the warning just a few hours ago cutting u.s. economic growth forecasts by more than half over the next couple of months. and be it gets worse. both are warning that we are, quote, dangerously close to a recession. stu varney of the fox business network is here now with analysis. stu, what does this mean? >> okay. megyn, jpmorgan is saying that we've got a 40% chance of going into recession. now, follow this through a little bit. it doesn't just mean we're going to have high unemployment living with us for a long time to come, it also means -- dig deeply here -- it also means that our debt and deficit situation will get a whole lot worse. the government is assuming that we're going to grow 3, maybe 4%, and that would, indeed, shrink the deficit a little. jpmorgan saying hardly any growth at all. that would mean that the deficit would get even bigger than it is now. because less money comes into the treasury, more money goes
10:01 am
out in social services. now, if deficit gets bigger, that means we're in an even worse position with s&p and the ratings agencies because they downgraded because of our rotten debt situation. it also means that the president's jobs plan and that supercommittee have a lot more work to do to get the deficit down. a shrinking economy or a static economy means a much worse debt problem. megyn: the government is projecting 3-4% growth as a basis for what figures? >> okay. they say we're going to have 3 or 4% growth in the future, between 3 and 4%, that's what their projection is. based on that rate of growth, they say that our deficit will come down a little from this year's $1.65 trillion because a reasonable growth rate means a smaller deficit. that's been reversed. if jpmorgan's right and we're at a standstill or maybe going into a recession, you will not get a smaller deficit, you'll get a
10:02 am
bigger deficit -- megyn: how does the government come up with such different numbers from, you know, jpmorgan? >> well, they have to. they have to make these projections. that's what the government does. they've got various economic agencies which have to project into the future -- megyn: do they have a weight on the scale? i work for the obama administration, so i want to make the forecast more rosy in the an election year, or are these independent government economic analysts who are legitimately trying to tell us they think 3-4% growth? >> there is an element of politics right in there, but they've only got the figures and equations which they've got to work with. if treasury says, hey, look, this is going to be the spending, this, that and the other, they create the equation, that's the numbers they are given. they come up with a growth rate of 3 or 4%. they make assumptions that the stimulus plan would have worked, the extra spending would have worked, they make the assumption that it's going to be 3 or 4% growth. jpmorgan is saying, you're wrong. much less than that, much worse deficit. megyn: they're talking about 1%
10:03 am
growth in the fourth quarter. i mean, that is -- >> and a recession would be even worse. but that, of course, which would mean you'll be thrown into a deficit of way beyond $1.6 trillion. megyn: wow. it raises a lot of questions. stu varney, thank you. well, to add to that bad news, there are reports now of layoffs in the future for thousands of bank of america employees. the financial firm struggling under the weight of bad mortgage assets this year, preparing to cut an additional 3500 jobs. that's on top of more than 2,000 they've already cut to date. since the beginning of the year, the bank of america stock price has fallen from about $15 to about $7. one executive promising customers the bank will remain competitive and efficient while trying to manage its expenses. and take a look at this picture. these are the thousands of out of workmen and women who turned up yesterday to a job fair in atlanta. look at that line. just look at that. rook at these -- look at these

125% increase since boik came into office. what is their job in their job is to crush the manufacturing sector. increase energy prices and do things that are top down government micromanaged to encourage green energy. green energy is not going to bring this country out of a recession. it will put it deeper into a recession unless we get folks mining coal and drilling for gas to keep energy prices down and encourage the economic growth that's necessary. that's one example of literally hundreds of obama-care is the other. the a. uncertainty the business community is experiencing because of this huge cost around the corner is holding people back. megyn: this is a difficult question. i know you personally a little bit. and my i am preparing of you i'll share with the viewers is you are an incredibly nice guy, you are compassionate, you are caring, you look out for other people. when i talk to some of my friend who are gay and lesbian.
11:38 am
they don't understand that characterization of you because they think you have it in for gaze and lesbians because you are anti-gay marriage and you called it wrong and called it destructive of the family. i want to give you an opportunity to speak to those people to explain why they should not feel that way about you. >> i appreciate the opportunity. we have have a public policy difference about what the proper marriage laws should be in this country and what's from the best interest of society and not hate somebody or feel ill will towards anybody. as i said many times. i have friend who are gay, i accept them as they are. but i disagree with them vehemently about what tonight best interests of society with respect to our marriage laws and what we are going to teach our children? schools, what the impact of those marriage laws will be on our faith community and their ability to proclaim the truth as god laid it out in the bible. all those things are
11:39 am
ramifications after public policy debate where again i'm going to be stand and be joke sal about. but that doesn't mean that i dislike anybody or hate anybody because of their sexual orientation. i respect that decision, by also -- you have to respect me for feeling differently about trying to take that orientation and then to try to project an agenda onto the american public that is consistent with that. that's where i'll drought line and have a disagreement. but it's not personal. it's about policy. megyn: a lot of people are saying, well, santorum can't win the nomination. but he could be tagged as somebody's vp, as a running-mate. to that you say what? >> i'm not running for vice president. i believe i'm in the best position to win this nomination. and more importantly, to beat
11:40 am
boik to beat barak obama. we have what it takes to win his race and go up against barak obama. someone who has been a solid consistent conservative. as well as the moral cultural issues. we can energize our base and appeal to the middle which i have done successfully in pennsylvania in the past. megyn: rick santorum, thank you, sir. see you soon. we wanted to update on our critical onshine poll. a new report from a group of scientists is asking if global warming may race the risk of alien attacks. their report is called would contact with extraterrestials benefit or harm humanity. some suggest when they see how we treated the earth they may see us and a rise together

university and attack. 3% say we should increase efforts to curb the greenhouse gases. 19% suggest that we should develop weapons to kill the aliens first. but the vast majority are saying the scientists should ask it research on this issue and focus on how to create jobs. we could use some nasa brains on that issue. her adoptiveston completely out of control. so she turned to dr. phil for help. videotaping herself musting hot sauce into his mouth and force him into a cold shower as he screams. but is that criminal? in today's "kelly's court." just one phillips' colon health probiotic cap a day helps defends against occasional constipation, diarrhea,

megyn: "kelly's court" is back in session. cruel and unusual punishment. putting mom on the witness stand after she was exposed on national television. >> i opened his mouth. it had no effect. so we went to hot sauce.
11:45 am
we have been having a lot of problems. it will stay in the bathroom in the many handy when you night. when he gets a cold shower i'm at the end of my rope. >> you are to do as you are told. nothing has gone the the results that i want. i want him to obey and to understand the consequences of his choices. nothing i have done has worked. i would definitely say it's the biggest stress in my life. megyn: she is seen disciplining her adopted son, washing his mouth out with hot sauce, then forcing him into an ties cold shower. she had been pleading with dr. phil to help with her boy's behavior problems. that she was charged and she is having to deal with the threat of prison.
11:46 am
should she go there? let's ask our panel. mercedes? the definition of child abuse that we are dealing with in the relevant state is you place -- create a substantial risk of injury to the child, do you cruelly punish or physically injure the child. >> it doesn't qualify bus putting away all of the graphics and a lot of folk look at that video will be upset when they heard that child crying. but it's not done cruelly. you see the mother constantly talking to him. do you understand. you cannot tell a lie. you cannot do this. do you understand what the consequences are, over and over again. it's not like a mother who puts out her cigarettes into her child's back. here is a mother who obviously is at the end of her ropes. she tried to use other measures.
11:47 am
it hasn't worked. so she continues the punishment. but she has a dialogue with her child back and forth. megyn: the defense is the child was extremely unruly as a lot of kids who have been adopted from russia have had major behavioral problems. she said she tried other methods and they wouldn't work. though it looks weird to us. she says it was a form discipline, not child abuse. >> you said she was exposed. but she exposed herself, right? she made the videos during these course of punishment which that in and of itself is odd and sends sit off to a national television show as opposed to going in her community and finding an expert to deal with it. i think it was a close call for the prosecutor whether to go as far as a trial. i think it will be a close call for the jury because mercedes does make excellent points. she is trying to teach a lesson. but for a 7-year-old kid.
11:48 am
soap is one thing. that was a big thing. you put soap in your mouth. megyn: how is this so much different? >> hot sauce or soap in your mouth. soap in your mouth doesn't taste good. hot sauce burns. megyn: then she puts him in the cold shower. you can hear him screaming in the cold shower. the thing is, sometimes children do that. you can put a child in time out who would scream and scream. it doesn't mean there is physical injury. >> you will have viewers who say we know what that like. we understand a parent who can take on those measures. if you can't control your child in the home, how are they going behave in other settings. megyn: is this a slippery slope if you let the government
11:49 am
interfere in this behavioral correction, how far can they go? >> the cold shower is water. even reading the opening statements. it didn't say how long the kid was in the shower. if you are in the shower for 45 seconds or five minutes? was the water temperature 70 degrees or 80 degrees. those are big issues. and the jury will have a tough time here. but those cries and screams of the child will go a long way. megyn: one final word for our viewer. criminal charges for something like this may start us down a slippery slope. this mother could be convicted. it's possible. i for one remain unsure whether that is a good and justified thing. welcome your comments on it at kelly@foxnews.com.
