like a president, that's about it. we are wondering what happened to this rally, what has been an incredible performance over the last week since donald trump was elected 47th president of the united states. interest rates are backing up, the possibility of a lot of economic activity, generally leads to concerns the bond market, inflation is a problem and rates are backing up as we speak. around the 41% level, a lot of things are attached to that. this is a performance with odds going one way and stocks going another way. stocks are responding after this. kenny, you've always said brilliant things on this show.

one of my favorites is you can't keep going up anymore than you can keep going up. we were going up a lot and that can to go on forever. what to do you make of where we stand? >> i'm surprised it took this long after the surge on wednesday, thursday and friday that the market hadn't backed off. this is healthy, the fact that the 10-year yields are at 4.42, the high was 4. 47 and backed down for read. fareed. 3 but the fact that it is edging up, we talked about the concern over inflation and what that will mean no matter which party god in. they promised to spend more money. that is something the market has to deal with but today's selloff is not surprising after the surge we saw. stuart: a wonder it took this long.

let me ask about the trump rally, don't know when that begins but where were we on collision course? >> the trump rally will run into a little bit of people are excited about the fact that it was decisive, didn't drag on for days the way a lot of people thought it was going to. the election was over and we could start to move forward. it got ahead of itself. it will pool back but i don't think it will be a massive pool back. that is probably right and we will gear up to the end of the year at asset managers position themselves for 2,025 and beyond. i suspect the santa claus rally will begin like november around thanksgiving and then rally. i don't think we are rallying much.

latest on proceedings that are put off a while, maybe a long while. >> reporter: we started expecting to hear from judge merchan who had a self-imposed deadline to let us know what he was going to do with the common a case involving 34 felony counts trump was convicted of. we had this massive trial in front of a jury, trump's defense team asked the judge to dismiss this case based on immunity but instead of getting this decision we got an order from judge merchan to pause the proceedings after trump's lawyers and prosecutors together asked merchan for the pause, they say they want to consider how trump's election impacts this case moving forward. what's left is the immunity decision and sentencing. brent velicovich prosecutors a week to advise how to move forward with this case. it opens interesting

possibility's. could the case still move forward with sentencing, otherwise scheduled two weeks from today or could it mean this case is positive while trump is the president of the united states or perhaps is it possible district attorney alvin bragg will agree to change course, dismiss this case or set it aside? trump's lawyers are making it very clear they are arguing for a full dismissal of this case on a number of grounds including immunity from earlier this year, wrong for judge merchan to admit certain evidence into trial from trump's time in office when he was president, that being conversations with white house aides, observations in the oval office to prove circumstances from before's time in office, but maybe merchan will not have to decide that issue if district attorney alvin bragg as suggested could change

course but sentencing originally scheduled back in september, and delaying sentencing until after the election two weeks from now and this is another agreement from his side to delay a critical decision on immunity, parties are talking, the dar -- office, where to go now that trump is president. lauren: 1 would reignite this four years ago? we will see. i'm not a lawyer but seems like it is not going anywhere. bob q set, the hill editor in chief. we love talking throughout this campaign, never focus on the moment. the moment is these cases seem to be getting pushed off, pushed out, canceled out right. what do you make of this? i want to fast-forward four

years ago, where there any of them able to survive or could survive? >> i'm not a lawyer but politically these cases seem like they are going to fade in one form or another, maybe they are postponed four years. that is a long time but obviously trump is very busy as the president-elect and i think his lawyers are being aggressive that we need to get rid of this, we could see a ruling from the supreme court immunity decision that throws this out but one way or the other donald trump is not going to jail in these cases are going to fade away, just a matter of when. neil: let's talk about what you have seen of the cabinet picks, the strategy, rarely have i seen so many appointees, announcements, we could have this entire cabinet wrapped up by next week at the rate he is going. what do you make of that? what does that, the only other

president i can think of that was running almost as fast was john f. kennedy after he won the 1960 race. your thoughts. >> this transition is going smoothly. they tapped a number of people including from congress, these, most of these nominees will sail through the senate, not all of them will but that will be the exception to the rule. that are different transition process van we saw which was all over the map, this one is very professional, very organized and you will see more appointments in the coming days. neil: has to be yes or no, the president-elect has made clear he would rather they have automatic approval with republican-led senate? >> i think he will. whoever is the next majority leader i will find out next

week, probably john thune or john cornyn but the trump world is pushing for rick scott. i think he has a shot but it is an outside shot, i think thune is the favorite and cornyn right behind him and they have to give trump a lot of what he wants because he did get a mandate. he won the popular vote. no one was predicting that. neil: democrats might complain about that, these are cabinet posed visions. we have to talk about it, nothing should be automatic. don't know if that will extend the supreme court picks when he assumes office but where is this going? >> a combination. for big appointments there will be hearings, republicans won of the senate, they will prioritize trump's nominee is right off the bat but for the lower-level you could see some recess appointees where it is

easy to get in as long as they are not too controversial. democrats won't like what will happen the next two to four years but elections have consequences. neil: what is different about donald trump, he has not taken the bait not that any was thrown out from jerome powell who was asked if he would step down if donald trump told him to, donald trump never commented on that. he's not commented on this race for the senate leader. he wants rick scott to your point but hasn't said one thing or another. he is stepping back and not getting and what could be controversial areas. it is still early on but what do you make of that? >> it is early on but it is smart if he sticks to that strategy. most people like powell. very even keel, media savvy public official. when trump was president powell
