>> pop-up kind? >> absolutely beautiful. >> so anyway, there's our christmas tree ready for the christmas season. >> and let's get right to your headlines for "fox & friends" and a fox news alert. 34 nato trucks loaded with fuel and supplies for u.s. troops in afghanistan now burning in pakistan. they were destroyed by militants who fired rockets at a trucking terment natural. no reports of injuries. pakistan closed its borders refusing to let nato trucks through after an american air strike accidentally left 24 pakistani troops dead. students at virginia tech holding a candlelight vigil last night after a deadly shooting five years after the massacre on campus that left 33 people dead. a police officer was gunned down while making a routine traffic stop. the 39-year-old was an army veteran and a father of five. the shooter reportedly came out of nowhere and ambushed him before turning the gun on himself. his identity and motive is unknown at this time. it took just six minutes after the shooting to alert students what was happening. back in 2007, as you recall, the

response time was two hours. texas governor rick perry and minnesota congresswoman michelle bachmann the latest republican presidential candidates to decline an invitation to donald trump's debate in iowa. so far, there's only two people that will take part in this debate, newt gingrich and rick santorum. debate is set for december 27th. president obama celebrating hanukkah at the white house two weeks early. he got a head start on the jewish holiday because he will be on vacation maybe in hawaii when hanukkah actually starts on december 20th. hanukkah to christmas now. here's a cool look at the making of the capitol christmas tree. >> this time lapse video shows the tree being hoisted up to workers putting up the lights, to house speaker john boehner flipping the switch. >> five, four, three, two, one!

>> right. these are -- they asked republican voters, who do you like for president? and as you can see, newt gingrich has a little more than a third of the vote. mitt romney a little less than a quarter. ron paul at 12%. and rick perry at 8% as well. this is -- this depicts the surge that mr. newt has had over the last couple of weeks. >> it also shows herman cain's people have gone to ron paul and newt gingrich. >> interesting because they're two totally different candidates. idea that they wouldtin s w would romney and gingrich do against president obama? this is actually the wrong poll. who will actually win? let's stick with this one. this is staggering to me. >> why? >> look at that. this is what perspective voters, registered voters think will win the 2012 election, 44% say president obama will win. 16% say newt gingrich will win. 15% say mitt romney.

is anyone else stunned at this result right now? >> you know what i do? i add all three. i add other republicans romney and gingrich and take that number, i believe it's 37 and then -- and you could even put the unsure, ok, leave that out and then it's a lot closer. >> because democrats -- >> i was thinking about it, yeah. >> democrats know who they're going to vote for and republicans still have that whole great big menu of people and when it comes to -- and gretchen was talking about this. when you do the head to head where you take the president of the united states and you run them against romney and newt gingrich, the results are like this. let's start with mitt romney and the president are within the margin of error. it's 3%. and you can see the president is 44%. mitt romney 42%. romney has been ahead. they've done, you know, they kind of played tag over the last couple of months. >> what's amazing is gingrich is surging everywhere, even in new hampshire even though he's trailing still, but when it comes to going against president obama, it is -- it is mitt romney within the margin of

error and it's newt that's six points away. >> when it comes to independents interestingly enough, the president beats romney by one but the president beats newt gingrich by five. and about a quarter of all the independents are still undecided at this point. >> ok. so now the stage is set. does it appear that it will be newt or mitt? well, if you're mitt romney, you got to come up with a way to try to gain back the lead so now he's going to some big name targets. speaking of targets -- it's talent, yeah. jim talent, i was using the word target anyway. he was a target yesterday. jim talent. it says target in the prompter. jim talent, john sununu, a former politician, they targeted gingrich yesterday. >> the speaker is running at a reliable and trusted conservative leader. and what we're here to say with reluctance but clearly, he's not

a reliable and conservative leader because he's not a reliable or trustworthy leader. >> the off the cuff comment, for example, that gingrich throws out on occasion is a reflection of the off the cuff thinking that he goes through to deal with issues. that's not what you want in the commander and chief. >> then you've got, for instance, tom corbin who, of course, is the senator from oklahoma. he says that newt gingrich -- he's worked with newt gingrich. he said he's the last person i'd vote for as president of the united states. senator lindsay graham says newt could be historic if he has "matured as a person" and is, for lack of a better word, calmed down. that is the closest thing, peggy noonan writes in "the wall street journal" today, that you can come to a compliment from anybody who has ever worked with -- >> but all that matters is the voters and i want to point that out, brian, is that newt has said after seeing these attacks i'm going to stay positive. my strategy is to stay positive

and i just wonder how the voters -- let us know. e-mail us or tweet me this morning, how do you feel about the campaign strategies? does it work when the other candidate is negative? or does it work when the other candidate says they're going to be positive? >> well, i'll tell you what, newt gingrich, it's easy when you're up in ohio and substantially in florida and south carolina to say i'm not going to attack back. if those numbers start closing, more republicans start standing up saying i work with newt and he's not my guy and i know he's not your guy. mitt romney said one thing directly yesterday and pointed out how critical he was and how wrong he felt it was for newt gingrich to come out and call paul ryan's attempt to restructure medicare and medicaid a right wing socialist project. he went after him a little bit there. for the most part, governor christie and others are the ones doing the attacking. >> president obama has adopted an appeasement strategy. he said this a couple of days

ago to the republican jewish coalition in washington. he said this president appears more generous to our enemies than he is to our friends. well, obviously, that really struck a nerve with the president of the united states because yesterday at that snapy press conference he had over in the briefing room, he fired back directly at republicans but specifically at mr. romney's comments about appeasement. >> ask usama bin laden and the 22 out of 30 top al-qaida leaders who have been taken off the field whether i engage in appeasement. or whoever is left out there, ask them about that. >> the president has a point with regard to taking out terrorists. he has adopted many of the bush policy, quite frankly. >> we don't catch them anymore. >> they kill them with drones. some argue that the president

doesn't want to bring them to gitmo because he doesn't want trials there although they're continuing there. i think what mitt romney and the other candidates are talking about is his policy for iran. his policy for israel. these types of relationships that they sense appeasement. >> it's all about the re-election. when you look, you know, the president can't really say i really fixed the economy because he really hasn't fixed the economy but he can say going forward, i've had some success there. what is he trying to do? trying to nip it in the bud. in particular, nip it in the mitt. >> the big question will be will republicans see that as vulnerable or tough on afghanistan or pakistan? he came up with his own plan to exit both of those wars on his own and he's already campaigning on it. >> but most republicans have already given the credit to the president of the united states for taking out bin laden. >> let's talk about herman cain. he disappeared for a week, it seems like a month and he appeared last night with sean hannity to explain the reasons why he really dropped out. it's all about family.

>> boiled down to two words. family first. because of the false accusations and the media continues, not everybody but some, they continue to stand and stand and stand and restand. it never went away. we also knew that because somebody was so determined that to knock me out of this race, but they're probably going to be some more down the road. >> who do you think is doing it? >> i don't know who is doing it. i think it could be coming from both sides of the aisle. >> well, they're probably -- if there are more accusations coming, it would only happen if he continues to put himself out on the national stage like if he's going to -- if somebody wants him to run one of the, you know, departments or something like that. the president chooses to do that. i don't know if anybody else is going to attack him if he doesn't continue to be on the national stage. >> i'll tell you what, if someone wrongly accused me, i'd take legal action. he discussed that last night and he'll consider all options and

i say that's good. some would disagree. >> maybe not. the president might do a recess appointment that would put this guy in power for one year. let's move on to jon corzine, former democratic governor and former senator from the state of new jersey. he read his statement on capitol hill yesterday and basically said i don't know where $1.2 billion is. >> that's left everybody absolutely incredulous. how could you lose $1.2 billion or not account for $1.2 billion? people have just -- just amazed at this. >> here's a little snippet of the former governor. >> i know i had no intention to ever authorize the transfer of segregated moneys. >> so the answer is you don't know whether you did or not. >> i certainly couldn't confirm based on what i have available to me today. but i know what my intentions are. >> over a billion dollars just went poof. he can't figure out where it is. and a lot of farmers across the

"doesn't the u.s. army -- i want to get this right. doesn't the u.s. army give to their soldiers, don't their

families send them yuletide goodies. aren't they paid enough what they want. it it should be doled out to people that really need it. that's only part of it. walker went on to rip republicans asking why they're the ones supporting hapless veterans. it's outraged so many people including our guest, joining us now as the new media director for the american legion and u.s. army veteran. you thought this was a joke at first, right? >> yeah, i actually had to look a couple of times. i thought this guy is not just stuck on stupid, he's encased in it. >> he said you have enough money, go buy your own cookies and buy your own blankets. >> he's under the mistaken impression that there's a target and wal-mart on every afghanistan corner. that's not the case. even above and beyond that, it's want really getting the items that are in the care packages as much as it is the intent of the sender. when you receive that, you know, it makes you feel good and there's a lot of our soldiers over there who don't have the

support family network that some of them have and that's why organizations like the american legion, soldiers angels, books for soldiers and other groups are there to make sure that none of these soldiers go without packages, particularly during the christmas season. >> you were deployed before, mark, what does it mean? >> it means a lot to get -- to get packages, you know, when you're in bosnia or afghanistan like i was, there are times when you have, you know, a lot of time on your hands with noing to do. so getting packages and reading letters from young school kids or getting a little bit of food instead of an mre is a very special thing for you. >> now, two kinds of groups are contacting you, i understand, groups that send out packages and other people who are involved somehow affiliated with iowa statend are embarrassed. >> absolutely. this guy's approval rating is about the same as lebron james in cleveland. the iowa state alumni and students are just up in arms. and i really think it's a shame

that it brings discredit on the school. it's much like the suffolk law professor that did this a couple of weeks ago, the first person i heard from was a suffolk law alumni who said please don't hold this against our school. i want to be very clear, it's not the iowa state community that's the problem. it's this one, you know, knuckle head who said some very ill advised things, i would say. >> that knucklehead, his name is thomas walker. we want to get him on and see if he wants to expand this on or take you on and here's what we got in response from the iowa state president. please understand that mr. walker's opinions do not in any way represent iowa state university and as a military veteran myself, i strongly disagree with his comments. i do, however, respect every individual's right to freedom of speech which is so highly valued in our nation and we have an opportunity, too, to evaluate that freedom of speech, don't we, mark? >> yeah, we absolutely do. and demonstrably what he says is true. it still doesn't exonerate this guy from the things -- certainly

threats of lawsuit from religious groups that wanted more displays than just a christmas tree in their public places, boca raton is going to ban christmas trees and menorahs from their public spaces. >> they said they're tired of playing referee and they admit it's just a select few people that complained and complained and complained and complained and complained and complained. and this is what's happening now all across the country. it's the threat of lawsuits, folks. that's what it's all about. cities can't afford it. they don't want to put up with it. and now they're just admitted it. the problem is it's affecting not just christmas, now hanukkah loses out on it, too. now they'll have nothing. if you want your kids to see any display, get them out of the car this year. >> no festivus either, no pole. >> i got a pole in my house. >> the mayor says this, we do still conduct business on a daily basis. the disruption, frankly, was too much and that's when they're trying to get things done and

same clothes found at a discarded backpack near the second body. but just like you said, what we don't know is the i.d. of the alleged gunman and also a motive. how and why and if he knows 39-year-old derek krause. he was a policeman found dead on campus, a retired army vet and a father of five. he joined the force just months after that deadly 2007 massacre. and what students tell us is that the initial shock waves yesterday were just as frightening. take a listen. >> as soon as i saw his face, i started crying because like i obviously knew it's not going to be good. and then when the other officers started yelling his name to try to get him to like wake up or gain consciousness, that's when it really hit me. >> last night, there was a vigil with about 150 students. there will also be a vigil tonight. final exams were supposed to begin today.

ear! >> he leaned over and said something to me. but i don't really think she's going to be in it. >> let's talk politics, something more tame. the fox news elves have been calling on the polls and they asked a whole bunch of people who they like for president of the united states. let's take a look. amongst republican voters, who do you like? well, newt gingrich by over a third. mitt romney by about a quarter. paul at 12 and perry at 8 at this point. margin of error, as you can see is 3 and that's important when you look at how the top candidates on the republican side stand up against the president of the united states. >> and look at, you got the cain people who went to ron paul and newt gingrich. gingrich at 23% and now has 36%. so he doesn't budge. >> steady. >> stayed in those low 20's. yeah, very steady but has never really peeked above that. and many people argue that's because people out there in the voting world are looking for the

other candidate, the anti-mitt one. how will it all stack up if they were to go against president obama? it's very interesting because actually mitt romney then does better against president obama. this is all voters. president obama 44% and mitt romney 42%. now, how does he do against newt gingrich? president obama 46%. newt gingrich 40%. >> romney has got himself an argument. you might be better in the republican poll but i'm right now the more viable general election candidate and that's within the margin of error. >> who do people think will be the president of the united states win in 2012? well, 44% and keep in mind, this is republicans, democrats, independents, members of the bullmoose party and what not, the president of the united states comes out on top. obviously, he's going to be the democrats nominee. meanwhile, it's still a food fight on the republican side with gingrich and romney pretty much in -- exactly right. >> i was still stunned by that

number. i mean, even though you did the math for me, brian, 15%, 16%, that's still 31%, if you add them up together, i mean, maybe you need to add up all the republicans and what they would have received and then see what the number is against president obama but that's a staggering difference, surprising. >> that's perception of who will be -- >> by the way, steve, karl rove will be coming up in about a half-hour to expand on these polls. he also wrote an interesting "wall street journal" look at newt gingrich. >> just one other and there are a bunch of republicans who have worked with newt gingrich in the past and they've come out and they've bad mouthed him. it's interesting when you look at the poll of the number of congressional members who are endorsing the top candidates on the republican side, newt has got six so far who have come out and said yep, he's my man. he's got six. mitt romney has 50 so far. he's doing better in that derby. >> he is. but the interesting caveat to that, do endorsements matter and congress' approval level is below 13% right now.

woman's lungs and she was hospitalized for five days afterwards. police are not budging on this one. standing by the officer saying proper procedures were followed. >> all right, meanwhile, let's bring in karl rove who joins us via the miracle of satellite technology. where are you today? >> i'm on the treasured coast of florida and as you can see, it's sunny here and we're not cold. we're not cold. >> all right. let's talk a little bit about "the wall street journal" that was a little cold when you talked about how newt gingrich while he may be surging in the polls, his organization is in disarray and in fact, you talked a little bit about a couple of states where he's -- he's not doing well, he's not going to be on the ballot. >> well, he's going to be -- he's not going to be on the ballot in missouri. now, look, my column caused some controversy which the gingrich campaign takes -- disagrees with. he failed to get on the ballot in missouri for a beauty contest, a primary in march.

and his campaign says well, we're not -- we deliberately decided not to compete there because it doesn't produce any delegates. well, the iowa caucuses don't produce any delegates either and he's participating there. if you're the frontrunner, remember rudy giuliani? i'm not going to participate until we get to florida. if you're the frontrunner, you're stuck participating everywhere and i thought it was a mistake for them not to attempt to get on the missouri ballot. i also said that they were -- that they did not get on the ohio ballot. now, they're going to eventually get on the ohio ballot. they took umbrage with this and said we filed a list of delegates and signatures. the secretary of state in ohio says two candidates fully complied with the current law and the gingrich campaign is not one of them. this again will be rendered mute because there's a new law in effect and they're going to reopen filing at that point. finally, i pointed out in new hampshire, he didn't file a full slate of delegates and alternates. the secretary of state said

file 24 delegates, 24 alternates. the gingrich campaign says look, there are only going -- their delegates are going to be cut in half. all we needed to file is 12. they haven't been cut in half yet and the secretary of state instructed them to file 24 of each. they filed 14 delegates and 13 alternates. they could have come up with eight more names for delegates and nine more names for alternates. his organization is struggling to catch up with where he is in the polls. that's the main point. >> right. so karl, the whole thing is if they put you into the campaign where a guy is nowhere and now he's everywhere. if i put you there with your experience, how long would it take you, do you think, to ramp up and get the presence in all these states? >> well, it depends on the amount of preparation. what i think is if somebody was not in charge of saying, look, what do we need to do? what are these timelines and let's get ahead of them. there's a couple more timelines where they'll have to collect in one state, it's due in two days,

i think it is, they have to collect nearly 11,000 qualified signatures which means they probably need to have 16,000, 17,000 signatures in order to qualify and we'll see if that happens. >> all right. right now, there's an op ed out there that says that for a former member of congress, actually, who says that romney maybe out in six weeks of this race. a former republican out of new york says the bottom will drop out of romney's remaining system in the granite state as newt surges there meaning new hampshire. then a few weeks later, newt wins new hampshire. the polls have newt crushing mitt in south carolina and florida will reflect the end of romney and romney's remaining support will sink like a stone. your comment? >> interesting thesis and we'll see if it's borne out. it depends on five things happening. one, that newt wins iowa which today, he leads in the polls by about 12. he's likely to win iowa which is only 25 days away but the question then will be expectations. how big is his win? is it close to what he got in the polls and if it's not,

people will start to say he's not performing as well as he said. the second thing is, is it assumes that iowa affects new hampshire. if you win iowa, you win new hampshire. that hasn't happened in an open race for the presidency in history. iowa does its thing. new hampshire does its thing. now, it also assumes that south carolina is not affected by whoever wins new hampshire and i've had experience with this. we were leading in 2000 in south carolina before the new hampshire primary and after bush was upset in new hampshire by mccain, mccain took the lead in south carolina by six points in a matter of days. a finally, it assumes that florida, that newt just wins florida. this is a big, expensive state. and one advantage that romney does have over gingrich is he's got resources. he's going to have 10, you know, probably 10 or 12 or 15 million more in his campaign war chest to spend than does gingrich. and his super pac, it's rumored to have over $30 million in its account. and as a result, they're going so have a lot of money to spend

and florida will be affected by television ads and spending. >> no kidding. big question is are people impacted by endorsements from their lawmakers. right now, when you look at that, you know, members of congress who have worked with newt gingrich, we're talking this morning about he's had some core endorsements like tom coburn saying newt gingrich is the last person i'd vote for as president of the united states. >> congressman peter king as well, does that matter? >> well, it only matters to the extent that it affects the people who follow them and that it gives, you know, credibility to an underlying concern about speaker gingrich. i think outside of the georgia delegation, speaker gingrich was from georgia, i think there's only one sitting member of congress to endorse him from outside the georgia delegation so this is a problem for him. >> mitt romney has 55 endorsements. >> karl, does it matter because look at congress' approval rating. 80% of americans disapprove of congress. only 12% approve. so are people listening right now to members of congress when

one day after that dinner yesterday, he told a visiting affiliate reporter in town from indiana that campaigning is not on the top of his to do list. he said, quote, my priority is right now putting people back to work. there is going to be plenty of time for campaigning. i don't know who the republican candidate is going to be, so we'll make a whole bunch of political decisions well into next year, much closer to the election. you might not know who their presidential nominee will be, but it does look like president obama has repubcan leaders from congress on his radar, blasting them yesterday just before the senate blocked two bills that would have each extended the payroll tax cut. >> so when i hear the speaker or the senate republican leader wanting to dicker, wanting to see what can they extract from us in order to get this done, my response to them is, just do the

seriously throughout our years growing up and when i found out about the rockettes -- we're from canada. we don't see the rockettes perform that often except on tv. but when i found out that i would have the opportunity to audition, it was just like a dream come true. i wasn't the most prepared for the audition, but it ended up working out. >> gretchen: it's so wonderful because the show i unbelievable. if you're traveling to new york, you should definitely see this around the christmas season. and when i saw it thanksgiving day, i was wondering, how many times they come back. you've been doing it how many years? >> seventh season. >> gretchen: the other two decided you would follow in her foot steps. how did it happen? >> as soon as i saw kristen performing with the rockettes her first season, i knew that was something that i wanted to do and it took me a couple of tries. i auditioned three times before i was cast. and finally it worked out for me last season and this is my second year and i've enjoyed every second of it.

>> gretchen: allison, you are the younger sister from the twins. what did your dad say when you said, hey, me, too? >> he thought oh, boy. no, when he found out that all of us had been cast in the show, he was extremely excited and same with our mom, very proud of us. >> gretchen: what is the regiment? so many people are enamored with how you do the leg kicks and you seem to be in such great shape. when you audition, do you have to do those kicks? what happens? >> audition process is very tedious. we come in and -- well, first of all, there are hundreds of ladies lined up around radio city to get into the audition and the first thing is you get measured and you learn several different tap and jazz combinations and at the very end of the audition day -- at the end of the call back actually is when they teach you the kick combination, so you're really exhausted and that's when they ask you to perform the high kicks. >> gretchen: how many shows per day do you do? >> we can perform up to five shows a day.

>> gretchen: wow. five shows a day. but there are actually two different teams of rockettes, right? >> yes. >> gretchen: how is it that work? >> there is two casts of rockettes. we call them the blue and gold cast. and kristen and i are in the followed cast and i'm in the blue cast. so we split the shows because each week there is about 32 shows at radio city. so we split the shows. >> gretchen: does it ever get monotonous? >> i love every minute of it. i don't think that you can walk on to that stage and strike up your first pose and not enjoy the feeling of being there. >> gretchen: a lot of other women and probably men are thinking issues wow. do they ever have to do any other workouts because they're up there getting all that exercise. do you work out op the side? >> not during the christmas season so much. we like to take dance class and work out, do pilates, yoga. but during the christmas spectacular -- in the show we have eight costume changes.

catch was inbounds, which would have forced overtime and therefore the giants would have definitely won. >> gretchen: it sounds like a political matchup this which is going on between mitt romney and newt gingrich, the gloves -- kind of coming off, at least from the romney point of view. what do you make of it? >> well, he's behind, that's what candidates do when they're behind and they're running for president of the united states. i don't think there is anything wrong with it. the only question, is it going to work or not? but you're right. he has this ad that i know you've been talk being in which romney talks about -- doesn't mention ne, but talks about the fact that he's been married to the same woman for 42 years and he makes commitments and if people want to contrast that to newt gingrich, obviously that's fully intended by the romney campaign. he's also had his surrogates go after gingrich hard and again, it's fair game. they're running for president. >> brian: how long, chris, can newt gingrich stick by the mantra of, i will not attack, i will not attack my opponents?

>> i don't think he's got it in him and i'm not sure it's necessarily the right thing. i understand there is a history in iowa. i think it was in 2004, dean and gephardt went after each other very hard. kerry sort of stayed above the fray and he ended up winning. so it can end up being a mistake to go after each other, particularly in iowa where they don't like rough politics. for example, when we had the fox debate, clearly some on the stage for the last time before iowa will want to go after gingrich at least and it will be interesting to see whether he says, that's fine, let them say what they want. i don't think so. >> steve: if somebody wants to make a final blaze of glory, they got to do it then or forever hold their peace. chris, regarding the family man ad called leader where he talks about how mitt romney is so steady, fox news asked this question: would you vote for a qualified presidential candidate who had an extramarital affair?

64% said yes. about a quarter said no. 7% said depends. what does that say regarding -- and there have been some surrogates out who have said, you know, newt gingrich has been married three times and that says a lot about his character. >> well, some people will read that and say america doesn't care. i look at the 26% and say that that's -- what you really want to look at t doesn't mean that therefore they're going to vote for newt gingrich. but the 26% means they won't if they're going to follow up on what they said in the polls. so those are just votes not available. i don't think that's particularly good news for newt gingrich 'cause it means that slice of the pie is not available. >> brian: on the 18th, you're going to sit down with mitt romney, his first national fox morning network show interview. that will be great. but this weekend will be big, too. >> this weekend it will be big. next weekend, i think this is partially a response to the fact that gingrich soared past him in the polls. romney is going to do his first

sunday talk show in almost two years. this sunday we're going to have rick perry and what a strange, wild adventure it's been for him. the fact is when he got in the race in august, he was up in the polls. he was the front runner. obviously did poorly in the debates and has dropped down into single digits. but he is making, as they say in texas, hold em, he is all in in iowa. he's spending millions of dollars in tv commercials there, especially emphasizing his faith, reaching out to the evangelicals when make up more than half of the republican voters there. >> gretchen: in a big way. reached out to them. remember, he raised $15 million in like a split second when he first came into the race and he was at the top of the heap. so he has a lot of that dough to spend and he's pretty much going o maybe spend most of it there because it might be his last fighting chance. >> brian: it's like from you that soup book. >> steve: that was his wife's book. >> gretchen: which by the way, i use on a weekly basis, chris.

investigate allegations of police misconduct in the treatment of occupy wall street protesters. in particular what happened right there. new york democrat jerry claims recordings and videotape at the scene of the rallies warrants a probe into accusations that the new york police department used excessive force against the demonstrators. is that possible? let's talk to judge jeanine, the host of ""justice." good morning to you. >> good morning. >> steve: you buy that? >> well, i certainly tonight think it's something to make a federal case out of. what you've got is organized chaos at zuccotti park. there's a court order. the mayor makes a decision after two months that he's going to move these guys out, and now they're saying hey, look, you violated our civil rights and our first amendment right to peaceably assemble and to voice our frustration. >> steve: is it true? >> no! it's not true at all! so this is what happens. they tell them you have to leave. they ask them to leave and then

they require them to leave. they're breaking through some of the police barricades. they don't want to leave and one of the complaints that he makes has to do with the brooklyn bridge. what the mayor said in response is, look, you can walk across the brooklyn bridge like everybody else. thousands of new yorkers do it every day, but you can't block traffic. just because you want to protest doesn't mean that you can block traffic. we've got kids going to school. we've got women who are naked. people defacating on the street, on cop cars. businesses trying to survive and these people are convinced that the nypd is trying to violate their first amendment rights. that's hogwash. and by the way, i was in washington yesterday. i sat behind eric holder in the fast and furious hearings. the last thing this guy needs is another investigation. he still can't figure out how 2,000 guns got across the border. >> steve: one of the other allegations from nadler was some sort of illegal surveillance of these people. people were in a public park

essentially breaking the law. so if the cops are watching them, big deal. i don't think that's an infringement. >> of course it's not an infringement and the bottom line is the police also have to protect themselves from -- we've got these protesters who are spitting at them, throwing bottles at them and by the way, they allege that nypd closed the air space so they couldn't send up helicopters and tape what was going on. that's hogwash, again, the faa closes the air space and nypd didn't and can't. >> steve: the police department did respond, spokesperson says this about the allegations. police officers showed professionalism and restraint in response to protesters. many of whom fought and resisted arrest and some who threw batteries and glass, who spit in police officers' faces and who threw liquids in their eyes. so did they get what they had coming to them? >> i don't think they really got that much. i think new york city has been very hospitable. remember, we are in a bad economy right now. we're spend ago fortune trying to sustain the peaceableness of their so-called protest. and at the end of the day, you
