being broken into, cars are being brokennen into. store owners have nowhere to go now because the d.a.'ses office has told law enforcement it won't bring those cases. >> reporter: and it's not just in l.a. where californians want to crack down on crime. as of today, proposition 36 passed with more than 70% of the statewide vote. with the9 passage of prop 36, serial shoplifters caught stealing three or more times can be charged with a felony. it leftens felony sentences for mob-style robberies. the measure reverses some of the criminal justice reforms passed by californians a decade ago. prop 36 also establishes so-called treatment-mandated felonies allowing offenders that accept their drug possession if charges to the complete drug treatment and have their charges dismissed in lieu of incarceration. still, the measure ratchets up the punishment for drug keillors selling certain narcotics like fentanyl. our new k. the a. says that he supports prop 36. he's been an outspoken proponent

of to it saying it's going to be another tool in his tool belt to fight frequent offenders. liz? elizabeth: max gorden, good journalism. thank you so much. okay, you heart max, california voters -- heard marx california voters fed up with crime. prosecutors getting toss tossed out of office for going week on -- weaken on crime. joining us now, fox news contributor, former utah congressman jason chaffetz. jason, you've held office -- it's great to see you, welcome back. show who's about to be tossed or getting recalled in california. it's l.a. d.a. george imas congress, san francisco mayor london breed, oakland mayor. what do you make of all of this? >> standing up and chairing. -- cheering. thank goodness, the voters had the take control. whether it be district attorneys or elected officials in political offices such as mayors, i'm glad the public's starting to realize that, you know, going soft on crime doesn't make crime go away, it

makes for more crime. and add kamala harris to that list. she was asked just before the election whether she voted for or against proposition 36, she couldn't even answer that question. it just show9 how soft on crime she was. i was up and down the ticket for democrats -- service the up and down the ticket for democrats. elizabeth: just last week two different walgreens in san francisco in just one hour, two different walgreens hit by smash and grab robbers. listen to the l.a. a d.a., attorney-elect nathan hochman, again on the passing of this tougher crime law, proposition 36. watch. >> we have to reject the extreme policies that gascon brought in. these are extreme pro-criminal policies, blab debt policies that say that -- blanket policies. there are certain crimes and criminals that he's just not prosecuting because of his political agenda. so i was a big support per of 36 because it's going to give the d.a.'s office additional tools to go after, in particular,

repeat offenders, people who commit theft, get convicted on the third offense can now go to prison with a felony. same thing with drug use. on the third offense, convictio- elizabeth: you know what happened, jason? recidivism exploded because of their weak on crime laws, and people in california have been victimized so badly under this far-left push. you know, california's oakland mayor, that's kamala's hometown, you're right. and if she wants the lead america, why can't she say how she voted on proposition 36? >> well, look, she paid the political price because i think people understood that she was more interested in bailing people out and getting them back out on streets for these riots than she was in taking care of victims. that's the other part. people pay -- they're all in fair favor of more rights for criminals, letting them out, going easier on them, but if these crimes are committed, these are allegation as that we're seeing on television, but there are victims on the other

side of no. people whose lives will never be the same. elizabeth: right. >> they're traumatized by it. they may lose some treasure, they may have had a broken bone, they may have -- but they'll live mentally with the idea that they're just not safe. and why should anybody have to live with that? so i'm glad these pro-, you know, pro-police groups are thriving politically, because that's what it takes. that's why so many people come to the united states. they like the rule of law, and we've got to institute that. elizabeth: well, these politicians violated their oath of office, and california residents are responding. jason chaffetz, good to see you. >> yep. a thank -- ♪ >> would that mean clearing out the top-level federal service workers that are currently at the fda -- >> in some categories, i would say. in some categories, workers, their entire department like the nutrition department the at fda that are, that have to go. that are not doing their job.

thousand ingredients in our food supply that are banned in europe and other countries, and we have an fda that is 18,000 employees. what are they doing? in some cases it represents the bloated bureaucracy that is the united states government. half the revenue of the agency comes from pharma which means it really doesn't have congressional oversight. the agency is self-sustaining with this massive stream from the same companies it is supposed to regulate. so there's been corporate capture, and we've never if really heard anyone talk about serious reform of the fda and our health agencies until now. elizabeth: kids are getting sick. people are getting sick from food literally. and then the pharma industry sells them drugs to fix it. i mean, let's talk about what the sicknesses are. let me just go through this. the u.s. lets in more creme calls into the -- chemicals into the food supply hand the e.u.. the e.u. uses 300 food add thetives. the u.s. uses 3,000.
