it is down to $66 a barrel. bitcoin strong, new record high, $91,578, a new high for bitcoin. donald trump is assumed to be very crypto friendly. what have we got? the best way to describe the administration that's taking place is trans formation all. he is transforming america's government and has done it remarkably quickly. the election that changed everything was only 8 days ago. pete hegseth, the defense secretary. nobody was expecting is that. our viewers know him as fox anchor and frequent guest on this program, decorated veteran who has written about the corrosive effect of the military's woke programs.

the house did very well and i think we are responsible for helping with 31, we could have lost by quite a bit and if you are looking at five up. doesn't matter. we get used to one for a little while and you can get used to anything. i want to thank everybody. we worked with a lot of you to get you in and you helped me too and my numbers were so they say 129 years the most important election in 129 years. that's pretty good. what was that? 129 years ago. it started at 100 and they upped it to that but to win the majority by 7.1 million, republicans aren't supposed to be winning the majority.

i think he is going to ask for unity, try to out elon musk to show we can cut stuff here, cut spending across the board. we've got -- what have we got? lauren: when he came the first time to office. we don't have it back. there was a situation where he didn't know how dc worked and congress people and republicans weren't all on board with him. he has support and campaign with people coming into the next congress. they are trump people weather in the senate or the house, that will help him pass his agenda, you won't have individuals on the republican side that go against him. there may be a few that don't go along with his agenda. looking at one in california. by and large if all three branches are in lockstep,

stuart: i believe the president-elect has ended his presentation, still at the podium, lost the audio. he is still going. wish i got the audio. would love to know what he is saying. look at the markets. we turned around a bit, the dow is up 37 points higher. not much price action on the stock market i call it fairly on the consumer price index. not having a traumatic effect on the market, dow is up 30, nasdaq down 49. bitcoin, back to that, 90 one thousand 300 and rising. there are crypto players involved, a mixed bag. coin base is up a fraction. math and digital, grayscale bitcoin up $1.43.

states. the states will find solutions. >> reporter: a laminating the education department would require congressional approval of that could be tricky. some say i cutting the department's near $240 billion budget could gain more support and further another trump plan, expanding the school choice movement nationwide. that gained traction over the past 12 years, 12 states have universal school choice and trump wants every american parent to have access to tax credits for private or homeschool. this is making unions nervous, major teachers union after trump won reelection the american federation of teachers, the president there, randy weingarten said the union, quote, must fight the means and agency to secure a better life and public education and growing labor movement are more important than ever. not clear whose tapped for the cabinet position of secretary of education.

i asked ryan walters who told me he's focused on the kids and schools in his great state in making trump's plan a reality. stuart: betsy devos joins me now, trump wants to abolish the department of education. habit education look if it were abolished? >> let's be clear. he wants to support education. and support kids and their families but illuminate the bureaucrats. there are plenty of bureaucrats that should be eliminated. they have had an agenda that has not been aligned with students needs but with adults needs. the department of education was a payoff to the teachers union starting in 1980 so i am -- 1979 by president jimmy carter. it is focused on adult issues and adult needs.

an outpost or in post for the union movement over all of these 40 plus years. the focus on the part of the next president is on kids and what is best for kids. stuart: how do you take on the teachers union? >> continue to provide options and choices for families as many states are doing across the country. where the president and congress can come together and form a federal tax credit to come along these programs, states that already have it and to give options to kids in the states that have not made those policy changes is how you can support kids and the best things for their futures. stuart: difficult to reform education where policy is based on the state level and not the federal level. you've got to get over that somehow or other. >> you need to turn those decisions back to the states.

it should not be federalized in washington dc. the needs of kids in a rural tiny vision - village in alaska are very different than the needs of kids in an urban the school in miami. it all coalesced under the department of education as 1-size-fits-all approach and we are finally realizing and recognizing that. stuart: biden has a vast plan of student loan forgiveness. what happens to that vast plan now that we have donald trump? >> the biden administration is not following the law, they keep trying to evade, totally illegal scheme and the next administration is going to refocus on cleaning up the mess that has been left to the

manager getting options to students in their higher ed years that will provide multiple pathways to higher education or education beyond high school, too much focus on only four year colleges as an answer and too much focus on the government with a heavy hand controlling student lending and trying to forgive it for some chosen students while others pay them off and others have not taken out student loans. it's a totally unfair and illegal scheme that was a vote buying scheme by the biden/harris administration. didn't work, not going to work and there's a lot of opportunity for a different pathway going forward. stuart: i believe unionization of the education system was imposed by executive order. executive order did it in the early 1960s. would it be possible to issue an executive order in this day

and age that d unionize is the education system? >> that's a great question. for legal minds to grapple with. it is very clear that donald trump in a second administration wants to return power, decision-making and control to the most local level possible. sometimes that will be states. ideally it is directly to families to make the best and right decisions with their kids. stuart: hope to see you again real soon. thanks for being with us today. what do you think of the teachers union? >> the department of education is designed to help the adults and not the students, teachers union designed to help the adults, not the students. why do we have these two entities depriving children of education of what they deserve.

the focus should be on the students. there's a way to accomplish two things, making sure kids are the best and brightest in the world and making sure teachers make a good wage because their job is really important. you don't need the department of education and don't need unions to do that. i know a lot of teachers whose salaries haven't gone up. look at randy weingarten's salary, she does a good job in terms of making money for herself. look at the unions, they do very well. teachers salaries have not gone up as much as other public-sector jobs or as much as the private sector. if i am a teacher i'm excited for this change because i might make more money with the union out of the picture. when the union gets involved, the kids suffer and the teachers don't make as much as they should. stuart: good stuff. a judge just blocked a louisiana law requiring public school classrooms to display

the ten commandments. what happens now? lauren: the louisiana attorney general will appeal this to the us court of appeals for the fifth circuit. that's a pretty conservative court. some parents in the state sued for mandating public schools k-12 and public colleges display a poster that had to be bigger by 1114 of the ten commandments. that is on display in schools by january 1st. parents wanted religion out of the classroom. the obama appointed federal judge agreed with them. similar efforts in other states to amplify public expressions of faith are often knocked down. i think that's the logjam now. stuart: lauren: brings religion to a secular space. stuart: let's bring you up to speed with what is happening in dc, trump is meeting with house republicans, then he is headed to the oval office for meeting with biden. we will have eyes on him when

stuart: president biden faces pressure to confirm as many federal judges as possible before he leaves office. how many more nominees is biden pushing a 4 oh? >> 25 in the pipeline. the clock is ticking for this administration to get this done before january 20th when the trump administration takes over. since president biden came into office, he has nominated 260 one federal judges, 213 have been confirmed. there are roughly 25 in the pipeline. dick durbin yesterday, looking over this entire situation said he thinks maybe 15 to 20 could get in before january 20th. they need to be confirmed by the senate. it is still it is thought democratic senate. white house press secretary karine jean-pierre wants republicans to help confirm

some of these nominees before the administration the signs off. >> that's what we want to see, republicans and democrats come together as they have to get key judges through. >> reporter: the incoming president says no working together, no judges should be approved in this period of time because democrats are looking to ram through their judges as republicans fight over leadership. when donald trump left office in january of 20 one, he was able to get 234 judges confirmed. dick durbin who is overseeing this says 15 to 20 confirmed a, important to note these federal judges are appointed for life. article 3 judges, their policies and their tone in the courtroom the last decades longer than the president who nominates them. very critical positions. stuart: lawfair and more on that, jack smith says he plans

stuart: what about the hush money case? it has been paused. what's with that? >> reporter: the judge has to decide the motion to dismiss based on the immunity decision. the trump team has to decide, they have significant legitimate appellate issues but an appeal can't go forward until judgment is entered with the pronunciation of a sentence. they don't get to argue the appeal, it is in limbo unless there is motion to dismiss in the interest of justice which wouldn't be granted unless the da consented. stuart: it just hangs around as long as it takes. >> unless the trump team chooses to allow him to pronounce a sentence. it would not be imposed through the state ending up your but the only way to get that appeal to be heard is if the sentences announced. stuart: is there something special about the georgia case? >> the georgia case was already

>> in massachusetts at least. one of the massachusetts congressman said something the 70% of americans agree with and the left in massachusetts growing up and proving his point that they are not able to have conversations that allow them to move forward with voters. look at a democratic firm after this election, social issues were like this, not focusing on economic issues, number one reason swing voters chose trump over kamala harris. democrats have a serious issue. in massachusetts, an exclusive report calls him a nazi cooperator. you have left and massachusetts freaking out including higher education, a tough professor has become this whole progressive back lash against seth moulton. stuart: but the left wants to

lead the democratic party, going for a leadership position like the biden administration. >> reporter: some don't understand this isn't a winning strategy, seth moulton reading the tea leaves understand their needs to be a shift on these social conversations. he has been progressive on lgbt q plus policy voter on commerce measures to protect people protection on housing, education, he's saying we should protect women's sports, keep it safe and fair. stuart: house democrats want to protect some of biden's agenda before trump gets into office. some plans include fast tracking citizenship, getting inflation reduction act funds out the door as quickly as possible to spend it. seems the resistance to trump is underway. >> it is. you see this out of a lot of progressive caucuses in the house. they want to get the money out from the infrastructure bill and all of this.

if you look at those bills it is a lot of social spending, the infrastructure bill, a lot of climate spending, might look like we are fixing the ports, fixing bridges but it is a lot of money going into progressive climate policies. we are seeing the biggest resistance in blue state governors talking about not cooperating on mass deportation. on the one hand you understand them saying we don't want you deporting people who have been part of the community for years, families are contributing but on the other hand in massachusetts they are not cooperating if somebody has been arrested for rape or assault and they've been released back into the community. there needs nuance from these governors. stuart: they are not reading the room, not reading the election which was 8 days ago. thanks for being with us. you are in a difficult position, you work in massachusetts.

republican this, the president-elect has a norm us power. can they stop trump's progress? >> break this into two factions. congress and the courts. when it comes to congress, the votes, ultimately you will win in the end. there are things procedure rally that can gum up the works in progress but push comes to shove it you get and you get a vote. the courts need to focus, you are recovering lawyer. i focus on the courts because there are things democrats can do using litigation to gum up the trump agenda when it comes to executive action, things the president wants to do, the power of the white house. that's why all the lawyers had on staff for the election. i would learn a different type of law and it would be

stuart: the 11:00 hour is here, almost. we're watching all the action. what a day it's been so far. trump's motorcade is on the way to the white house. he just finished his meeting with house republicans. elon musk attended and got a standing ovation and trump told the room he was 100% with speaker johnson. to me that means he's going to get the unity he wants. also said we're gob that carry out the largest deportation in history. the crowd cheered. he's now on the way to the white house. the market reaction was muted and semi benign inflation news earlier this morning. dow up 100 and nasdaq down 40 points. but the action is in bitcoin. look at this. we're now at 92,600 per coin.

it's hit a new all time high as of today. show me big tech, please. that's where the money is. only one winner. amazon up about $3. apple, nvidia, microsoft, alphabet down. 10 year treasury yield. where is that? it is down to 4.42%. now this. who leads the democrat party? at this point, nobody. they're busy criticizing each other and trying to work out a winning policy for the future. meanwhile, the president elect is powering ahead with a whole new raft of cabinet members, advisers, and dramatic new policies. the democrats can only watch from the sidelines. organizing some kind of resistance. kamala harris and tim walz may want to be apart of it but they lost so badly and ran such a lackluster campaign they've been cast out into the political wilderness. there are no standouts in biden cabinet to lead the party.
