earnings. republicans are saying today that is not the right way to raise revenues. >> what it does, it adds further instability to our system, more uncertainty and punishes job creation and those people who create jobs. class warfare may make for good politics. but it makes for rotten economics. >> reporter: the president speaks tomorrow, he won't give specifics about the exact new rate he wants or how much it could bring. a look back shows he thinks 5.4% is fair that's the millionaire's surtax he pro -- he proposeed in '09. that didn't fly now he's trotting out his buddy warren buffet. something the president has been doing for quite a while now. >> right now, warren buffet pays a lower tax rate than his second. an -- than his secretary a outrage he has asked us to fix. we need a tax code where

everyone gets a fair shake. >> reporter: buffet did write a "new york times" on that some called stop coddling the super rich. now a super peace for the president's sales pitch. a pitch democrats think will have no problem winning over the american public. >> i wonder if john boehner knows what it sounds like when he continues to say the position of the republican party in america is you can't impose one more penny in taxes on the wealthiest people? i wonder if he understands how that sounds in ohio to working families who are struggling? >> reporr: this new minimum tax for millionaires will affect 450,000 people which is 0.3% of the 144 million file terse from 2010. >> shannon: thanks peter. campaigner in chief that's how the head of the rnc is characterizing the president.

do any of the gop candidates have a viable alternative? reince priebus joins us to break it down. chairman great to see you. >> thank you for having me. >> plenty of criticism for the president's job plans. we saw speaker boehner float some ideas. does the gop have room to criticize? >> this is sort of an interesting theme. sometimes people have asked me about that the reality is, the republicans that have been offering all the plans. the republicans you saw paul ryan that was on earlier, it was his program that really tackled the debt and deficit crisis head on. the 10 year unbelievable monstrosity that is facing our country in entitlements and debt. it was the republicans, all republicans in congress, except for that voted. it was the republicans that voted for cut, cap and balance. and what do we see from the democrats? speeches, pageantry. lectures from the president. they didn't pass a budget.

the democrats in 860 days. it is the republicans that making all the offers. in trade agreements, regulatory reform, lowering the business taxes so that job creators can bring more people under the payroll. i reject the premise of the question. but i understand why you ask. >> shannon: the speaker has talked about the fact there could be areas for compromise. he sounds like there are some places where both sigh come together. -- both sides can come together. heed is for a meeting with the president he didn't get that meeting. -- the speaker said tax increases were not okay. hoping the super committee working on finding economic plans doesn't go that route. we are hearing the president is going to roll out something people will consider big tax increase tomorrow. are the two sides, too combative to come to any compromise? >> interesting question. it is true that the speaker and leader cantor said if

there are areas that we can agree on, let's agree. less payroll tax issue the president rolled out, sure. if we can reduce or extent the deduction, that would work. then axelrod came on television and said the democrats aren't willing to compromise. it is a take it or leave it proposal. either you are for me or against me. that's what the president said. this sympathetic of -- this schtick of them wanting compromise that is not what they are after offering. they are offering a take it or leave i proposal. number two, as far as raising taxes, the only reason we've been having this debate is we are spending too much money. our problem is not that we don't have enough coming in, we are spending too much. taxing job creators is only going to make it more difficult to provide good paying jobs for the american people that hurting in this country that want get back to

work. >> shannon: there's a big debate this week, thursday night fox and google and florida republican party holding a debate. a lot has been made about the fact that sometimes the candidates in these debates feel like they are being pitted against each other. you need to see the differences among them so voters can make an informed decision. how dangerous do you think it is to have a very heated primary? do you think it makes the eventual nominee stronger? >> i think it makes the nominee stronger. i'm a big believer in -- before i became chairman, we had primaries up and down the ticket that produced scott walker, ron johnson who beat feingold. it want a walk in the park. these were serious primaries. i think it makes them stronger. i think it is part of the primary process in the end we are going support our nominee to make sure we save this country and make barack obama a one-term president.

we are going to make it happen. in question comes up a lot. hillary clinton, barack obama, they went at it all the way through the end of june. how did that work out? worked out well. >> shannon: fundraising, you had a very impressive august something that you don't usually see on a nonelection year. >> we are doing well. we've started out at the rnc, we know the story. but it started with us just trying to rebuild trust and credibility among our donors. get the party being functional and operation al. we've done that. we've built up a donor base that has confidence in the rnc. more importantly o donors and grassroots are starting to see we have to replace this president. we can beat this president. these love with the sound of his own voice but not with following through on his promises and the american people are ready to make a change. >> shannon: thank you. see you in orlando. >> we want to let you know the democratic congresswoman lynn

at work already on the ground at the airfield back here behind me pouring through this massive debris field that has been left. you can also get a better feel for what they are dealing with. take a look at these pictures. cameras were allowed into the accident site last night. folks were escorted in. you can see the damage. it looks really as if a bomb went off. there's a crater in the tarmac about three feet deep and eight feet wide. they estimate this plane was traveling about 400 miles-an-hour, as it plummeted to the earth. twisted metal and plane parts scattered over more than an acre. the ntsb says this particular plane had been modified to make it fly faster and make it more aero dynamic. on youtube the 74-year-old pilot said that his crew cut five feet off of each wing and shortened the back edge of the tail from 60 some odd ins to

30 some odd inches. now the feds looking into -- into whether this compromised the plane's safety. >> as part of this process the ntsb has been aided by a technical inspector with firsthand knowledge of these modified aircraft. he has facilitated access to some exemplar aircraft which has helped our investigators further understand the systems in these modified aircraft. >> reporter: this is an image that gives you chills. the pilot jimmy lee ward had this picture taken with the doomed plane, 24 hours before his ill-fated flight. his family was here from florida, watching the race and witnessed this whole accident. officials say more than 60 people were injured and treated at area hospitals in the wake of had disaster. 36 have been released. nine remain in critical condition. >> shannon: casey thank you.

we have breaking news. shooting in lakeland, florida has left one dead and two injured. authorities are telling us a man shot and killed one person at a home and gunned down two others at a church about a block away from that home. officials say it is not clear if a suspect has been taken into custody. no word on the extent of the surviving victims' injuries. we'll keep you updated on that story. the palestinians are pushing for full membership in the united nations at this year's meetings in new york. israeli netanyahu does not believe that is going to happen. steve centanni is live with more. >> reporter: last minute talks are underway aimed at preventing a showdown at the united nations with the u.s. finding itself in the uncomfortable possession of vetoing a palestinian effort to seek world recognition. a top palestinian official is hoping the u.s. will not follow through on its veto

officially fall. you are looking at more normal temperatures. right now temperatures for this time of year are normal. 65 will be today's high in new york city, 74 raleigh, north carolina. 60s across chicago and minneapolis. another story over the past months is severe drought across southern portions of the country including texas, oconomowoc, portions of louisiana. -- texas, oklahoma portions of louisiana. some of that rain will come in the courtroom of strong to severe storms, including dallas and eastern portions of oklahoma into southwestern parts of missouri. something we will keep an eye on throughout the day. a few showers and storms, nothing severe. large hail and damaging winds the main concern. rain across portions of louisiana, eastern texas and slow moving front continue heading east and towards the northeast.

border security requires around the clock answer along our southern border. some are warning 24 hours patrols are doing permanent damage to the environment there. is it possible to balance both concerns? here for a fair and balanced debate republican congressman rob bishop. welcome to you both. randy, let me start with you. what kind of damage do you say is being done because of border patrols and security? >> well, the efforts of the border security agencies to do their jobs on the border works better when they work with land managers on the ground to

do that job. they benefit from site specific knowledge. those land managers know the terrain better than anybody. in some cases that relationship doesn't work as well as it should. nay national wildlife refuge along arizona's border we see -- 8,000 milds -- miles of roads blazed through a wilderness area. it is a situation where in recent years the majority of those roads have been caused by the border patrol. they are driving 15, 20 miles north of the border. not on the border stopping people from coming into the united states and protecting that resource. they are driving around 15, 20 miles from the border. >> congressman s there a way to meet both of -- is there a way to meet both objectives? while also protecting the environment? >> there obviously. the argument that a few hundred border patrol agents are causing more damage than the hundreds of thousands of

illegals coming across the border, many of home are the drug cartels, human traffickers, they are starting the diversion area fires, leaving s of crash, -- cutting down endangered flora and fauna to use as road brocks. until we control the board we are not going to be to -- they need to be able to do their job. private property, the border patrol is not prohibited from doing their patrolling jobs. only on public property owned by the federal government. because of that -- >> i would disagree with that >> it is the law. because of that this is the avenue of choice by the bad guys trying to come in. and they are destroying the environment. the border patrol has to secure the borders first. >> shannon: randy? >> the american people don't trust the department of homeland security to operate outside of american law. q(resentative bishop's

approach, he wants to waive environmental protections. the people who live along the border deserve the same clean air and water that the rest of us benefit from as a result of those laws. >> shannon: how do you spoken to his allegation that people who are coming across the border aren't respecting the environment either? >> there's a lot of foot traffic. also 20,000 border patrol agents driving vehicles all over fragile desert landscapes. a lot of other border patrol activities do a lot of damage. homeland security constructed a wall on the border not only does it not work, but it has done a tremendous amount of damage to public and private property.ekñ millions in damage has been done through flooding and erosion. the reason is clear. because they constructed that wall outside of the purview of over sigh of legal over sigh. representative -- representative bishop still wants to extend that waiver of authority to 100 miles inland all over the united states.

investigators trying to figure out what caused that deadly plane crash in reno.

woolsey thank you for your time. >> thank you for having me. >> shannon: what is it about the president's plan that the right fit for you. is it a come pan piece or instead of what the president is proposing --? >> actually the cpc traveled the nation over the month of august and early september and talked to thousands of constituents. the president's plan is good. we just would make it bigger, if we had our way. we think we should go with the president's plan, 100%, not parts of it, not pieces of it. but the entire plan and invest in making it in america. bringing jobs back to america. and making those jobs right near america. so, we would have early on have had a much bigger, bolder and i would say braver jobs

bill. we support what the president proposed at the joint session. we will encourage that we don't want anything less than that. because we know this is a crisis. we need to deal with it right now, as an emergency. we need jobs immediately. certainly, infrastructure jobs answer. plan green jobs, absolutely necessary. and -- extending unemployment, the 9 9ers running out of unemployment they need that and the chronically unemployed who have to get back into the -- into the job market. we have to do that so middle america becomes who we know the united states to be. >> shannon: you mentioned several things that are controversial on capitol hill.

even democrats joining with some republicans on the hill who say the president's plan goes too far. after what was uncovered with solyndra this week, selling green jobs is going to be an uphill battle. how does the president pull together not only his own caucus, but get bipartisan support? >> well, i would suggest that all of us, not just the white house, not just the progressive democrats, but every single elected official listen to our constituency. i represent marin and sonoma counties. we have a 10% unemployment in sonoma county. marin is much better off. but, the number one outcry is we need jobs congresswoman. and we need them now. and we need them here in the united states of america. all the politics around this can get -- will get in the way. we need to make sure we listen

should the gop folks be careful about being too smug or gloating about this because we know that is a world of time in politics. >> it is a world of time in politics. on this book, i have known anita dunn forever and she has denied what is said in that book is what happened as have a number of people. i think when we talk about anger it is not just democrats. everybody is angry. people are scared out there. they don't know what their future will be or if their retirement will be there. people can't get a job. i was in the grocery store last sunday at home and three people came up to me, telling me one had been an unemployed engineer and hadn't been able to find a job for three years. one was a mother. they need help. none of us can give them the answers that they want to hear. we all have to start figuring it out. we have to get the best economic minds. stop saying this is a off the table and this is off the table and work together.

reduce the budget. what is the right tax policy. how do we fix america together? >> and when you look at capitol hill congress as a whole, both parties included their approval rating is at like 12%. americans are upset across the board. >> they are upset across the board and if you are that engineer out of work for two years and there are so many people across america. in california you have unemployment 12%. nevada 12%. double digits in many states. message of we are going to tax the wealthiest doesn't translate into this is how we create a job for you. now, that might be good politics and the economists can argue whether that is good economics. i don't think it is good economics but that is not a jobs plan and i think that the frustration is who is talking about putting us back to work and who is talking about how to come up with a proposal that allows the job creators to create more jobs and not just tax the people who are the job creators. and i think that is -- that frustration trickles down

have done over the last decade, we created 1 million jobs in the state of texas at the sim time american lost 2..5 million. >> that is all true and just since the great recession began at the end of 2007, only north dakota, alaska and the district of columbia have grown jobs a at rate faster than texas. indeed, texas accounts for nearly one quarter of all jobs added in america over the last year. >> 95% of all of the jobs that we have created have been above minimum wage. >> that is also true as is the fact that texas average hourly wage for private sector jobs stands at $21.95 good enough to rank 22-out of the regions studied by fox news. also true when you consider all of the jobs that existed in texas in 2010 not just those created over the last decade, the lonestar state ties with mississippi for dead last in the nation in seeing one tenth of its hourly work force earning at or below the minimum wage and improvement on that scar is slow.

some upholding the mandate, others striking it down. what is the best argument for the administration on upholding the individual mandate. >> the most important argument is that it is a feat of judicial activism to overturn an act of congress. it is surpriseing that we had conservatives who have attacked judicial activism, liberal judges, new interpretations of the constitution. the same conservatives arguing to use that kind of judicial activism against the affordable care act. and so i think the main argument that proponents have is that the commerce clause allows the federal government to regulate issues and the economic marketplace, healthcare, health insurance is in the economic marketplace and is a that is why the congress should absolutely -- the courts actually should absolutely find this constitutional and be conservative arctivists concern.

>> i have done a lot of cases at the supreme court of the united states where i challenged federal and state statutes when i think they are unconstitutional. it is did congress and the administration have the authority when the bill went in into effect and became law to pass a that you s the most ex-expansionive view of the commerce law. i hope they will make a determination that they overstepped their bounds. i think that is the argument. trying to cast this as a case of judicial activism. i litigate at the supreme court of the united states. i'm regularly challenging arenac counties of the state and the senate and the house when they back laws, the federal government. that is not judicial activism. that is a different scenario when the judges are creating the law or interpreting the way that is foreign to what the congress said. the constitutionality test has nothing to do with judicial activism. it has to do with is the court looking at the law and determining whether congress had the authority to pass the law in the first place. that has nothing to do with

presented its plan to create new jobs. america learned what a big job he has. how few jobs there really are even after his first shot at creating them. word from the labor department hit washington thursday that the number of people asking for unemployment benefits jumped last week to the highest level in three months. weekly applications rising by 11,000 to a seasonally adjusted 428,000. a bit of irony that the week included the labor day holiday. now, unwanted wh holidays are e norm these days for many more than the official 9.1% unemployment rate. yes, 14 million people are unmany ployed. but that is not all. those without a job have to fight for work with nearly 9 million more not counted as unemployed. part timers who want full-time work and get this, more than one in three have been out of work for a year or more. and this is not just on a national basis which is, of course, 9.1%.
