convicting him in a court of law. but he has a couple of paths to keep this case moving forward but i think those hurdles are insurmountable for him. first you can't have state courts interfering with executive function and the transition from president elect to president is a necessary function of the executive that would interfere with the ability of donald trump to run this country on day one if still facing these legal actions. the second is the immunity decision last summer was something that was infiltrated into the case itself. that needs to go up on appeal if the judge is to push forward on a sentence despite what happened with the immunity decision. even if he overrules that i think that goes up on appeal before donald trump is sworn in. stuart: is there the slightest possibility donald trump could go to prison or be sentenced to prison? >> there is the slightest possibility that the judge sentences him to a prison

sentence. i see no possibility that the courts would allow that to happen. he could try to strong-arm donald trump but i don't see him going behind bars. stuart: an extraordinary political year trump going to prison, the white house says using their words there are no plans for biden to pardon his son hunter. >> secondly, his son hunter is up for being sentenced next month. does the president have any intention of pardoning him? >> we've been asked that question multiple times, our answer stands, no. stuart: i think biden suggested that he might pardon hunter, didn't he? >> he has been relatively stable in his statements that he is not going to pardon or commute his sentence. what we need to wait for is the sentencing itself.

president biden has a tough choice. if hunter biden is given an excessively heavy sentence then perhaps he pardons him. maybe he is willing to let his son serve a year or two or three in jail so that he's able to maintain some dignity in his decision. stuart: isn't there talk about a deal where hunter is parton dance so as trump pardoned by biden? there's talk about it? >> there is not good basis to believe biden is going to do that. that's not the politics he has played throughout his career. he has not engaged in that kind of trading. i think the best hope hunter biden has if not pardoned by his dad's donald trump has said he might pardon him, because he in his magnanimous approach to our country over the last few months has indicated he does not think it is good to jail people like hillary clinton or hunter biden and he may see that as a way to unify the
