that. based on the election of 2010. and the promises made. but the 6 committee dems wouldn't move. would not agree to restructure the tax code to raise revenue. they simply demanded 1 trillion in new taxes. think about that the golf the super committee was to cut 1.2 trillion in spending over 10 years. a pittance. and the whole thing is deraltd over a tax increase? the u.s.a. owes 15 trillion plus. and the democratic not willing to curtail spending. simpson bowles wanted 12.2. mr. obama ignored that what we have is a citing president who does not want to cut back, it seems. just today the nation spent another $4 billion it doesn't have. just today. in 2012, the president and the democrats will put forth that rich americans, and corporate greed heads are responsible for the economic mess, including the massive debt and sadly millions of americans will buy that. failing to understand that another four years of wild spending will pretty much doom

the country. talking points isn't a partisan. i think you know that i recognize the republic party is in disarray. divide between the moderates who will compromise and zealots who will not. the republicans do have an advantage. every poll shows the americans have lost confidence in mr. obama's economic leadership and if the republic candidate can show a plan of fiscal responsibility, and ward off the class warfare attacks, he will win. it will be nasty getting to next november. that's the memo. now for the top story tonight. president obama already campaigning in new hampshire where he challenged congress to expand the payroll tax cut. >> so congress has a very simple choice next week. when push comes to shove, are you willing to fight as hard for working families as you are for the wealthiest americans? what's it going to be? that's the choice. >> bill: joining us now from austin, texas, fox news analyst carl rove. is it really the choice?

is that really the choice that congress has between protecting the tax cuts in place now, which are about 35% for people like me, the 1 percenters or expanding the payroll tax cut? is that a choice? can't you do both? >> well, you could do both. let's are be clear about. this the president earlier this year with bipartisan support got an agreement that we would roll back part of the social security payroll tax this year thereby reducing the revenues that go into the social security by about $175 billion and havening the day when it goes broke. now he is asking for us again to do it for next year. if the congress does do it they need to offset this by reductions in spending, otherwise we are simply going to do. >> bill: that's right. >> and make social security less solve solvent. >> bill: i don't understand. this i'm not being disingenuous on any level at

all. certainly president obama knows that the super committee failed, that the spending $4 billion a day now that we don't have continues. that we could get downgraded and do you think we are going to get downgraded next week or the week after? because if that happens the stock market goes down another 500 to 1,000 points. certainly knows. that he is right on the cliff. is he not? >> yeah. well, yeah. here is what he is counting on. if you take a look at the latest quinnipiac poll they said who do you blame for the failure of the super committee. obama manned at democrats 38, republicans in congress 44. the president hopes the people blame republicans more and more. i think this is a mistake. you see another question recently asked. do you approve or disprove of president obama's ability to deal with congress? in may it was -- they approved by a 49% to 44 disapprove. today it is 38 844 -- him

versus republicans in congress. is he diminishing people's confidence in him as a leader. look, as a president, the most powerful asset you have is the vision of you as a strong leader. the president somatically this year gone about stripping away confidence as a strong leader. >> bill: why, in your opinion, didn't president obama give an address to the nation and say we got to cut the deficit down. we have got to cut the debt down. and i want $4 trillion in cuts made over whatever period of time. 10 years or whatever. and here's where i would suggest that we cut. why didn't the man do that? why hasn't he done that? >> because this is all about politics and has been all year long. the president had the ability to do that -- look, he had two years in which he had super majorities in the congress in which he could have restrained spending and did something to reform entitlements and make our fiscal position better and he wasted those two years.

he had simpson bowls last fall, a year ago this past year. and he appointed the commission. by part son in nature. they issued a cut $4 trillion he dismissed it. in january he said republic congressman paul ryan h serious entitlement. >> we know the facts the people who follow know the facts. >> he is more interested in getting reelected than he is confronting the problems that confront us. >> bill: the economy is so bad and the debt is so high, how does he think he is going to get reelected from that? i know. >> by creating a strategy. >> bill: blame the others, i got it. >> yeah. >> bill: what if we get another downgrade next week and the market is down 500 points which is certainly possible. >> it is possible. i think that's unlikely. one good thing going for him is that there was a back stop in this measure. they are going to cut through sequestrations across the top. but, look, here is the point. the point is that he has made a determination he he can't get reelected because people

approve of what he has done on the economy or what he has done on health care and he has got to disqualify the republic candidate whoever he or she is. part of the way to do that is to run against the republic house of representatives and pretend that a, he is not the president and responsible for things and b there is not a democratic senate. i don't think it's going to work. i think, in fact, he has made a big mistake starting a year ago this month when he decided this was going to be all about politics in 2011. and not being about being president. >> bill: last question. do you think that he wants to bring down the national debt at 15 trillion? do you think that the man wants to bring it down? >> no. i think he wants to raise taxes and make government permanently bigger. and as a result, is he looking for a way to maneuver in all of this. you pointed it out. they wanted a trillion dollars in additional revenue at the same time that there was supposedly cutting $1.2 trillion in spending. that simply guaranteed them the ability to spend more

>> bill: a 17-year-old high school student at central mountain high in mill hall, pennsylvania. apparently fellow students are blaming him for penn state coach joe paterno getting fired and now the student had to be taken out of school. joining us now to analyze attorneys kimberly guilfoyle and lis wiehl. why is this kid being persecuted. >> because he is the first boy, the first victim that came forward andaid that jerry sandusky had been molesting him. >> bill: how do the kids in the high school know that if it's a grand jury secret deal. >> you know things get out. people talk. fingers being pointed. here is probably why. some of those kids saw him with sandusky over the years. don't forget this is several

years. >> bill: each one of the accusers, 17-year-old boy. and then got around the high school and what were they doing to him? >> taunting him. threatening him verbally. as far as we know, nothing physical happened but a lot of verbal assault to the point where the mom had to pull him out. this is a kid, a 17-year-old boy in the middle of a senior year in high school. she had to pull him out. >> is he already that mat advertised enough. the alleged abuse acts against him 11 and 12 years of age over a two year period of time. acts alleged in the indictment very offensive in terms of what was adding to have happened to him. the abuse was pervasive as well and continuous course over the two years. >> bill: is the school culpable here. >> the school is culpable. they have the failure to act here is what is alleged because the fact they did not prevent. >> bill: that is the law in pennsylvania. >> in pennsylvania. and federally speaking so there is a number of means available for these parents. they can sue the school district. there has been historically a large number of cases that we were able to find where

here is what i believe. he doesn't need to do that you know me, i have been around the block. and, also, he is not doing an ad about anybody in the field running against him right now. i'm presidential. i'm on top. i deal only with the president himself with obama toe to toe. it shows disdain for the others who have been nipping at his leg one at a time in sequence. in the end it's been stewardship. it's about competence. it's about running the economy. that's his strong suit. that's what he is going to run on. we as youd in obama care because he knows on the ideological front that's the one area where obama is extremely weak. you cannot even imagine obama ever mentioning this was his -- which is his signature legislative achievement. he would never even dare to mention it in an ad. i think it's smart in both ways. stewardship and ideology. >> bill: you said romney is on top but he really not.

gingrich has passed him as herman cain did a few weeks ago as rick perry did a few weeks before that he has got to deal now, mitt romney with newt gingrich who is a better debater than he is. and i assume that, you know, mr. gingrich is thinking about one guy and one guy only and that's romney. >> no. romney doesn't have to deal with him yet. on that list you have to add bachmann and trump. romney first waits to see whether gravity will bring this last pretender down. and as we have discussed, newt has a lot of baggage. i'm not talking about the personal stuff. but ideological, look, what's the weakness of romney running in iowa and new hampshire, elsewhere. that he has changed his opinions on lots of stuff, important stuff that conservatives care about. well, it's equally true of newt. so, let's -- he is not going to do anything about newt until he waits to see whether he will come down from his own unforced errors. if he doesn't, which means

everybody involved needs to apologize because that kind of slander cannot stand. the person who said it would have to apologize. the person who let it go by without challenge would have to apologize. and the network. some executive at the network would have to come forward and apologize. because. that kind of accusation is important. but when a celebrity makes a dopey comment as celebrities have a tendency to do on a silly little cable tv show, that's not important. >> bill: it doesn't rise to what you are saying. wait a minute. let me challenge that let me challenge that. i don't care what they say about me. my problem in this country isn't with people who watch me every night. it's with people who don't watch me and don't know and hear third hand from people like that. that's a bit of a problem. but since we are the dominant number one program. not much of one. but what if i'm not famous and

what if i'm just a doctor or a lawyer or, you know, an iron worker a blue collar worker and my name comes up in a conversation and somebody says well, that person did this or said. this and it's flat out false. headline news, bernie, knows this is flat out false. they know it. >> right. >> bill: they basically said, you know what? we don't care what she said. we don't care. >> so that means there are no rules over there. >> right. in a better world, somebody -- in a better world where everything is corrected that's incorrect, there would be a media culpa and somebody would come forward and say we got that wrong, we didn't know, we're sorry. the difference of taking a shot at you you come back the next day on a cable program. >> bill: you bet. >> that has a thousand times the audience of the other show and you slap down everybody involved, that sort of the end of it. if they ever do something

really nasty to a working guy, a carpenter, somebody who works on a railroad, some woman who is a secretary or a school teacher, you know, the rules of libel apply to those people in a different way than they apply to people like you and me. and that person can take action. >> bill: if that actress and miss behar and by the way miss behar's show has been cancelled but it hadn't h. nothing to do with this. she didn't get very good ratings. >> it's a shame. >> bill: if they were discussing a civilian, north somebody who was famous that say both of them had a business dealing with or both of them had a run-in with or a car accident, a car accident, and they -- this person did f, -- x, y, you believe that person could take them into a court of law and sue them. the person would have to show damages which isn't easy to do in the court of public opinion. >> no, you are right. you are absolutely right. and a the fact of the matter is, and this is something that

we all have to understand. that in the real world, sometimes people get away with crummy things. i mean, there isn't a solution to everything. >> bill: no, but there should be rules. there should be rules of behavior. >> there should be rules but they are not -- they are not tv rules. if you are telling me that a civilian who has no actual damages except that they have been slimed on tv. there should be rules, yeah, there should be rules that the legislature passes. not that the tv cable association passes. >> bill: i disagree. on this program, if a guest says something that is untrue on this program, i will correct it as soon as we know it's untrue. and i think all the networks should have that rule in place. you have to do that. now, i have got a minute left on this. >> go ahead. >> did you know that ellen barkin asked me out once? >> bill: that is a frightening thought to consider. >> i was in her trailer at the time and she said get out. so that happened.

>> bill: goldberg. fbi data, 2010, hate crimes against jews, 10 times as many as hate crimes against muslims in the u.s.a. you are not going to hear that report on many news programs. you are not going to hear it? >> right. because a story line developed after 9/11. and the story line was basically that muslim americans are under attack. now, it wasn't true. there was some isolated cases. but even the "new york times" ran a story that said there was a torrent of vandalism against muslim americans. you would think there was an epidemic. but the fbi statistic that's made reference to. >> bill: very small. >> far greater among jews. but that doesn't fit the story line. didn't even fit the story line in the occupy wall street story where there were plenty of examples of anti-semitism. >> bill: they didn't report those. i just want to give the facts. >> muslim-americans are seen as underdogs and liberals in the media root for underdogs and that's why that story took off. >> bill: violence against

this is still an unstable situation. because your two frontrunners, gingrich and romney both have great difficulty getting the votes of tea party people and romney because of his religion and his position on health care and gingrich because of some of the stuff he has done on global warming and climate change and the personal stuff. and the -- therefore, the tea party evangelicals who are a very large portion of the vote haven't voted yet. >> bill: in iowa, you are talking about in iowa? >> well, all over the country. iowa more than new hampshire, but all over the place. and the thing is that they started off with bachmann and then they went to perry. and then they went to cain and now they really don't know what they are doing. i believe that the final race has got to feature romney, most likely gingrich, and one of those other candidates, most likely cain but possibly

perry, possibly even bachmann. because those voters have to have somewhere to go. sometimes we forget that this is divisional play. this isn't all the teams compete in the top three or the playoffs. there is the establishment economic division. they are nominating romney. the reagan conservatives. they are nominating gingrich. and the evangelize and tea evangelical and tea party division they don't have a candidate yet. we need to see who wins that division. >> bill: herman cain got hurt down in the poll can he make a come back. >> i think he has been hurt by three things. obviously the sex harassment stuff but also gingrich's rise, which he helped cause and then is suffering from. but also that the last debates have been basically about foreign policy and national security and he shines when they are discussing economic policy. he needs one ever those debates to be on that.
