moments was donald trump himself. sources are telling us the president-elect who is in mar-a-lago right now apparently was on speaker phone with both reps the two hold-outs that voted against johnson right in those final hours after they voted against him, and we are told that he said this to them. "it be disrespectful to americans who voted in a historic presidential election to have the speaker's vote go to a second and third ballot" and it be disrespect full to me. he ended with this , and said we have a lot to do, let's get to it. apparently it worked. in an exclusive interview trump tells us a great honor to have helped this process has brought the gop conference closer together. now, johnson secured the gavel in the first round. not without a little drama though. we saw six republicans who refused to vote for him and three republicans who voted for somebody else but then again, members began huddling on the house floor and that's when that talk with trump happened.

there was a second conversation i'm told without trump. somebody in the room in that conversation told me that johnson promised these members he be more inclusive. it would not be a top-down conference and that good faith negotiators will work on these big bills like reconciliation. i'm told that johnson did not make any deals. here is what he said after getting the gavel. >> our people are asking for a thriving economy and a rebuilt middle class and strong borders and a strong military and we can deliver that. see , these objectives and these aims don't have an r or a d behind them. they have a usa. that's what we're about. >> [applause] reporter: a lot of happy folks right now that are celebrating with their families, their kids are here. grandkids but it's back to work next week on the trump agenda. liz: always great reporting thank you so much aishah hasnie good to see you. >> you too. >> we will act quickly and we will start by defending our nation's borders.

are now unified to do the trump agenda because congressman mike lawler told us he got just two years before the mid-terms to fix america. are they unified to get it done? >> we are and today is the glorious day. we are so happy. god has been merciful on us and on mike johnson. he's the right guy, like you said he's a decent guy. he will compromise and what we need to do, what the american public told us. the trump agenda. he won by the popular vote, so thank god we're going to start doing it starting monday. liz: okay so voters gave president trump a mandate for sweeping reform. can house lawmakers package all of president trump's reform in what he calls one big beautiful bill? the budget reconciliation bill. that means you could bypass senate democrats with just a 51 simple majority vote in the senate. can you get one bill done? >> we can, and we're going to be talking about that tomorrow. we're all going to get together into one room and we're going to

talk about what reconciliation is going to look like but reconciliation is basically two things. sealing the border and making the tax cuts permanent and i'm voting for the tax cuts, because the tax cuts and i have the numbers here. 70% of americans in the package that we have and in place right now that we're making less than 50,000, they made $5,000 more, and 6 million people were lifted out of poverty. that only happened in four years so we've got to make those tax cuts permanent and that is why we need reconciliation so we in the senate only have 51 or 52 votes and we can make it the law of the land. we are working on that and border. liz: you think all of the republicans will get that done, because you know, tax bills have a lot of give and take and pork barrel rolling in it to get what people want. can you get the tax cut? it's a $5 trillion tax hike if those trump tax cuts expire.

>> well they are on the books and like i said they helped the american people ever since then. they are going to now in 2025 they are going to, we need to make them permanent and i know that the new york delegation has an issue with some tax breaks that they want to put on the books, but i am sure, and this is the spirit that i can share with you. within the house gop members of the house of representatives, we know we have one mandate, which is to implement trump's policies. what he promised. what he told the american people he was going to do. we are his party, so we need to be siding with him and speeding this through the next two years so we can show the american people that they send us here for something. not to be just playing around and that's what we were fearing today but thank god it did not happen. one round, one speaker, is done. liz: okay so, it sounds like there was unity.

violations. fox news bryan llenas live with the latest. great to see you. reporter: liz, good to see you. good evening. judge is writing in his 20 page decision denying president-elect trump's motion to dismiss this falsified business record 34 felony account conviction. he did not dismiss this case. he said that because the conviction would not interfere in his estimation, with president-elect trump's ability to do his job in the executive branch. instead president-elect says he will sentence president-elect trump on january 10 just 10 days before inauguration day, but he says he will not sentence trump to jail time. instead, he's inclined to sentence trump to what's called an unconditional discharge which means trump would receive no punishment, no probation, no fine, no prison time, but

the conviction would still stand and he will have a chance to appeal this case. judge is writing "it seems proper at this juncture to make known the courts inclination to not impose a sentence of incarceration but one the people can see they no longer view as a recommendation" and as such, in balancing the aforementioned considerations in conjunction with the underlying concerns of the presidential immunity doctrine, a sentence of an unconditional discharge appears to be the most viable solution to ensure and allow the defendant to pursue his appellate options. president-elect trump spokesman said president trump must be allowed to continue the presidential transition process unobstructed by the remains of "this witch hunt" and trump spoke to fox news exclusively following this decision by judge merchan, and he said this is a totally conflicted judge doing the work

the landmark decision, by the supreme court. there are significant criminal procedure issues. the statute of limitations, the ability of taking a misdemeanor case, and magically transforming it into a felony. these types of issues have made this particular ruling and this particular case against the president so constitutionally infirm, this case shouldn't have gone on but it occurred precisely to have this headline. president found to be a felon. first time in american history. that's its only purpose and that's not the way the law is supposed to work. liz: this case feels like an asterisk. all of the other cases are gone

but judge merchsn claims this somehow doesn't violate the supreme court upholding president trump's immunity doctrine, plus it doesn't violate the presidential transition act, the supremacy clause, so now, it seems like the judge is trying to place himself above the supreme court. let's go through the constitutional violations. the jury in this case did not have to come to unanimous decision on whatever the underlying offense was. the state you served federal powers over campaign finance laws, there was a legal gag order plus the judge did not allow chair smith to testify, as you note, this is a case that dates back to 2006. it was a misdemeanor, books and records case. those 34 counts are each of the legal, excuse me, the bookkeeping entries for payments out the door for stormy daniels or whatever, but it was so jerry rigged and put together with masking tape and staples and glue to boost up a misdemeanor case and to

felonies that weren't really there. so for him to keep going with this before the inauguration, it seems like he's trying to embarrass president trump. >> well he is, and the problem here is if this really is going to have to go to the united states supreme court, what a shame that it will require a smackdown like that. i predict that even within the state of new york, this case is going to be dismissed. it best, at best the judge could have ordered retrial and then suspended that determination in light of the fact that the president was inaugurated, but the statute itself has been misused. everything you outline here, if he were in a criminal procedure class at our law school, he would get an f. the judge did this to be

in congress. house speaker mike johnson keeps his speaker gavel today so now, the democrats we're hearing reports they will ramp up their attack against elon musk and vivek ramaswamy and doge. the department of government efficiency claiming things like unspecified conflicts. joining us now fox news contributor liz peek. liz? didn't voters reject democrats here, particularly the far left because these are the same democrats who demanded the irs audit and track little $600 phone app spending by taxpayers, but doing nothing to stop the government wasting trillions and trillions of taxpayer dollars. >> liz, this doge effort, the effort to cut government waste is incredibly popular and democrats simply don't know what to do about it. their problem is that they assess the value of projects simply by how much money they can spend. they talk about biden being a consequential president not because he's accomplished

the chicago fed said that. san francisco fed researchers say that. former obama officials say that. you know, so, the other thing too is you make a good point that they are mistaking all this over-spending for some kind of achievement or accomplishment because now this is another story. republicans are moving to stop democrat spending for more irs audits or taxpayers. republicans just froze more than $20 billion in new spending for the irs. you know, liz, they initially wanted an extra 80 billion to the irs for audits cut to 60 billion and now irs official democrats are complaining this is not a good thing here. >> yeah. liz what they are saying is if they aren't given that extra money, $20 billion, they might not be able to uncover 140 million in tax fraud amongst wealthy businesses and americans. okay, so wait a minute. $20 billion to spend to root out $140 million in tax misbehavior?
