welcome to "america live," i'm megyn kelly. one headline reads republicans pulling off twin defeats if special elections in both states. first republican back turner taking a house seat held by democrats in new york since the 1920s. here is turner, the republican shortly after his stunning win. >> this is a historic race. we've been asked by the people of this district to send a and i hope they hear it loud and clear. we have been told this is a referendum, and we're ready to say, mr. president we are oning wrong track. i just want to be our guy and your voice, and i think we have

[applause] megyn then there is a nevada, a state that president obama narrowly won back in 2008. republican mark amaday taking the election from kate marshal and winning by a 22-point margin in a case that the old state was really watching. chris stirewalt is is with us. let's talk about what is happening in new york. this is from politico talking about democratic donorsnd strategists commiserated over obama calling the mood office. people feel afraid, disappointed, disgusted and hopeless, and one and on it goes, they believe the race was not so much about the democrat, but about president obama. >> reporter: right you heard from the republican, that's what they meant to do, they made it a

referendum on president obama. they made it a refe referendum on his policies against israel. it's something that the jewish american poll lacing doesn't like. it's something that certainly the israeli as don't like. they don't like the president's economic policies. they were trying to send a deliberate message to the white house that says, look, you cannot count ounce in 2012 and we want you to hear that right now. megyn megyn today they are giving a different message, it's no big deal, that seat is going to get eliminated any way. it's more about what a poor campaign weprin led . >> reporter: it sounds like what they said when martha coakley lost to could the brown in 2009 and the democratic senatorial

commit see said, oh, this is one race, she was a crummy canned day see what you dissatisfied democrats and democratic leaning independents saying i'm done with this. i'm going the other way here, and that is the problem. as they look to other states where voters like this. blue collar voters, jewish-american voters and others around the country are acting and giving their donation tph-s this crucial phase they've got to be worried skwraot president's policy with respect to israel turned out to be a very big issue in that race. we'll talk more about that in a short bit. thank you. both republican winners bob turner in new york and mark am ma day will join us from nevada at the top of our next hour.

he'll tell us what message he thinks the voters are trying to send to washington. another fox news alert. lawmakers demanding new answers from the white house today about a tax-payer fund -d loan gone bad. more than half a billion dollars approved for a solar panel manufacturer that was politically connected, and is w bankrupt. the f.b.i. raiding that company solyndra just a few days ago. here is how it all unfolded if you haven't been paying close attention to this. just a few weeks before president obama took office in january of 2009 the bush energy department says this loan, it's a biggie, needed morey view. about two months later a white house budget analyst wrote a warning email saying, quote, this deal is not ready for prime-time. but just days later on march 12th and 13th george kaiser paid a visit to the white house, at least his name is on the white house visitor logs, he has been identified as a major

investor in solyndra. you've got the government saying this deal is not ready for prime-time, and then george kaiser shows up on a visitor log. a week later the white house announces conditional approval for the loan. eye first loan for the obama administration. in may and june that same guy george kaiser visits the white house again. in august 200 the the white house asks the house of management and budget if it can speed along final approval of the loan. on december 3rd the deal is done. solyndra and the department of energy enter a financial agreement. fast forward to may of 2010. president obama comes out and tells the american people, quote, companies like solyndra are leading the way toward a brighter and more prosperous future. that brings us to exactly two weeks ago august 31st solyndra announces it is suspending operations and firing off, laying off 1100 workers. the f.b.i. raid comes a few days later. so what is the administration

saying now? our chief white house corresponden correspondent ed henry is live where this is getting a lot of attention. >> reporter: there is a house committee holding a big hearing on this. there are administration officials testifying. a lot of new questions raised at that hearing including a slew of emails in 2009 within this administration ahead of a talk that vice president biden gave in the fall of 2009 to this company solyndra around the time just after they had this white house had officially approved the loan, then a flurry of more emails ahead of president obama's visit in the spring of 2010 to the actual solyndra headquarters. you mentioned that the president went there and spoke. bottom line that jay carney a short time ago told the reporters on the record about all the emails, what the emails make clear there is an urgency to make a decision on a scheduling manner.

it is to schedule a mountains or put on an event. people were looking for answers on whether or not people could move forward, they mean move forward on scheduling, for example, the president's visit in 2010. you and i both know the big question moving forward is were these emails really about schedule asking or were there people on the receiving end? some of the bean counters within the government who are career officials and were deciding whether or not to move forward on the loan and then down the road whether or not to restructure the loan. did they take these emails saying, hey, look the president is going to be going to this company, are we moving forward on some of this money? did they sake that to mea that to mean a scheduling matter or to mean pressure to move forward on all of this. if you're a career level government official in the middle of all this getting emails from top people in the building behind me saying we really want the president to go there, that may lead to a feeling among the recipient of that email that, look, they want

the president to go there because they want the money. i've talked to white house officials that insist to me, look there was absolutely no political pressure here and so far the emails do not show political pressure but i think that is one of the issues moving forward whether the people on the receiving end felt there was pressure. megyn thank you, sir, i appreciate it. a massive search underway for a missing gasoline tanker, the truck stolen in warton maryland, it is packed with thousands of gallons of gasoline. nothing points to terrorism says the f.b.i. but they are not taking any chances given the recent terror alert. updates on them as we get them. new searches today for a utah mother who has been mission for nearly two years. susan powell vanished without a trace back in 2009. since then there's been numerous searches, a lot of finger pointing between family members and even claims that she allegedly had a sexual

relationship with her father-in-law. the father-in-law is the one making those claims. her family says it's ridiculous. today investigators are back combing a new section of the utah desert hoping to find any sign of the mother of two. trace gallagher has an update from our west coast newsroom. why this search, why now two years later, trace. >> reporter: that's the question, megyn because this search in the topaz mountains, 30 miles from where susan powell lived with her family. police won't tell us exactly what they are searching for. these dogs specialize in finding decomposed body. clearly the signal is they are searching for the remains of susan powell. this is near the area where josh powell says he took his two young sons camping, remember that, back in december of 09, in the subject freezing temperatures the night that susan power disappeared. police clearly believe they are acting on good information. listen to this. >> we think he was out here that night, we don't know, we just

really don't know. >> and he won't tell you. >> and he won't tell us that is correct. but the possibility of him being out here is definitely there, and that's why we're here. >> reporter: the times is very serious, josh lives with his father up in washington state, steve. and this whole thing came out, the police raided his home they went in there, they took out journals and property and that's when susan powell's father-in-law, josh's father, steve as you alluded to earlier said he had a sexually charged relationship with susan, that he was falling in love with her and he believed she was falling in love with him. the only thing josh would say about that is his wife was very sexual. the question is did information that came out of that raid lead them back to the utah desert? that's what we hope to find out in the days and hours to come, megyn. he's the only person, josh powell, by the way who is a person of interest in susan powell's disappearance.

megyn just a few hours agnew lee elected congressman bob turner received a congratulatory phone call from his democratic opponent david weibren. he beat him in a special election tuesday. in new yor new york city for the open seat of disgraced congressman anthony weiner. he is the first republican in 90 years. he joins me right here. congratulations to you. >> thank you, megyn, thanks to be here. megyn shocked? >> no. megyn why not? >> i expected to win.

megyn 90 years, not even shocked a little bit. megyn i liv i've lived in this district my hole life. i had high ear to the ground. i sensed the mood of the people and i'm not surprised. megyn the democrats are blaming this on a lot of things but we are hearing, it's all anthony weiner's fault. he turned off the district with his antics and sex thing he was doing and they didn't want to give the seat to another democrat. >> i think anthony weiner is history. i don't think he was even a factor in this case. megyn who was the factor. >> president obama loud and clear. megyn how so? >> the people in this district are really unhappy with his treatment of israel, it's a very large jewish district. they are very unhappy with jobs, the deficit, and our inability to return to prosperity, an

administration that is perceived antibusiness. there is enough to work on here. megyn you have democrats 3-1 in this district. there weren't enough of them still in president obama's camp to say i'm still going to do what i've done every election in my whole life, and that is vote blue? >> i think people are thinking, and the issues are clear, and they are clearer than party loyalties. this district has voted for republicans, foe voted for guiliani, they voted for bloomberg, and i think when the time is right, and the issues are clear, they'll cross party khraoeupbs. megyn why do you think this is a har bin skwrer of things to come in 2012. >> i think the country is on the wrong course badly, and the house has not provided the leadership or policies to correct it. people are going to vote, and vote against them, and they have. megyn when you go out in your district when you were campin

campaigning and you would talk to democrats, which you have to do. what would people say about president obama? what would they say, i voted to president obama but -- how would they explain the flip? >> they may not mention president obama, but the underlying issues of jobs and the economy and what was being done about it would resonate constantly, and the fact is there is no leadership in these areas, so -- megyn you're it. >> afraid so. megyn talk to me about israel. that became a big issue. the democrats put david weibrin out, he's an orthodox jew. it was sort of like trust me, i've got israel's back. but israel was a big issues in this. >> indeed it is. and mr. weprin said i will find

megyn: we are hearing about a controversial new plan being unveiled by michigan's governor. governor rick snyder a republican looking to tackle the issue of childhood obesity. directing doctors to monitor their young patient's weight and give the data to the state. we hear the childrens identity would remain anonymous. arkansas came under fire in 2002 when they passed a ru rule to

send parents information such as that. u.s. and nasa officials unveiling plans for the multibillion-dollar space launch system today. the program hopes to send space crews to astroids, mars and beyond with a new and improved rocket system. the only catch? we are only about 6 years and $35 billion away. trace gallagher in our west coast newsroom with more on that one, trace. >> reporter: not exactly to infiniti and along like buzz light year would say. yep it's $35 billion which is a boat load of money for people who say they can't afford to put any more shuttles up in the air. thinks the rendering of it. it looks like the saturn 5 rocket used to launch the apollo missions. if you look on the side it has two solid rocket boost sisters.

megyn: president obama, pushing his jobs bill at north carolina state university in raleigh, among other things, the president says his plan will cut taxes for businesses that raise the salaries of current workers.

natalie's holloway wants the missing teenager to be declared legally dead, he filed court request for that, but his mother, beth holloway plans to fight the effort. natalie vanished to a trip to aruba six years ago. >> children under age will no longer have -- under age 12 will no longer have to take off their shoes, they will avoid the patdown method for younger children as well. how about that? >> one of the top stories today, tough new questions for the white house about why it loaned a half billion dollars to a solar panel company that just went bankrupt a couple of weeks ago, laying off 1100 people. the fbi raiding solyndra a few days ago, looking for documents on where the money went and asking questions about whether it misled the government when it got that half a billion dollars worth of loans. in washington, lawmakers today are demanding new answers from the obama administration. these are live pictures of -- live pictures of a

hearing on capitol hill. white house memos have now turned up showing staffers inside the administration were warning that this company had money troubles an nonetheless, the loan was made. joining me now, monica crowley, radio talk show host and fox news contributor and alan coomes, host of the alan coomes radio show. okay, panel, today, there are now some ties to the white house on this. we've gotten some e-mails, abc news reported on these showing one, white house budget analyst writing in march of 2009, nine days before the administration formally announced the loan, quote, this deal is not ready for prime time, and just a couple of days before that is correct the chief of staff to the vice president wrote if you guys think this is a bad idea, i need to unwind the west wing quickly. nonetheless, they did give the loan and now the question is, why. should they have known this was not going to be a good deal. let me start with you ton monica. >> at the very tail end of the bush administration, this procedure had started under the bush administration, this company

wanted taxpayer-backed loans. the department of energy under president bush made a recommendation, they actually voted, a credit committee of the doe, actually voted not to go forward with this taxpayer loan to this company. megyn: my understanding is they didn't vote not to do it, they just urged caution. >> the recommendation was tread very carefully because this company is extremely shaky, we need to do more due diligence on this before we can give the go ahead to the taxpayer money, the the obama administration comes in, their omb people as you pointed out megyn were saying whoa, we need more time to go through this because before we commit taxpayer dough we got to make sure it's going to a company that is actually not going to collapse, we need more time on this. the vice president's office, in a number of other e-mails are saying look, the vice president is scheduled to speak at brand new solyndra facility in september '09, you have to get this done before he tkpwoerbgs now we're seeing e-mails saying okay, we got to give this the go ahead and it shows a lot of political influence,

a lot of leaning by this white house and this administration to go ahead with this loan. megyn: how about it alan? the argument in a nutshell is red flags were all over this and the detractors are saying that's because one of the big investors in solyndra was a buttonedler. >> it's also the walton family, big republican contributors in the same company and as ed henry reported as you point out, that it was a yellow flag, not a red flag at the end of the bush administration. the same committee three months later, the very same committee in the doe then approved it or said it's okay to go forward, the very same people, and they then, in fact, went forward with it. so -- >> megyn: why did they do that? because now, the energy department inspector general is criticizing the energy department saying you should have maintained the e-mails that disgus -- discussed how the winner of these loans, including this one, was selected, we should know exactly how you made this deal and that leaves open a question mark about whether the reason this company got this deal was -- >> well, there's been no

proof of that. that's the implication that the obama administration is pay for play. you got it mixed up with rick perry of texas. there's been no proofer that, no reason for that. and the reason we need an answer, biden wanted a photo op, but it was yes or no, we want to know the answer. megyn: i'm the logs show this guy, this buttonedler, who got together donations for president obama and the white house, was visiting the white house, and department of energy officials were sitting in on these board meetings at solyndra and the question is how could they not know. >> how does the white house benefit from this? if the implication is they did this to satisfy some group, i don't know how they benefit it *plt megyn: it seems to me the allegations were some sort of political payback or just negligence in not knowing. >> it may have been negligence but the sail caution came, the bush administration was pushing

forth initially, too, until that yellow light came up, but certainly there's no evidence -- >> this whole thing raises a bigger question, this is what happens when you have government activism in the private sector, when you've got the government going into the private sector and -- >> megyn: how does it create more jobs in the private sector as opposed to pub stphreubg. >> this was taking taxpayer money and pouring money in to it to where the bush administration and obama administration was saying wait, we shouldn't pump money into it and they did it, anyway. what they did was try to make a loser money and turn it into a winner and the taxpayers are out half a billion dollars. megyn: and apparently they needed more money after we gave them the $500 billion loan, then they needed more money and something like $75 billion more came in from preft investors and they allowed them to have private priority -- priority over us. >> some felt the company could be sustainable because the -- >> megyn: but get out of our way, we're the taxpayer. how do they get priority over us?

who would agree to that? >> you know, everybody thought -- >> the government. >> the government wants to really do something, as tom friedman points out, you've got to actually put taxes on coal and sustainable energy, and the right wing wants to stop this towards the move to green energy. that's exactly what they're trying to do. >> we used to have a free market in this country. we have had solar, we've had all the other alternative energies out there, they cannot survive without massive infusion from taxpayer dollars, and even after that, as we see with solyndra, they collapse. megyn: the demand is not there yet is the argument. >> we're paying too much for oil, coal, sustainable energiful only then will there be a demand. >> taxpayer propups of companies and industries that cannot survive on their own. >> megyn: we got to go. we may be out of this 500 billion bucks for now. >> unbelievable. megyn: alan, monica, thank

megyn: now to a sto expected to get a lot of attention in the next couple of weeks. a murder trial going on right now in the same courthouse where the casey anthony case just unfolded, millionaire bob ward isuse -- accused of killing his wife diane, she was shot five times in the face in the bedroom of their orlando mansion two years ago, 63-year-old ward told police he was trying to wrestle the gun away from his wife as she tried to commit suicide, but police didn't buy it. take a look at some of the bizarre twists in this case. >> on september 21st, 2009, diane ward was found shot to death in the master bedroom of the mansion she shared with her millionaire husband, bob ward, her death rocks the exclusive orlando neighborhood which golf grates tiger woods and arnold palmer once called home, police say diane suffered a gunshot wound to the face and died at the scene, in a 911 call bob made moments after the shooting police say

statements like these incriminate bob ward, quote, she's dead, she's done, i'm sorry, and it was an accident, the gun just went off. ward was arrested that night and taken to the police station where he called family and friends and told them about diane's death. including this call he made to diane's brother. >> it was diane's death. >> oh no. -- listen, diane is dead. >> no. >> and it's not real pretty right now and nobody knows about it but you. >> well, why? how did it happen? >> well, that's another story. but right now, their mother is dead. i probably can't tell you anything right now other than that she's dead. and it was an accident, and i will tell you more about it later. but you know, it was a very tragic accident. and other than that, all i

wish i could do was go -- [inaudible] >> myself in the head and go on. >> despite the 911 call, police say ward changed his story once they started interrogating him, telling investigators he was actually trying to stop diane from committing suicide when the gun went off. during the interrogation, detectives say ward was smiling and seemed to northbound a good mood, but was clearly also aware he was under suspicion. >> it's like a nightmare, but we probably need to go ahead. >> toxicologist tests showed diane had alcohol and powerful antidepressants in her system before her death. this sensational trial has made big headlines in orlando, not just because of the twists in the case but also because of ward's bizarre behavior. during a jailhouse meeting with his sister-in-law and daughter, ward can be seen dancing and laughing, even pretending to take off his shirt at one point, and then there are exchanges like this one: >> there's money in the account for you to get

kidnapper. arrested in 1998 for kidnapping four girls and taking them across state lines is now apparently trying to make amend by running for the school board. how is this possible? >> reporter: it many possible because the rules say all you have to do to run for school board is be 18 years old, be a u.s. citizen and not have a criminal record. she was a long-time teacher in northern california but she was distraught over what was happening up there. so she took a leave of absence. went to illinois and she said the same thing was going on in schools there. so to save those four girls she kidnapped them, tookhem across state lines, they were quickly recovered but she was not convicted. instead she was sent to a mental hospital. now 15 years later she is running for school board. listen to her. >> i made a mistake and i paid
