terrorists are blocking and killing civilians from evacuated. blocking americans from leaving, wanting to use gaza strip civilians as human shields, blocking the border crossing to escape to egypt and e i didn't want not taking them in, jordan not taking in the palestinians and iran is not doing that and neither is saudi arabia. watch gop contender nikki haley here, watch. >> you're going to hear all of those arab countries vilify israel for what's about to happen. you're going to hear them all say how dare you not do more for the palestinian people, but where are the arab countries? where are they? where is qatar, lebanon, jordan, egypt? why aren't they taking the palestinians? because they can't vet them and don't want hamas in their neighborhood. the arab countries aren't doing anything to help the palestinians because they don't trust who is right, good, and evil. they don't want it in their country. so they're going to come and blame america, they're going to come and blame israel, and don't

fall for it. elizabeth: your reaction, sir? >> i'd be hard pressed to improve about anything nikki haley says on this topic or many gop political topics and some issues that require nuance and complicated and some are not and this is not. i agree with her 100% this. is the challenge particularly for the united states of america who should be in the leadership role of negotiating these things. you need to hold people accountable and that's one of the problems we're having is that we have a weak president whose weakness invited some of this activity. granted he's saying some of the right things now, but he needs to get allies together and hold every nation accountable and start negotiating some sort of a humanitarian way out for some of the palestinian folks that should feel more comfortable going into egypt rather than coming into into israel for example. these are not complicated. elizabeth: moving onto this

this is somebody who knows -- evidently caught or suspected of mishandling classified documents and three assistants, three aids with close ties to all this mess. this is really, really bad. what's striking me as what were the conditions of which he was hired by the obama administration and clinton administration. how does he get to this point without better scrutiny and right now it's congress has to step in. and be part of this scrutiny if you will, not just an inside deal. elizabeth: it's not the first time the obama campaign. obama campaign in 2008 kicked out malley and the biden white hired him. did they purposely funnel billions through iran for lack of sanctions and enforcement and sanctions relief? it's something like $80 billion iran has gotten over the last 2.5 years under the white house. >> these are all the questions that you have to wonder about, you have to ask, obviously and
5:52 pm
your imagination can run pretty wild but you're right about the $80 billion. a lot of that, liz, came, maybe most or maybe all. it's an administration that hates american oil production so much that they've actually sought oil from our enemies. they've unleashed venezuela for crying out loud. they've relieved sanctions on iran, allowing them to sell around the world and then they sort of look the other way if you will when it comes to things like china buying a lot of this oil from iran sort of under the table shipping with the ghost armada ships that are flying other country's flags even though it's not that country's. we need to clamp down on all this and this requires major leadership from our president to amass the g7 nations and other allies and know your friends and who your adversaries are and get the collective economic might of g7 and other allies so we're not just going this alone and the

elizabeth: well, look who's back with us, form ere congressional investigator sam dewey, great to see you again, sam. do you think former president trump could win this on appeal. we've got today, u.s. district judge tonya chutkin officially placing a partial gag order on him saying it can criticize special council jack smith, prosecutors and court staffers involved in the 2020 case. he can call jack smith things like a thug or deranged and the judge did not like that. what do you make of this? >> so i think first of all there'll be an appeal and second i think that the part of the gag order that is most concerning, and i should emphasize that we haven't seen the final written order, and the words are going to be very important, her specific wording and the final written order, but going off what was said today, i think the concerning part is the inability to criticize the special council because the special council is
5:58 pm
exercising a lot of powers that the department of justice and there is arguably a political angle there. it relates to the attorney general, to the administration, it's on, i hit shakiest grounds there. elizabeth: so, legal experts say this may not survive on appeal. it's a first, fifth, and sixth amendment that, those rights belong to the defendant, not to the prosecutors. a gag order that stops the defendant from criticizing the government of public figure, it's less likely to survive in the appellant scrutiny and gag orders are heavily disfavored under first amendment law. >> right and the purpose of the gag order would be obstructing cerumen stensively to prevent the jury pool from becoming tainted or in some extreme instances prevent threats, harassment, of court personnel and this one i think clearly
5:59 pm
goes beyond it when you get to special council and get to we'll see whether or not the judge can be criticized, both of those grounds are concerning under that and you're right. it's also, you know, a bit odd to say that there's a concern about tainting the jury pool in this case. we've heard it before and everybody know this is is a political case. there's a concern and improperly intimidating challenging jack smith or the judge for being biased publicly doesn't carry water to me. i think there's a good chance he'll win on appeal again with a caveat that we need to see the specific language in the final order. >> i mean, former virginia governor bob mcdonnell. he said jack smith overcharged him and really went after him in that case tossed out and finally october of last year, judge cutkins slammed trump during a sentencing for january 6
6:00 pm
defendants saying "it's behind loyalty to one person who remains free to this day. but he can't talk outside of court. final word. >> no, that's the extremely concerning part to say the judge is biased or to say that jack smith is acting politically not just, not in relation of trial frankly and relation to other reasons trump is going to be speaking and that's fairly concerning and where the appellant court has issues. sam dewey, thank you so much. tune in tomorrow for congressman russel fry and tudor dixon podcast host, tudor dixon and charles payne joining us. thanks for watching "the evening edit". i'm liz mcdonald. time for the bottom line. jackie deangeles filling in for dagen and sean duffy comin
