dire, not just in terms of

what's happening with the budget but with the weaponization and department of justice so they are looking for really dramatic pushback. republican's, the only thing they have is the house so they think more should be done there. it is a shame given the republican leader in the senate is mitch mcconnell, he could not be less responsive to the needs of the average republican voter. mccarthy is pretty responsive and that's what seems. elizabeth: we got the mayor of washington d.c. says d.c. more cops. after texas democrat cuellar carjacked outside his apartment building, this is the second member of congress victim of crime this past year. representative democrat angie greg attacked an elevator in her building. hill staffers are attacked. then you've got the mayor of d.c. saying we need more cops. let's watch peter doocy asking the white house press secretary karine jean-pierre about crime in d.c., are they getting a

would brand an economy in your own name when the economy has not recovered. it has not changed that no matter how loud you scream, the economy is better. what you think? >> if you look at total wage growth, wages have declined on his watch. why do you want to put your name on that performance looking forward, the good news is somehow we get through and have a period of slow growth recession. that's the good news. the bad news is a recession. why would you want to own that? have never understood the strategy and it's not showing up in the polls. elizabeth: the irs is putting out news releases and it looks like it's picking up on rhetoric from the democrats. it's important irs should go after tax. it is turning high income filers who had their income and paying their fair share. the irs uses the language of not paying your fair share.
