suppose he does resign, forced out by the governor. he would be replaced by the public advocate. and he was disturbed by antidiscrimination protests. his family's fertility challenges and leaving with tourette's syndrome. what does williams know about running rather than ruining the city? next development, this may be positive. new york appeals court looking at donald trump's civil fraud conviction with a $480 million penalty. this is a case brought by leticia james who claimed trump invaded the value off of businesses to get low interest loans that he repaid in full. at the hearing the justices were very skeptical.

moulton said nobody claimed any harm. he said, quote, the immense penalty is troubling. it is. a half billion dollar fine for bookkeeping. the case was a deliberate attempt to bankrupt and slime joe biden's political opponent. the appeals court has the opportunity to throw out the whole thing and restore a sense of justice to new york. new york grinds on is the most dysfunctional city in the country. tammy bruce is with me. the appeals court can throw this out. i think they should. will they? tammy:considering the comments it looks like they are looking at skeptically at this as everyone else. one of the things is about the victim issue. prosecutors argue the victim's where the victims were the people of new york. look at donald trump, hundreds if not thousands of jobs, his philanthropy saving important

areas, the reputation of new york. the nature of new york itself. that shows the american people that this is political, they are twisting things around making absurd claims in order to prevail. that is not what the legal system is supposed to do and this is why the legitimacy of the legal system is at stake. trump has the money to appeal it to the supreme court but most americans don't and we don't like the example being portrayed here and thank goodness trump is standing through this process so that he can show how rotten it is. stuart: eric adams, the mayor, will be arranged today. what do you make of the charges against him? tammy:we shouldn't have to do this. everyone is looking funny at this because what we've seen, the federal prosecutors do before, an issue of legitimacy. he should stay. he should fight this.

people say the charges are week but we always see the opponents of adams want adams to go. considering mr. williams's issues, calls for adams to retreat a little bit. this is, when people vote for a public community advocate, it would be good for him. i don't think a lot of people realize he would be next in that seat. this is, always dysfunctional. we are seeing it for what it is. stuart: listen to what one cnn panel said about trump and harris's economic policies. >> a similar message which is investing in manufacturing and industrial policy.

bolstering manufacturing and american jobs. what harris is saying, we want to do this through tax credits. the same goal -- >> it is in fact correct to. harris is the republican in the scenario and donald trump is the liberal in terms of the nature of the policies. stuart: where did that come from? >> if she things kamala harris is going to win, it was done. but see, might have been produced in the white house. this is what americans, you are not getting clear in formation. you can make arguments about one idea being better than another but one person has a history of doing great things for the economy. another person has a history of destroying the economy. to not bring up the issue of

history, both these individuals in the white house which is comparable, what they are seeing are numbers that show the american people don't like what the democrats have done, don't like the biden/harris administration, she's donald trump and a republican, it will not work. stuart: it was good, thank you very much indeed. kamala harris has said multiple times that climate change is a, quote, as essential threat. how much, we had this argument frequently. how much has she spent on private jets? before becoming -- lauren: since becoming the nominee at least 3. $8 million on private planes in less than six weeks according to a fox news digital review of filing to the commission. the most energy intense form of travel and convenient which is why a lot of politicians take them but when you are a politician and say it is,

you are now getting close to 22 times forward earnings. it is industrials, a lot of sectors, cyclicals joining the rally a little bit, getting to the territory, for equity and security, a little much unless it produces earnings growth. we are getting to the point where there is so much optimism on earnings that people are afraid to miss the rally. we are melting up. stuart: what is your advice for someone not yet in the stock market but has money to get in? >> usually not this absolute but when i get to 22 times earnings, weight and sit in cash. i don't come on here and pick this or that the, there is stuff to pick but if you look at i need some s&p 500, more equity in my life going forward long-term you got to wait because the type of pullback you could get if there's a disappointment in this

bringing massive flooding, catastrophic damage and knocking out power in part of georgia. janice dean, give us the latest. >> reporter: 4 million people without power from georgia to virginia. even though it is just a tropical storm, it is bringing incredible rainfall to areas like georgia, the carolinas and virginia. i will show you my maps, the emergency flooding happening right now. flood emergencies from georgia to the carolinas and into virginia. we also have the threat for tornadoes. don't know that we will see the maps but we have flash flood emergencies throughout the morning, you showed them video of bob van dillon, this is part 2, a beautiful look at outside new york city, there we go. to a third time's the charm but let's go to it. it's a serious situation and we

have flash flood emergencies for all the cities and areas you see shaded in pink. over a dozen cities under flash flood emergencies, the national weather service issued these because they want people to know catastrophic flooding is happening now, and potential for severe weather, tornado warrant storms but there's the track of helene, category 4 as it made landfall yesterday, last evening, as 140 mile-per-hour sustained winds but this is the dyer situation across the appalachians. people are urged to listen to your local officials. i'm concerned because we were so worried about the hurricane and now we have this incredible flooding situation that will last 24 to 36 hours. the area of low pressure will stall out over kentucky and tennessee this weekend. the main threat through the next couple days is going to be

the potential for catastrophic flooding and severe weather. stuart: russell fry from south carolina joins me now. there are a million people in your state, south carolina who are without power and it's not done with you, yet. >> i woke up to a tornado warning, and sought shelter. we are not in georgia, the entire state is under a tropical storm morning. we are seeing about flooding and high winds. 40 to 50 mile an hour winds on the coast, 80 mile an hour winds on the interior, the columbia metropolitan airport clock 60 mile an hour winds. you are seeing the rain and flooding and we've been getting drenched for a couple days at this point, more to come. stuart: i would imagine the

path of the storm, homeowner insurance rates are probably going to go up. better negative. >> with south carolina, florida, georgia you are seeing those rates go up. we will see what the claims look like but right now you are seeing 1.3 million south carolinians without power, flash flooding and the water begins to filter into the rivers. stuart: you are in the middle of rescue efforts? >> for sure, the governor declared a state of emergency, asset in place to return power. we are not out here right now. there are places across the state that are so as they continue to restore power and get things back to normal we are not out of the woods yet. stuart: any idea how long it will affect you before it moves out?

visa reports before the justice department launched a lawsuit against visa. what has donald trump said? >> visa is number one. what donald trump is saying is she could be prosecuted. >> nancy pelosi has a little problem because her husband sold visa stock, one day before visa was announced that visa is being sued by the department of justice. think of that. nancy pelosi sold vast amounts of visa stock one day before the lawsuit we are read about a few days ago, was brought against visa. you think it was luck? i don't think. nancy pelosi should be prosecuted for the -- lauren: paul pelosi sold some of his holdings, 2000 shares but also sold tesla and that

was on july 1st. the department of justice antitrust suit against visa came this week. it might look shaky but it is hard to prove who had what inside knowledge and when they had it especially when selling and buying other stocks at the same time. and it is legal. stuart: he sold visa stock months before the department of justice went after visa and there's nothing illegal about what he did, period. it is not illegal. he can do it legally. kamala harris is headed to the border. she's going to arizona today. she wants to change the narrative on migration policies. jackie heinrich has the report after this.

the national popular vote but democrats of won the national popular vote seven of 8 of the past straight presidential elections so if donald trump is winning the national parties vote than the electoral college would likely follow because republicans do better in the electoral college than the national party vote. donald trump's numbers, who doesn't know donald trump? who doesn't know everything there is to know about donald trump? he faced all the negative, onslaught of the media continuously, her numbers, if i am donald trump i'm feeling good and she is failing to bring together the coalition democrats had in the past, not doing as well as past democrats, young voters, hispanics and blacks which i would rather be donald trump heading into november than kamala harris. stuart: i am sure you've seen this. a new quinnipiac poll shows donald trump gaining ground among women voters, down, but

stuart: look at the dow jones average of 350 points. unitedhealth, home depot, and these are three dow stock, all up sharply, adding one hundred 40 points on the dow industrials. new york city mayor eric adams is at the manhattan federal courthouse, going to be arranged on bribery and fraud charges.

the mayor have to surrender himself to the feds? >> reporter: adams's attorney suggested they arranged for the surrender to happen late in the week and we know it is happening today. new york city mayor eric adams is helping new yorkers to listen to his defense before they rush to make any adjustments on this case which has them in court this morning for this arraignment on federal criminal charges which include soliciting illegal foreign campaign donations, bribery, and fraud. the mayor kept quiet but his attorney had lots to say after prosecutors laid out their indictment but they accuse adams of corruption dating back to when he was a top elected official in brooklyn, new york. they say adams accepted bribes from wealthy foreign businesspeople and one turkish government official. damien williams showing these photos saying adams/out and accepted free meals at high end

how are politicians reacting to the adams indictment? lauren: the governor, kathy hochul, had the power to remove him, said she carefully reviewed the indictment and it is up to eric adams to show new york city he could lead, not calling for him to step down. she's got to work with those who keep getting in trouble, that's the bottom line. chuck schumer, the charges are serious, a legal process shouldst play out speedily and thoroughly so aoc says resign and her colleagues say not so fast. stuart: let's check the market. it is friday morning, i will call it favorable inflation news, the pce, personal consumption index. lauren: it doesn't take shelter
