gaetz was, quote, doing very well, he did not want to be a distraction for the administration for which he has much respect. gaetz was announced just a week ago and was considered trump's most controversial pick. but now that the he's out, trump has moved on announcing same day his new pick for attorney general, and that would be pam bondi. his announcement, trump says that the doj has been weaponized against republicans and vowed that under bondi that would not be the case anymore. one last point on gaetz, he signaled his support of bonn i do with a post -- bondi with a post on x as well, stu. stuart: all right. joining me now, jason chaffetz. bondi is another loyalist. is she going to have any trouble getting confirmed? >> oh, i don't think so. she's a highly competent attorney the, the highly successful, is a who to-term attorney general of one of the largest states in the united states -- two-term. she's exceptionally good on her feet answering questions.

she has great proximity to the president, and for she's got a mandate, i think, to the clean up department of justice. and that's going to be a welcome sight to these republican senators who i think will, in unison, unanimously vote for her. stuart: with gaetz out, will pete hegseth and rfk jr., will they have an easier time getting confirmed? >> yeah, i -- listen, they're going to focus on something somewhere, but these people -- look, if you have somebody where the department of justice or law enforcement comes in and looks at something and then said there's nothing here, there's nothing there. if they could have charged some people along the way, they would have. i thought the way they treated matt gaetz was absolutely fundamentally wrong. i think pete hegseth is an exceptional candidate. he's got the right background, he's going to come in and clean up the place. i happen to know him because of, proximity to fox but i'm telling you, he is a patriot, and he's got a fight on his hands to help clean up that pentagon out

there. i think all of the candidates that are up there, they should be confirmed. they did this, they bent over backwards to confirm the biden nominees. the republican senators should do the same for the nominees that are in place right now. stuart: jason, i want you to listen the what the white house says about biden's claim that trump is an existential threat. watch this. >> you know, i've been asked about existential threat, i've been asked about threat to our democracy. the president is always going to be honest with the american people. he feels like he is obligated. what he said still stands, but we are now in a different place. we are -- the american people spoke. they deserve a peaceful transfer of power. that's what this president wants to do. stuart: you know, jason, i don't think that really helps, a peaceful transfer of power, if you're till saying he's a threat to democracy. >> i totally agree with you. you know it's -- what's an existential threat? when you start authorizing long range ballistic missiles to be

fired into russia. that's a little bit more of an issue than name calling of donald trumps who is going too,ed i think, a bang-up job in making our world more safe and secure and trying to negotiate some settlements. that's what really matters, not this verbal jousting from the white house. it's kind of a joke at this point. stuart: who do you think is the real president of the united states at this moment? if any idea? the who's calling the shots? >> i guess the first person i'd call would be jill biden. i don't know. that's the scary part, who's calling the shots? if you can't negotiate your way through the amazon jungle off of a podium, then i got real questions about who's actually controlling the nuclear codes at this point. stuart: that is a threat to democracy isn't it, really? if you have a president who just didn't seem to be this there but all kinds of major events are being organized by this president, by his team, you have to ask that question, is it a threat to democracy? we didn't elect jill biden. we didn't elect his chief of

staff. we didn't elect the secretary of state. they're the ones who seem to be maybe making the decisions here. >> two things. first of all, kamala harris, she's on vacation. she has a job to do for the next 60 days. and i'm sorry, but i used to be in the congress, the republicans still control the congress. why aren't hay calling up the secretary -- they calling up the secretary of homeland security, the secretaryover of national -- of the pentagon, secretary of defense? why aren't they calling up the national security advisersome come testify. what is going on? by bombing russia, those people should be up on capitol hill. they should be issued subpoenas. congress is still in session, folks. you just don't get to spend if turkey day with your family when you've got world war iii on our edge here. you've got to be able to call those people. they should be there testifying and explaining to the american people what it is we're doing with ukraine in authorizing these long range ballistic

missiles. stuart: world war iii, that's an expression we have heard a lot of recently, and we're to going to get into it later mt. show. jason, thanks for joining us. the chair of the sec, gary gensler, he is preparing to ten down as trump takes back -- step down as trump takes back white house. when he goes, the crypto world will be opened up, won't it? >> yeah, absolutely. i mean, part of his term, tenure as sec chair, he really pursued the crypto industry through lawsuits. so i think this is going to be a lot of opportunity, you know, that in tandem with a crypto-friendly president. so when it comes to sec chair, his last day is going to be january 20th. he's going to step down at noon. that clears the way for president-elect trump to install his pick as the top regulator. we till don't know who that's going to be. he sought to enact ambitious rules and pursue ised lawsuits that resulted in high profile -- both traditional markets as well as crypto. so gensler tried to force

corporate america to tell investors about climate-related risks within business, and on the crypto side he pushed to bring crypto under the sec's authority with numerous lawsuits. establishing the rules of the road through litigation rather than regulation. so with that out, we could see a lot of change there. on the enforcement front, gensler focused on wall street's use of tech, whatsapp and other unauthorized channels to discuss business and levied fines of more than $2 billion against firms like jpmorgan and goldman sachs. so later in the show you're going to have on sec commissioner mark -- help me out. stuart: [inaudible] >> you're the king of last move -- names. we don't know who trump is going to appoint, but we can expect a republican commissioner as acting head. stuart: definitely a republican, i would say, yes, indeed. thanks, madison. a little later in the show, we will have the sec commissioner. can check futures friday

morning, mixed picture as we go towards the end toking bell. dow's up, nasdaq's down. kenny polcari with me this morning. the big financial headline so far today is bitcoin. it's real close to $100,000 a coin, kenny. why should it not just keep going up? >> i think it is going to keep going up only because we're less hand $2,000 away from in that $100,000 big, round number. my guess is it's going the take it there just to take it there, right? and then it'll consolidate. look, it clearly has been on a tear ever since the election. i continue to think it's going to continue to be on a tear now that, to your point, we're going to get a new sec chair, someone much more friendly to crypto. the president's friendly to crypto, so i think it certainly has room to go. i expect it to go $100,000 today or early next week. stuart: how about nvidia?

does it still have room to run? >> i love when you ask me this question. the last time we had this conversation, i think it was the last time they reported. it was trading at, like, $110, i said you gotta bite on weakness, and look where -- buy it on weakness. they reported again, we're making new highs. if you already own it, maybe your not so quick to chase it. but if you're somebody starting out, you need to dip your toes anytime, at some point you have to buy it just so you're in it. doesn't mean you're spending all you want to spend on it. dip your toes and then get started. at some point you've got to jump in. you can't just continue to watch it and say, well, i'm going to wait, i'm going to wait. you can't do it. jump in! stuart: i wish i'd taken your advice, kenny. my account would look a lot fatter. kenny polcari, have a great weekend, and we'll see you again next week. >> with you as well, bye-bye. stuart: changing the summit, will be to this, "the view"'s joy behar questioning joe

of fighting crime and making america safe again. i've known pam if for years. she's smart, she's tough, and she's an america first fighter who will do a terrific job as a.g.. bondi was recently on stage at a rally in greensboro, north carolina, right before the election talking about her relationship, rather, with trump and said she's ready to get things done. >> i was potential adviser to donald trump office of white house counsel, but most importantly i'm his friend. house on day one. stuart: i think you're right. listen to what bill clinton had to say about democrat outreach. roll that tape, please. >> i think that we're behind in the sense that a lot of the small town and rural people are now highly sophisticated in how they get their information. and there are zillions of new web sites now all trying to advance their sort of conservative to right-wing, radical cause. and a lot of times we're not plague on the same field. concern playing on the same field. we're not even being heard. stuart: lawrence, that's interesting. >> he's so slow when you compare him to donald trump. stuart: same age. >> just a clear difference in speed. second thing is he's wrong. this has nothing to do with sites. it has to do with the party that he once represented. it's a different party.

[laughter] i mean, he tried to educate them about the dangers of illegal immigration, and they got so upset with him. the once idea and view of the democratic party is gone. and until they moderate themselves, they're just going to lose normal people. stuart: they haven't sorted it out yet, have they? >> they don't seek to. i mean, they're to doubling down. you have governors that are saying heir going to resist even though the majority of the country, over 60%, want mass deportation. because they don't like what's happening in the country. they don't like being talk down to. i found this so ironic when i'm watching this commentary and the exit polling is coming and in they're saying 700% of the country -- 70% of the country believes we're headed in the wrong direction. i'm, like, where have you been? you don't need a book on this, stu. just go and talk with voters, and they'll tell you exactly what the issue is. it's not social media. stuart: start now, please. >> right. stuart: lawrence, always a

care. stuart: two minutes til the opening bell. a mixed picture. dow's up, nasdaq's down. mark mahaney's with us this morning. i really want the talk to you about uber. it's your number one large cap stock pick, and you say it's going to $120 a share. make your case again. >> yeah. so this stock's been recently dislocated, stu. i'm trying to make a living out of picking what i call dh, qs, dislocated high quality companies, and it's hard to find that dislocation. but when you find it that's what you want to focus on. uber is in that category right now for me. earlier in the year it was amazon, right now it's uber, and i think there's two catalysts. i think they'll be able to announce more deal with waymo next year that shows autonomous vehicles are actually going to be coming to us all in part on uber's nerc. that'll be -- network.

that'll be a positive catalyst. and i think they'll be able the maintain this bookings and revenue if growth, that's an issue that the street's been hyperfocused on. i think that tide is going to turn in the first half of next year. i think you're going to get stable growth, and i think that takes the shares higher. it's our top pick. stuart: i'm just trying to imagine robotaxis in new york city. >> they're coming. if they can make it in l.a. and and san francisco, they can make it in new york, i guarantee you. stuart: okay. the dow has opened with a gain, .17%. 88 points, as we speak. and the majority of the dow 30 stocks are in the green as we open occupy on a friday morning -- up on a friday morning. that's' the dow. show me the s&p 500, please. that's a broader indicator, up 6 points, not much movement. the nasdaq composite, that is up down -- no, it's not, it's absolutely dead flat. move on. how about big tech? is that a kind of mixed picture we've been seeing recently in yes, it is. microsoft, meta, alpha a bet down. we've got to get going with bitcoin. you know, good morning, taylor. >> good morning. stuart: creeping towards $is 0d100,000. that's got to be good for the crypto stocks. >> yes, this is incredible. i think when trump was elected we thought we'd get to 100,000 on bitcoin by the end of the year, we might do it by december 1st at this rate. we could even do it today. some of the place lower today. again, this has been a huge

rally, so a little bit of a relief today. not too concerned about some of the crypto plays a little bit lower. stuart: okay. gap. it's not the gap, it's gap, as i'm told -- [laughter] clothing brand, got that. they reported yesterday. what are they saying about -- look, the stock's up nicely. >> yes. stuart: what are they saying about holiday shopping in. >> that it's off to the a great start. this is the third time they've raised their annual guidance. they're in the middle of a big turn-around. wealthy customers, those making over $100,000, six figures, they're coming into the store, and they are staying. i have to admitting, i'm one of those, baby gap for my daughter is great, and it's affordable. and they're really saying those making over six figures are loving the value play. stuart: 12 higher, not bad. intuit. they reported after the bell yesterday. what went wrong? they were down a lot more than this. so what's going on with that stock? >> only down about 2%. but remember, this is the stock that's been under pressure because doge said that they

might create a government tax filing app that is free. so the ceo of intuit yesterday sort of addressed those concerns. he said that, look, hay don't think that the government -- they don't think that the government wants to get into this space. they hi that the government will really just want to take things away, so they think intuit's going to be okay, not have a lot of of competition, we'll see. stuart: what's this about a more advanced siri for apple? >> siri is 13 years old, can you believe it? they're calling it llm siri, large language model siri. they have a plan in 2025, and they want to do a broad-based rollout in 2026. basically, they want siri to be a little bit updated, a little bit fresher, act more like a chat a gpt -- stuart: is that a big attraction the at apple, siri in. >> you know, it might be. and apple has been behind in the a.i. fight, and i think this is the way that they see apple

to figure out who these people are. stuart: let's move on. trump's threatening to repeal biden's ev tax credit. that can't be good news for the ev -- they're all up. >> so had been a few-days story, right? we heard from elon musk when they wanted to reduce of get rid of that tax credit. elon musk says, great, because tesla sales would hurt a little bit, but he said it would decimate the legacy car makers and, indeed, a study the overnight says they think sales would drop about 237-30% -- 27-30% overall. tesla's, of course, relatively affordable without that credit, so tesla wouldn't be as hurt. everyone else would be. stuart: they're up again. 342 on tesla this morning. what's going on with merck's popular asthmadrug linked to, i'm reading the words here, serious mental problems in. >> so i'm not a doctor, but what we are hearing from a research that came out overnight is this

drastically increase -- some time to drastically increase production, right? >> in many cases, that's exactly right. one of last things we've -- things we've seen under the biden administration is wells going dormant. the increased taxation and regulation has made it so that we are only using the most profitable wells. drillers have done a very good job of getting every last drop of oil and every last found pound of natural gas they can out of their a wells, that's why production has been going up. but we still have an increasing number of wells we're not using. well count has been going down. so if you can get rid of that excess tax decision -- tax sayses and regulation, you could increase production relatively quickly because a lot of the infrastructure's already there, it's just not being used. stuart: but we've also got to get pipeline capacity. if we're to going to produce a whole lot more oil and natch gad pipelines to push it around the country.

trump wants to make the u.s. the world's crypto capital. how will the next sec chair make it happen in. >> good morning, stuart. president trump is absolutely right, the current administration's war on crypto needs to stop. there are a number of things we can do to help make america one of the global leaders in crypto. if first off, from a regulatory perspective we can provide the appropriate clarity. some crypto is not even a security at all, but we need to make clear whether or not you fall within sec jurisdiction or not. if you do, we need, again, a set of rules. so those players in this space know what to do whether it's making an offering if your a brokered dealer, how you handle those sorts of transactions, how you custody and safeguard those, what it means for asset managers. one of the other very important things we can do is create safe harbors. and regulatory sand boxes to

allow that innovation to occur. and finally, we need to work with the congress, the white house and other federal regulatory agencies the make sure we have a cohesive and comprehensive approach to crypto. stuart: you seem to have a pretty firm grass. of with where you want -- grasp of where you want to take the sec. gensler steps down on january 20th. would you want the job? will you take it? >> that's a decision for the president to make. what i can tell you is that whoever steps in that job, there is a lot of work that needs to be done to address some of the regulatory excesses not only at the sec, but at a other administrative agencies. there are a lot of new rules and regulations that were rolled out. there are a lot of unintended consequences, many of which will need to be addressed.
