lot of people off today. but some of us are here, we've got lots to talk a.c. it's 11:0n this monday, february 19th. yes, i'm ashley webster in for stu today. the markets are closed for president's day, but check out the futures. we were in the positive. dow is essentially flat and the s&p and nasdaq slightly higher. let's take a look at price of oil that was moving slightly higher as well. earlier in the session if you like earlier in the day, up 52-cents and verging on $80 a barrel at $79.71. how about the price of gold? used to be the safe haven for inflation. maybe not as much these days all though it could be. gold up $1.70 at $2,025 per troy ounce. how about bitcoin, which last week went above 53,000. it was up slightly earlier and it is up slightly $16 at $52,121 per bitcoin.

the president appears to confuse nato with ukraine appearing to urge congress to pass the funding bill. take a look. >> the idea that we'll walk away from ukraine, the idea that letting nato to split is totally against the interest of the united states of america and against our word we've given since all the way back to eisenhower. it's about time we push congress to pass legislation, funding nato. it's critical. our security depends on it. ashley: it's confusion and mumbling a bit. charlie hurt joining me. the president spent his entire weekend at home in delaware and still getting confused and comes back to the white house and nothing on the schedule. shouldn't that be raising, you know, continued questions about his mental fitness and physical fitness for that matter? >> oh, yeah. i think it re real is.

obviously if i take a weekend at the beach, i would hope to come back with a clear head, but that does not seem to be the case with this guy. we are seeing it raise alarms among democrats who are starting to seriously worry about his cognitive ables because it's not going to get any better and it's as bad as it is now and and talking about it there and it's a remind their he really -- he is not thinking clearly these days and there's no reason to believe it's going to get any better as we go forward. ashley: it's no wonder they try to protect him. house republicans of course are pushing for biden to take a cognitive test, should he? >> the whole thing about a cognitive test, it's a great political issue and i think he should and i love it had when donald trump took a cog mitive test mainly because it was hilarious and the whole idea

that we're going to come up with new tests for presidents or politicians, i get a little squeamish about that because the only test that matters is a free and fair election. if we have free and fair elections, we can pick our leaders just fine. ashley: you mentioned earlier that even democrattings now are starletting to raise doubts about biden and his ability to even fulfill a second term if it comes to that. at first they said he's perfectly fine and lucid and dynamic. now they say, well, you know, it's just republicans trying to use it as a crush. now they're relying on strategies apparently of trump getting into legal problems that will eventually prevent him from beating biden. i mean the expectations have gone down considerably. donors are wondering, democrat donors wondering where the heck is my money going? there's a change of, i guess,

sentiment among democrats and feel it almost daily. >> yeah, without a doubt. it kind of comes and goes in waves but it's definitely going in a certain direction. we're going to have more really bad episodes like we had with that press conference where he, you know, came out to declare he was mentally fit to stand trial for his document's case and then manages to put mexico in the middle east, which was very strange. but they're going to -- those episodes are getting more common and only going to get worse. it's shocking and go back and look at video of him even just three years ago or two years ago, the amount of decay that has occurred and obviously the president seizure disorders is a very demanding taxing job and it has really taken its toll on him and he is, a lot of us didn't think he was all together with it. two years ago ask a lot less with it now.

ashley: he's going to debate at some time if it's trump or whoever is the republican nominee, i mean, i can't imagine him going honestly, you know, toe to toe with trump in a debate. that could get very, very ugly. >> yeah, even democrats realize that and even though some people try to bring up donald trump's age and try to make a comparison between the two, the comparison's don't work between the two. people can watch them and especially if you saw them side by side on a debate stage, it's clearly evident that one of them is still with it and the other is not. ashley: thank you, charlie. the markets are closed on this president's day but it's flat and s&p and nasdaq slightly

hihigher and dow jones slightly higher. bring in jason katz. we've been watching with some market watchers and do you think rate cuts from the fed could be off the table this year? we've gone from expecting seven down to four, maybe three based on hot inflation numbers we've been seeing recently. could a rate cut be out of the question? >> is it six, four, do i hear o two? they're not all at the table and in the latter part of the year, you get to rate cuts and it's almost like a full course of antibiotics and you're sick and don't take the full course, you don't eradicate the illness and the fed's in a similar position, ash. they must finish the job here. and inflation data of last week vindicates the fed's wait and see attitude and investors are waking up to that fact. make no mistake about it, this is not a great cut or bust market and you're not going to get rate cuts doesn't mean the

market can't go a little higher. what will drive the market at this point is the rubber might the roads and it's earnings. we expect up 10% this year, 13% next year and upside inspite of the fed not cutting rates. ashley: interesting and i think goldman sachs put out a note about s&p and s&p finishing this year around 5100 and getting more bullish and now pushed it up to 5200 necessary the second half of the year. do you share some of the optimism? jowski >> look, in order to get there and big tech has a lot more heavy lifting to do and for better or worse, myoclients are stuck. those stocks would drop by at least the long term cap tail gain rate and justifying will

fraud case. kelly o'grady joins me now. kelly, trump has awarded to other business leader -- has a warning to other business leaders. what is he saying? reporter: ashley, he's saying you're next. the concern being if former president trump can be targeted as some are characterizing this as, what's to stop other real estate developers, other industries in new york from enduring the same fate? a spokesperson from the trump team shared this statement "every member of the new york business community no matter the industry should be gravely concerned with this gross overreach and brazen attempt by the attorney general to exert limitless power where no private or public harm has been established". now the financial penalties as you mention, they're pretty large and hoal $450 million -- they'll total $450 million if you look at interest and it's the biggest challenge for the president, he can't get a loan under this ruling from any new york chartered institutions for three years so that essentially means he can't borrow from

anywhere except smaller institutions or friends. that's pretty tough for a real estate developer as well as someone who is gearing up for an election year. the ruling sending shock waves through the business community and one hedge fund manager said it's for every property owner to be declared guilty and others questioning why stay in new york at all given the business climate. >> this is an assault from the sector in the state of new york and why take the risk to put up much money and have a judge arbitrarily decide you're in some form of breach of fraud and no damages occurred at all and same process that occurs everywhere. reporter: this seems to be spur ago grass root organization among the elite and truckers among social media declaring they'll not make deliveries or pickups in the city of new york

what say you? >> yeah, her intention to haves say to new york businesses and business owners and perspective business owners. don't worry new york is a great place to do business. what she really said is exactly what you eluded to, don't worry, you're fine as long as your name is donald trump or i would also say if you plan to run as a republican and any time in the foreseeable future and we'll go after you. that leaves the question: why would anybody want to do business in new york if you're a republican or a conservative? a lot of republican conservative business owners if they're not as forthright and conservative and great news like florida and texas and tennessee and south dakota north dakota and all the great red state withs great already business-friendly practices and codes. this is a great time to consider moving to somewhere much better than new york if you want to do business or just want to be a republican.

ashley: to protest the trump ruling. do you think that gets any traction? a lot of truck drivers are making a living too and they want to stand in solidarity with president trump and they want to say this is wrong and send a message but fortunately they're livelihood will depend on them making pickups and deliveries and it's said they're in this position and admire their grit and admire their livelihood and sad sate of affairs to be this way. so mice these truckers to want stand up for the former president and send a message.

ashley: they don't like their choices on the presidential ballot. what do you think that could do to voter turnout? >> well, i would say this, there's a reason that the biden campaign is investing so much money in their tiktok army of influencers because they know they desperately need to reach millennials and gen zers and feel like this current president is far too old and out of touch. i've maintained for over a year that joe biden is not the democrat nominee and republicans need to get in the game and make sure they're communicating to gen z and millennials and if joe biden isn't the nominee and put in a younger guy like a gavin newsom, we'll have a real issue on our hands and speaking of issues, that's what we have to lead things with, donald trump is a great personality and talk about issues impacting young people. can't afford anything? that's a democrat joe biden problem, my friends. ashley: that's bidenomics in action. tomi lahren, thank you so much as always for joining the show today on this president's day. thank you very much.

ashley: the supreme court could hear a connecticut case relating to the issue of title 9 depending on how the justices rule, it could result in banning transgender women from competing in women sport in college and school. that question is is that what you'd like to see happen? >> we're increasingly seeing men envieding women's spaces whether it be the locker room or women opportunities and this is in violation of title 9 and especially educational opportunities when it comes to title 9. i expect we'll see more lawsuits and pray one will reach the supreme court and act july to not ban a certain group from playing sports and be able to play sports but be able to do so on equal grounds where we can also pursue an athletic

scholarship one day. ashley: should there be a separate category for the athletes who are biological men who are taking hormones but clearly have advantages? should there be a separate division for these athletes? >> we've seen such categories arise nationally and that's certain alleviating this problem of fairness in the female category but when it come tots states and educational opportunities, a third category would open up twice the opportunities for male domination and so it would raise other issues but the problem of men using biological advantages to steal opportunities away from women. ashley: we'll continue to follow as i'm sure you'll be. macey, thank you for taking time to chat with us today on an issue that a lot of people have strong opinions about. macey, thank you very much.

now we've surpassed 20,000 in just since last october. clearly something is up. don't you think beijing exploiting this massive hole in the defense. i mean, come on. >> of course they would. just like all countries are exploiting what's currently happening. when you look at number of people that we're arresting from the middle east, you know, that has more than quadrupled under what we were apprehending under president obama. i'm not going to talk about president trump because he had this issue under control. when you look at obama to biden, four times more from the middle east than chinese. we're talking about ten times more chinese under this administration. of course these countries that are enemies to us and want to see our government fall, cassioppi they're going to be sending people when they know all we're going to do is release them into the country. it's not an if something is going to happen. it's going to be when it's going to happen.
