border patrol agent brian terry last year. guns linked to fast and furious were found at that scene. congressman issa suggesting today it was criminalç incompetence. >> the justice department oversaw a program that let weapons walk into the hands of the worst of the worst drug cartels. we have enough information to know they did it deliberately, with knowledge of who was receiving it. we want to know more with who authorized it and why? >> reporter: even though an investigation is underway attorney general holderç broke his silence on this scandal. he said he told the truth in may when he informed congress he only heard about the program for the first time a few weeks earlier. he says his critics have political motivations. he takes issue with the allegation that federal agents were accessories to murder. holder says such irresponsible and inflammatory rhetoric must beç repudiated this the strongs terms. those who of in the ranks of

hul has won the values summit presidential straw poll he pulled in 37% of the vote despite his success in several straw polls he repeatedly scores in single digits in the national polls. we spoke to him and he was pleased with how the event was going. >> all i do is deliver a message that i'veç been delivering for 35 years. i was very pleased it was well received today. i felt good. a lot of times i'm very critical of myself, because i see my flaws. today, i felt pretty good about the reception that i got. >> shannon: riding theç hermentum herman cain came in second with 23%. perry 8%, romney drew 4%.

for many it wasn't a question of if romney's faith would become an issue but when would it. it sparked a controversy this weekend. joining us to talk about that and more isç tony perkins president of the family research council. thanks for coming in today. >> thank you. good to be with us. >> shannon: first this controversy. job jeffress is a pastor he introduced perry he's not the his pastor, he did get approval from the campaign to him. ha'r made comments about mormonism as a cult. he clarified that today, to say he didn't mean it in the traditional sense of the word but theological cult that has sparked a lot of controversy. tell us what the perry campaign did and what they knew about this pastor? >> none of this was said from the platform this came in a sidebar that theç pastor had

with some reporters nobody knew that was going to be said. hit been recommended that he introduce the -- it had been recommended that he introduce rick perry and it was sent to the staff and they signed off. he's a well pastor this was an unfortunate comment made a sidebar conversation. not to gloss over the issue.ç clearly three logical differences between evangelicals and mormons that was not the purpose of this summit. this summit was pulled together values voters those focused encore value issues we are not building a church we are building a coalition to move the country back to the right road. >> shannon: this comes from the perry campaign the press secretary, heç said the governor doesn't agree with every issue with everyone he knows or supports his candidacy. he's running to get our economy back on track and create jobs. that will continue possibly to play out. >> you can't have a weekend

this big without controversy. >> shannon: let's talk about the straw poll. ron paul does well in strawç polls. when it comes to polling with potential voters it changes. tell us how your straw poll works? >> we had 3400 registered, 600 registered early saturday morning. we had a large crowd for ron paul after he spoke a lot dissipated. he's very good at organizing his vehicles to começ in and hear his speeches. this was a summit of values voters from across the country. the majority came undecided, wanting to hear the candidates. i think it is unfortunate that ron paul's campaign does this, they bring their folks in. these are people looking for information, just there for the weekend. not there just to hear one candidate vote and leave. that's whatç ron paul's people did. >> shannon: could they buy tickets?

>> everybody had to buy a ticket individually. the paul campaign tried to buy a pwhrbg early, we refused to sell blocs of tickets to the campaigns. i have to give them credit for being well-organized. and a strong following. i wouldn't write that campaign offç because. they are tapping into a lot of discontent that is out there with the direction of america. i think politicians in particular need to pay attention to it. business as usual is not good enough. >> shannon: he does have a campaign that resonates with a lot of people. is there room in this current environment to be talkingç about social issues during the campaign? >> the two are intuned. look at big expensive government, we'll never shrink the size or scope of government until we strength the american family that's the message of the value voters.

has said in his testimony before congruous, thus far. the white house has resisted calling for -- special council, do you think they will be persuaded? >> i think they have to. this is a free society and a republic whereç we respect the rule of law. nobody is above the law. eric holder is not above the law. president obama is not above the law. we don't have a king here. we need these people held accountable. that are there are people killed in mexico, 200 plus people. we've armed these terrorists in mexico that have worked to topple the mexican government. my deputies and officers across theç southwest could face the barrel of a gun that our own government, eric holder and the president, put into the hands of these criminals. this, we believe, they should be held to account for this. whoever approved this should be criminally held to account for this. >> shannon: how i that whoever

>> when the metal detectors were here yesterday they were in the area behind the house and the property. we didn't do the backyard. the family today recon sented. we are going to -- we are going to fry the backyard, because we haven't. >> julie: they are canvassing the neighborhood again, knocking on dj@5j, talking to neighbors who might have seen or heard anything monday night or tuesday morning. there are reports police questioned and collected a dna sample from a teenagedmj3h3 neighbor of the parents friday. authorities aren't commenting. that neighbor was at the hope the day lisa vanished and knew the access code to the family's garage. baby lisa's parents say she was snatched from herç crib monday night or early tuesday. the mother deborah plaid did says the police told her she failed a lie detector test and accused her of being involved. police aren't commenting on whether a test ever happened.

>> i'm sure that they want to vote on it when it is a full bill, not just a partial bill.ç we're stuck at just over 9% unemployment. to become unstuck, we have to be bold. we need a big, bold jobs bill. and the senate is working towards that end on the democratic side. and that's what we will support on the democratic side in the house. are a member of the congressional progressive caucus. do you want to see a measure that is bigger or different than what the president has proposed so far? >> i would have prefered much bigger 2 1/2 years ago. get the president's proposal enacted, immediately,ç we would make a big different. people would go back to work.

they would be customers for our small businesses. and they would pay taxes, which would offset our deficit. we have to get people back to work. and, they would improve our infrastpwraur that is -- infrastructure that is crumbling and our country. >> shanngn; they say the last couple of -- didn't work well they think this is another stimulus and not going to work if it passes what is your response? >> first of all the first stimulus did work. it just wasn't big enough. those of us, you mentioned the progressive caucus, we wanted it twice bigger which the president's row postalç now would double -- proposal now would double that stimulus and meet the needs of the severity of our unemployment problems in this country. it needed to be big. it worked, but we needed way more. and we -- now we need a big, bold jobs bill.

we need it now. one way to pay for that is bring our troops homeç from afghanistan. 10 year anniversary friday, we are spending 10 billion dollars a month in afghanistan. think what those 10 billion dollars could do to create jobs in the united states of america? >> shannon: quickly congresswoman, a lot of democrats have publicly criticized the president's plan for a number of reasons. do you see democrats getting together on the sameç page to get behind one proposal? >> i believe we will. as long as the proposal split in half. -- proposal isn't split in half. half tax breaks for small businesses and stopping the employment taxes putting them on hiatus for a while longer but it cannot be the only part of this jobs bill. if the -- actually creating jobs is not part of the jobs

bill, i think you will have a hard time getting it passed. >> shannon: congresswoman woolsey, of california, thanks for dropping in. >> thanks for having me. >> shannon: you may have seen the crosses along the highway in some stays that are meant to honor lawç enforcement officer who lost their -- lives in the line of duty in utah some sit on public property. some say that is unconstitutional, the crosses have got to go. this week we find fought supreme court takes up this case. joining us to talk about it is utah's attorney general who has asked the court to take the case mr. attorney general thanks for joining us. >> my pleasure.ç >> shannon: i know these crosses are privately funded through a group that wants to recognize law enforcement officers who have died in the line of duty. some sit on public land that seems to be the problem for this atheist group that started this lawsuit in 2005. how do you spoken to their concerns about this being on public land? >> it is also on public land

and the 10th circuit coreç has ruled incorrectly, we believe, putting the highway patrol symbol on the cross, even on private land that is unauthorized mixing of church and state. the supreme court has ruled, even spoken about crosses honoring troopers and law enforcement officers killed in the line of duty, you can use, under our constitution, religious imagery if it is for a secularç purpose in this case everybody knows when they see a white across on the side of the road it means somebody died there when you have a trooper symbol on it is a message that a law enforcement officer died at that spot. >> shannon: over the last couple of years, a number of cases in the supreme court are similar. they've had a lot of pronouncements about religious displays on public grounds. with thoseç rulings in mine, do you think the court will take -- in mind, do you think the court will take the case and what did you think is your chance of success? >> if he look one day and bring it back like they did

able to take advantage. brenda buttner is here to explain what is going on. hi, brenda. >> hey, shannon. mortgage rates at all time lows. if you refinance you can likely save quite a chunk of change on your mortgage. the average rate on a 30 year fixed fell to well below 4%. the lowest rate ever. for a 15 year fixed close to 3%, also a record. few people will be able to rsvp yes to the rate either because their credit rating is low or their homes are underwater, they just don't have enough equity and most banks now are getting a lot more strict and reire 10 or 20% equity to refinance. as for help from the government, reports are forget about it. the federal government is sending back a half billion of its billion dollars mortgage

relief effort. only 12,000 people ultimately were helped. only a 10th of the applicants even qualified for the grants and interest free loans. bureaucratic problems plagued this program from the start. its rollout delayed for months. many would argue that is not such a bad thing. perhaps the problem is that government has had too much a role in the housing market. what it needs to do instead is get out of the way and let the very painful foreclosure process take place so that prices can finally bottom and slowly start recovering again. now, low rates have done very little to help the housing slump. if you don't have enough cash or home equity to get a modification or you are just too scared of risk in this market to buy you don't take advantage of even record rates. others have already refinanced because the average rate has been below 5% for a lot of ths last year and you aren't ready

>> shannon: the week ahead promises a battle between the administration and congressional republicans and some democrats still over president obama's jobs bill. this as the latest jobs numbers show very slow growth. former labor department chief economist joins us now with her take.

thanks so much for coming in today. >> great to be with you, shannon. >> shannon: talk about the fact that unemployment remain is above 9%. held steady at 9.1%. didn't see an increase but not a decrease. what do you make of where we are right now? >> certainly very discouraging to the 14 million unemployed americans looking for jobs and the broader measure of unemployment which includes workers working part time who want full-time jobs. that went from 16.2% to 16.5%. there were more workers employed part time who want full-time jobs. >> shannon: let's also talk about job creation. looks like a bright spot in this. 103,000 jobs created over the last month but you say we have to look behind the numbers. >> we do and part of the 103 is 45,000 verizon workers who came back to jobs after a strike. the new jobs creatingion including the verizon workers just around 48,000.

although any positive job creation is good. >> shannon: we are all looking for positive job creation signs. talk about where we are in terms of a double dip recession. where do we stand right now with the possibility of going there? >> well, it looks like third quarter growth was probably around 2.5% so we are probably not in a recession right now. the possibility does exist of moving into a recession at a later stage. and what we need to do right now is focus on how to create jobs and the regulations that we have right now that are impeding job creation. and there is the new employer penalty with the new healthcare law that takes effect in 2014 that if you have more than 49 workers you have to pay $2,000 per worker per year if you don't have the right kind of health insurance. moving from 49 workers to 50 workers would cost an employer $40,000 a year because the first 30 workers are exempt from the penalty and that is a big disincentive.

if you are 40 workers right now you might be saying i'm going to hire another nine but not going to hire another ten. >> shannon: how do you respond to those that say when you criticize the regulations in washington right now you are jet sizing what is keeping people safe and their food safe and environment safe and making sure that they have health insurance. how do you balance those interests on business? >> you know, it as great question because i was on capitol hill on thursday and there was a staffer saying to me and i won't say who he is. he said yes, i realize more people will be unemployed because of the new healthcare law but at least they will have health insurance. they are better off with health insurance and no job than a job and no health insurance and i think that is the wrong way of look at it because everybody has access to healthcare now in america. maybe in you are between health insurance programs you go to the emergency room and we need to, of course, fix our health insurance system so everybody has access to better health insurance. but the way to do it is not by penalizing employers and making

and where it is built. a process that took us about 28 years. we compare that to f.d.r., 45 years concept to completion. we are excited that we are here. we raised $117 million. we still need to raise another 3 million today's close off the campaign but we are confident we will get there. >> shannon: you are close. as with anything that is put on the mall or put here in washington there are always criticisms and folks who wanted it this way or that way. there was criticism about a quote that is on the memorial paraphrased from dr. king's remarks. do you feel like that is all settled now and soothed and fixed. >> don't know if it is all settled yet but the secretary of interior and myself we were over there the other day and looked at it and we agreed that we will revisit is after the dedication. we want the celebratory moment and then we will look at it after the dedication. >> shannon: we get millions of visitors here in d.c. every year. what is the message you hope
