♪ ♪ stuart: i have proof, i love this music and it works for me. it's real christmas music. it's not the little drummer boy. it is 11:00 a.m., east coast. it's tuesday, december 17th. check the markets. the red ink is still with us. the dow is off 260, the nasdaq down close to 100. show me big tech, please. something of a mixed picture. we have apple, microsoft, and google up and amazon nvidia down. look at nvidia down again. that's in correction territory. the 10-year treasury, the yield there backing away from the 440 level down to 438. now this. kamala harris vacationed briefly in hawaii and made a short video saying don't ever let anybody take your power from you since losing the election. i don't know what that meant.

more recently addressed laid off campaign workers saying our spirit will not be defeated. again, not sure what that means. she is 60 years old, she's been california's attorney general, a senator, a vice president, and the loser in the last presidential election. so where to from here? well, on a call asked donors to cover her campaign's debts, she pledged to stay in public life. but in what capacity? may be tempted to run for governor of california. that would be something of a come down from the vice presidency. might try to run again for the white house if trump could come back after a defeat, why couldn't she? one good reason why running for public office again wouldn't be a good idea. kamala harris was not a good candidate and not equipped to win votes and democrats could make excuses and didn't have enough time to develop an effective campaign and couldn't shake loose from unpopular joe biden or america wouldn't vote for woman of color. all the executions ignore kamala

harris' weakness as a candidate, specificsly her inability and unwillingness to answer questions. candidate trump was in front of the cameras constantly. even when tied up in court, he was dualing with the media. his long interview with joe rogan hit 20 million viewers in 20 hours. harris shied away from rogan like she shied away from countless other opportunities and vote erics became convinced she was afraid of questions and sensed that she wouldn't go near the key issues like a failure on the border or persistent inflation. if you can't directly address your voter concerns, you lose. kamala harris is still the vice president, that's her job now. after january 20th, she'll have to chart a new course. hard to believe that she will run for public office again any time soon. third hour of varney starts now.

robert f. kennedy jr. on capitol hill trying to drum up support and he's trump's pick for health and human services secretary. guy benson joining me this morning. is rfk jr. confirmation in trouble because of the comments on vaccines? >> i'm not sure it is clear it is in trouble at this point. he might have tough questions from the right flank on abortion and single issuer healthcare and some on the left and others questioning him about vaccines and some of the things he's said through the years, but in terms of hard nose lining up, until you start seeing those, i wouldn't really categorize it as in trouble and let's say hypothetically, there's one or two republicans who can't stomach something about rfk jr.. some on the left wing are back hand for the reasons and possibly another strange bedfellow moment and going for vaccines.
