we'll follow the election as it continues. liz, good to see you. >> good to see you. >> we're not going anywhere. we're out, shannon bream is in. >> thanks, you guys. wow, what a great showing! thank you, nevada! you know, this is not the first time you gave me your vote of confidence. this time i'm going to take it to the white house. >> mitt romney's running high after a big win in nevada. he finished ahead of newt gingrich by more than 20 points, but there are new battles looming for the gop field on tuesday. john roberts is live in las vegas where we don't have the final results. good afternoon, john. >> shannon, we'll get to that in just a second, but, first of all, get to last night. milt's victory party at the red rock casino was a big one. he took on secret service protection.

take a look at this picture working the rope line after his victory speech. he's beginning to look like a nominee. he's got two big wins in a row, three in total, and last night he ignored his rivals, focusing strictly on president obama making this look like it's already a two-man race. take a listen. >> our campaign is about more than just replacing the president, however. this is really a campaign about saving the soul of america. president obama says he wants to fundamentally transform america. we want to restore to america the founding principles that made this country great. >> now, at this point mitt romney leading with 47.6% of the vote. that's not going to change. newt gingrich is in second place with 22.6%. and ron paul behind him, about 19%. here's the issue -- only 50% of the votes in the biggest county,

clark, which includes las vegas, have been counted. got a picture to show you. this is the clark county gop headquarters. the parking lot is empty. they're not counting votes right now. apparently they were counting until 4:00 this morning. they want to be very careful, because only 1,000 votes separate newt gingrich and ron paul, and they want to make sure there's no error. they're supposed to to reconvene in the next few minutes to start the counting all over again. we had heard there might have been problems with counts of the secret ballot, not matching up with the number of people that were registered. i just got off the phone with the state gop chair, and she says she's not aware of that happening, just want to make sure that the count is accurate. as for the total vote, looks like fewer people turned out for these caucuses back in 2008. so far it looks like clark county is going to be about 5,000 off from four years ago. that may actually bode well for ron paul as he tries to take second place here.

his calculation was the fewer voters that turned out, the better he would do. we won't get the vote count until a few hours, but we'll let you know as soon as we get it. >> you have beautiful background noise there. thanks for reporting through the sound. >> bells of the venetian. >> beautiful. >> all right. >> well, he might not have won in nevada, but newt gingrich says he's staying in the race all the way till the republican convention. he may not be the only one. casey stegall has more. hi, casey. >> speaker gingrich knew heading into nevada he was coming in with a disadvantage. meanwhile mitt romney is wildly popular in this state. the former massachusetts governor, as you know, won nevada back in 2008 with 51% of the vote. and gingrich also knew that ron paul does especially well in caucus states. as you just heard my colleague saying, gingrich and paul really vying for sending place here in nevada as we're waiting for the remaining votes to be tallied. we were here at the venetian hotel last night where gingrich

held a press conference and dismissed any claims that he was dropping out of this race. listen. >> what happens is every primary day, or caucus day, the romney headquarters in boston sends out the rumor that they believe i will withdraw, which of course is their greatest fantasy. i'm not going to withdraw. i'm actually pretty happy with where we are. and i think the contrast between governor romney and me is going to get wider and wider and clearer and clearer over the next few weeks. >> meantime former pennsylvania senator rick santorum appearing on "fox news sunday" where he talked to chris wallace about turning his campaign around following a third place finish in south carolina and florida and a last place finish it's looking like here in nevada. >> now we're getting into the states where people don't have the natural advantage, don't have the time commitment and staff commitment to really build out an organization like they did in the first five.

i think we're going to do very well here in minnesota. i think we're going to do very well in colorado. >> and santorum also feeling pretty confident about missouri as well. the show me state holds its primary on tuesday. a lot of campaigning there, because he sees a golden opportunity, shannon, as you know newt gingrich is not on the ballot there. >> could make all the difference. casey stegall, thank you very much. >> yes. >> newt gingrich is being sued by a ron paul supporter for more than $75,000. a florida man claims one of gingrich's security guards intentionally stomped on his foot, fracturing it during a florida primary. eddie dillard says the confrontation happened after he shook gingrich's hand outside a polling place. >> immediately when he saw i was a ron paul supporter, he turned his back to me and started greeting other people. >> dillard was wearing open-toed sandals. his lawsuit claims a gingrich aide dug his heel into dillard's skin. ron paul's campaign has asked gingrich to apologize. all right, it is your turn

here's more details. hi, steve. >> with pressure mounting on iran, it's revolutionary guard has launched yet another round of military exercises. now, these are ground exercises in the southern part of the country, and come against a backdrop of tighter sanctions and new threats. iran is saying it will cut off european oil supplies in response to a european embargo. it's threatening to close offer the strait of hormuz. today a military commander warned any country that helped in attacking iran would become a target. at the same time u.n. nuclear inspectors went to iran without achieving their goals, even though the u.n. sees progress. >> they achieved a great victory. they had a

from miami to washington, d.c. so israel is in close proximity to this threat. and again, just on friday, the religious leader on iran called israel a cancer that must be cut out. and so iran's intentions are more than clear. they do intend to wipe israel

off the face of the map. israel has very few choices. they must protect the safety of their people. that's why you're seeing the conversations that are extraordinary in the last few days. >> what do you make of word that bubbled out from the pentagon this week that there are real concerns, at least there, that israel is going to act on its own sometime -- they mentioned april, may or june. i mean, that is just weeks away. >> it is just weeks away. of course, this was made by our defense secretary, leon panetta. but also look at the results of the election that occurred in kuwait just yesterday. we saw, again, a majority of the seats taken by radical islamists. that occurred in egypt. we've seen a tremendous change and shift in radicalization in the middle east region. israel sees that. that's not lost on them. they see their hostile neighbors are becoming even more emboldened, even more hostile. that's why israel is looking, i

believe, at a position of having to act to protect the security, and the defense secretary, i think, is commenting on the very reality of what is occurring now in the middle east. >> well, in addition to threats to israel, there is talk this week about iran possibly attacking here on u.s. soil. what can you tell us about that? >> well, of course, that was the one public hearing that we have with the intelligence committee. we had the national director of intelligence, also the fbi director, and cia director, former general petraeus in front of our committee, and they stated this informa a increased aggressive attacks indicated by iran on u.s. soil, as many of your viewers know, the iranians had attempted an assassination of the saudi arabian ambassador in washington, d.c. this was their attempt. they've also indicated that they will likely have more increased attacks in the united states.

we have to be vigilant. we cannot take this lightly. we must do everything in our power to stop iran. iran is clearly an aggressor. we must treat them as such. >> and congresswoman, i got to ask you about a little bit of political news of the day. you're somebody who knows what it's like to be on the trail for the gop primary nomination. are you worried at all about the fact that everybody who's in now seems to say they're going to stay until the convention, or do you think that's a good thing for eventually vetting our nominee? >> it's a part of the process. i think we're seeing some upsets. here in minnesota, for instance, we will have our caucuses this coming tuesday. and the latest polling data that comes out has rick santorum at the top of the polling data. that's different from what people thought. he may show well in missouri as well. while in some respects it looks as if there's a closing in on the nominee, some of the states

are opening up. it's far from over. >> it is. republican voters have a lot of deciding to do in the states ahead. congresswoman michele bachmann, thank you very much for your time. >> a pleasure. thanks, shannon. >> despite international condemnation, syria says it's not stopping its crackdown. this is amateur video that appears to show the military is still attacking that battered city, a day after activists say government forces killed 200 people. western countries and arab countries are outraged that russia blocked u.n. security council action on syria. an official from qatar says it's a signal that president assad has a license to kill. secretary clinton called it's a travel vestee. it's a campaign promise that some say president obama has not kept his promise. and it's super bowl sunday. that means people will actually watch the commercials on tv. >> how can i handle work on a

>> if i don't have this done in three years, then it's a one-term proposition. >> shannon: that was an interview president obama did back in 2009, part of a new campaign run against him by the rnc, but in a poll it shows he's still ahead of a gop candidate. gentleman, welcome to you both. >> good morning. >> good to be with you. >> shannon: sean, you're smiling. i know you like the ad. are you wanting to close on the promise the president made? >> his words speak for himself, he said if he didn't have the job done in three years, it was a one-term proposition. i want to hold him to his standard and wish him well going forward, because i think we'll put a republican back in the white house based on his failed record. >> shannon: this week, improvement in unemployment

numbers, somewhat not expected, not a great number, but at least it's moving in the right direction. >> over 200,000 jobs in the last month, unemployment has dropped over the past five months, close to 4 million jobs over the last year and a half. that's much better than what the president inherited from the last administration. i don't think the american people want to go back to the failed policies of the past where you saw an economic crisis caused, you know, result in a major bush bail-out. you also had people looking for jobs, manufacturing was hurt. i don't think people want to go back to that time. so the numbers, i think, both economically and also if you look at the polling, the president is doing well, head-to-head, and in key battleground states. i'm feeling pretty good about the president right now. >> shannon: will your nominee take the country backwards? >> that's ridiculous. gallup came out with 50-state polling this week. 47 of the states, the president has gone backwards. in the other three, there are

only three states where he's actually improved, and some of them aren't that good. overall of the 50 states, only in 10 of them is he above 50%. so the polling doesn't bear that out. second, on the economy, on his record, he's added $4.5 trillion to the debt. gas prices are through the roof. healthcare costs are up. grocery costs are up. when you ask people in terms of is this country on the right track or the wrong track, 70% to 80% say we're on the wrong track. that's not a record to run on. >> if you actually look at polling in florida he's beating mitt by 10 points. he's beating mitt in his own backyard of new hampshire by 10 points, in ohio. if you look at economic indicators across the board, the president is in a much better position than where he started. we had a great day on friday on wall street, in stocks. and so i think that when people, again, compare his record to what -- you know, whether or not they want to go back to the failed policies of the past, i think the president is going to

be in good shape. >> shannon: i want to play a little bit of his remarks at the prayer breakfast, national prayer breakfast, that he had this week. let's take a listen to those. >> but for me as a christian, it also coincides with jesus' teaching that for unto whom much is given, much shall be required. >> shannon: it's no secret that religious voters are very important in any national presidential election. there were some who thought that the president's speech was a little bit more political than they expected for a prayer breakfast. how do you think religion may play? >> two things. on his comments alone, the top 1% of wage earners in this country pay 40% of all the federal income taxes. the top 10% pay 70% of all federal income taxes. so his bible verse is accurate. the rich are paying, not only their share, but plenty of it. second, in terms of his attempts to reach out to the religious community, this morning in church the pastor read a letter from the bishop of virginia,

talking about this administration's attack on religious freedom and the first amendment. so he has a problem with religious leaders, especially in the catholic church. i would argue throughout all serious religions, whether it's judaism or christian. this submission has had a full-on assault on religion, and he's got a major problem with folks that that's a core reason to vote. >> shannon: doug, how does this administration respond to those charges? >> that's absolutely nonsense. there's no full-on attack on religion. that's crazy. i think the president has reached out to all religions, whether it's christianity, judaism. he's been very open. the white house has embraced many faith leaders. i think the republicans are actually worried that the two candidates that they're running right now may have a problem with faith leaders themselves if they end up being the nominee. i mean, you have newt gingrich who i think may have some problems with value voters. and again, you know, mitt romney may have a problem, too, with evangelical voters. i think this is about them trying to attack the president

now before the general. so i think it's just crazy to say that he has -- he's been attacking religious leaders. that's nonsense. >> but again, just to be clear, that's not what we're saying. that's what every bishop in america says. so it's not what the republicans are saying about -- >> every bishop in america? come on. >> absolutely, every catholic busch has read a letter to their congregation telling them about this administration's attack on -- >> you're talking about the contraceptive issue. >> i'm talking about the catholic churches, the -- >> catholic bishops, again, if you a lot the policies we passed, the catholic church was pretty supportive of the healthcare reform bill. >> shannon: certainly a key constituency that will be have to be persuaded when it comes to november. we'll see how it plays out. sean, doug, thank you. >> go patriots. >> shannon: oh, no! >> go redskins are. >> shannon: sadly the redskins will not be in the super bowl this year.

ducey has your top story. >> the four remaining candidates are looking ahead to the next election contest, colorado and minnesota. mitt romney handily won the nevada caucuses, and right after that newt gingrich reiterated he plans to campaign all the way to the republican convention in tampa. eight american sailors have been discharged because of hazing. a navy spokesperson says the sailors were accused of assaulting and choking a fellow sailor as part of a initiation rite. a trio of mushroom pickers have been found safe and sound after getting lost for six days in an oregon forest. officials say the three took shelter in a hollowed-out tree. all three were taken to the hospital for minor injuries. a north carolina woman was arrested for causing a commotion at a mcdonald's drive-thru. police say the woman cut the line and went straight to the

pickup window and refused to leave until she was served. police had to use a stun gun to subdue her. the woman's child, in the car at the time, was taken into protective custody. those are the top stories right now, shannon. back to you. >> shannon: i mean, there's delicious stuff at mcdonald's, but nothing really worth getting tasered for. >> maybe at burger king, but -- >> shannon: at mcdonald's. peter, thank you. who is the true conservative in the race for the white house? america's top conservative thinkers will gather in the nation's capitol to debate that this week. the conservative political action conference is a meeting of the minds and chance for debate to hear from most of the gop candidates and other headliners, including a republican senator who says president obama is trampling the constitution. in fact, the president used his weekly radio address to fire back at our next guest, senator mike lee of utah. senator, thanks for joining us today. >> thank you, shannon. >> shannon: you say this has to do with the recess appointments the president recently made when

the senate wasn't in business. he says he's justified in doing it. where's the rub? >> the rub is the president doesn't get to decide when the senate is in session. ours is not a government of one, and the minute he decides that he has the power to say that we are in recess when in fact we had just had a session one day earlier is dangerous. and it threatens to take away the senate's advice and consent prerogative to make sure we have the ability to confirm presidential appointees. >> shannon: primarily what we've been talking in recent weeks, appointments to the neighbor relations board, and richard cordray to head up the consumer bureau. you have vowed that you will block other appointees and nominees, and the fire president fired back saying a senator from utah has promised to obstruct every appointment i tried to make, and one senator will gum up the works. is that your plan? >> well, of course i haven't said that. the president has taken it upon himself to be my spokesman.

those are words i've never uttered. i said i've been cooperative up to this point, voting for a lot of the president's nominees, with whom i disagree on a variety of policy issues, but that my almost complete cooperation up until this point, and now, and i will start resisting when it comes to reviewing those nominees. i haven't indicated in what form that resistance will take, but the president has nonetheless taken it upon himself to tell me what i meant. >> shannon: all right. the administration is relying on guidance from the department of justice, from the office of legal counsel, saying that the president can make judgments about the senate, when it is and isn't in business, and basically the letter outlined the fact that what was happening in the senate was nothing at all, there wasn't real business to be done there. you say that's not the call for the president to make. is it the senate's? because it's still being led by democrat harry reid. who makes the call? >> well, the senate makes the call. we are a coordinate branch of

government. just because the president thinks we aren't doing enough at any given moment can't mean he can thumb his nose at the constitution and install people into high political appointed positions without any role for the senate to play in the confirmation process. so we think this is a dangerous precedent, and under the analysis outlined in that 23-page, single-space memorial day you that referred to, it's just a short hop to get where the president is now to the point he could easily say, using the same analytical framework, that every time the senate breaks away for the weekend, he can recess appoint someone else. >> shannon: senator, you'll be speaking at cpac this week. is there somebody in the field that most lines up with your philosophy, your understanding of the constitution and these issues? will you endorse someone from the primaries wrap up? >> i don't think so, shannon. like most republicans, i'm eager

to get behind whoever the republican nominee is. i think we'll know within the next few months who that will person will be. i'll be anxious to get behind that person once that becoming a-pointer. >> shannon: senator mike lee, thanks for your time. >> thank you. >> shannon: fresh off another loss to mitt romney, newt gingrich, rick santorum and ron paul are promising to keep the race going. that has us wondering at-home if you think a prolonged primary strengthens or weakens the gop eventual nominee. we've heard from many of you via twitter. mark says, a prolonged primary will hurt as long as these candidates continue to go negative against one another. >> a marine's wife, mother of two, is dead after a propane gas explosion outside a california training base. marines released a statement identifying the woman as

>> shannon: the susan g. komen foundation is struggling to clean up this week's pr mess, hiring a public relations consultant to deal with the controversy over pulling funds from planned parenthood and reversing the decision. it held calls with local affiliates addressing the concerns yesterday. there are concerns that supporters of the breast cancer charity will pledge their support elsewhere. in montana, the u.s. forest service has just renewed a

permit for a statue of jesus that sits on federal land. an atheist group says it will sue the u.s. forest service because the statue has no place in a national forest. the debate on the separation of church and state continues with our panelists. welcome to you both. >> thanks, shannon. >> thank you. >> shannon: what are your objections to this statue? it's been there since 1953, put there by the knights of columbus, but you say it needs to go. >> yes. the forest service should never have given a lease to this catholic men's club to place a shrine, a religious shrine on federal land. and the purpose was clearly always religion just a moment it's in the permit and application. they've never paid any money, by the way, and this has been renewed every 10 years. we are suing tomorrow in missoula federal court, charging this is an unconstitutional endorsement of religion and

improper use of federal land that excludes those of us who are not christian, who are not catholic. the 15% of us who are not religious shouldn't have to support a shrine to jesus on federal land. >> shannon: jordan, where is the line? >> it's been there since 1953, and no one's complained until 2012. now, 2011, when you had freedom from religion foundation, and this is the group that is against under god in the pledge, our national motto in god we trust, a national day of prayer, i'm sure would love to lambaste religious references around washington, d.c., maybe moses from the supreme court and 10 commandments. this has got a historical reference. the reason why this statue is very different than other statues you'd see anywhere else in the country is because it's a copy of what soldiers, world war veterans, saw in europe, looked through switzerland, look through poland, eastern europe as well, and you see these statues. they came back, and it was to

honor world war veterans from montana. no one's ever complained. you can't make up a constitutional controversy over something that's been there since 1953 and no one has said that it's not used for worship center, for a facility, knights of columbus follows the rules. freedom from religion foundation tried to pull a fast one and tried to get the forest service to pull it, and they reversed -- >> shannon: you said that the forest service did open a public comment period after a freedom from religion raised concerns about this, and said we don't feel like this is right. they had a comment section. eventually that was closed. we're told that the majority of those weighed in favor of keeping the statue. annie, even if the public comments that the government has gone a step too far here? >> you don't take a poll on whether to obey the constitution. the bill of rights places freedom of conscience above

one of the ads supporting newt gingrich says george soros said there is not much difference between mitt romney and barack obama and they link to the video of him saying that. how do you respond? >> ironic that newt gingrich would be making a charge like that because it was george soros that funded the group that paid for the global warming ad that newt appeared in with nancy pelosi. he will mentioned this last night at his news conference. that was a sad spectacle. i think people were surprised by the venom that he displays. we look for certain qualities in our president. magnanimous in victory, cool in defeat. at the very least exhibit the same qualities of good sportsmanship that we expect of our young children. he did not look becoming and certainly did not look like a president. >> shannon: he continues to say he is the only true conservative in the race, newt gingrich does. i want to look at exit polls that came out of florida.

41% of those who voted there where you had a clear win felt that your candidate mitt romney is not conservative enough. a charge i'm sure you have h heard many times. how do you respond to that? >> i tell people who are curious about what type of president mitt romney will be to look at how he governed in ms. . he was a conservative governor in a very tough place to be a conservative. he vetoed an embryonic cloning bill. vetoed a bill that would have provided emergency contraception to young girls without age restriction. cut taxes 18 times. balanced the budget four years in a row and left behind for his successor $2 billion in a free cash fund. there is not many governors who can say the same thing. he is a conservative both fiscal and social and demonstrated that as governor in massachusetts. >> shannon: eric, congratulations on your win last night and we will be with you on the trail this week. >> thank you. >> shannon: all right.

mitt romney says he will focus his efforts on helping the middle class. what exactly is the middle class these days in 2012? fox news senior business correspondent brenda buttner has details. hi, brenda. >> the middle class has always been a hot button topic especially in election years but congress asked the research arm to define it. who is the middle class? researchers did what they did best. number crunching. taking numbers from the census bureau. first in 2007 and updated three years ago. the congressional research service crunched income levels and defined the middle which is a bit above $50,000 a year. that was the easy part. how far on each side of that number to take the middle income was the next question. the researchers decided to divide income levels into five and to use the three in the middle. that would make the middle class any household with income between $20,291 and $100,000 a year.

now, things get a bit harder because even capitol hill's research team knows that middle class is not just numbers. very few, only about 1% to 3% of the population thinks of itsself as upper class. everybody on top likes to be average. and the bottom doesn't feel it makes enough to be in the middle. so in the end, the numbers are just, well, numbing and don't tell us were. even the chief number crunchers admit this. the report says the middle class is probably closer to, say, $40,000 to $250,000. and get this, this is the real giveaway. a quote from the report. what constitutes the middle class is relative, subjective and not easily defined. now, this from the guys who are paid to define, specialists to make the subjective objective and transform political footballs into presize packages of neat numbers.

charge? >> if you want to get out of the politics of it, step down and resign. it is clear there are mistakes made. nobody has been disciplined. nobody has been fired. they just shuffled personnel around. >> shannon: the department of justice is taking some heat from one of our colleagues, representative daryl issa. are you not getting the answers you are looking for? how do you feel about the amount of documents they released so far? >> we have less than 10% of the documents that they have used on their internal investigation. plus, they are not releasing any documents after the congressional in quer inquiry . as a former attorney you know a lot of times the coverup is what gets you. >> shannon: they say they are continuing to cooperate and have addressed the very words you just used, cover up. the attorney general says there is no coverup and they are trying to work on getting

pick for republicans in 2012? >> i think somehow this man has a magical ability to be able to discern the fallacy in the left wing rhetoric and turn it back in a way that demonstrates to the whole world the principles and american and effective policies of the republicans and i think that this coming year's general election we are going to see a billion dollars spent by barack obama not to defend his own record, that is essentially impossible for him. the only thing he can try to do is distort the republican perspective and i think mr. gingrich is gifted in being able to cut through all of that and see the truth emerge. and i think that is one of his strongest capabilities and, of course, his history has been one of being a centerpiece of the regan revolution and that is something that the republican party and the country at large still resonates to in my mind. >> shannon: you mentioned the war chest that the president will undoubtedly have going into a reelection campaign.

let's talk about that the challenges that it sounds like newt gingrich is facing at this point. reports that he is in debt now. how does he inspire and motivate donors that he needs to continue moving forward? >> well, it has come down to a race i believe with all loving and due respect to the other candidates but between mr. romney and mr. gingrich. and the country is going to have to make a decision whether or not they are going to look to the substance of the candidates and their past records politically or if the ability to kind of drown the other candidates in negative advertising is going to win the day. i have to say to you before i make this next statement i will adopt whoever wins the republican primary because the worst nightmare america could have is a reelection of barack obama. it is very important for the romney campaign to focus on the real issues and not to count on negative false campaign ads. you know, in florida, which was a critical race, 92% of the romney ads were negative and they were also focused on

suggesting somehow that newt gingrich was antiregan or that regan was antigingrich. nothing could be further from the truth. my first campaign ever being involved was in the regan first campaign and mr. gingrich was, indeed, a centerpiece of all that. here is what happens when we focus on negativity in our primary we lose our greatest advantage in the general, conservatives have always had to rely on the truth and principle carrying the day because the left is so good at focusing on things that are not the issue. and it is very important that we don't surrender that high ground if we going to win the general election. the greater danger we face would be like a third-party candidate in the general and i think if we fight straight up in the primary, have a spirited debate, honest contrast is fine, we will do a lot better in the general and make sure by the grace of god that there is a republican in the white house a year from now. >> shannon: congressman trent franks, newt gingrich supporter.

they are get getting pushback. how do you think this is going to play out? >> i believe at the end of the day if the american people see what we are trying to do that is to make it trans parent for congress anding executive branch people if they trade it has to be disclosed i think that will be the law of the land. we passed the senate with my amendment which expanded the lieberman colin legislation. i think it is the right thing to do. we have people in the executive branch at the sec perhaps in a lot of independent agencies that have all kinds of confidential information that they can trade on. we ought to be across-the-board with it. it will be a step in the right direction. and i think it will pass. >> i have got the question i get over and over again when we cover this story and i am sure you have been asked many times, too, why don't current laws

apply in the situation. don't they cover members of congress and others? why a separate piece of legislation? >> well, it has come to a lot of people's knowledge recently that there was really no ban on members of congress from dealing in information, that is trading on information. there has always been an ethical lapse there if you do it, you shouldn't to it and now we will try to make it statutorily and i think it ought to apply to the executive agencies, too. tell it the american people as much as we can that we are not going to put up with this. transparency is important. honesty and integrity is very important. >> senator leiberman offered something that would have reached to maybe 2,000 executive branch employees or so. yours as i understand it is to reach to maybe 28,000 or so but there are concerns from some who say they feel it would reach 300,000 executive branch

employees, people who don't need to be included in the legislation. who exactly would it apply to? >> it would apply to people -- it would apply to the president. viceuld apply to the sarah president, sec enforcement. all of us in congress of course, too. but my amendment would apply to executive people that i believe make $125,000 a year, a gs 15 type designation. they already interest to file. they would just have to comply with this, too. according to the office of government ethics it would be about 28,000 people. it is good for america and good for the idea and expectation of the executive branch. >> members from both sides of the ail, both parties voted against a measure that would have permanently banned earmarks. you were one of those that voted against a permanent ban.

can you tell us why? >> first of all, the constitution gives the poured concreter to congress to appropriate money and although there have been bad stories about some ear marks we have always earmarked things. right now we are in just a voluntary ban on them for awhile. but you it is temporary. and i believe that the legislation offered by senator enhoff ha that i supported sas if it is authorized by the authorizing committee, debated, out front and appropriated by the appropriators that would be okay. i think that makes a lot of sense but that will be up to congress. each congress does what they want to do in this regard. but to ban earmarks will give more power to the executive branch and more power to bureaucrats and less power to the congress. >> shannon: senator richard shelby, republican of alabama, sir,, thank you for your time

>> shannon: time for a look at the headlines making news this sunday afternoon. 19 americans banned from leaving egypt are now facing trial. one is sam lahood, the son of u.s. secretary of transportation ray lahood. egyptian officials say they will be on trial for banned illegal activity and illegally receiving foreign funds. according to officials the utah governor was put on lockdown and moved by security. police arrested a 52-year-old man they got a tip was sending

text messages threatening the governor's life. as the economy improves the price of cars expected to jump. the national automobile association predicts the cost of a new car will rise 6% to $30,000. used car prices are expected to jump just about 1%. 8 sailors discharged after assaulting one of their own. a navy spokesman says the victim was choked until he blacked out and it it has been caught on video. peter doocy is live with that story. >> there was wrestling, punching, choking and horsing arounded a and the sailor being initiated on january 17th in the berthing area went to the ship's doctor with minor injuries and that is how the captain found out. the captain then launched an investigation and ended up discharging 8 soldiers who admitted to participating in this initiation because the navy has a zero tolerance policy on hazing. the lieutenant commander says that when an incident like this happens it has got to be taken

care of. it goes contrary to our core values. and there is a videotape of the incident that the navy did not end up seeing until after their investigation because the sailor who shot it kept it to himself. i have seen it, the sailor who was injured does not appear to pass out at any time although the navy says he blacked out and this news comes just days after democratic congress woman judy chu kicked off a campaign to end hazing in the military to try to curb military suicide. she says too many young people are being harmed. the highest military officials must make military hazing a top priority. none of this will change until the secretary of defense commits to eradicate the culture of hazing so engrained within the troops. the 8 received a general discharge which is different than a dishonorable. they won't lose the gi benefits
