"fox & friends" starts just about now. >> thank you very much. 4 welcome to studio e here in the heart of midtown manhattan and if you're watching on the show yesterday where we did talk about the pearl harbor story regarding those guys who were interrupted by "hawaii 5-0" you were so outraged yesterday, today you will be quite happy at what happened. >> all right. we will follow that story. in the meantime, let's get right to your headlines. we're learning more this morning about one of the victims in the deadly army chopper crash. a 36-year-old was one of four soldiers killed at joint be

louis mccord near tacoma, washington. he served three tours in iraq and afghanistan. he leaves behind a wife and four children including a son with special needs that they just adopted. >> he loved his kids and his wife above anything. he would have done anything for them. they don't make them like frank. they really don't. >> the army expected to release the names of the other victims today. overnight, police in belgium found another victim of a grenade attack and shooting rampage that left six people dead including the attacker. police say the body of a 45-year-old woman believed to be a cleaning lady was found at a warehouse used by the 33-year-old gunman to grow marijuana. he was a convicted sex attacker and drug dealer. investigators say he targeted christmas shoppers using a pistol, rifle and hand grenades. more than 120 people were hurt. the motives, though, still not known.

the recently found cell phone of missing mom michelle parker is helping police in their search. investigators in florida are getting clues from her phone but they're not giving out the specifics. parker's iphone was found in a lake not too far from the home of her ex-fiance dale smith jr. he remains the main suspect in her disappearance. lumps of coal all around as the u.s. senate held its secret santa exchange. senator joe manchin gifted fellow democrat chuck schumer of new york with two pieces of west virginia coal carved in the shapes of a donkey and an elephant. manchin also received three lumps of colorado coal from democrat mark udall and those are your headlines. if they don't come to some sort of payroll tax decision, everyone might get coal in their stocking today if you're a member of congress. >> yeah, but what animal would it look like? >> i'm not going to go there. >> i got to tell you yesterday at 6:00, eastern time, "special

report", the house passed the payroll extension tax bill allowing the tax holiday to go on so i guess they can go home, it will sail through the senate and the president will sign it, am i correct? am i right? >> warning, warning, brian kilmeade. absolutely not. the president has said his top priority is passing it. and the house did pass it. by the way, we should point out 10 democrats voted with 224 republicans to do that. but because the president has insisted that any tax cut extension must be paid for by jacking up taxes on certain successful americans, he has vowed to veto it. however, the senate -- the democrats in the senate will make sure that doesn't happen. they will save him that displeasure. >> yep, so they're going to vote no against this. and we should mention that 14 republicans voted no against it. it was bipartisan on both sides of the fence but senator barbara boxer. remember, it's coming now to the senate. she says that there's some sort of a deadly agent involved in this bill.

>> they have given a poison pill, colleagues, literally because it will kill 8100 more people otherwise would have been killed from pollution. >> they're talking about a provision that would be in this bill, the republicans would include it. they would delay the e.p.a.'s industrial boiler regulations because it's another economy killer. this is another transition in our energy department that we can ill afford. this might not be the timing and we don't see 8100 people dealing over tomorrow. >> so she made the same kind of incendiary charge that guy from down in florida did, what the republicans want you to do about health care, die quickly. she's saying now that republicans have passed this thing, 8100 americans are going to die because of the boiler provision. i don't know where she comes up with that. that's just kind of the bomb she threw into the whole thing yesterday. >> what are the differences between republicans and democrats as far as how they want to pay for it?

that's key in this whole thing. and one provision is the keystone pipeline. remember, this was going to be the pipeline from canada down to texas that at one point, president obama was in favor of. why? because it would create up to 20,000 jobs. and we are in an economy right now where we need to try to create jobs. but those who opposed it were the environmentalists. remember about a month ago, the president came out and said we're not going to make a decision until after the election and many people thought that was politics. now the republicans have attached that to this payroll extension. and the president has said, i will veto it so if he's working both sides of the fence on this, that's what the majority whip kevin mccarthy is saying. >> such hypocrisy. here's a president that campaigns around the country saying we can't wait. he says i can't make a decision. this is a pipeline that comes from canada and goes all the way to louisiana. supplies energy and make our energy price lower. if we don't make the decision, canada will sell it to china. this is a pattern of behavior when he was in the senate, his

number one vote was to abstain. >> i'll tell you what, here's the reasoning. now, a lot of people say on the outside, they might have -- they might have a case, that keystone pipeline doesn't belong in this. you know, let's get the payroll tax holiday but if you also got to put unemployment insurance in this and put provisions in there that people are on unemployment for a certain amount of weeks have to start taking drug tests, why can't this keystone pipeline that's been directly linked to jobs be included in this and get people to vote it. >> the political peril for the president, right now he's struggling with his base and you've got the unions which want the jobs teaming with mitch mcconnell. >> exactly right. >> because it's a shovel ready project and whatever the estimate is, 20,000 jobs, 100,000 jobs or other numbers out there and on the other side, you've got the environmentalists and keep in mind, both those groups are funneling cash, campaign cash to the president right now. as soon as he -- if he were to decide, let's go ahead and i'll sign it and we're going to build it, there goes the environmental

base. if he opposes it, there goes the union money. >> you know what the overarching thing is, the president wants us off oil and gas. technically long term he's right. he wants to go solid green. the economy can't afford to go solid green. green energy isn't there. if he puts an oil and gas pipeline in, how is he going to dump oil? >> exactly right. there goes the price. let us know what you think about that and it looks like members of congress will be sticking around a few more days until they sort this out. in the meantime, let's go back to the republican primary situation now. you have mitt romney and newt gingrich in what appears to be the battle for the top spot now. but really, it's a different kind a battle so for mitt romney, it's trying to get the republicans' primary voters to be on his side because look at how it stacks up this way. gingrich now 40%, he's broken the 40% barrier. romney is 23%. ron paul is surging at 9%. bachmann 8% and perry 6%. so then you have newt gingrich's problem with the general

electorate. >> yeah. >> where romney and the face-off is against obama. >> if you put newt against obama and mitt romney against obama, look at these results. the president beats romney by just two points so within the margin of error and this is a guy in mitt romney that's trailing by 20 points going into most polls overall with the republicans as gretchen mentioned and then you have president obama taking on newt gingrich so right now would get the nomination if it was to end today. look at that lead. that's not even close. that shows you that maybe -- maybe the moderates are not showing up on these primary polls because mitt romney clearly has the moderates and almost has no shot at the tea partiers. >> right. >> where i think newt locked them up and ron paul has locked them up. >> so mitt romney could win the general election but he can't win the primary at this stage. the big question is is president obama beatable? and the answer is yes because if you look at exactly the same "wall street journal" poll that we're quoting this morning, about 70% of all of you feel that the country is headed in

the wrong direction and when it comes to whether or not you approve of the way the president of the united states is handling the economy, 39% approve but 57% disapprove and that's exactly where it was last month so the president has got some real problems. he is vulnerable. it just depends on who the republicans put out there. >> so the first contest is going to be in iowa less than three weeks away now. let's look at the latest iowa poll. >> this is stunning. >> you can see that newt gingrich is on top 22% but look who is in surging magnificently, if you're a ron paul fan, 21%, mitt romney at 16%. michelle bachmann up as well to 11%. >> but if the people of iowa are responding without herman cain there and having seen newt gingrich be attacked by ron paul, you know what they're saying? i like ron paul's attacks on newt beginni gingrich and if neo win iowa, new hampshire he will likely lose, he's going to have to wait three weeks to get the

victory he's sure to get as of right now in south carolina and in florida and that would get the uncertainty away from newt gingrich where everyone says, well, look at this, it's inevitable. if you barely get iowa or lose iowa and you don't win new hampshire, where's that air of inevitability. you ask rudy giuliani about that, he's going to inevitably win florida. you wait in florida. by the time it gets to florida, it's nowhere. >> what happens if ron paul wins iowa? >> that's what i'm saying. he's not going to win new hampshire and in south carolina he's not polling very strongly so i think that if i gets close to newt gingrich, newt gingrich will be saying what happened to my 10 point lead? what do the people of america have a problem with me that i lost that and maybe other states will think the same thing. >> stand by for that. more politics very shortly with the great dick morris. in the meantime, we told you yesterday about how a number of world war ii veterans, survivors from pearl harbor, average age was 91. they went to the national

memorial cemetery of the pacific on friday during pearl harbor week where they so happened to be shooting an episode of "hawaii 5-0". well, the crew there was very disrespectful. they essentially told the people at the cemetery, look, we rented this part of the cemetery. you can't walk over there. they shooed them off and told them to be quiet and they were disrespectful during the playing of the national anthem and of "taps" as well. >> and so they were looking for an apology. and cbs has put out yet another statement now, this is from the executive producer of this show. any rudeness by our staff can only be attributed by haste to finish our work, not a lack of respect for men and women who have served and sacrificed for our country. we sincerely apologize to any that were offended. now, we want to tease that coming up, we're going to ask whether or not that apology will be accepted by a veteran. >> by a veteran, too, and the courage of that, i think it's a denver reporter. >> right, koa. >> that wrote the story up. here's the other thing, the veterans wanted to meet some of the actors and they were told

>> 16 minutes after the top of the hour. maybe he's been studying the polls but even president obama acknowledged the election won't be a slam dunk especially in key swing states. voters who identified themselves as democrats in key swing states, well, it's dropped five points since 2008 to 30%. at the same time, the number of voters leaning republican have climbed from 38% to 43% while democrat leaning voters stayed the same. dick morris, former advisor to president clinton and the author of "dubs goes to washington"

that cute little book about his dog joins me now. >> my dog is -- not my dog is a great christmas present but the book about my dog is a great christmas present. >> let's talk about shifting party affiliation in the swing states. shifting more to republicans, why? >> i don't know if the data on the screen is correct. it's a five point drop among democrats and a five point rise among republicans, just a literal shift like that. i guess you got to -- >> from 2008 until now. >> you got it right. ok. so the -- really, what's happening is that the traditional swing states, ohio, pennsylvania, michigan, wisconsin are moving decisively republican and in some cases are really no longer swing states. the states that aren't normally swing states but have large black populations largely in the south are now -- obama hopes will become swing states by

having a large african-american turnout. so virginia, north carolina, arizona with the latino population, nevada, those are states that are sometimes swing but usually not in the same sense that ohio and the industrial heartland are. >> what's also interesting to me in that same poll was the growing number of independents across the country. i mean, i think one of the figures was maybe 37% to 40% independent now. >> obama does very poorly among the independents. his votes are -- have come overwhelmingly from the decratic states. >> he got the majority in 2008. >> no i mean now. >> 2081. now he's losing. >> i want to bring you to a quote from congressman cardoza, democrat out of california. an amazing quote from an op ed that he wrote. after observing president obama for the last three years, it has become obvious to me that the president might prefer to be a university professor rather than do the job he holds today and

that's from a fellow democrat. why is he saying that? >> well, that's always nice to have your party helping out in the election coming. i thought there was something really significant and you have a column on my web site about this today. obama gave the statement to "60 minutes" where he said essentially it boils down to do you believe in the republican philosophy of tax cuts or don't you? and what that statement said to me is first of all, he wants to focus on the republican plans, not on his own. secondly, he doesn't want to defend his record. he wants it to be my proposals against their proposals. and thirdly, that he does not want to be running based on anything that -- on the issue of competence. in other words, he wants it to be what do you advocate, not are you competent to getting the stuff done? and that's the opposite of what the republicans should do. the key thing the republicans have to do is to ask the following question. what will you possibly do in the next four years that you haven't done in the first four years?

and has failed? >> he said he needed another term, maybe even another president to do all he wanted to do. dick morris, stick around, if you will, because tomorrow is fox newschannel debate is make or break for some of the candidates and dick says there's one thing that romney needs to do. he'll answer that coming up. he promised to crack down on illegal immigration. not this hard. it's now affecting legal americans, too. a vacation on a budget with expedia. make it work. booking a flight by itself is an uh-oh. see if we can "stitch" together a better deal.

christians thinks god would reject mitt romney because of his mormonism. the defense secretary says there's no plans to stop the drone program along the border. he said it will absolutely continue despite the loss of a valuable drone to iran. that was an exclusiveer interview for fox. >> it was. today's final debate is before the iowa caucuses, what should newt gingrich do to solidify his lead? >> and should mitt romney take off the kid gloves. if you're advising mitt romney and newt gingrich, tell me the two most important points in the debate. >> romney at this point has to get out of the way and let newt gingrich do his thing and let gingrich be out there and take all the shots and take all the flak because what happens in this process is whoever is in the lead gets all of the

attacks, the slings and arrows of outrageous fortune go right his way and i think that that's a process that brought down a whole series of republican candidates. and now i think those shots are directed at gingrich. i don't think that gingrich is going to be knocked out in the same way that cain was or perry or the others. but i do think it's going to go down to a two way fight but i think newt is going to come back to earth and it will be a tough two way fight straight through the rest of the process. what newt has to do is have the same great debate performances he's had before this past saturday. i didn't think he did well on this debate on saturday. abc thinks otherwise but they want him to win and i think newt did not do well in the saturday debate. he did much better in the previous ones and for him to keep his frontrunner status and build it back up in iowa, he's got to shine. he's got to be newt gingrich.

>> why does abc want them to win? >> because abc is democrat and the democrats are laboring under the point of view that gingrich would be easier to beat than romney. now, they say that because it's true that romney is a better candidate for the swing voters. but a lot of the republicans believe that gingrich will summon a passion and a strength that romney won't. and that therefore turnout will be higher. but democrats tend to believe with the republicans in the swing voter area. >> the thing is, too. i think republicans look at newt gingrich and see how well he debates and say that's the guy that really -- >> that's what i mean by passion. >> look at iowa, i couldn't believe this poll. you have newt gingrich in front by one point. >> but look at the emergence of ron paul at 21 and romney at 16. >> who looks worse, romney or newt in this? >> well, newt because romney doesn't need iowa. newt does. let me say this. i absolutely guarantee that if ron paul is the republican

nominee, barack obama will be re-elected with more than 40 states going democratic. there is no chance on earth this planet or the next that ron paul could ever come close to defeating barack obama. so anybody that votes for paul -- why is he surging? nobody is attacking him. a is attacking b and c is surging. that's all it has to do with. and you can't have a kanld date that says basically let iran develop a bomb, pull out of all of afghanistan. >> let israel die. >> let israel die. legalize drugs and stop fighting the war on terror, repeal the patriot act and expect this guy to win. n anyone in iowa voting for ron paul should put the word o-b-a-m-a over their sticker.

they think fort bragg amounts to nothing more than a victory lap for president obama. and senator john mccain is expected to give a speech later today on the floor of the senate very similar to this statement his office put out on monday where he said "the sacrifices of both our peoples in a long and costly war, the continued needs of iraq's security forces and during u.s. interests in a stable and democratic iraq all demanded a continued presence of u.s. troops beyond this year but domestic, political considerations in each country have been allowed to trump our common security interest." press secretary at the white house jay carney said the president is looking forward to thanking the one million troops that served and discussing what the sacrifice they made all means now as the iraq war is just about as -- we're about 2 1/2 weeks before all u.s. troops are set to leave iraq, i should say. back to you guys. >> thanks a lot, peter, also the president of iraq says this. it will record that the

"the new york times" reports that bungled arrests are caused by flawed information from the department of homeland security's computer data bases. the number of americans wrongfully arrested, not known because homeland security reportedly does not keep track of that embarrassing figure. >> fox news has learned investigators are checking jon corzine's phone records now and e-mails to see if he misled investors in the days before his former brokerage m.f. global collapsed. brokerage firm, that is. corzine back in the congressional hot seat tomorrow. in a senate hearing yesterday, the former democratic governor and senator from new jersey was grilled again about a billion dollars in customers' money that's now missing. >> i never gave any instructions to misuse customer

funds. i never intended anyone at m.f. global to misuse customer funds. >> a financial exchange executive testified that corzine knew $175 million of his customers' money was being improperly transferred out of the firm a week before it went bankrupt. oops! >> he just doesn't know where to put a billion dollars. it happens to all of us. a wrong turn landed one police officer up a pole. yep, it happened in miami, florida, the officer apparently dropped his pen and took his eyes off the road to get it. that's when he swerved and drove his car right up the light pole and the officer walked away unharmed. however, he knocked out power to the entire community. >> oh, my! >> an army vet turned baptist pastor never thought his military training would come in handy in his church life but he was wrong. the pastor was relaxing at home when he spotted someone throwing a rock into the church's window and crawling inside. he ran to the church and found the burglar and wrestled him to

device while you're driving. ok, can you imagine if this proposal were to become law in all 50 states? virtually all of us would become a lawbreaker. who hasn't used a hands-free device? >> how do you enforce that? >> second, the law would not be reputable because it would be seen as a revenue raiser for the local authority and what would you think it would do to productivity? how many millions of americans are getting in their cars right now and will check in at the office on the drive into work. >> the problem is 900,000 accidents last year -- 900,000 because of distracted driving. 3,000 people killed in the united states because of distracted driving so that's their recommendation. it's completely unenforceable and going forward, you know, distraction takes many forms. >> look, the use of this proposal is maybe to give publicity to the idea that we should not be distracted in any way shape or form while we're

driving. to have this proposal become full law, i don't think it's going to happen. >> let's think about what a hands-free device does, it allows you to have a conversation with a person on the phone. should we not be allowed to talk to the driver while he's driving? >> the radio. >> you can't have a radio! that could be distracting. especially the song that you like and you start getting a lot of energy and you go too fast. >> what about drive-through fast food places. you can't have that. am i going to eat and drive at the same time? good heavens. can't have it. >> you can make $3 million. >> what about the stereotype of women putting on lipstick and mascara. >> i'm not going there. >> i was waiting for my colleagues to get their questions in. so my -- my point was that i thought it was that you could -- that they were going to ban using the ear phones. they're going to ban that, too? >> uh-huh. i believe it's a total ban. hands free. i'm not for that, i think people should be able to conduct business. i don't agree with you it's a flat out revenue maker. >> no, it's not just a flat out revenue raiser.

>> the pledge of allegiance is stirring controversy in the city of lamont, california. lamont elementary school students have been reciting the pledge of allegiance in english and in spanish simultaneously since 2002. but one teacher wants to change that. joining us now is a third grade teacher at the lamont school district, armando ruiz joins us from l.a. hello there. >> good morning.

>> since 2002, they've been reciting it in english and then in spanish as well. why? >> i think a lot of our teachers or a few of our teachers took this upon themselves as well to accommodate our students that are in their classes. >> right. and 97% of the kids in that school are -- english is a second language to them. >> yes and i actually teach an english only classroom. >> ok. now, you say that the pledge of allegiance should only be recited in english. why? >> it's an act of patriotism towards our nation. i grew up in the united states. i'm a natural born citizen. my parents came over from mexico but went through the process of becoming a citizen. to them, it's an act of honor to be able to recite something according to our nation. i have a problem with the fact

that we're manipulating something to accommodate a certain group of people. it shouldn't be that way. especially if we are trying to teach our children the history of our nation. it's something that is -- will benefit them even more instead of enabling them and crippling them in a different manner. >> now, armando, some say they just want it in english. that's racist. how do you reply to that critic? >> i know that's wrong and i think it's wrong for someone to come up and say this is a racist remark. as a american, i'm more offended by that. i'm more offended when i hear the pledge of allegiance spoken in spanish. it takes away the meeting of what our fathers found it for as a nation. and i think that if there is no reason why we should have to manipulate our national documents or our hymns in any manner into a different language just to fit a community. i think it we want our students to be more productive in our society and in our communities,

and the other guy smells you. a little closer. a little closer. >> how can you possibly say that a city is ugly? >> well, they did! and they just got some publicity. >> well, well. >> i like you. i think they're beautiful people. >> capital city of california. brian just mentioned gallup. there's new polls out today we'll tell you about and if you look at the polls right now, exactly three weeks before iowa, mitt romney has some challenges with primary voters and let's take a look at the very latest "wall street journal" poll in the general and the primary, what would you vote for? look at that. ron paul at 9. there's a triple p poll out this morning that shows newt and ron paul tied and there's another poll that shows rick perry in third place. >> let's take a look at how the president matches up with mitt romney if they were head to head within the margin of error. newt gingrich within some polls

you just saw with a 20 point lead on mitt romney gets trounced by president obama right now with the approval rating of 43%. president obama still wins 51-40. in iowa, this is significant, gretch. >> are these all voters? is that a poll of all voters? >> yes, in the general. >> if we go to iowa and try to parse it out anymore. this is a stunning poll, it shows newt gingrich has lost some support in iowa. 22%. he's still on top but ron paul surging to second place at 21%. romney is pretty much where he's been at 16%. and then bachmann surging, too, at 11% but the big story there is ron paul. saw dick morris on our show earlier saying if ron paul, dick morris' words wins iowa, it's not good news for the republican party. >> it shows the people of iowa think he should be the nominee. if you like ron paul or don't like him, he cannot win the general election with his stances on a myriad of issues. he's true to school. >> on that poll, if ron paul

attacks newt gingrich directly with ads and every time he sees the microphone, he goes after newt gingrich and he gets that kind of result, what does that say for mitt romney if he wants to get the same result? and if you look at what ron paul is doing as somebody who can take iowa look for him for the first time to be a main target thursday night on fox. >> you got ron paul surging and actually, newt is -- his support is softening a bit in iowa and elsewhere. part of it has got to be the constant drum beat by a number of republican insiders who say look, you know, he's an extremist. he shouldn't be elected and -- >> fellow lawmakers who used to work with him, republicans. >> say he would be unreliable and he was erratic as a speaker. david axelrod sounded like a republican insider because he said regarding newt gingrich, the higher a monkey climbs up a pole, the more you can see his butt and he went on to say some speakers very high in the poll

right now and we'll see how people like the view. people are getting a better view of newt gingrich and charles krautham he were was on the o'reilly program last night talking about why the g.o.p. insiders don't support newt. >> there are two reasons why i think they're against him or at least a large number of them. number one, they're worried that he's too erratic or unreliable. in a way, he's sort of a victim of his own creative intelligence. second, i think they're worried about if he can be elected and a lot of them are worried if he would be on the ticket, he would do so badly that he would hurt the house and the senate. >> this goes back to the polls that we just showed you earlier. i think the people who are in favor of newt gingrich are against the republican establishment. those -- that's why you're seeing this surge. and it's almost when a member of congress comes out and does not

endorse newt gingrich, it fuels the fire for those people who like him, they like him because he's not ironically the republican establishment even though he was speaker of the house. it signifies the divide in the republican party between the candidate that maybe can win a general election and is part of the party establishment, mitt romney, and the one who is not. >> yeah, but party establishment but not the tea party because it seems like the tea party and the very conservative have not run to mitt romney where moderates say he's ok with me and perhaps even some democrats say i could probably go with him and the other thing to keep in mind, this one point is just bring us to january 3rdrd. let's say iowa goes to ron paul or it's a very small margin victory for newt gingrich. he can't really celebrate. yeah, i want iowa but i was winning it by 15 and then he goes to new hampshire and it's more than likely that mitt romney is going to be unbeatable there. i'm not saying it's not going to be close. unbeatable. so you're going to be going three weeks without any significant newt gingrich win and that will make people say well, maybe there isn't -- >> there might be a debate in that time period where he always

performs well. i mean, i think it's exciting for the republican party to not just have a slam dunk. i think, you know, a lot of people want to go back to the days where it was actually brokered at the convention, you know, imagine that. it would make it all exciting and maybe the people would feel more a part of the process. >> ron paul will be a power broker regardless because they want his loyal voters and the people that support him. >> meanwhile, speaking of more debates, there will not be that news max debate two days after christmas, donald trump announced yesterday he will not be the moderator of it. they only had newt and rick santorum. trump said he's not willing to give up his right to run as an independent if the republicans don't nominate the right guy. here's donald. >> because of the fact that the republicans are upset and because of the fact that i refuse to give up the possibility of running as an independent candidate, i've decided to cancel the debate. i don't want to waste a lot of

newt's time or rick santorum's time or donald trump's time so i won't give up the possibility of come around june running as an independent candidate. i just don't think it's fair to myself, to the country, to all of the millions of people who are following what i say because they're tired of having this country being ripped off. >> i don't see him running as an independent. he's made it clear in this program he doesn't want to see barack obama get a second term. if he was to run as an independent, that would split the vote. >> if ron paul has the nomination, he would. >> he had to say that, that was one of the main reasons why the candidates decided they would want take part in his debate. >> conflict of interest. >> maybe if he was going to be running for president, he shouldn't be moderator. >> i would think that's a bad excuse. for michelle bachmann who has a bunch of challenges if she wants to get the nomination. having debate with donald trump as part of an independent

understand, was sitting 50 yards away and they pushed you 100 yards and 300 yards, none of that was good enough. >> yeah, you know what? i wasn't at that stage where what steffan tubbs was going through with his group of veterans. the national parks appointed a golf cart to me to transfer veterans from the lower portion of the memorial up to the top portion and as we stopped half way up to allow the veterans to go visit some of their fallen brothers, you know, these guys just came out of nowhere and pretty much said, you know, you need to move and you need to get out of the shot and i really at that stage didn't say anything to them other than pay some respect to these veterans. this is their first time back in 70 years. and how dare you approach these veterans and hush them along. it was a disgrace. it was an absolutely disgraceful event that took part. >> i agree with you. how do you tell that group of people we have to finish an episode of "hawaii 5-0", break this up now. here's an e-mail from the show's executive producer to the blogger who posted about this incident. he says "i spoke to

approximately 30 folks. all say they paid respect during the anthem. then called lunch to give vets privacy and respect. everyone knows how much we respect our military. we couldn't do our show without them and since 80% of our crew is made up of locals with deep ties to the military, i can't imagine any of them doing things that you said. wish you contacted us before trashing us so aggressively in the blog." the bottom line as we're finding out, the column was right and this guy was wrong. >> you're right he was wrong, mate. he wasn't even there, so, you know, cbs, i have 24 war veterans, 23 of them pearl harbor survivors. oldest 96. youngest 89. you know what? i'm happy to bring forward these veterans that were there to testify on our behalf to show the mistreatment towards them. you know, as i said earlier on, it's a national disgrace, mate, for our war veterans and, you know, as one veteran described to us. this is the grand finale of my life to come back here. and to see how a production, a

opening up their wallet and writing a check to some outfit. but you know, we don't know a lot about a lot of these places so you've got some tips on responsible giving. >> you know, i met with a guy who is a multimillionaire who gives away hundreds of millions of dollars a year and one of the things he taught me about giving was he said start treating your giving like it's an investment. if i'm going to make an investment, i investigate the investment. because this is an investment. it's investment in other people and it's an investment in god's money so treat it like an investment. that will take you a long way through your giving analysis. >> all right. we have some e-mails and questions for you this morning as well. steve from oklahoma has this one. dave, what percentage of my income do you recommend be earmarked for extra giving? we already give to our church. >> well, giving to your church is certainly a great place to start. those of us that are evangelical christians give a 10th, a tithe to our local church. above that, that would be called an offering in that world. but certainly, any percentage works.

obviously, the more money you make, the less income -- the less outgo you have, the less debt you have, the more wiggle room that you have the higher percentage. i'm working sometimes with athletes or music stars or those kinds of things, they're able to give a larger percentage of their income. so it's not a certain percentage but sure is good to give at least 10. >> all right. james from new jersey writes this. when looking at a nonprofit organization's budget, what are the red flags i'm looking for? >> well, i want to look for some kind of certification from the group they operate in. there's lots of different watchdog groups in the charity world and look for those. for instance, the ecfa is one christian accountability. you can look for that in ministries is one. you can look for that. other things i'm looking for is look for the high salaries in people operating it and a high rash other of overhead. what percentage of the dollar goes to overhead vs. helping the people that the charity is supposed to be helping. >> that's such a good point and

>> couple of quick headlines for you right now. u.s. postal service holding off on closing anymore branches until next may. it wants to give congress time to try to come up with the bailout. postal service has racked up $10 billion in debt this year alone. former new york mayor rudy giuliani says newt gingrich is a stronger candidate than mitt romney. giuliani ran against romney in 2008 and has not formally endorsed a candidate for 2012 but he will be on "fox & friends" tomorrow. fantastic. guys? >> a lot of people like newt. >> yep, the investigation is heating up in indiana. prosecutors are looking into allegations of election fraud stemming from the 2008 democratic presidential primary. eric shawn has been following this story and he's been in a few kitchens doing so. he joins us now with more. what happened, eric? >> hi, brian. hi, steve. this is pretty astounding. there are questions about whether or not president obama actually legally qualified to get on the indiana ballot in 2008 during the democratic

primary there. there are allegations that signatures on the presidential petitions for the president and hillary clinton were forged. a slew of them allegedly faked. there's now an election fraud investigation, a criminal investigation ongoing in st. joseph county in the northern part of the state, south bend, notre dame, that area, about how this potentially could have happened. as part of our investigation, we talked to voters, a bunch of them who said they never saw in these petitions for the president. let's take a look at some of them and what they told us. >> is that your signature on this? >> that's not my signature. >> did you sign this petition for barack obama? >> no. >> you did not? >> no. >> so this is a forgery? >> it is. >> it's a fake. >> absolutely. >> it says here on this barack obama petition, it has your signature. is that your signature? >> no. no. >> you did not sign for barack obama. >> no, i did not sign for barack obama. >> someone forged this? >> that's correct. that's not my signature. i did not sign for barack obama. >> it's scary! you know, a lot of people have

already lost faith in, you know, politics and the whole realm of politics and so this kind of solidifies all of our worries, our concerns. >> oh, boy. >> the -- the indiana democratic party calls this an isolated incident. the republican party, though, of indiana, they believe that the president in their words cheated. there's no indication or evidence this came from the obama campaign itself. but the chairman of the indiana republican party, he doesn't believe that the president even qualified to get on the ballot in the first place. >> if he wasn't qualified to be in the ballot, some might do the math, he shouldn't be president -- i'm not going to get into that. >> i don't know. >> right. exactly. all they needed were 500 signatures on that so had they known then, you know, these are bogus signatures or forgeries, they could have probably gone out and got some more. >> or it could have been challenged. here's how it works. in each congressional district in indiana, you need 500 signatures. the obama campaign qualified

that country for good. >> the iraqi security forces have gotten more and more effective. that doesn't mean things are perfect there. it does mean that it was time for them to take full responsibility for their country and that was their preference as well as ours. >> but victory lap is how some republicans are describing the president's speech today and they don't mean it as a compliment. senator john mccain's office says he will give a statement on the senate floor today that will be hard hitting and similar to this news release he put out on monday that said in part: the sacrifices of both our people -- the americans and the iraqis -- in a long and costly war, the continued needs of iraq security forces and enduring u.s. interest and stable and democratic iraq all demanded a continued presence of u.s. troops beyond this year, but domestic political considerations in each country has been allowed to trump our

common security interests. speaking of b the president also said yesterday that keeping america strong should be washington's number one priority and something else his press secretary said yesterday is that today's speech at fort bragg will be an opportunity for the president to thank the 1 million americans who served in iraq and explain to them what their sacrifice means now that the war is almost over. back to you. >> steve: all right. thank you very much for the live report. meanwhile, you would think the people -- that the occupant of the white house would be happy with what the house of representatives did last night. 234-193, including ten democrats, they voted to extend the payroll tax cut. plus they're going to extend unemployment and all sorts of stuff. what's interesting, though, is while the president said that's my number one priority, let's pass that, he's not going to be happy because the republicans are not jacking up anybody's taxes. >> gretchen: what they wanted to do -- the president wanted the

wealthy to pay for this. the republicans don't want to do that. they added the keystone pipeline to it. here is how the republicans would pay for it. one year pay freeze on federal workers. higher pension costs for those federal workers. higher medicare costs for senior s who make over $85,000 in income. that's how they would pay for it. not just saying yeah, let's tax the millionaires and billionaires again. but they also put on that other thing which we'll get to. >> brian: we're going to get to it shortly. but i think it's interesting, the house passes a bill. 14 republicans opposed it. but they did pass it. the senate sarks before you get here, let me tell you it's dead and before it gets to my desk, the president says i'm going o veto it. they're not going to try to work it out. >> steve: the democrats and the senate are absolutely going to kill it. barbara boxer is a democrat in the senate. here is her comment. >> they have attached a poison

pill, colleagues, literally, 'cause it will kill 8100 more people than otherwise would have been killed from pollution. >> steve: so that extraordinary claim that because the republicans have attached this thing that would delay boiler regulations that the epa recently enacted, apparently with it would do is it would continue to exempt coal fire boilers from epa regulations. she's doing the math. she says if you keep those boilers working, they're going to be puffing out all that stuff that's going to kill 8100 americans. >> gretchen: so this one provision that we were alluding to earlier, the republicans in the house tacked on the keystone pipeline. that's the oil line, as you see here on this graphic coming from canada, down through the united states. the path i believe has been adjusted now, down to texas. remember, the president was at one point behind this because the latest figures show that it would add about 20,000 jobs to our economy right now, which we desperately need. but then about a month ago, he

said i'm going to hold off on this decision until more studies are done and guess when the date is for the decision? after the election. so now the republicans are saying, wait a minute. you told us you can't wait to pass that jobs bill, told that all throughout the summer. we're now saying to you, we can't wait to create jobs for americans. >> brian: here is majority whip kevin mccarthy last night. >> here is a president that campaigns around the country saying, we can't wait, then he says, i can't make a decision. this is a pipeline that comes from canada that goes all the way down to louisiana. fly energy. canada says if we don't make the decision, they'll sell it to china. this is a pattern of behavior. when he was in the senate, his number one vote was to abstain. >> brian: so this has been attached to the bill. the unions are for it. it would give us economic security. canada is our friend. it will be something positive.

environmentalists are against it. so therefore, the president didn't want to anger one group even if it means praising another group that normally support him. so he punted. this makes him not punt and not fair catch it, but play the ball. >> steve: what they've done is they've already suggested -- they're worried about it going over an aquifer, so they moved it hundreds of miles to calm those people down, so now the fact that they're punting it seems arbitrary because they've done all the environmental test, they've done all the studies. it seems like he doesn't want to hack anybody off before the election. he will do anything to get reelected and he certainly do not want to anger his union base nor his green base. >> gretchen: the senate will take care of it for him. for the political side of the story, they'll punt it so they won't have to. >> steve: then it's going o have to come back. >> gretchen: we're learning more about one of the victims in the army chopper crash. 36-year-old frank was one of four soldiers killed at joint base lewis mccord near tacoma,

washington. he served three tours in iraq and afghanistan. he unfortunately leaves behind a wife and four children, including a son with special needs that they had just adopted >> being a wife above anything, they don't make them like frank. they really don't. >> gretchen: the army expected to release the names of the other victims today. it's a fox news exclusive. leon panetta telling us there are no plans to stop the u.s. drone program along the iran-afghanistan border. he says it will absolutely continue despite the loss of a drone to iran. later this week he'll be in bag doing for a ceremony to mark the end of the u.s. war in iraq. police in belgium found another victim of that grenade attack and shooting rampage that left six people dead, including the attacker. police say the body of a 45-year-old woman believed to be a cleaning lady was found in a warehouse used by the gunman to

politics. the controversial political record and rocky personal life. but newt gingrich's supporters say the former house speaker has turned a new leaf. our political panel is here now. mark is co-founder of tea party patriots. todd, former white house economic advisor and author of "rush, why you need and love the rat race." and tara is a former aide to jim mcgreevey and political strategist. good morning. >> good morning. >> gretchen: let me start at the end. co-founder of tea party patriots, mark, i would assume maybe you would be on the outside of the gop establishment and you might like the new newt gingrich. is there such a thing as a new newt gingrich? >> i think that's the best question you could ask. i don't think there is. he has a long history and his behavior today is consistent with that long history. i think folks are paying more attention to that history than ever before and i think newt better than anybody else would understand that. >> gretchen: all right. so why is it different with the voters? i want you to look at these two polls. so these are gop primary voters. 40%, he's broken the threshold

of 40% now. they like gingrich. then you drop down to 23% for romney. 9 for senator paul. et cetera. now you compare that to the general electorate. romney does better against obama, 45 to obama's 37%. gingrich slips to 40 and obama beats him. so my question to you, todd, is why does the general electorate like romney and the primary voters like newt gingrich? >> because with newt gingrich, it's 16 past the hour. it's just a matter of time before he says something dumb or wreckless. the one thing that hasn't changed is that newt gingrich is a great target for democrats to attack. they will portray him as a symbol of the federal government. they'll say he's big, he's out of control, he's fat and he's out of touch. and that's exactly how he can be portrayed and i think republican primary voters ought to be very concerned about that. >> gretchen: why do they like him? by the way, he's been in all these debates and he really

hasn't had -- >> he's an interesting guy, innovative guy. we live in an era of reality television where interesting performers rise to the top before they're pricked examine before they blow up. republicans shouldn't want that kind of candidate. >> gretchen: tara, do you agree with this, this is a reality tv phenomenon, that's why newt gingrich is on top of the polls now? >> i will give it to newt gingrich. he's a very good debater. so he had a strong showing in the various debates. but the reality is, democrats would be easier for us to attack newt gingrich. not because we could portray him as instability, as part of the problem, but because he is part of the problem. newt gingrich is the equipmentessential politics for profit politician. that's his biggest issue. forget the personal issues. put that aside. it's the ethical issues, it's the lobbying for freddie mac. it's all of those things that make him very much part of what americans are tired of. >> what republicans ought to be more concerned about is newt

gingrich is the guy who sat closer to nancy pelosi than i'm sitting next to tara. newt gingrich is the guy who admitted, quote, i melt when i'm in bill clinton's presence and i need two hours to detoxify. i'm worried about a guy who melts in the face of charming democrats. >> gretchen: yet living in an era where nothing gets done on capitol hill because there is no such thing as bipartisanship anymore. i don't know, maybe some people would like that. mark, my question to you is why did the voters like newt gingrich? they know all this stuff about him and i'm wondering, we got a lot of e-mail about this, people say they only care about the person who can fix our country, present tense. they don't give a rip about the other stuff. >> i think they like him because he's a good talker. he's saying all the right things and saying it in the right tone. for example, folks love the fact he goes head to head with the media. he'll push back. those who are watching, we like that. it feels good to us. i think there is an emotional connection being made.

can get you some after this commercial break here. tara, the democratic enthusiasm, 47%, the republican enthusiasm for the upcoming election, 61%. are you worried? >> certainly there is no secret, i don't want to be cast in obvious here, but president obama is going to have a very challenging, hard-fought election cycle. there is no question about that. i think the bigger issue for the president, though, that not a lot of people are talking about and i'm sure my colleagues tonight want to talk about this, is that these voter suppression law, these laws that disenfranchise many of his key supporters, things like closing polling places earlier in urban centers, all of these laws that have been put in place by republican legislature, that's going to be the biggest issue the president is going to face. there are about 5 million voters that will be impacted by that. >> gretchen: i think there is the flip side because there is a tremendous amount of voter fraud that favored president obama. but that's for another day and another time. mark, let me get your thoughts

on the enthusiasm. do you think that that poll that i just shared means that more republicans will go out to vote than democrats? >> i think it definitely does. we see it in our base, the tea party movementers, people are organizing already. they're holding meeting, vetting candidates. it's going to affect not only the presidential, but the down ticket in the city council. >> gretchen: todd, look at another poll. this has to do with the swing states. there were 12 of them and in 2008, president obama won all of them. look at now what's happened. there has been a shift, like a 5% shift, democrats lost 5% in these swing states as far as registered people. republicans have gained 5%. your thoughts? >> look, if you're a democrat and you're a moderate, you realize gosh, this hope and change thing didn't work out so well, so i might as well, if i'm an independent, try the republicans. if you're a left wing democrat, you say, hey, guantanamo bay is still open! he was supposed to close it. you say, he was supposed to

bring all the -- afghanistan, we sent 100,000 troops to afghanistan. we're killing people across the globe. americans top assassin. if you're on the left side of the democratic party, he's been a disaster. if yu're in the middle, you say it really hasn't worked out and the republicans are the ones left with some enthusiasm. >> gretchen: tara, do you want to go up against your colleague? >> i would like to address a couple things. i think the republican party isn't exactly lighting the world on fire. the republican presidential candidates throughout are not really resonating as well either. so that's a good thing for the president. that's not how you want to win, but it's certainly a good thing for him. i do think, though, that the bigger issue that many of the democrats complain about and you hear amongst moderate democrats as well as liberal democrats is not so much that they are upset with the president's policies. they understand what he encountered. they understand what he's dealing with. what they're upset about is they feel he hasn't pushed back hard enough against the republicans. that's what the democrats are really buy and large, that's the largest complaint that you hear from democratic voters.

>> gretchen: another fellow democratic voter from california says he thinks obama would have been happier as a professor. >> i would have been happier if he were a professor than a president. >> i think it's a little disingenuous to say that's what democrats are upset about. for the first two years, he had the house and senate, he could have done pretty much whatever he wanted. i speak to people across the aisle. they're furious. they're angry because he didn't deliver. it was hope and change. he had all three branches of government. he could have done what he wanted and he chose not to do so. he went main stream and status quo. >> gretchen: thanks so much and i promise coffee. good to see you. we told you how the crew of the show "hawaii 5-0" pushed these veterans out of the way so they could get their filming done. well, you spoke up and now we have an update for you. fresh off his military tour, chris daughtry to share what he saw overseas. the singer joins us live next

>> this is the only way we can find out what the candidates -- what the platform is, what their policies are. >> steve: yeah, but there are a million of debates. but the donald trump debate would be different. newt gingrich himself said it would. >> absolutely. >> i for one would love to see someone on the different side of, i don't know, society, someone that's more familiar with the public eye. >> steve: in fact, donald trump himself said he might -- he's probably smarter than a number of the moderators who have done some of the debates thus far. what about his suggestion that if the republicans don't nominate the right person, he reserves the right to run as an independent? what do you think about that? >> sounds like a man that's not committed. >> steve: how many men are really committed to politics or anything else? what do you think? >> i don't know. it's a little disrespectful, i think, to some of the other candidates. but if he thinks he can do a better job, let him run. >> steve: there you go.

to misuse customer funds. i never intended anyone at mf global to mise customer funds. >> brian: financial exchange executive testified corzine knew much of the money was being improperly transferred a week out of the firm a week before it went bankrupt. there is a problem there. >> gretchen: nick nolte setting the record straight on that infamous mug shot. remember this one? it was snapped after he was busted for driving drunk ten years ago. can you believe it's ten years? now nolte revealing that was not his actual mug shot after all. this picture was snapped at the hospital where he was taken for a blood test. he claims a police officer wanted a picture of him, so nolte let him take it. why would you let someone take that photo of you? but anyway. >> brian: remember, he was very good on "rich man, poor man." >> steve: those were the days. >> brian: okay. let me tell you what's going on of the cbs changing its tune after these photos sparked outrage.

they show a "hawaii 5-0" "disrupting a ceremony during pearl harbor week. they issued this, any rudeness by our staff can be attributed to haste to finish our work, not a lack of respect for men and women who served for sacrifice for their country. for that he sincerely apologized to any offended. we talked to timothy davis of the greatest generation foundation. he organized the veterans trip. is that policy enough -- apology enough? >> no. no way. as i said earlier on, my ten-year-old can produce a better apology than what cbs provided us. how tear you approach these veterans and hush them along? it was a disgrace. >> brian: some viewers are still outraged. they're threatening to boycott the show because of it. >> steve: speaking of the military, our next guest is fresh off a tour visiting our men and women overseas. >> brian: we're talking about chris daughtry who finished

fifth in "american idol" and somehow made something of yourself. how did you do -- welcome back. your impression of what we just told you about that story over in hawaii with those veterans? >> i don't know. i don't want to comment on that. it's a touchy thing. >> brian: but you just went and visit add whole bunch of veterans. >> brian: where did you go? >> man, everywhere. there was a few places they told us not to talk about or they'll electrocute me. we started in spain and ended in germany and went to the middle east and parts of asia. we literally flew over afghanistan. i was able to look out the window and see the mountains and it was extremely beautiful and hard to believe that's a war zone. it was a very rewarding thing for us to do and it was very humbleing. we were visiting u.s. air force bases and we get to go home for christmas and a lot of those men and women are there.

it was very humbling to see just a taste of what they go through on a daily basis. >> steve: one thing we hear when entertainers receive from overseas is they knew it would be moving, but didn't know it would change their lives. >> it was definitely a life changing experience i don't think i'll ever forget, absolutely. i'd be -- i would jump at the chance to do it again. >> steve: why? >> something we do anyway, that we're play music anyway, to see how grateful they were for something so simple, we're just going over there and doing what we do and it turns out they don't see a lot of that. the gratitude was overwhelming. >> gretchen: i know you're a family guy and maybe i was wondering if that pulled at your heart strings, too, because a lot of these members of the military have families and little kids back at home. >> absolutely. >> gretchen: we see all that video when they come home and the joy in hugging that parent. you have is it four kids now?

>> four kids. >> gretchen: this is your wife here if this beautiful photo. you had twins, right? >> they just turned a year old. they change every day. i go away for a couple weeks and these men and women are away from their kids, sometimes before they were even born. they don't see any of the stuff. it definitely made me appreciate a lot. >> brian: also one of the tips you have, i understand, christmas morning, is make sure if santa happens to get toys that need batteries, make sure you have batteries. that is one of the tips you have. >> i've been on the receiving end of not having batteries before and it can be a little hectic. >> brian: do you prefer duracell batteries? >> we actually use them on the road. >> brian: you do? >> for all our wireless packs, our mikes and everything.

step into a church, into a temple, into a synagogue and say, no, we want to do it our way. you can't do it your way. in this particular case, judge jones writing for the court of appeals in new york state, the highest court of the state said, listen, we've looked at this and it's been our determination that although these folks were, in fact, parishioners at one point of this church, in lower manhattan near the tunnel, originally a lithuanian church, designed to serve those immigrants, no one is going to that church anymore. there is no more baptisms, no more weddings, so we have to respect the decision of the arch bishop, cardinal egan to say no, listen, we suppressed the church as a religious matter. we're closing it down and now it's in bad shape. we don't have the money to keep it going. steve: can't fix the roof. >> we need to knock it down. so the court said, listen, we're going to stay out of this. we've looked at the rule of law and we think under new york state law, the roman catholic

emaciated. we rescue the ones that really need medical attention. we also rescue seniors and we try to rehabilitate them and get them into homes. >> brian: this is jack. jacks has been here before, right? >> that's correct. he came to us from the acc in brooklyn with a broken elbow, a broken front arm. and he had to have reconstructive surgery done. we did do the reconstructive surgery about six weeks ago, yeah. and now the pins are out, the rods are out and now he's healed and he's ready to go home. >> brian: that's fantastic. you did the surgery and this dog is really happy. so we got to get him a home. >> very playful. >> brian: he's a lot of fun. now, right now we also have terrence. by the way, what is the mix on jacks? >> i would say he's a pit mix. >> brian: we're still exploring. now over here we have terrence. terrence is a little shy. a year old, but so mellow.

>> terrence was we think dumped by his owners. he was living on the street for some time. >> brian: both from brooklyn? >> yes. >> brian: are they excited about the nest. you tonight know what his history is? >> no. we don't know how long he was on the street for. he was pretty skinny when we got him and a bit stinky, too. he's filled out quite a bit and he's a very happy go lucky dog. a big mush. >> brian: look at this. if you could zoom in. i love the way if you push one wrinkle town, the other wrinkle pops up. it's amazing. i could do this all day. but you were saying this would be free. correct? where could we contact if you we wanted to pick up the dogs? >> there is our web site. we have a web site with a phone number for forgetten friends on the web site and, yeah. we have rescue -- an adoption contract, adoption application that people would have to fill out. we do a home check. we make sure the people are going to give the dog or cat a

good home, that if they have pets in the house, that their pets have been to vets and there is a small adoption fee. but, of course, what people have to understand is that we fund raise for every cent that we get in to take care of the animals. our bills are high. >> brian: this reminds me of what steve and gretchen do when i do my solo act. they sniff each other and walk around each other. this is very similar. and steve will often lay down and gretchen will say please, steve, get up. this is fantastic. this is all fun. we got to get jacks a home and get terrence a home. and we're going to link it to kilmeade and friends -- excuse me.
