along because you cannot trust hamas, and they are going to take advantage of every opportunity they have. can and i think that this is an opportunity for them to refurbish, to rearm, to redo everything that would put them in a better setting when they the resume. elizabeth: colonel, so what the general just said, israel's netanyahu has said no ceasefire until all hostages are released. what do you think, colonel? >> i agree with the general. hamas is a terror organization that's going to do the whatever necessary to kill as many israelis as possible. if you stop the hostilities now, all they're going to do is probably use or move if those hostages elsewhere so they can use them as a shield. the reality is that these people use proxies all over the world, the iranians, that is. whether it's hamas, hezbollah or even black lives matter in this country and some pretty radical

professors that push a social justice theory down our throats and protest in front of the white house. so we have to understand what we're dealing with here. these people have a very cheer can agenda, and it's not only the destruction of israel, but they would love to troy the great satan -- destroy the great satan which they call the united states with. elizabeth: yeah. so what the colonel just said, general. so why are we sending tens of millions in tax dollars, by the way, to gaza, to palestine? why did the obama white house send nearly $1.8 billion over to iran? because now you've got hamas leaders doing the osama bin laden model, living a lavish lifestyle abroad while gazans suffer in poverty, directing others to do their dirty work and to slaughter. there's evidence billionaire hamas leaders live abroad in luxury. what do you think, general? >> if you go back and look at yasser arafat, yasser arafat had somewhere between $2-5 billion

is kind of the key to the whole situation. he's the guy that was running the business. he's the guy that claims he was funding his dad's life, and he was the guy that was recruiting business people. he was the guy that was introducing joe biden to potential clients. he was the guy that facilitated all of this business. rob walker was right there with him as his business parter in, and they were working -- partner, and joe biden was the brand that they were selling, access the president biden. obviously, before he was president, when he was vice president. then you have james biden who's out there, and he's in this thing up to the his neck as well. he was working on different projects, but also he -- we have the two recent checks that have come to light saying he was repaying joe biden several hundred thousand dollars. what for? is this principal there? was there a promissory or note? what were the terms of this alleged loan in and i think we're going to get answers, i hope we get answers to the all

those questions. elizabeth: rob walker has made dozens, at at one point i think more than 80 visits to the biden vice presidential offices and met with the president, vice president. and, you know, handled his finances, apparently. that's according to reports. you know, this is coming -- and so the reports are that you guys have bank records showing the biden family made at least $24 million off of multiple deals overseas including with u.s. adversaries. but, you know, hunter biden's lawyer, abby with lowell, had written a letter the speaker mike johnson demanding he call off these subpoenas against the biden family, you know? saying there's disregard for the truth. what do you make of that? because it lookses like, you know, it's full speed ahead for house oversight. you guys are not listening to the abby lowell at all. >> that's right. this is not surprising, and we anticipate that they're going to try to fight these subpoenas. but we expect hem to ultimately answer the subpoenas. we're prepared to go court, we're prepared to hold them in

contempt if they don't come in. the reality is they have pert pertinent information to this investigation. we've seen literally tens of house of pages of bank records. we've seen additional hundreds of pages of suspicious activity reports. they all indicate their participation this in this scheme. and it looks almost like a money laundering scheme, and it looks like they were selling access and that there was bribery and corruption involved. so they need to be here. we need to be able to have access to them. we've seen their records, we need them now to come forward ask let us ask questions about these -- elizabeth: so abby lowell, the lawyer, is saying hunter biden is eager, you know, to give his perspective on what happened. don't know when he'll do that. there's also this, why did house oversight request transskype ised -- transcribed interviews from james biden's wife sarah, hallie biden, hally biden's older sister and moneyer biden's

meant to cause a stir, meant to cause hatred against israel and meant to cause violence. elizabeth: you know, university of iowa student jasmine jordan testified at this hearing on what it's like to be a key on college campuses -- a conservative on college campuses. >> i was doxxed in a group chat9 of over 800 students and chat9 of over 800 students and was falsely labeled as a nazi, a token, a white supremacist and a bigot. some individuals even expressed that i made them uncomfortable and feared that i might commit a hate crime against them since i am black and hold conservative principles. these students believe that if you are conservative, you are hateful, support oppression and only want to benefit straight white men even though such beliefs are untrue. elizabeth: your reaction to that. by the way, we have a new story out of "forbes." half of high school seniors, 53%, won't apply to colleges costing more than $40,000 a year old. when they see stuff like that

going on, do you blame them? >> no. and the reaction to that story is the fact that you've got people who haven't done anything, but because they're conservative, they're already being shut down. but then you've got other groups on campus right now that are being encouraged by professors to the actually justify terrorism, justify babies getting their heads cut off, babies being put many ovens, women being gang raped and civilians being used -- this is what you're seeing on college campuses all across the country. elizabeth: the issue is who's funding -- >> yes. elizabeth: we've got reports that colleges are taking undisclosed donations -- >> yeah, they're taking about $30 billion from arab nations and 8. 5 billion they don't even know where it's going. elizabeth: 200 colleges took in $13 billion in one study -- >> and cornell was the number one. yeah, no, this information definitely needs to be disclosed. and i was really proud of one of the members of our republican conference because she passed

elizabeth: okay, ivanka trump testified today in the new york civil fraud case against her father after new york's attorney general subpoenaed ivanka trump as a fact witness. fox news' nate foy live outside the supreme court with the story. nate, good to see you. >> reporter: ivanka trump remained poised and corrected os stand today, she answered questions both from lawyers with the new york attorney general's office as well as lawyers for her father, former president donald trump. while leaving the courthouse tonight, ivanka did not speak to reporters, just like she didn't speak on her way into the courthouse this morning. and as you mentioned, a state court denied her request to the avoid testifying in the trial. do during her direct examination, ivanka testified she never prepared any

case. trump's attorney, alina habba, says they will move for a mistrail tomorrow. >> it is very clear that they have failed to prove the essential elements of the case. >> reporter: so the state rested its case, liz. so that means if a mistrial is not do declared, former president donald trump's lawyers will call their own witnesses to the stand to present his defense starting on monday. we'll send it back to you with. elizabeth: wow, what a story the. nate foy, thank you so much. joining us now, former u.s. assistant district attorney andrew mccarthy. you've been critical of this from the start, thousand trump's team is potentially demanding a mistrial. from where you sit, andrew, you're an expert here. when you look closely at it, should this case scare everyone, and why do you think that? >> well, liz, this is more about your side of the street than mine, but i think that if you set up a government climate for

business where they can put you out of business under circumstances where even though they're alleging fraud there are no victims of fraud and we have a situation where they not only can put you out of business, but under this idea of disgorgement, take back $250 million in profits. again, in a case where there's no victims and where the banks and insurance companies that did business with the trump organization were sophisticated financial actors who knew exactly what a they were getting into and made money on the transactions. if that's the kind of behavior that puts you out of business in new york, who the help wants to do business in -- who the hell wants to do business in new york? elizabeth: so they can take away an entire business empire, no due process, no jury, in need to prove intent to defraud or anyone was defrauded.

the state doesn't have to establish any creditor or bank relied on any of the misrepresentations the allegations there were misled e? i mean, the manhattan d.a.'s office looked at this same case and declined to move forward with it. >> yeah. liz, that's right. this case started out way back when actually in my if old office, the federal prosecutor's in the southern district of missouri who had the michael cohen -- of new york, who had the michael cohen case. they were ones who initially looked at this and decided not to go forward with a criminal case. then the manhattan district attorney's office moved heaven and either to the point of going up to the supreme court not once, but twice to get trump's financial records. and when they finally obtained them, it turned out that it wasn't the motor lode -- motor lode that they were expecting. but, the ish james, who is the state the attorney general who brought this case, liz,she has access to in the civil context

this monstrous statute that you just described where they can accuse you of a persistent pattern of fraud notwithstanding that there are no fraud victims, and they don't have to prove intent to desteve. elizabeth: that's -- deceive. that's really something. i mean, we get it. we've been following and reading as much as we can about the case. i mean, prosecutors are asking why the value of trump's ab aberdeen property, for example, increased by the i think the report sate 245 million but in 2014-20 the a 15 when it appears little was done to the property, but it's how the case is being carried out that you're pointing out, andrew. the judge already pronounced trump guilty. the court's how in the penalty phase, again, no jury. they're going to ask for a mistrial. trump is saying i should have a jury on that. >> well, they brought it under a provision -- i actually think they should apply harder to try to to get a jury.

i think hay might have gotten one if they had tried harder. that's my view of it. it's not really just the penalty phase. what the judge did here, there's seven claims, civil claims. he decided one of them, but it's the most important, prior to trial. and the other six are still being tried. that's supposedly what the trial is about. but really you're quite right that what he's done is he made the essential proud if finding against trump -- fraud the finding against trump even before the rile started, and this exercise is just about how much he's going to let tish james run up the score, how much of the 250 million does she get to disgorge. i think trump recognizes that if he's going to get any relief here, it's going to be in the appeals process, not with this judge. elizabeth: okay. andy the mccarthy, good to see you. >> thanks, liz. elizabeth: former arkansas governor mike huckabee coming up on why president biden can't take a victory lap over yesterday's democrat victories in state elections. he's not off the hook. what's really at a stake here.

policy. it's really different from that. first of all, in kentucky you had a hotly-contested republican primary. cameron was a great republican candidate, but he had to spend all his money getting through the primary. on the other hand, beshear had a clean fight all the way to the general, and that makes a difference. incumbents are hard to beat in the middle of their term, they're just hard to beat. so you could look at that one. here's an interesting thing in virginia. don't hi that that was a big disaster -- think that that was a big disaster because every single seat that joe biden won by up to the 99 points went -- 9 points went to republicans. now think about that. that that's a big deal. so, yeah, virginia didn't completely flip, but most of us, quite frankly, didn't expect it to. you've got so many federal employees that have moved into virginia, those folks are going to vote liberal and democrat. but the fact that every seat went republican, even ones that biden won by up to 9 points, that, quite frankly, is a big deal. elizabeth: you know, we have
