moving on, tuesday, december 3. dow is down 100 and virtually no change for s&p and nasdaq up all of seven points. big tech and mixed picture this morning only one loser and that just happened to be microsoft. amazon, apple, nvidia and they're all up and down nine-cents. check the yield on 10-year treasury and still below. it's moved above 420. you're at 421 as we speak. now this. i sometimes wander if california is really part of america. i arrived in san francisco in 1975, nearly 50 years ago. back then the golden state was indeed golden. it was the cultural leader of the country and seemed like everybody wanted to live there. 50 years later it's lost its way. california is now fighting a rear guard action to keep the old failed policies in place.

they can't handle donald trump and gavin newsom established a $25 million legal fund to defend california's values. the fund will pay lawyers to fight trump if he challenges california's extreme pollution rules or if he enforces the deportation of migrant criminals. i wonder how taxpayers feel about fighting the feds when the state is deeply in debt already. these wonderful california values have already saddled the state with the highest poverty rate in the country and some of the highest tax rates. let's not forget the bullet train that newsom pledged to reign in. nowhere near complete and cost of $100 billion. most expensive gas in the country, a crime wave and failure of k through 12 public education and newsom's children go to private school. newsom is leading the developing trump resistance and using it as a platform for his run at the presidency in 2028. four years, that's a long time

a year going back 11 month asks a lot of people told the -- experts told you be cautious. you have to stay out of the market or invest in this or rotate out of that. and what's worked again is staying long in the market. now as we sit here, what happened? that's the past. what happens in the next month? what happens over the course of 2025. i think we have a strong rally for december. i think we have the potential to close the year north of 30% to the upside. so that's only another 3% from here. i think it's very doable. and the reason is you talk to -- jimmy talked about usa is back. we have an economy that is back or pushing higher because of incoming trump presidency. stuart: how did tariffs help the economy? >> okay, the one thing they don't do is hurt the economy. what president trump is saying, people want experts that want to tell you this is inflationary, this will hurt the american people. it's really not. it's going to do the exact opposite, help the american people by making goods made in

america more affordable for american consumers. it's going to prevent companies from going to mexico or china or anywhere else and developing products there, and then having them sold at a cheaper price within the united states than what u.s. companies can do. just like you did last time around, i think it'll be a boost for the u.s. economy and a lot of people are discounting that right now. stuart: got it, mike. stay there for me, please, for the hour. a delaware judge just blocked elon musk's $56 billion tesla pay package. lydia hu with us this morning. what happens now? >> well, stuart, as you point out always seems like the lawyers win because tesla says they're going to appeal and more work for the law lawyers and tea posted this on x after that decision "the court's decision is wrong and we're going to appeal the ruling if not overturn meaning that judges and plaintiffs lawyers run delaware companies rather than their rightful owners, the shareholders".

stuart, this is the second time the delaware judge decided to strike down elon musk compensation package. tesla shareholders approve that package for musk six years ago. at that time, the company was worth around $60 billion and shareholders wanted mussing to focus on growth and they -- musk to focus on growth and decided to tie compensation to performance and stock options only if tesla hit a market cap of $650 billion. at that time, no one really expected him to do it, but he did and did it sooner than what was expected and 2.6 billion and value spiked to around $56 billion by the time it was canceled in january and the judge decided then that musk had too much influence over the tesla board, she said, and the process for adopting this package to pay musk was not transport. the shareholders in june res responded and got together and voted to approve the package again. tesla lawyers argue that had the

shareholders are fully aware of details and the judge's concerns, took it back to court. the judge rejects it again. big concerns coming from some heavyweights in the business community. you know who this is, cathy wood. she called the judge "activist judge at its worst and assault on investor rights". wood is confident the judge will overturn it. i was reporting on this in january, the first time the judge rejected it. vivek ramaswamy was commenting on our network about this saying this is a real damage to capitalism. it's so interesting that musk and vivek are working together now in the next administration. stuart: it's not absolutely over? >> it's not over. stuart: total forever rejection of the pay package. stuart: it's not over and they're going to appeal and before anyone gets worried about musk, he's still the wealthiest man in the world, even without the pay package, which sin credible. stuart: 360 billion. incredible. lydia, thank you indeed. coming up, the u.s. has nearly 1,000 troops in syria. the government says they're not picking sides after rebels

will re-instate them on day one. stuart: i'm sure you've seen this but new york times reports that mexican car cartels are recruiting on college campuses and want chemistry students to help them create stronger strains of fentanyl. how will trump go after the cartels and talk of using special forces and talk of seizing their money? how will it work? what will he do to the cartels? >> we have a full court press for north america in the region or the world and best way forward for mexico to ascend to doing very specific things in country to combat the power and viciousness of the cartels. whether that special forces or military, whether they designate them as terrorist organizations and all of those things should be on the table in the discussions within the u.s. government starting on january 20th but also with our international partners with mexico and in the region because these cartels have way too much
