elizabeth: okay. we've got breaking news, breaking news coming into the studio. hunter biden today again tried to raise that already discredited narrative that probes into biden family corruption are a russian disinformation campaign. let's bring in former deputy assistant attorney general tom dupree and former congressional investigator sam dewey. let's get your reaction to this, this is news coming in to the studio. hunter biden saying today after the justice department hit him with nine federal criminal tax evasion chargings. listen to this. >> this may not in every aspect if be a russian disinformation campaign, but it has literally every earmark -- [laughter] of what the russians did. >> yeah. >> there's, what's it call called, it's called reeliminationist e -- eliminationist rhetoric, something that the nazis came up with as a tool to undermine their political rivals. they are i trying to, in their

most illegitimate way but rational way, they're trying to destroy a presidency. and so it's not about me. and their most base way, what they're trying to do is they're trying to kill me knowing that it will be a pain greater than my father could be able to handle. elizabeth: tom, so he's -- this is off the wall. he's a criminal defendant now speaking openly about, again, this discredited narrative about russian disinformation. i've covered the irs for years. i've testified twice to congress about the urs. it took them five years -- the irs. it took them five years to file these charges against hunter bide when other americans would have been hit immediately in and now he's raising russian disinformation? why now? what -- tom, take on the timing of this. is he going to plead the fifth and not testify about bribery

allegations against him and his father about biden family corruption? >> well, the whole thing is off the wall, liz. i mean, it makes absolutely no sense. i guess the first thing i would point out is that this indictment that he says is somehow russian disinformation, i mean, this is from his father's department of justice. this is from officials appointed by his father who are serving in his father's administration. [laughter] the second thing i would say is that anyone when reads this indictment sees it is a very serious document with an unbelievably detailed factual summary of exactly what hunter biden was doing, all the money he got in, all the taxes he failed to pay. and, of course, the way he was spending his money. he was paying adult entertainers, he was paying exotic dancers. basically, he was paying everyone except for the irs. elizabeth: yeah. if a regular american, sam, did this five years ago, they could be in prison. there's talk out there, i mean, he faces 17 years. he could get busted down, you know, basically the charges are stacked, maybe 1-2 years.

let's recap. a grand jury out of california, hunter biden -- he's living there. that grand jury indicted him on a 4-year scheme of evading, paying $1.4 million in federal taxes owed, filed false tax returns in 2018. again, he spent hundreds of thousands of a dollars on drugs, strippers, luxury cars rather than paying his tax bills. this is all russian disinformation, everything about bribery allegations, russian disinformation against him, sam? >> no. all of this is from his own records. his own records and the records of his business. this is about as far from that as a you can get. and something else he said is very interesting. he said this will hurt my father. look at the timing of this. look how long it took to bring this case. why was it repeatedly delayed when david weiss didn't have the authority that merrick garland swore he had? well, a pretty good answer is this probably isn't going to get to a jury before the election. what does that mean? president biden doesn't have to

pardon hunter until after the election. not before. elizabeth: if he's reelected, right? >> correct. elizabeth: tom, that means the house impeachment inquiry, they're going to have to dig more to make these connections -- by the way, hunter's money came out of alleged influence peddling of selling the biden family brand overseas. and, tom, the oh irony of it all, president biden's got a crack dunn on tax cheats, and now the justice department says his son is one. [laughter] >> the ironies abound here, liz. the interesting thing today is that hunter biden's lawyers came back and said look, you know, if his name were anything other than biden, this wouldn't be happening. what i would say is if his name was something other than biden, these charges would have been brought years ago. what we learned from the whistleblowers that congress has done a terrific job bringing forward, what we learned from them is that this was slow-walked. and i think that today's indictment or or yesterday's indictment is in large part owing to the fact that those

whistleblowers were willing to keep the media a spotlight on this, they were willing to come forward and report what they had seen and heard and really put the pressure on the justice department to the ultimately bring this indictment. elizabeth: sam, we've never seen a member of a president's family indicted like this. hunter biden was already indicted on federal gun charges in september. i mean, hunt or 's lawyer, abby lowell, has been sending threatening letters to congress demanding the doj stand talk about an owl -- on all of this. he tried to claim his daughter's law school tuition us with -- he tried to hide income. he made numerous false statements on his tax returns. >> yeah. i think there's a slight of hand here. the reason you would get charged as an average american is lying on the taxes. that's the key factor, did you lie, did you we said the taxes. i evade the taxes. other stuff, yeah, no one does get charged for it. but as you said, there is a

laundry list of facially absurd claimed deductions that come from his own records. these are his own receipts for over $27,000 in online porn that he claimed as a business expense. that's not russian disinformation. it's his own records. elizabeth: you know, the other thing too, tom, listen, the american people are a giving people. they -- governor giving people. they don't want to see family loss, they don't want to see that. they understand the pain of that. but the biden family has been accused of basically manipulating public sympathy for them in a very cynical way to avoid any accountability whatsoever, tom. and this russian disinformation thing that hunter biden again is bringing up alleging that he's going to be, you know, this is going to kill him, i mean, this is, again, trying to enginedder sympathy within the public, tom. >> well, look, the fact is a lot of americans are struggling with addiction, but not all those americans go and commit tax crimes.

i think that hunter biden was very fortunate that he had this strong support network of people who were giving him a lot of money, who were there to help him and, nonetheless, he went ahead and at least allegedly committed all these federal crimes. so i think the fact that they're trying to say, well, he was addicted and all these things, that doesn't excuse what he did. elizabeth: sam dewey, final word. >> that's absolutely right. and there's also a broader implication here, are the other charges going to be brought? what can the tax treatment of joe biden's loans? this goes back to the biden family who arguably used hunter. and let's remember, this wasn't just drug abuse, this was a lot of money. of there's a lot of other uncharged stuff. look at his treatment of women. it is appalling. elizabeth: yeah. where ooh's the me too movement on that? if also where are the foreign lobbying violations? tom dupree, or sam dewey, thank you so much for joining us. and now this, remember how president biden repeatedly denied house lawmakers' allegations about the biden family making $24 million

selling access and the biden family brand overseas? the president repeateddedly denying interacting with hunter biden and his business partners. watch this. >> i did not know he was on the board of that company. i've never discussed my business or their business, my son's or daughter's. i never discussed a single thing with my son about anything having to do with ukraine. i've never spoken with my son about his overseas business dealings. i've never discussed with my son, brother or anything else anything having to do with their wizs, period. -- businesses, period. elizabeth: joining us now, former u.s. congressman jason chafe -- chaffetz. is this going to be one of the key impeachment charges out of the house against the president? house law makers accuse president biden of lying over and over and over again to the american people when white house visit or logs, e-mails, text messages show dozens of communications between vice president biden and hunter biden? and his business partners?

>> look, lying to -- as a politician, lying, you're not going to get indicted or impeached for lying even though repeatedly joe biden lied about that. what he could get impeached on is inappropriately taking income. this whole case with hunter biden and all the saishes salacious -- salacious details is important. remember, the dem democrats are the ones that preached to the world that nobody's above the law, and it's an important case. but then very quickly it's going to swing to where did all this money come from? and if you remember, the democrats went after donald trump because he was going to take money from and be suggests to china and russia and ukraine with. and guess what? the allegations are such that joe biden and the biden family is taking by the millions of dollars money from our adversaries. is he compromised? did he inappropriately take that money? if did he break the law with a misdemeanor, or did he commit treason? those are the things that will drive an impeachment case.

and this is a growing list of evidence. don't -- even joe biden this week said that a there was no evidence and that it was all a lie. but that's not what the records show. elizabeth: yeah. i mean, there's dozens of examples of the former vice president speaking or meeting with hunter e biden's foreign business associates. this break breaking news coming in, senator ron johnson reported by told just the news that u.s. banks filed at least six suspicious activity reports about the biden family business deals with the u.s. treasury, that those bank filings cited the biden family's wilmington, delaware, property. and basically, let me just read it to you. so banks reportedly were red flagging to the u.s. treasury about millions of dollars of family business deals overseas that passed through biden's wilmington, delaware, home. the senator reportedly said, yeah, they might be double counting here. but these are, again, more banks' suspicious activity reports citing the president's

wilmington, delaware, home for, that u.s. banks were red flagging that, that possibly $12 the million was sluicing through using the biden family home address here. what do you think? >> those are the types of things that drive an impeachment inquiry and why the house is going to vote on it next week. you have 175 suspicious if activity the reports which is treasury doing its job saying this looks inappropriate. this money flowing overseas might be used in some sort of money laundering scheme. and when you look at a the 20 plus llcs that the bidens had set up, and some of those payments now are going directly from china to the llc, to joe biden. and yet the democrats sit there and say there's no evidence. and now we find out senator johnson, senator grassley do amazing work, that that money is flowing through the wilmington, delaware, residence? come on, folks. this demands an inquiry. elizabeth: yeah. this demands further investigation, and the banks were reportedly concerned about

possible criminal activity involving money laundering, human trafficking. and there's also this, the national archives, reports are coming in this news, it's coming in that the national archives reportedly will release 62,000 pages of biden vice presidential records to the house impeachment probe. let me look at this news coming in. including that the president at that time under the obama white house used fake alias e-mail accounts. so is the house impeachment inquiry going to move forward looking into the fake e-mail accounts? also they're going to possibly get more details about biden bribery allegations. what do you think? >> yeah. we know that there are actually around kentuckys has more than 80,000 -- archives has more than 80,000 of these documents. of 62,000 is a good start, but why not the additional 20 plus thousand they have in their possession? we also know that joe biden directly, directly mailed eric. >> wane, the business partner of

199,000 there. september and october were reviced down by 35,000 job jobs. revised down. edward lawrence has more. >> reporter: the administration highlighting the better than expected jobs report. but when you take out the striking workers e that went back into the work force, this is in line with a weaker job market. still, americans are feeling that economic pain as the white house still pushing the brand of bidenomics. >> he had signs just behind mihm just last week, i was there, i'm sure you saw them, that said bidenomics. and you've heard me as you just stated and many oh white house officials talk about how bidenomics is, indeed, lowering costs -- >> what's the text connect between what people -- disconnect between what people are feeling and what the from the president's saying? >> let me be clear, we've actually seen a decrease in eggs, in bacon, in milk since last year. so we are seeing lowering costs. >> reporter: but inflation is

up 17.7% since the market took office -- >> inflation, inflation fell to 3%. that mattered. >> reporter: the president touting the unemployment rate at 3.7%. still, no one person in this administration could nail down all of what bidenomics actually stands for. >> reporter: the president hasn't mentioned bidenomics by name since november 1st. are you guys standing behind that term, bidenomics? >> well, we're certainly standing behind record job growth, record low levels of unemployment but also what bidenomics really is about is investing in america. >> reporter: and she's talking about government spending which government was the second leading hiring sector in this last jobs report. back to you, liz. elizabeth: no one does it better than edward lawrence. joining us now, fox news contributor liz pique peek. -- liz peek. liz, it's good to see you. great writer. digging into these jobs numbers, liz, did you see this report that government jobs hit a near record high of nearly 23 million government jobs out there? what do you think of that?

>> well, that's been going on all year, liz. what is bidenomics? bidenomics is big government and big spending. we've seen no relief at all in continued spending which is driving up our deficit and initially kicked off inflation. so i wasn't very impressed by this jobs report. if you take out the fact that strikes, the uaw went back to work, hollywood went back to work, that was 47,000 jobs. you had a revision of 35,000 downward prior month. government up 49, i mean, really the private sector didn't see much growth. and the most start thing part of it is that retail actually had layoffs. this is going9 into the biggest time of year for retailers, a holiday season. i actually can't really kind of make heads or tails -- elizabeth: wait a second. stay on that because usually, it's an important point you just made, because usually you see an uptick in jobs numbers because the retailers hire more people to sell christmas and holiday

presents. but you're seeing that going down, and now it's being patiented over possibly by a rise -- papered over possibly by a rise in government job hiring, right? is that what's going on? >> absolutely. another sector that didn't grow is manufacturing. again, take the out the uaw chains going back to work, and manufacturing hasn't seen much job growth at all. going back to retail, liz, consumer borrowing in october is now up about 9% year-over-year. sorry, that's a november number. 9. consumer spending and retail in october, which is the latest month we have, was only up .2%. so it's all about the consumer now. that's what's been driving our economy. the question is, are consumers now laden with debt to the point where they're really going to sort of roll over in the fist quarter? that's what i think's going to happen. elizabeth: interesting. you know, liz, the other thing too is "the washington post" workers and reporters, the

workers are going on strike, right? the workers want higher wages. liz, they're saying they want higher wages because of record inflation. that's what the washington post is saying. and now biden is turning to hollywood celebrities for campaign donations. the president's going to be in los angeles from friday to sunday, liz. again, what we're seeing out of california, they have a massive hole blown open of $68 billion in the red, in deficit, right? >> yeah. elizabeth if now the california legislative analyst's office says, they're a blaming that on flakes. on inflation. [laughter] >> so it's going to be a little bit of a tough sell for joe biden and bidenomics, i think, out in hollywood. look, liz, workers all across the country want big raises. and weaver seen with the uaw settlement, with the pilots' union settlements and many others, health care workers recently, big numbers coming through. this jobs report said that wages

are only up 4%. i don't know anyone who's happy with a 4% raise right now. i think if you talk to most private employers, they're having to give people wage increases higher than that because the cost of living is up so much. you get in that sort of terrible wage price spiral -- let's elizabeth yeah. and you know what's really making people upset? in blue cities like new york and chicago, los angeles, taxpayers are saying, wait a second, you know? it's the border. democrats and republicans, they're trying to hammer out border policy, right? republicans not signing off on that ukraine aid and israel money unless there's tighter border security. when you see -- by the way, senator steve daines says president biden is siphoning veterans affairs' health care resources away from the if nation's military veterans to serve illegal aliens at the southern board or. watch the white house press secretary. you know, she's basically trying to say, okay, where are the republicans on immigration

reform. biden did nearly 300 executive actions through january last year, liz, to take away trump's border policies, and the border has collapsed. more than 9 million illegal immigrants crossing. watch the press secretary here. >> you know, republicans talk about immigration reform, they talk about border security. the president, you know, on day one the president put forth an immigration policy, right? the system is broken. we want to find real solutions. elizabeth: on day one he a started, it's been 297 at least executive actions, a majority weakening the border, liz. final word. >> he dismantled trump's very successful policies, liz. end of discussion. they want nothing to do with securing our border. it's appalling to me. elizabeth: liz peek, have a good weekend. merry christmas to you, it's good to see you. >> thanks, liz. liz: we've got league eagle gene

on. yes, i think it does go to the supreme court. eventually, these are major questions, major legal issues that have to get resolved. everyone at home needs to keep in mind this is an unprecedented situation. we have never, ever had a presidential candidate subject to a gag order before. what we have today was at least some act knowledge ifment -- acknowledgment from the if appeals court, from three liberal judgements, that the overbroad order that the judge in the district court in d.c. issued was overbroad. it was, in fact, overbroad. now, it's been narrowed in, but its existence is still far too egregious. it is still far too much. it limits what donald trump can say or do. and so it has to be review ared, it has to be or true tailed. elizabeth: got it. now, these reports coming in that georgia fulton county d.a. a fani willis e-mailed in november, ahead of time, that she wants to jail trump, she

wants to jail his former chief of staff, mark meadows, she reportededly wants to jail ruthty giuliani. this is according to "the guardian" citing two anonymous sources who saw, they say, the e-mails. the e-mails on november 29th, quote, we have a long road ahead, long after these folks are in jail we will still be practicing law. you know, reports coming in, jeep, that defense lawyers -- gene, that defense lawyers are really upset that the d.a.'s office was throwing around a prison threat in such a cavalier manner. >> and they should be, because the cell phone i -- the job of a prosecutor is to do justice. the job of a prosecutor is not to throw someone in jail at all costs, at all expenses. and what fani willis appears to be interested in is promotion of her own career, of her own success. that is an improper motive for a prosecutor. and if you read that same reporting, it appears as though fani willis is taking issue with

some of the defense counsel not referring to her as, quote-unquote, district attorney. so this is someone when's on a power trip. this is someone when's not interested in justice. she is out for a scalp. it's wrong. no american should be subjected to that by any prosecutor. elizabeth: can the former president on any grounds whatsoever use this as grounds to, you know, get the case tossed? >> well, i certainly hope so at some point in time. it might be a painful process, but eventually this level of evidence, this level of evidence of irregularities in the positive and misstatements by the prosecutor is going to mean something sometime. it's just a matter of when. elizabeth: and by the way, house judiciary chair jim jordan is probing and sent a letter to fulton county d.a. fani willis asking why she reached out to the january 6th committee and why she reached out to chair

bennie thompson for information and records for her case. he, jordan is saying that's improper. couldny willis say, well, this is just part of my investigation? >> well, she can certainly say that, but it's whether the viewer at home or whether the juror at home believes it. and the fact of the matter is that what she is doing and what all of these other prosecutions are doing is they're on a political witch hunt. that's all it is. elizabeth: got it. gene hamilton, thanks for coming in. it's good to see you. >> you too. elizabeth: coming up, we've got university of pennsylvania student the eyal, he is fired up and ready to go. he already spoke out on capitol hill against anti-semitism on college campuses. we've got breaking news coming in. this news is big. now the trump -- for the university of pennsylvania reportedly will meet on sunday on whether to fire school president liz magill after her disastrous testimony downplaying

the news coming in that the trustees for your alma mater, u-penn, they're going to meet this sunday on when to fire the school president, liz magill? >> i think the biggest thing i want the make clear is that whether or not it results in president magill's resignation or her being forced to leave by the board of trustees, that the work has only been started. that is only the first step. we still have professors that i just want to quote the professor in the political science department in the past 24 hours tweeted: blame the victim is what jews are best at. the are re restriction of anti-semitism to jews is a political effect and should be resisted. if president magill does resign or is removed, it should foreshadow and be a signal to professors and students who want to amplify hate that their hate is not going unnoticed, it is going noticed -- elizabeth: eyal, that professor also should be fired. that professor should be fired today. that is unacceptable.

more work to be done because at the end of the day, her inaction is allowing hate to fester, but she's not the source of the hate directly. there are professors and students who have actively been creating a hostile environment. i just want to say one more thing, is that two months ago i asked penn whether or not they allow for pro-terroristal rallies on campus. i center over 12 follow-up e-mails -- i sent over 12 follow-up e-mails, i still have no idea. it speaks to the idea of an unsafe environment. about a month ago a, there was a bomb threat made early in the morning, i was eating there for two hours unknowing there was a bomb threat. the school didn't make the community aware until eight hours the bomb threat was made. i was eating with bomb-sniffing dogs in the building. if we're talking about creating a safe environment and magill sticks to her word, men why wasn't the school community made

aware that there was a bomb threat against a building? elizabeth: how did you find out about the bomb threat? >> because there was a e-mail sent out at 3:30 p.m. i believe the threats were made at 6:30 a.m., and there was an e-mail at 3:30 p.m. telling the community that there were threats made against the l -- hilel and the louder college house, and we were not made aware. and there were bomb-sniffing dogs in the building, and when i asked a cop why there were dogs sniffing in the building, they sid -- said there might be a bomb in the bidding. elizabeth: nobody in the media heard about this. nobody heard about this at all. but you were -- i mean, okay. so what did other students say about this when they heard? >> a lot of students don't know. that's the issue, that no one's disseminating information. and at a certain point and especially after a hearing the testimony yesterday with, especially after hearing the former chair of the political

congressman. so now the president, he's in hollywood talking at a fundraisers for his campaign. but your state of california now faces an eye-popping deficit of nearly $70 billion. how did california burn through $100 billion in just two years? >> well, because creative accounting. they simply loaded forward all of the monies including capital gains they enjoyed knowing this deficit was coming. it's the oldest trick, unfortunately. gavin newsom knew that he was going to have a large deficit as he was giving away money last year, sort of winning favorites. and now, of course, he'll be pushing for a tax increase because he spent that munch -- that money. elizabeth: what you're saying, nearly 8ing 20,000 taxpayers left california in the last two years, and then tax revenues dropped. so they just blew through 100 billion surplus over the last two years. i mean, that's astonishing.

that's a lot of people leaving. >> it's well deserved because people who are earners and net employers are leaving the state while we're welcoming undocumented and low skilled individuals into the state. on a net basis, we're losing hundreds of house of people, but you have to dig into it to find out who we're losing and who we're getting and find out it's worse than it appears. ble elizabeth so is gavin newsome being up front about all this? do tax pawiers in -- taxpayers in california understand really what's going on? >> of course not. as a matter of fact, inflation is good for them. they've enjoyed record increases in property revenues, and we -- with 3.3 -- 13.3% state income tax, heavy got record revenues there. they don't have capital gains from high net worth individuals who invest and then have to pay those gains because more and more they're leaving. and they should leave. staying in california doesn't make economic sense, and you

should vote with your car or your truck and your home just as a much as you do with your ballot. elizabeth: and you're the congressman for the state. wow, and you're saying that. congressman, what worries you the most about all of this? >> what worries me the most is that gavin seems to be comfortable with hurting the state and ignoring the reality that we're the place people want to go to. but when they can pay little or nothing in the way of state the taxes in other states and they're paying 13.3% in california, they're basically being told to leave. on top of that, if you're in san francisco, incredible high cost of living, and you're walking through poop and needles trying to get to work. these are reasons to relocate your businesses and your high-paid employees to places where they enjoy a better quality of life and more net revenue that they can spend on their families. elizabeth: interesting. congressman issa is, thank you so much for joining us and merry christmas to you. >> thank you.
