runaway car striking several men on the football field. we'll tell you how it happened and how these folks are doing now. >> gregg: we begin with the sprint to the finish line. mitt romney picking up a pair of major endorsements. influential des moines register throwing its support squarely behind romney and bob dole says he is backing the massachusetts governor, as well. as romney sits down for his first sunday show appearance in more than two years choosing fox news sunday for his exclusive interview. carl cameron. tell us about what these endorsements may mean. >> reporter: they could mean a little bit of support. endorsements matter do matter in presidential politics, particularly when there are

people that have run in raft in question. that is the case from bob dole the senator from kansas. he was the majority leader back in the '90s and nominee back in 1996. he has won the iowa caucuses twice. one of the few that can claim to have done that. it comes in the face of essentially a legislative partner with newt gingrich back in the '90s. he was the speaker back in 1994 and 1996 when bob dole was in charge of the senate. now, he casted his support behind romney. it comes on the same day as des moines register's endorsement. this is the largest newspaper. generally considered to be more left leaning than right leaning. it's not a conservative newspaper and it's endorsement means more in democratic races than republican ones but here what they said. wisdom and judgment. he stands out especially among candidates in the top tier.

gingrich would alienate rather than unite. with both of these endorsements today it becomes a look back at newt gingrich's time in the history as speaker of the house. it hasn't been put forth favorably by either the des moines register or bob dole. >> gregg: so they were duking it out on the sunday show talk shows today. tell us about that. >> reporter: romney hasn't given a sunday show appearance in many months. newt gingrich didn't plan to have one. he wasn't scheduled to be on a sunday show. it was a to prong approach he left for the campaign and went back to d.c. he is not in iowa and not in new hampshire. he had a teleconference and said he needs a ground came. cause of action us are a little

more than two weeks from now then he was on the sunday morning talk shows and he was surprised how well he is doing. listen. >> i thought i could fight my way back up to being in top three or four but i think positive solutions and ideas, it has attracted people. someone that is being positive. >> speaker says this is right wing social engineering. talking about unreliable. he kept the legs out an important message, with regards to cap and trade. this was the battle on capitol hill and he sat down with nancy pelosi and spoke in favor of legislation dealing with climate change. he has been unreliable and zany, i don't think you would call mirrors in space particularly practically or a nune are a

colony practical. >> reporter: essentially making fun and right wing social engineering is what mr. gingrich when he referred to paul ryan budget proposal and trying to sort out the budget problem. he acknowledged all the attacks from romney and others have taken a toll. we're 16 days away and still at this point, some of the neighborhood about 50% of the likely caucus goers are like to change their mind. >> gregg: carl cameron, thanks very much. so will landing the endorsement of the des moines register help romney win the support of republican voters? our political panel will debate this. plus, be sure and stay tuned with the interview mitt romney fox news sunday following this program at 6:00 p.m. eastern time. >> this weekend marks the end of america's military operations in iraq.

last night, just before midnight eastern time, the last convoy of soldiers crossed the border and into neighboring kuwait. greg palkot and geraldo rivera was there. >> we're down to one, two, three vehicles, when the last vehicle crosses through the border. that is it. all over. geraldo, the war is over for the united states. >> heather: and greg palkot is streaming live for us from camp virginia, kuwait. >> reporter: we were that the border for those of us who have been following this war for year after bloody year. it was an amazing scene. it was an historic scene. as you just heard we were there were geraldo rivera and here is a little bit more of what we said a little bit after what you just heard a.crucial moment in

that historic evening. take a listen. >> that is the last truck, the last troop, the last vehicle. the war is over essentially for the united states in iraq. there they are. hurrah as the u.s. army says. the world's media around here. there they are. >> there they are, indeed. last convoy consisted of 500 troops, 110 vehicles. they made their way five hour drive a camp that is deep in southern iraq and right to the end, militants in the region were going after blood. they said they wanted to kill americans but it was high security and no one was killed. no one was hurt. it went without incident. then, this convoy traveled further south, about an hour

into kuwait to where we are now. camp virginia, the vehicles were stripped down and ready to be shipped to other places, including afghanistan where another war is being fought. as for the troops, they are being processed right now and they are ready to be shipped out too. take a listen to some of the folks that we talked to today. >> how does it feel getting out? >> it's great. glad to be done and complete the mission. >> how does it feel to be last troops coming out of iraq? >> it's definitely of pride and sense of accomplishment and sense we were part of history. >> my grandkids will be reading about me. i will say i was one of the last once. >> how does it feel getting home from for christmas? >> it feels great. she says she doesn't have to call the commander in chief. >> reporter: it is a very good thing not to call president obama. it looks like they all getting home and welcome break for these

folks no have been fighting and working so hard for the united states and for iraq. back to you. >> heather: it's been a long nine years. home for the holidays at last. thank you. >> gregg: as the last of the american troops leave iraq, war stories with oliver north, 100th episode, looking back at some of the service and sacrifice of our men and women in uniform. here a preview. >> that is their home in st. louis, missouri, jason and his wife are living to the fullest, six children's ages one to 11. but when war stories first met frye back in 2003 he was a captain serving at camp pendleton, california. he was the father of two. >> when i was captain in marines i was commander of an artillery battery.

we had those marines and deployed. >> he was one of 93,000 troops in kuwait ready for their orders to enter iraq. >> we were right literally on the border of kuwait and iraq when the invasion kicked off. >> gregg: catch the entire episode beginning 9:00 p.m. eastern time right on the fox news channel. then 10:00, geraldo rivera is catching up with the troops as they prepare for their final trip home. >> heather: man credited with bringing democracy to the check 12 vii republic has died. he led them through the velvet revolution. following word of his death president obama said this. peaceful resistance shook the

foundations of an empire and proved that more leadership is more powerful than any weapon. he embodied the aspirations of half a content continent that have been cut off by the iron curtain and helped unleash tides of history that led to a united europe. he had a history of respiratory problems and he died in northern bohemia. >> third straight day rocking the egyptian capital with troops and protestors battling near tahrir square. at least ten people have been killed. hundreds more have been wounded. leland vitter has that story. >> reporter: this is most disturbing video we've seen come out of egypt since the revolution there, in many ways there are no words to describe how savage some of the beatings are. >> video shows army soldiers

clubbing defenseless protestors, stomping on their heads, they used long batons, beating women as well who were out on the street, of all things, these people were there to protest. the violence started when the egyptian army burned down a protest camp that had been set up and then the protestors tried to storm a government building. that is when things erupted. also rare for these situations, the army brought out live ammunition and so far a dozen people have been killed and hundreds were injured. an account by an american journalist where protestors were taken and then beaten. >> you might remember, a couple weeks ago we had huge protests ahead of the election and then things went smoothly but not the way the u.s. and western world wanted. islamic party took more than 60% of the vote. these protests have a lot to do with army to leave more quickly.

the army arrested erected a barbed wire barricade and there was call on facebook and twitter for women to come out mike o make a human chain and keep egypt from plunging into right lanes. >> gregg: thanks very much. >> heather: an extreme weather alert. death, devastation and desperation in the philippines after a tropical storm swept through. coastal toundz are hardest hit. more than 650 people dead and red cross workers expect that number will rise significantly. the area was ravaged by flash floods after receiving more than a month's worth of rain in just 12 hours. let's turn to the weather center here and weather here in the united states. maria joins us from the fox weather center with more.

>> we do have unsettled weather that is going to impact us here in the u.s. weekend was quiet. we did see a few snow showers across parts of the great lakes and still see them south of buffalo and light showers in texas. again, we're going to see big time changes and all because of this low pressure system across the southwest that is starting to bring in light showers across the phoenix area and parts of the southern california. as we head into tonight and tomorrow, this system is going to get its act together and pulling a lot of moisture and cold air. we'll start to look at potential blizzard conditions for northeast new mexico all the way up to western portions of kansas. we do have advisories issued with a lot of snow in the forecast for those areas, that includes the texas panhandle and oklahoma panhandle up to 18 inches of snow could fall. of course, with a blizzard it's not the amount of snow but the winds and those cold temperatures. wind gusts up to 45 miles per hour.

very significant blowing and drifting. there are a number of blizzard watches across northeast new mexico and oklahoma panhandle and with the same storm system on the warm side of it, very strong thunderstorms with potential for severe weather across texas and also parts of southwestern louisiana with isolated tornadoes possible. so we'll keep an eye on it. >> for folks traveling to the upcoming holiday. thank you very much. >> gregg: american soldier accused of slipping government secrets to wikileaks. what led to the biggest leak of classified information in u.s. history. the attorneys for bradley manning tried to explain his action. >> heather: caught on tape. an unmanned cart plowed through a crowded football field. we'll show you the painful outcome. my doctor told me calcium

early morning exodus marks the end of nine-year war that cost $800 billion and the lives of 4500 americans. >> john boehner opposes the bill of tax cut and jobless benefits for just two months. he wants congress to pass something that will last the entire year. and a soldier charged in the biggest leak in u.s. history claimed he struggled with being a gay soldier. bradley manning is accused of slipping secrets to the website wikileaks. >> gregg: new threats to the global economy, chinese government is saying that economic boom has slowed to a near standstill or least their version thereof. economists are warning that markets will see another downturn. brenda butner, host of bulls and

bears. the term economic slowdown is a relative term. it's dramatically different than ours? >> they have been 9% gdp and they might slow down 7 or 8%. we are at 1%. we could dream of 7% at this point. >> gregg: what does it mean to consumers at home? >> it's difficult, china really is an important part of the world economy. it's the second largest economy. we import so much of what they make because it's cheaper. now, this could mean good things. we'll be buying more of our own or we may have a chance perhaps to manufacture and make more of what we have.

>> gregg: our trade deficit is down for four straight months and that means exports are growing. that is break for us. >> we have been importing less oil. >> gregg: consumer confidence is up, rising consumer demand. you see good signs for the u.s. economy? >> i think there are good signs but it's hard to know. we have to look at january, a lot of that could be seasonal in terms of unemployment and we have to wait until after christmas to get a real sense of what is going to happen. >> gregg: employers added 120,000 jobs, but the caveat half of those jobs are temporary and a lot of people just gave up looking during the holidays for jobs. once january 1 rolls around they will start looking again. might we see the unemployment number reverse course? >> yes, we might. >> gregg: china has grown due to

the huge exports and also enormous government spending on infrastructure, but you can only do that for so long? >> you can. it's very interesting for china because it's such a hybrid of communism and capitalism. in 2012 they have a big regime change. they have been able to maintain basically unrest in the country by taking people out of poverty and bringing them into the middle-class but they are seeing labor unrest. there could be some problems in china. >> gregg: and they are anticipating a generational change in leadership that will take place in the next few years. that could fuel dramatic politics in china. i want to ask you about this. 22% tariff on u.s. made suvs and other vehicles. does that hurt us? >> we really don't export that much but they are biggest, they are huge market for anything.

we had a tear iv on cars. we have our own problems with trade and the rest, but they are a big market. you cannot ignore them. >> gregg: brenda, good to see you, thanks very much. >> heather: the job hunt, employment picture might look bleak for millions of jobless americans unless perhaps you might happen to be a machinist. they are in such high demand these days, the companies that train people for machine jobs actually have to turn away prospective students. live from los angeles to explain the sudden demand for metal workers. >> reporter: you're right, skilled laborers have been instrumental in u.s. manufacturing for decades but today quarter of the nation's welders and steel workers are nearing retirement age and fewer

young people are interesting the trades. the result is a shortage of skilled workers to run the machines that run our lives. >> there is a huge demand for machinists both in manufacturing and industrial maintenance side which is repairing equipment, refineries, water companies. >> reporter: the list goes on and on which is why machinist schools like this one in oakland are booming. once they get the hands-on training and master the precision that is required, they know a good paying job is virtually guaranteed, some with a starting salary of $30 an hour. some are straight going to trade schools to find talent, donating equipment and materials so student can be familiar with how it works and specific skills before they are hired. many here are looking at their second or third careers and like the idea of thinking with their

hands. >> it's not hard work but it's precision work. if you can pay attention to detail. it might be something for you. >> it's definitely where i can be challenged for a long time and have a career that will last a long time. >> reporter: the need is so great some students are hired after completing just one semester of school. a study by the national association of manufacturers says the largest impediment to future growth is a skilled work force which means training the next generation of machinists all the more critical. >> heather: thanks very much. >> gregg: hang on to your hats, freak accident. high school football game in texas. take a look at this, cowboy stadium, arlington, texas, runaway electric car plowing into a number of folks including the winning coach. the other folks were not seriously injured. still no word on what caused it

>> heather: it's going full throttle in american election headquarters, making their final picks right here on the fox news channel and today on the sunday talk shows. steve is live in washington. steve, what kind of news are the candidates making today. >> reporter: national front-runner newt gingrich is hearmgs home his controversial idea of holding federal judges more accountable on their decisions. it was triggered by a texas federal judge who blocked school prayer.

>> such an anti-american dictatorship of speech that there is no reason that america needs to tolerate a federal judge that is out of sync with our culture. one recourse is impeachment. >> reporter: some question the constitutionality of his plan which includes hauling judges before committees. some conservatives say it would undermine judicial independence. >> heather: and the other candidates going after gingrich over his plan for the judiciary? >> not directly but we did have a candidate jon huntsman today. he sees the issue as a major distraction at a critical time for the country. >> this takes our eye off itself ball of the core issues that are at hand and ultimately allow us to win the election. whenever we talk about that it takes the energy out of our economic deficit which is the issue of this election cycle. >> reporter: focus clearly on

iowa with the caucuses only 16 days away. batch manage says she sees the momentum shifting in her favor and paul and perry are pinning their hopes on that vote. >> heather: steve, vng you very much. you have a little more. >> gregg: possible setback for newt gingrich. rival mitt romney getting the endorsement of the des moines register, arguably the most influential newspaper in the entire state. so far gingrich is holding up as the front runner. take a look at the average here. real clear politics average has gingrich on top, ron paul in second. mitt romney falls behind in third. the question is by the endorsement by the newspaper sway republican voters. time for a fair and balanced debate. founder of a group and -- good to see you both.

matt let me start with you. des moines register opens up it's endorsement with this description of mitt romney, sobriety, wisdom and judgment. how much if at all does that endorsement help romney and adversely hurt newt gingrich which was described as mean-spirited, undisciplined which would alienate and not unite? >> interestingly enough, the endorsement could help gingrich. some of those qualities that they describe of him is what republican caucus voters are looking for. they are looking for somebody who is angry about the current situation, is willing to fight obama. romney's problem, with republican voters, he has had 17% of the votes in iowa. they have been running in the last five years. >> gregg: further what the editorial board said about

gingrich. despite his divisive reputation he says he is changed and bridge the partisan divide. gingrich juggles endless ideas but yet to make the case that he could focus his attention on the important ones. isn't that a quality of gingrich's ideas that can be an asset as matt was pointing out, and for the newspaper a liability? >> the voters don't seem to think so but newt has hit his high point with voters. that is what the polls seem to show right now. fact is iowa, he is coming under tremendous attack not just from the other candidates but also reliable conservatives like the national review and endorsement for romney doesn't help matters either. >> gregg: as we mentioned in the introduction, if you average out the polls gingrich has dropped about 8 points but still leads mitt romney.

i want to pointed to one specific poll that undermines all of that, rasmussen poll, it shows a drop, 20% down from 32% a month ago. romney reassumes the lead at 23%. do you think all the negative attacks on the former speaker are beginning to take a toll in the minds of iowans? >> without question he is battered right now. he is taking flack from all sides. he could see candidates like bachmann and perry and ron paul make a strong showing in iowa. this whole thing could change from now until new year's day. >> gregg: christy, what about those people that matt just mentioned. des moines register gave the assessment of all the other candidates based on the individual interviews. here is a snapshot. ron paul, quote, well schooled contrarian who shouldn't be written off as a nut even if some of his ideas are nutty.

rick perry -- his answers often ramble after a debate stumbles he asked to take a second look. rick santorum, he used the presidential bully-pulpit to be the minister in chief. bachmann, an impressive fireball that can regurgitate tons of information even if tons it turns out to be inaccurate. do you see any of those four individuals that have strong organizations in iowa pulling off a hawkeye victory? >> the fact is it really is anyone's game in iowa right now. there is no question there is 16 days to go a number of them have legitimate claims to win. could be ron paul, could be gingrich and outside chance somebody could come in, as well. the register endorsement

certainly helpful has not been predicted in the past. past president's, hillary clinton feel about their endorse ysd from the register in 2008. >> ron paul has a devoted following in iowa left over from his run in 2008. he has a strong ground organization there. in a state in which there is unique caucus process really demands a ground game. would you give advantage to ron paul here? >> i would. i think ron paul is going to be a factor no matter what happens between now and january 3rd. what i would look for is a candidate that can connect with mike huckabee voters between now and then. bachmann and perry are find fighting and santorum and they could catch up to the front-runner very quick. >> gregg: thanks very much. >> heather: the last american troops now out of iraq. our power panel takes a look

>> heather: welcome back. after more than eight grueling years the war in iraq officially over. the last u.s. troops crossing the border into kuwait early sunday morning local time. here with their thoughts on this historic moment for the u.s. is lis we will and judith miller and k.t. mcfarland. thank you all so much for joining us. one week before christmas and home for the holidays, these troops that headed out of iraq almost nine years, eight years they've been here.

march 2003, remember the shock and awe? and departure last night. >> it was eight years ago and wonderful to see the footage over the last couple days to see them coming home. one thing upsetting they are coming home, one of legacies. >> i think, military fought well and turned around a disastrous situation. we're coming home heads held high. political leaders of both parties. they said there were weapons of mass destruction and there weren't. they said it was cheap and easy it wasn't quick. they said it was going to be quick. it wasn't. at the end of the day we would have a pro-american iraq -- we don't. so it's a lesson we have to a define our mission and forces

adequate to achieve it and stick to that mission and not let mission creep takes over so ten years later we are left with a big question. >> 4500 americans. >> 40,000 americans were injured >> i think the other thing that really stays with me, having been there at the beginning and been there last year is watching the extraordinary determination of american forces, the kind of work with the iraqis, to make this work and make a success of it. at the very end the president of united states could not use the words victory to describe this nine-year involvement. i think the way in which we're leaving is kind of rush to the door, i'm really glad that everybody is going to home for christmas. wait that we're leaving does not maximize the chances that iraq is going to go the political way we want to.

>> for president obama to say a victory, doesn't it sort of pat bush on the back. he doesn't want to give him any credit at all. >> if it doesn't fall apart before the election. he is claiming a great victory. if it does fall apart it won't happen before the election. >> we won't know that. >> because in fact, the nrc the second largest bloc in the parliament they despise nouri al-maliki they are not going to participate in the parliament. >> so it could wreak havoc and anniversary of the arab spring and marks the one-year anniversary of so-called arab spring, wave of uprising begin with this man, he set himself on

fire to complain about mistreatment by police. i know we've all been there from the beginning. this has spread across all these countries. where do we think this will end? >> from any revolution, act two can all the rebels get together and learn something, act three they get it together or they don't. but a reeth ruthless and violent minority takes over. >> i think in tunisia things were looking pretty optimistic. they had an election, tunisia is very orientated towards europe. they want what europeans want. other countries especially egypt 80 million people that is much of the arab world, my sense

their situation is deteriorating quickly. i wonder how long it's going dictator was terrible but maybe he wasn't so terrible. maybe the army isn't so wonderful as we thought it would be. >> isn't it incredible the receive resolution was started by one 26-year-old. >> the ingredients are all the same. >> and also leaders who will not let go. they air is they were going to hand power down to their sons and people said, no. >> heather: at christmas just a week away, we mentioned it's possible big holiday traditions may not be seen before. what is on the endangered list and why? we'll talk about that up next. stay with us. i'd race down that hill without a helmet.

it was music to the ears of millions of americans. it faces an uphill battle in the house. leadership making it clear they are not happy and some that voted for it is calling for a revision. peter doocy has this report. >> reporter: they opposed the senate bill because they think it's offensive to the middle-class. that is what an aide told fox late last night. speaker of the house made clear just because the bill containing a two-month payroll tax cut extension passed the senate doesn't mean his members to have like it. >> it's pretty clear i and our members oppose the senate bill. it's only for two months. president said we shouldn't go on vacation until we get our work done. frankly, house republicans agree. >> reporter: yesterday president obama said this about the plan the senate passed. while this agreement is for two months, it is my expectation

in fact it would be inexcusable for congress not to further extend this middle-class tax cut for the rest of the year. >> reporter: when the house comes back tomorrow monday, eric cantor says they will amend the built so it's responsible and in line with the needs of hard working taxpayers or pass a move to conference to accomplish it. harry reid fired against that house plan saying this afternoon speaker boehner refuses to vote on the bipartisan compromise that was passed with 89 votes, republicans will be forcing a thousand dollar tax increase on middle-class families on january 1st. speaker boehner summed up the problems the legislative branch has been having. there are two things that people should never watch. sausage being made and laws being made. it's not a pretty picture. >> heather: peter doocy.

thanks peter. >> gregg: house republicans aren't the only ones that might be grumbling. home buyers could get burned, as well. part of the payroll plan would attach increased fees. maybe you can call them taxes to certain mortgages, fees that would hang around for entire life of your loan. brenda butner is a fox senior correspondent. we're going to pay for a tax cut increasing taxes, we'll call it a fee. >> here is what is interesting, the tax cut is for two months. it will take ten years for these mortgage fees to pay off. >> gregg: $36 billion for payroll tax cuts. >> that is the math that makes sense. >> gregg: i would have flunked that kind of math. which makes me perfect for

washington. >> exactly. >> gregg: essentially you are putting money in one pocket and taking money out of another pocket. >> you absolutely are. this is only people that are going to buy homes or refinance homes through fannie or freddy or fha. that is nine out of ten mortgages. the white house says what they are trying to do and congressional leaders are trying to do is get people away from fannie and freddie and move them toward privately backed mortgage companies. so many people go to fannie and freddie. >> gregg: let me do the math here. this my kind of math. if you have a $200,000 loan per year you are going to pay 180? double it 360. is that the kind of incentive that would make people want to go to the private marketplace for loans as opposed to fannie and freddie? >> what it really does, but the

payroll tax cut is supposed to help the recovery. one key to the recovery is the housing market. what you are doing here is adding on to your mortgage. essentially, this adds on to your mortgage and then your mortgage company takes it and sends it to the treasury. the housing market is in a shambles. this is not going to be the incentive for home buyers and refinancing. >> gregg: payroll tax cut on social security to put more money in your pocket to spend that money to boost the economy. also depriving $360 a year out of people's pockets so they are going spend that much less? >> yes, exactly. >> gregg: for a rational person it doesn't make a whole lot of sense? >> you are saying rational again? >> gregg: revenue from the tax, from the increased tax doesn't go into the social security

trust fund, does it? >> no. >> it goes into the general fund. so are not putting the money back where it belongs? >> right. >> gregg: why? you don't know why. >> i'm not quite there. >> gregg: so they can spend it on something else. otherwise it would be earmarked for the appropriate fund for which the money was going to be spent. >> bottom line this isn't going to help the housing market and, if you are going out there and looking to buy a house, just know there is going to be an extra fee. >> gregg: this may not pass the house of representatives, so it's not a done deal. >> no it's not. >> a lot of guys were on conference call, i don't like this. american public is not going to like this principally is kicking the can down the road for a couple of months. >> this is hidden in there. it took a little digging around to find it. >> gregg: yet the white house

>> who else needs help? >> catch the entire episode tonight starting 9:00 eastern on the fox news channel, and at 10:00, geraldo rivera catching up with the troops as they prepare for their final trip home. greg? >> switching gears now, the united states supreme court announcing this week it will review arizona's controversial immigration law deciding whether the state is entitled to impose some tough measures aimed at catching illegal immigrants despite the objections of the white house. now arizona's law in part requires state and local police to check the immigration status of anybody they think is in the country illegally. they also have the ability to check the status of any one they arrest, and legal immigrants required to carry their papers with them. federal law already requires that legal aliens carry their papers here. >> right.

>> and in fact, federal law goes even further than arizona's law, saying that federal officers can stop anybody anytime, any place, and ask for documentation. so how did this usurp federal authority? doesn't it complement federal authority? >> many parts of the arizona law do complement federal authority, i would agree with you, until they don't, until they overstep that. you were talking about, for example, pulling somebody over and asking for papers. well, arizona law makes that a crime, whereas a federal law that's a civil violation. in that case that's overstepping what the feds do. there are a couple other examples as well. the state law allows police officers to, you know, pull somebody over without a warrant, without probable cause -- >> the feds can do that, too. they don't need probable cause. they can stop me or anybody anytime anywhere and ask for papers. >> that's in the purview of the federal government, delineated through the federal government.

>> this doesn't reinforce federal law? >> many provisions do reinforce federal law. that's 80s a mixed bag with the supreme court. >> having police check on the status of suspected illegals during a lawful stop places what they refer to as an undo burden on the feds. since when is enforcing existing law somehow an undo burden? >> well, listen, this could be cut a number of different ways. it comes down to an issue of federalism, irrespective of what provision you're talking about. you raise a good point. some provisions will be upheld, others will not be. it comes down to whether or not arizona should be entitled to enact and invent laws that are not federal in nature. now, here's the point to this. we have to have a uniform system. we're called the united states of america for a reason. we're united. if we allow each state to enact laws that might differ or be contrary to federal law, we would have a problem. i also think that the precedent that would set would be harmful

in general to everyone concerned. so there are good measures of what arizona's trying to do, and i get it, however to the extent that they may surpass and overstep those measures they will be struck down. >> you know what, in the past, the supreme court has said that states may take steps to increase enforcement of existing federal laws. >> right. >> and five different federal circuit courts have upheld state action -- states arresting illegals e, the fourth, fifth, ninth, and tenth circuit courts. >> that's why the supreme court does have to step in. five appellate decisions already out there, but they aren't in measured with a lot of the other -- you don't want different states with different laws. joey, i take issue on one point, and that is the resource allocation. this idea that, wait a second, it's going to be too much of a burden on the feds to impose the laws on the books, that's crazy. >> you know what, it takes 81 minutes on average to check the federal database to check somebody's immigration stats do it.

that's what it's there for. >> 81 minutes for goodness sakes. >> it comes down to the issue of federalism. there's historically been that fight over whether or not the federal government should be dominant, should they be the ones, and shoot issue be preempted, should the federal government speak on that issue? >> to give police powers inherently to the states. when their border is on another one, don't they have the police authority? >> well, i think in some respects you're right. why? because if you look at arizona, you look at 370 miles of their border, which are porous and could permit for illegal aliens to come in. at the same time you have the federal government working with them, because you have border patrol agents, drones, surveillance. the federal government is involved. >> isn't that concurrent authority? concurrent authority. >> that's the argument the states are making, the states especially on the border, because the federal government has not been living up to what they're supposed to do, so they have to step up as just the police power. it's a question in that arizona

law of having -- if it goes too far. i gave you a couple of examples. >> right. >> that the supreme court can hang their hat on that and say -- >> that's not a distinction without a difference? >> i don't think so, when you talk about some of those provisions. look, black and white letter law, they go further than the feds. >> let me ask you this, joey. the supreme court already has sort of a narrow conservative majority, kennedy's the swing vote. elena kag gan, when she was solicitor general, she did get involved in the litigation here. he's recused herself from being involved in this decision. does that give arizona an advantage before the high court? >> well, think about it this way. now, she's doing a right thing to speak to that issue. in the event you're involved in it, you've already declared there's going to be a lawsuit, you shouldn't be participating. i credit her in that regard. at the same time what it comes down to is there being a 4-4 tie. in the event that it's a 4-4 tie now you have a situation where

the court is not over -- you know, they're not ultimately overruling a law, because you need the majority. >> what it means if there's a 4-4, a tie, the ninth circuit prevails, which strikes it down. >> blocks those four provisions, a couple of those we spoke about. >> but allows other provisions to stand. >> , yes unless something untoward happens, that the what will happen. >> some folks say kaggen decided to recuse herself in the immigration case because she doesn't want to recuse herself in a more important -- >> healthcare. >> right. >> i don't know that's true. i do agree with you that she did the right thing. she was solicitor general. she helped file the lawsuit against arizona to strike down that law. she was a counselor and advisor. with the healthcare issue, she can say i wasn't a counselor -- >> she handed it to off somebody else. >> all that's on paper is a couple of emails to larry tribe, the professor at harvard. >> i don't think it shows bias. i think the emails when she says

>> welcome back. let it snow is more than a christmas carol, it's a mantra for businesses at the mercy of mother nature, especially this season. warmer-than-normal temperatures though are taking their toll on ski resorts in the new england area specifically. fewer than half are even open right now. julie bandaras is live in our newsroom with more details. hi, julie. >> that's right. no one is dreaming of a white christmas more than whose jobs are counting on it. for many seasonal workers, if there's no snow, there are no jobs, a big problem, especially in vermont, where 30% of the state's workforce are seasonal workers, and ski slope employees are being told to not even bother going to work this week, making bare trails like these even more painful to look at it. as of wednesday, only 16 of northern new england's 52 ski areas were open. in pennsylvania, only one of the state's 24 ski areas had opened as of last week.

in upstate new york, the ski areas that are open have very limited terrain. since mother nature isn't producing her own white stuff man-made snow is the only way to go, but unseasonably temperatures making it nearly impossible for man-made snow to stick. nighttime temperature, a recipe of 10 degrees, is considered optimal for snow making, but temperatures mostly have stayed in the 20s overnight, a gamble ski resorts are dealt every year. >> it's just the business that you're in. you know that there will be good years and there will be bad years. you know, you take it for what it is each year that you come. it does balance itself out. and with mother nature, you know, we're due for maybe not having as much snow as we've had in the past few years. we'll see. >> northeast ski resorts generally try to open by thanksgiving. last year, it was a good year for northeast ski resorts, but the prior years were bad, coupled with the economy many are struggling to survive. heather? >> thank you, julie bandaras live in our newsroom.
