found not guilty in the subway choking case, a person of interest in the fatal shooting of united healthcare ceo being questioned in pennsylvania, lieutenant dear import your joining us now, thank you for being here what a busy time for the new york crime stories let's start with daniel penny this case a lot of people say d.a. trying to divert attention from his failure to keep citizens safe in his city what do you think about the case and the verdict. >> i applaud the verdict and the jury got it right. we look to daniel penny as a person that's an innocent citizen protecting and defending people in the subway car that did not have the ability to protect themselves. i also think this is the mayor's hunter miscarriage risk of justice on the prosecutor because when they were unable to get the initial charge on the manslaughter that's when they reverted back and focused on the

criminally negligent homicide. if you can't get out there then drop the case totally this sets forth a serious precedent for us coming to new york if you step up and assist your fellow man or woman he will not be convicted in the court of law, this is something that alvin bragg took on a personal level and i'm so happy that we got this verdict. i cannot even put it into words. david: i think the major point that a lot of people in new york are thinking it should not be up to private citizens to restrain people that should be threatening them on the subway, it should be up to law enforcement to new york city law enforcement and frankly they have been unable to do the job that they were sworn in to do because the prosecutors like alvin bragg and a lot of judges that let the crazy people out on the street. >> you bring up a good point. when daniel penny came into the precinct for questioning he was

not arrested but police did not feel that they have probable cause to arrest. probable cause is a standard to arrest and it was clear probable cause was nonsupported when daniel penny came in he gave the statement. however, alvin bragg being an elected official felt as his constituents wanted blood they wanted arrest as it related to daniel penny and that's why he drove forth the charging handle and had daniel penny indicted and put up against the court and literally ruin his life for months and finally the jury got it right. when you speak to the police department, absolutely we think of the social contract affords us as common citizens protections within government and it was apparent i want to say the backfill of the nypd police officer was not there. the nypd is thousands of officers in the red, people just

don't want to take the job. as a result we had to avoid officers on the train. david: can you blame them not wanting to take the job when they're not supported by the prosecutor and the judge is that very often that criminals back out on the street? >> i cannot blame them. when we look at the dcom police movement that happened a couple of years ago after george floyd incident, it was not just new york but on a national level there was a chaotic push against police. fortunately the elective rate because a lot of people that were running for election in the democratic party to lose they're down ballot elections because they supported the defined police mentality, now we are understanding our eyes are wide open and we see that doesn't work but we're still at a deficit in policing and that will take some time to get the staff levels up to a proportionate level to provide the protection to the place like new york city.

david: i want to switch to the other case in new york of the united healthcare ceo getting murdered on the street and the suspect apparently or a suspect we don't know if he's the one they have been looking for but the suspect has been captured in pennsylvania and he matches the description of the suspect that was put out that we saw a picture of. now what were looking at cops in central park and new york city looking for more evidence we found apparently over the weekend the backpack used by the suspect. what are your views, are you surprised that we were able to capture and are you surprised if this is the suspect he got out of the new york ring that was supposed to keep him in? >> i am surprised he was not captured sooner. i'm surprised this took so long. the one thing that law enforcement has to be careful about, when we go back years ago and the olympic bombing there

was an individual named richard you that was placed in front of the cameras as a suspect and we later found out that he in fact was not the suspect. as a result he sued the fbi civilly and one. the nypd cognizance therefore did not introduce the name of a suspect because if they get it wrong they don't want to be sued. we are still working on providing as much as formation as possible to reach the level of probable cause which is the standard proof necessary to affect an arrest. i do believe this individual has been arrested. he still in custody and still be in question. it's good to be determined later on down the line as if he intact is the suspect that will be arrested for this horrific crime. david: lieutenant dear import your great to talk to you, thank you very much for your insight and the breaking news stories. nvidia shares falling today on

david: for thing that is different now than the first trump administration now they have the supreme court behind them now there is supreme court decisions saying the epa and other agencies that biden was using for the ev mandates cannot be used to has to be done by congress that is requisitioning billions and billions of dollars that congress has to approve with the supreme court behind them i want to switch to one of the subject if i can we now have the question of what is going to be the first priority of this administration whether it be immigration or taxes the tax cuts of 2017 will expire at the end of next year that would mean 65% of american taxpayers would see a tax increase on january 1, 2016 if that is not happen, shouldn't extending the tax cuts which you been so successful at bringing in more revenue shouldn't that be the first priority of the trump administration?
