samaritanspurse.org. i will reported back. reverend, you are a good man. that is all the time. greta is next. see you tomorrow night. >> greta: tonight donald trump drops out of his own debate and he is dishing out the blame. >> republicans were very concerned i would run as an independent. that is their concern. that is their problem. you would have had a real debate. it would have a debate on important issues. >> greta: what is his next move? he is here. and the plot thickens. >> i never gave instructions to misuse customer funds or at ms global. >> greta: billion dollars vanished in thin air. the senator is trying to get to the bottom of it.
7:01 pm
a senator goes on the record but first there is no doubt in his mind, newt gingrich says this. >> they try to knock you down. we work very hard to be front runners. why are they picking on me now that i am the front-runner. >> greta: just how close are the numbers? we have news out of iowa. a new poll shows big changes, congressman ron paul is closing in on the speaker. it gingrich's lead has been shaved to one point. he still leads by a wide margin. politicalnalyst joins us. how is it to be the front-runner sort of. >> they have lasted a few weeks. they started to sink.
7:02 pm
one wonders if this one poll, it's one of only three polls that is showing this suggests that mr. gingrich's position is slipping. >> greta: it shows how confusing this is. you take this poll that came out where 22% and 21% for the pal. national poll newt gingrich, "wall street journal," nbc news, 40%, romney at 23% and way down at the bottom is paul is down at 9%. >> think we have reached in the stage where the national polls really don't matter. it's a series of state by stated races. you have to win them one at a time or show well enough to get delegates to keep going. newt has built a lead in iowa. he appeared he was doing better in iowa than he was nationally. if this poll is right, two
7:03 pm
others that don't show that and average is 10 or 11. so he has a meaningful lead out there, but if something is happening. ron paul, colleague brett baier, says the air waves and ron paul ads against gingrich are constant. this may begin to take a toll on the speaker. his record is extensive and target. >> greta: you think the des moines register that is the big paper in the state, the newspaper says there is evangelicals that is hitting the road for bachmann. then two pastors calling gingrich an empty suit with a broken zipper. >> my feeling is evangelical christians will be more forgiving of gingrich because of this con verge go catholicism.
7:04 pm
he has asked for forgiveness. that is meaningful to evangelicals but there is lot out there that is subject of attack. if he begins to stumble. i think gingrich perhaps any other candidate need to win iowa. he needs something that would really establish his footing in the race. that would be source of additional momentum going into the states to come. >> greta: and new hampshire, one of the main papers says romney country, speaker gingrich was there and had deafening applause. you don't expect that in new hampshire. >> there are conservatives a lot of conservatives in new hampshire. gingrich can stir a conservative audience. he has been a conservative leader over the years. he has claim on the loyalties of
7:05 pm
people in new hampshire. mitt romney has campaigned hard up there. he is next-door neighbor and well known and he has strength in new hampshire. his lead has begun to decline. i think romney looks very vulnerable in new hampshire. it would help him to do well in iowa. newt gingrich has said this himself. if gingrich wins in iowa, that may hurt him in new hampshire. >> greta: what if game, with the polls so close, this particular poll, ron paul, one point behind speaker gingrich. how does the field change if ron paul takes iowa? >> i don't think you can rule out the possibility because gingrich doesn't have the momentum going into new hampshire which would help him in that state. >> it's hard for me to say where ron paul goes in. iowa may be one of his very best states.
7:06 pm
if gingrich finishes like a strong second to surprise of ron paul, it may work like four years ago huckabee won iowa. he had his moment. so it's hard to know what effect it would be. it would be a grea relief to mitt romney if ron paul knocked gingrich off in iowa. romney's standing in iowa is sinking and if he loses badly there, that would take some of the luster from him and make it harder. >> greta: and virtually every candidate, governor romney hasn't had a surge. what does that mean? >> it means, he has some weakness. he has had this core strength 20-25%. now, the numbers are under that. that has to be a concern. it doesn't seem people are
7:07 pm
deserting him. i think he has the machinery and money to make a long race are of this. >> greta: we'll see what happens. thank you. $1.2 billion of customer money vanishes, no one seems to know anything. jon corzine was on the hot seat at a senate hearing that he insists that he told anyone there to misuse funds. and the cfo and coo told conscious essentially the same -- don't look at me. >> if i were to ask any of you to think of any way or provide an example of how $1.2 billion of customer funds could be transferred and disappear without any laws being violated? given the hypothetical scenario of how it could happen with
7:08 pm
existing regulations? in anyone want to take a stab of that. >> i never directed anyone at ms global to misuse customer funds. >> i do not recall participation in any conversation about the use of customer funds. >> i did not authorize approval of any transfers of customer funds for broker or dealer. >> stunning accusation against jon corzine. a financial executive says he knows more about the use of customer money. >> they also participated in a phone call with senator ms global employees wherein one employee indicated that mr. corzine knew about the loans it made for the customer segregated accounts.
7:09 pm
>> greta: so finding out the truth. >> good evening. >> the hypothetical question you asked. three panelists, if there is any way any laws broken. there were six seconds of silence and then five seconds. did it scare you? >> it was really pretty stunning. dead silence in response to the question. i think it gets to the broader issue in all this. how could a billion dollars, more than a billion dollars just disappear into thin air unless a law was violated. >> greta: if i 'make a five dollar trade there is a transaction. everything has a fingerprint in the digital age. how is it remotely possible? >> i don't think it is. it doesn't pass the smell test.
7:10 pm
they were very trained. they provided the same eanlsz when they were testifying in the house of representatives. you showed the clip from terry duffy, chicago mercantile exchange. that was the smoking gun. that suggested they know something. there is more there than meets the eye. there is an investigation. you've got the justice department and f.b.i. involved. sec is interested in this. hopefully whether when it's concluded we'll know more about this. clearly there is a lot more. >> greta: the ceo, the cfo, the coo, three top guys. $1.2 billion, it doesn't seem quite a big deal. it is huge. do think have no explanation? >> they didn't. is the thing that is absolutely
7:11 pm
infuriating when you try to get these answers. $1.2 billion. you the money can't disappear like that. their responses, they don't know where it is, there is investigation underway but clearly between wednesday and friday when this occurred and the company went into collapse, something very untoward happen. >> greta: and it looks like activity the last couple of days when they knew the jig was up and there was a lot of activity then. it was like a bad vegas bet and they went to segregated accounts and try to establish themselves. >> that is what terry duffy they used customer segregated funds to make a loan to a european affiliate. clearly these funds which are supposed to be off-limits to them, that got breached. there is no or explanation for
7:12 pm
this. >> greta: when you use somebody else's money, there is fancy code words, frankly it's stealing. when you use somebody else's money without permission. >> there is very little explanation it would appear. until we get the investigation and completed and we have a better idea where it all went. i think you are someone out there, somebody in america today you are wondering what the heck is going on out there. a little bit interesting to me because jon corzine is somebody, too, that the administration has looked to, joe biden says she smartest on the economy. president said he helped write the stimulus bill. this is someone in this administration places a lot of confidence. >> you do have a duty, a fiduciary duty. i don't know. i don't have my records.
7:13 pm
is it awkward having an ex-colleague sitting there in this horrible situation? >> of course it is. i think it's a little uncomfortable. look, he has to be accountable. the committee, future trading commission, we view this as important to try to figure out where the money went. get back in the hands of the people whose money it is and make sure it doesn't happen again. with the investigation, the justice department and some of the other folks that are looking into this that are going determine whether charges need to be brought. >> greta: did he direct any money from the segregated customer accounts to be used in any way? >> he says not. that is kind the question ways trying to get at, how could those funds, if there wasn't some law broken, where necessity weren't using segregated funds, how could that without a
7:14 pm
violation of law, how could this money disappear. >> greta: you had six seconds of silence and five seconds which is eternity to not have an answer. senator, thank you. hope to get to the bottom of this. tomorrow night, rush limbaugh goes on the record. you'll hear what he has to say about the gop race and everythilse. join us tomorrow night for a rush limbaugh interview that you will only see right here on the record. it could happen, a government shut down. will congress beat the clock this time? within the last two hours, the house passes a payroll tax plan. now president obama is threatening a veto that would throw a wrench into the works. kevin mccarthy goes on the record. once again, donald trump turns the 2012 race upside-down. he is making news tonight.

>> greta: hold on to your seat. incendiary showdown between house republicans and president obama. she is threatening to veto the crot payroll tax cut plan. two hours ago they passed the bill. it would extend the payroll tax cut and unemployment benefits and prevent medicaid payments to doctors. that is top priorities of president obama. they say the republican plan place politics at the extension of middle-class families. kevin mccarthy joins us. i suspect would you say that it plays politics to not to pass it in the senate? >> a lot of politics. we just took a vote that was bipartisan. democrats voted for this bill, as well. it takes things that the president asked for. it takes things republicans ask for and low and behold, that is how the founders created the governmen nothing moves in the senate but it's sitting on the senate
7:20 pm
democrats. the only thing that is holding back from a tax increase are the senate democrats. >> greta: it's first got to go through the senate. you passed your bill tonight. now tell me what has to happen and where the holdup is? >> harry reid has to decide. three things we have to get done this week. you have the one bill that takes payroll, the payroll tax if not by december 31, everyone's taxes go up. unemployment insurance, it goes way, sweeps back by des did he say 31st. the doctor fix. what happens is, come the end of the year, 27% cuts to doctors in medicare. that is going effect individuals getting their healthcare. then we put in also keystone. we don't tell the president he has to say yes to keystone, you have to make a decision.
7:21 pm
i got an article, 61 people got laid off today because the president plays politics won't make a decision on key stone until after the election. >> greta: i haven't gone into it whether it should be or shouldn't be but i know it was put off until after the election so after the election and i realize environmentalists are one side. >> that is hypocrisy. he campaigns around the country, we can't wait. i can't make a decision. this is a pipeline that comes from canada that goes all the way down to louisiana to supply energy, to make our energy prices lower. you know what canada says, they'll sell it to china. look, it would create more than a hundred thousand jobs. >> greta: it could be decided after the election. >> he doesn't want to make a decision. this is a pattern of behavior. when he was in the senate, his number one vote was to abstain.
7:22 pm
>> greta: now what is reid going to do with the bill? >> we don't know. it is sitting in his lap. all the determination takes place is whether he'll take it up and move it. an interesting thing happened. we have appropriation bill where you go through with each department. something is different has happened now republicans have taken over. house and senate passes something and we go to conference. so we went to conference for last four months. they came to an agreement republicans and democrats shook hands, came to an agreement on spending, accountability and everything on this bill. just as congress has to sign it, reid says don't sign it. >> greta: because of keystone? >> no thisas nothing to do it. this is the funding of government. he wants to play politics. it ends on december 16th.
7:23 pm
he is putting politics before people. he is saying i'm not going sign it. to try to make some kind of political gain and put america in jeopardy. >> greta: let me go back to the extension of the payroll tax cut. democrats wanted to pay through wealthy americans with a tax. how are you going to do it? >> democrats didn't pay for it last time. they increased unemployment insurance nine times and only paid for it once. when we do everything in here, when you say pay for it, we make sure this is budget neutral. over ten years, it saves $5 billion. >> greta: how about one year, how much is it going to save you? >> over ten years it will. some of these reforms last a lifetime but the costs are right now. this is temporary.
7:24 pm

7:29 pm
i would run as an independent. you know, that is their concern and that is their problem. >> greta: do you think they are afraid of you? >> i know they are afraid i'll run as an independent. i'll only do that if they pick somebody that i don't think will win or will do a good job. >> greta: what difference does that make in you moderate ago debate? >> they didn't want to be in a debate where somebody would be running as an independent sometime in the future. as you know, equal time laws against me because of the show the apprentice. i'm not allowed to run until may 20th. after that time i can do what i want. if i see the republicans have picked the wrong candidate or somebody that won't do a good job. then it's after may 20th.

governor romney. is it safe to assume now that you are going to endorse either gingrich or santorum in light the way the cards unfolded? >> i don't think it's safe to assume. i do respect the fact that newt gingrich came up and was immediately willing to do the debate. he didn't wait. he was the first one. he said i would love to do the debate. his big thing he wants to beat obama. he is looking at this audience not just to win the nomination but to beat obama. i haven't made my mind up. i haven't made a decision yet. when i do, i'll let a lot of people -- a lot of people are waiting for me to make the decision because they understand that i see what is going on. i see what is being ripped off by other nations and opec and nobody does anything about it. we are like a trust without a
7:32 pm
trustee. we don't have somebody that is confident enough as a president to protect us as a nation. >> greta: do you think gingrich can beat obama and what is your level of confidence he could? >> i think he could. i think president obama has con such a poor job and divisive job class warfare may be the only way he will get re-elected because the country is doing terribly. the uchb employment rate is 21%. i had a smile, they got it do you than to 8.6. 315,000 people gave up and may gave up permanently in trying to get a job and therefore they don't count. what kind of charade is this? if you look at the numbers you are probably talking about 21%
7:33 pm
unemployment. >> greta: what would it take for governor romney to get back in your good graces and bachmann that have now disappointed you. what would it take to regain your trust and confidence in them? >> we'll sof see what happens. i'm going to give an endorsement in the not too distant future. as you know, millions of people are waiting for that. they are not waiting because i am a nice person or waiting for any reason, they really feel i get it. i watched the republican debate. they don't even talk about opec or very little about china. i think the major reasons why our country is doing so badly. they take our jobs in the case of china. they manipulate their currencies. then they take our money and loan it back to us and we pay them interest. the whole thing is incredible and it could stop so easily if we had somebody at the top who
7:34 pm
was confident which we don't. >> greta: what are we not going to see in any of these other debates? >> i think you would have had a tougher debate. i wouldn't give 15 minutes giving instructions. then to go ad nauseam on and on. it would have been a debate on the real issues. it would have been a great debate. i also understand, very strong in the fact he thought it may be dangerous for republicans to go into a debate with somebody that could potentially beat an opponent after may 20th. >> greta: would it have been dangerous? >> i don't think it would have been. even if that was the case, they are going to get their word out, i don't see how a candidate that is far behind -- you could name
7:35 pm
any of them. newt gingrich is way up, but i respect the fact that he has the courage to go out and say immediately i want to do that debate. it's going to be a hell of a debate. there will be a lot of people watching. i was very disappointed that other people didn't want do it. they are so far behind, what did he have to lose? >> greta: one last question. how important is loyalty in the element of endorsement? >> loyalty is very important. she is not going to win anyway. i said you are a wonderful women why don't you go home and relax. michele bachmann would call me constantly. she came up four times. i didn't want to see her. out of respect i saw her. he asked advice from me. we get thousands and thousands of people. call lasted over an hour. then i said do the debate.
7:36 pm
she says i don't want to do that. it's not relevant because she is not going win anyway. i thought was very disloyal especially in her case because she came up four times. she called. she talked and then i get this long lengthy call with thousands of people and she says she is not going to do the debate. >> did anybody call you and say donald, i'm not going to do this? >> yes. >> greta: who? >> governor romney called me and said very nicely he weochbtd be able to do it. his schedule doesn't permit which is farfetched, i think. if i think he is the best job, i would endorse him in a minute. it's not because he won't do the debate. i guess you have to get over that psychologically, but the fact if i think he is the best that will do the best job for the country, i wouldn't hesitate
7:37 pm
to endorse him. i will say that i'll be making an endorsement at some point. if that person wins, obviously another not going gob running. if the person doesn't win and somebody else, i might depending on who that is. >> greta: difference between gingrich and romney in your mind is what? >> i think there are a lot of differences. both have done very well job. they seem to be leading. it seems inconceivable that somebody is going nab the position. i think they are very different styles. they have very interesting stuff. i will say it's amazing the way newt has caught on. he is like a rocket ship. mitt romney is really having a hard time getting in that 2% quagmire. for some reason, herman cain is an excellent guy, when he leaves
7:38 pm
and all those potential voters come up and it comes up in the poll. you see romney gets none of them it's really -- i don't understand why. he doesn't understand what is going on. he doesn't seem to pick up any momentum. that is big problem. he has to solve that problem very quickly. >> greta: donald, nice to talk to you. >> thank you very much, greta. >> greta: budget battle heats up and it is getting ugly. senator orin hatch goes on the record next. and you would think early christmas presents would make kids happy. why are they smiling. it's a holiday surprise. stay tuned. tossing and turning have given way to sleeping. where sleepless nights yield to restful sleep. and lunesta can help you get there, like it has for so many people before.
