san francisco santas. >> is that crazy or what? >> bill: caution, you are about to enter the no spin zone, the factor begins right now. captions by closed captioning services >> bill: hi, i'm bill o'reilly. thanks for watching us tonight. suppressing the presidential vote. that is the subject of this evening's talking points memo. this year eight state have passed new laws that require voters to show photo identification at the polls. that makes 15 states which require a photo id to vote. some liberal americans object to id laws say they put the poor at a disadvantage because they might not have idi's. my question is why can't they get idi's? what is the duty of a citizen? it's to cooperate in the voting process, is it not? the id laws are obviously there to inhibit illegal aliens and other people not entitled to vote. isn't that a good thing? are we not a nation of laws? what is the beef?

the justice department is responsible for making sure each state conducts a fair election. attorney general eric holder has to sign off on any new id law. holder says he is concerned. >> are we willing to allow this time, our time to be recorded in history as the age when the long held belief that in this country every citizen has the chance and the right to have shape their government became a relic of our past instead of a guide post for our future? >> bill: i guess is he referring to jim crow laws or something to show an i.d. to me, the attorney general's rhetoric is theoretical. if he thinks a state is abusing the electoral process, he should say that right now mississippi is proposing the toughest voting law because it would require a government issued photo id. most other states accept all kinds of identification. let's take wisconsin, for example. the aclu is suing that state saying the use of a photo i

imposes a severe burden on the right to vote and 149 amendment. severe burden. this is insane. many cases you need a photo id to buy cigarettes. wisconsin will accept a driver's license, a passport, an id card issued by an indian tribe, a student id and most other forms of id with your picture on it. i mean, come on. that's a severe burden? what a crock. this whole thing comes down to voter fraud. we have it in every election. states want to make it more difficult to break the l in voting. they victim posed reasonable requirements and yet, the left octobers. that's the memo. now for of the top story tonight. the other side of the issue. joining us from los angeles dr. who teaches politics at occidental college. all right, now, will you spare me the poor can't get an i.d. card? you can please spare me that tonight? >> well, some poor can't get an i.d. card. >> bill: why couldn't they get it?

romney at 22. gingrich losing 6 percentage points in a week. why did he lose six? >> i think he had a bad debate. abc spun the debate that sponsored it, spun the debate as gingrich won because they made a lot of that $10,000 bet mitt romney had. newt was not nearly as brilliant as he has been in recent debates. everybody is ganging up on him. ron paul running negatives on him. romney. ann coulter and savage offering him a million bucks to get out of the race. you have the fear of exactly what you just reported. a lot of republicans are saying i like newt more than mitt. he is smarter, more conservative, more reliable in health care. is he also less likely to beat obama same going to vote for romney. >> bill: you see this trend continuing? the race tightening? >> yes. i definitely do. i think that this is going to be a much tighter race. and it will be a two-way race that will go down to the wire.

footnote colorado is one of just six states in the union not having mandatory sentences for child rapist. sharon a criminal defense attorney and the president of the institute. what's going on? why no action on jessica's law? >> you know, i think the answer is you have got to look at why colorado is still a left leaning state. here in colorado i believe the heart of most people is moderately conservative. this is a traditional red state. we have had a wonderful takeover of the left over the last three or four election cycles. well funded individuals infrastructure and created their own move on.org and media matters and think tank organizations and quite simply elections have consequences. >> bill: has there been a demographic shift? a lot of people move to colorado for quality of life there has been a lot of people coming up from mexico to work in the service industry, the

ski industry, restaurants in denver. has that changed the attitude in people in colorado. unaffiliated in democrats. that's stayed that way for a long time. there are more democrats now. democrats had a slight edge. >> bill: not as well organized and funded as the left. >> i couldn't say that. >> bill: as an attorney, you must know that 60%. 60% of convicted sex offenders in colorado are sentenced to community placement, that is probation, parole, or community service. 60%. i mean, that's dangerous, is it not? >> not necessarily. i mean, you have to look at what the law is trying to do when they are sentencing them to probation, to community service. it's not just a slap on the wrist which is easy for somebody to say oh they don't
