thanks for watching us. the spin stops right here. we're definitely looking out for you. >> sean: welcome to hannity. polls have cloud in missouri for that state's primary and caucus gores are gathering in why and minnesota. ail be joined by herman cain. we'll get his analysis but first bret baier is standing by with an update. >> bret: voters in minnesota, colorado as an missouri are participating. the caucuses are convening right now all across colorado. polls closed about an hour ago and caucuses are just ending in minnesota. here is the latest in minnesota.

there you see it's very early, just the first caucuses, all these they are non-binding, for minnesota and colorado this the stirs step in awarding delegates. in missouri, it's essentially a statewide straw poll. take a look at the numbers here. you can see rick santorum has an early lead of 2%. the votes cast in missouri won't be awarded delegates. newt gingrich isn't on the ballot there. please join us for 11:00 p.m. eastern a full recap of tonight's voting. you'll see the raw total all night long. >> sean: we'll be watching all night long and check in the course over the next hour. in the meantime, turning for analysis, former candidate, herman cain, sir, how are you? >> mr. hannity, i'm fine. >> sean: this process is a

little different. you got a beauty contest going on in missouri, very early numbers show that rick santorum, polls show that he might do better than he had for example in south carolina and florida. what would that mean for him? >> i think it would mean a slight bump for rick, but i don't think it would create a surge. let's go back to iowa, new hampshire, south carolina and florida, the one thing to describe the results of all of those, sean, was unpredicability we knew who was going to win new hampshire but iowa was a surprise. south carolina was different from florida. i think we're going to see more unpredicability but a santorum win is going to mean a huge bump for him. >> sean: we go on from here, everything is moving, momentum goes toward super tuesday.

is that the night we define and pretty much decide who is going to be the nominee? >> yes. you recall that romney has about 101 committed delegates but on super tuesday, you have almost 200 delegate votes up for grabs. that is going to be a defining moment. if romney wins big on super tuesday, that tells you something, because in addition to the number of delegates, you have to look at the fact where he has won up to that point. however, if newt wins big on super tuesday, we still will have a long way to go. >> sean: at this point, if you were advising any of the campaigns, what do you think newt has to do to regain his momentum. santorum if he has a good night, what does romney need to do, he has a lot of momentum coming out of florida and nevada. what would you advise the

campaigns as an analyst rather than supporter? >> i would recommend the same thing to all three. i don't hear a lot about what specifically is your plan to boost this economy and create jobs. every survey that has been done has said that is number one issue on the minds of the voters. i can't tell you specifically what santorum economic growth and jobs plan is. i know what newt is because i studied it and governor romney, i even suggested to some of his people, his points won't cut it. they aren't going to remember that. be specific how you are going to grow this economy and create jobs. the report about the unemployment rate is down to 8.3%, yeah. when they get taking all the folks they don't count, real rate is over 15%. the people that aren't employed

know that, be more specific is the advice i would give to all three. >> sean: you think there is too much infighting. do does it make the eventual nominee stronger. you may not like a lot of the infighting? >> i don't like the infighting. for those people that say it will make them stronger, i don't think so. what it has done, it has diminished a lot of the voter enthusiasm. you have to look at some of the previous primaries, the voter turnout was down. i think it's expected the voter turnout is going to be down for some of the caucuses. the infighting i believe has a negative effect on enthusiasm which is why whoever gets the nomination, sean, is going to be uphill battle to get people re-energized and reengaged for the republican nominee. that is going to be the big uphill battle. >> sean: why do i suspect this

will be long forgotten by the time the nominee and the debates come along and conventions come along. there is so many issues around barack obama. his war on religion, the free exercise thereof, with catholic church and christians around the country. i think i it be a big issue. green energy, gaining access, getting money, wasted thrown down the drain. fast and furious is emerging. the overall issue is the economy for the president. whether or not they give us false numbers on unemployment or not, nobody thinks the economy is doing well? >> president obama did republicans a favor when they made that statement relative to the catholic church, you got provide those contraceptives free. let me tell you, that was mistake. i got to tell you, that is going to get christians and

evangelicals out of their chairs. he is doing them a favor. you still have to worry about getting people excited. go back to when mccain was running. too many people stayed home because they were excited about john mccain. we need to get excited about the candidate. what the president did relative to the religion thing, he did them a favor. three things will cause the average person to start to pay answer. that would be a favor. taxes and jobs, gasoline prices and somebody's religion. >> sean: all of these things will come into forefront. president has been able to be on the sidelines and throw out anything he wants. eventually he has a lot of questions to answer this time, he got away without answering the last time. last question: when we have supreme court justice on egyptian television and says the

following, i wouldn't look to our constitution if i were drafting a constitution in 2012. what is your reaction to this? >> it's despicable. if you don't have something good to say, don't say anything. [ laughter ] >> she shouldn't have said anything. that does not bode well with respect on our constitution. that will be a big issue also. because this whole religious thing relative to what obama said, trying to force certain things on catholic church, here is another example how people are going to push back on people trampling on the constitution. i think that was a mistake. >> sean: always good to see you. coming up election night coverage continues, very latest results and dana perino and

christians all across america are fired up over president obama's approval that requires insurance plans of religious organizations to provide contraceptive coverage. the conference of bishops have vowed to fight the edict and archbishop of new york ard cardinal designate says, to force american citizens to foregoing health care is unconscionable. it's an attack on healthcare as religious freedom. obama administration has drawn an unprecedented line in the sand. meanwhile, the white house continues to defend the decision. they argue that regardless of religious beliefs this is what all women deserve. >> i understand there have been oklahoma and some people disagree and we're going to work with institutions that have concerns here. it's important to note if we believe that the services are important and that american

we will not violent our conscience by providing things we don't believe in. president obama told him, he says don't worry. don't worry. it's going to work out much better than you expect. you know what has happened. he is forcing us to violate our conscience. >> sean: if they back off this it will be only for political reasons. they can't say the president was involved in the decision-making. as far as i'm concerned, this is a war against our constitution, the first amendment, freedom of religion, free exercise. tell me where i'm wrong. >> 98% of catholic women use contraception. 60% support the measures. doctors can opt out. catholic universities, catholic hospitals cannot opt out. >> they were given a year to make peace with this.

david axelrod said today on tv he was prepared to negotiate with catholics. >> doug, look at me here, you know, we've come halfway. we have offered olive branches. the two they have offered, number one, as long as you are only ministering or serving people of your own faith, you get an exemption. you think a catholic hospital is going to be checking certificates to make sure they are catholic? >> wait a minute. >> sean: only now because of the political consideration. when it came down to the first amendment and came down to people's conscience and the right of free exercise, this president chose contraception

over freedom of religion. that is why this important. >> they said don't worry about it. we'll meet you half way. you've got a whole year ready to violate your conscience. >> to do what axelrod said today find common ground and extend affiliated institutions. >> wait a minute. to violate his conscience? >> to work a way out to make everybody comfortable. who don't want to provide will not provide. >> excuse me. that is not what they decided. after he met with the bishop, in the oval office and called the bishop and said, sorry it's not going to go your way, is that what he said to him? >> that is what happened. remember, sean, remember this great speech in notre dame, in which notre dame university decided to give him an honor.

what did he say? he said this is all about us sharing values but then recognizing that we will also respect the freedom of conscience, freedom of religion. what he has done, i will not respect freedom of conscience because i believe as you said, sean, contraception being provided by insurers. he chose that over religious liberty. >> sean: this is what he said back in turkey. >> we have a large christian population, we don't consider ourselves as a christian nation or muslim nation or jewish nation, we consider ourselves a nation of citizens that is bound by a set of values. >> sean:, wait a minute. was this country found order

religion, war on religion, am i wrong? >> you are not wrong but listening to doug schoen. he and i agree on lot of things but i think are boxing against a ghost. the policy is what the policy is. when they argue they try to make it about to be something else. it's not about the use of contraception. it's about compelling an organization and then fining them if they don't provide free. >> i'll be harsher. i think this is a cruel and arrogant move on the part of the president. it's cruel to tell catholics you must abandon your faith or abandon charity. that is a cruel decision to place upon anybody. >> sean: i think it's deeper than that. i think he is shredding the constitution. >> absolutely. >> sean: i think she ripping up the first amendment, freedom of religion, free exercise of religion. it runs very deep. now there is another issue as it

relates to free speech because you have the office of the chief of chaplains for the u.s. army was forbidding catholic chaplains from reading a letter from the bishop that condemned obamacare. where is the freedom of speech now? >> partly because they said in the letter the line about civil disobedience could be taken a long way and they didn't want to take that step. they ended up calling the health and human secretary's office. >> sean: thank you, for letting us. >> it's either free speech or not. >> sean: they are basically giving you a choice. they decided against freedom of religion in favor of contraception and in the case of the morning-after pill abortion. >> they say you got a year to work out a compromise. wrong, you cannot compromise on the issue of principle and what

is enshrined in the constitution of religion freedom. >> the language they use is a grace period, really? how does that work. you take it past the elections. here is the other thing. even if they do find some compromise where they wait and study it for another year and put this behind hem them. if president obama wins a second term, you think they won't do this on the second day in office second term? >> sean: i'm fearful as father morris pointed out, if he spoke directly to the bishop and called him and said, i decided this isn't going to happen. he can't pawn this off on his advisors are sibelius or anybody else. now that axelrod is involved, it's a political arm, they are making a political calculation this may not be beneficial for the election or temporary

>> bret: i'm bret baier. let's check the numbers now. three nominating contests, caucuses in colorado are still going on. numbers are coming in. here you look at minnesota, they are just closing. latest totals and they are over. it's early here. santorum with the lead. the other one is missouri, beauty contest poll, a straw poll. zbinz not on ballot. romney did not campaign here. it's a huge lead for santorum, and ron paul in third. caucuses in colorado begin at the top of the hour. let's get some thoughts from joe trippi and charles krauthammer. if santorum holds, let's say he

does well in missouri and minnesota, maybe wins or does really well, does this race change? >> think he'll be the claiming the mantle of being the anti-romney. he is missouri with fifth of the vote in up by 25%. that is major margin. minnesota small number, he is up also by 25%. romney had won in 2008 by 20% over mccain. this could be a big night for santorum and it would damage romney. >> bret: you are looking at these numbers. do they hold? >> when you look at missouri and the big lead, 25-26 points and over 20% of the vote in. it's got to start turning now. romney is going to pick something on the margin or looks like santorum is going to have a big win tonight. >> bret: we'll bring you complete results and analysis tonight. you'll see the raw vote on the bottom of the screen. a special at 11:00 p.m. eastern

time. sent we'll send it back to hannity. >> sean: another monumental flip-flop after years of demonizing them is embracing super parks packs. they announced that top officials will be able to go out and raise money alongside left wing groups like priorities u.s.a. and we're supposed to forget the awful things that the president said about those super pacs. >> the shadow groups are already forming and building war chests of tens of millions of dollars to influence. >> i don't think american elections should be bank rolled by america's most powerful interests. >> they can buy millions worth of tv ads and they don't have to reveal who is paying for them. >> who is behind all these attack ads? you don't know?

>> sean: strongest thing that republicans will have, obama in his own words. >> it will be obama versus obama. we got a couple ads i really want to get these on the ads. this one shows the difference between the language of barack obama and the language of ronald reagan and it does so well. not just among republicans but among democrats. >> we've been lazy over the last couple decades. it's the american spirit. we are still there ready to blaze in life. this is not class warfare. >> we have do to do the practical things, to create policies that will stimulate our economy and increase productivity and put america back to work. >> after all, why shouldn't we believe that? americans. >> it's very powerful. because it's so optimistic.

the difference between the language, there was no division. reagan wanted to raise everybody up and he didn't divide one group against the other. obama's effort, no bailouts, no handouts, no copouts about yet it's all about bailing out wall street. handouts in the form of stimulus and copouts by blaming congress. the yes question is are the republicans are going to be effective in taking him on. >> sean: they have bad economy. $5 trillion in debt, i think they have a foreign policy that has shown a lot of weakness. president will say we got bin laden. it wouldn't have happened if he had his way. that could be proven on tape. >> also the unemployment rate is coming down. >> sean: but it's being manipulated. david stockman had a great piece. they are making the numbers up. participation rate is down 1.2

million the same month you are creating 200,000 jobs. there is something wrong with that number. 1.2 million people participating. we don't count them. >> 79% of all statistics are made up on the spot. >> sean: they've got other scandals that are emerging, green energy scandals, fast and furious. there is another ad by americans for prosperity for solyndra. >> it talks about taxpayer dollars. washington is spending their hard earned money and they are fed up to it. when it goes to company that goes bankrupt, they say enough is enough. >> wealthy donors with ties to do so lynn dra give them hundreds of thousands of dollars. he gives them half a billion in taxpayer money to help solyndra. a business that they knew it was on the path to bankruptcy. loaned them money anyway.

when the government found out solyndra couldn't make payments, they changed the terms of the loan to let them continue taking taxpayer money. now solyndra is bankrupt and taxpayers are stuck with the bill. >> sean: huge numbers. >> it's incredible. you hate the spending and you hate, that ad is on the air now, but to take your money to give it to president's campaign donors. >> sean: we continue our coverage. great, great american panel is up next. associated press is calling missouri for rick santorum. he will win the missouri primary. as the beauty contest there. but he will win and wins big. a lot of focus in missouri. he'll give a speech in missouri tonight. he is the winner there. we don't know how the rest will stack up. newt gingrich was not on the ballot. its beauty contest. a straw poll in the state of missouri. they don't apportion delegates. they will do it march 17th. a big win in a swing state for rick santorum. i'll send it back to you. >> sean: by the way, bret baier is going to have a special coming up at 11:00 eastern. >> so that is big win for rick santorum. new momentum for him. its beauty contest but it's an important win. what does it mean? >> i still think overall that mitt has big momentum.

newt is trying to say, this is going to be good for santorum, not going to be good for mitt. i don't know. i think we know what the world is going to do, what the country is going to do and they throw something else at you. i love it to be at the end and everybody can get behind one person. >> sean: rick has to be happy with this. it is a beauty contest. we're not talking about delegates? >> somebody tweeted me they are getting ready for the big convention, one of the t-shirts, we are all rhinogs now. the concern now, they want somebody that is going to stand on character and not rely on polls to determine their positions. that person is looking like rick santorum. >> i think congress made the case against mitt romney.

rick santorum had a great victory. i'm not sure what in terms of nomination, but santorum hangs around probably for a long time. it keeps romney from getting on his "a" game for a general election. >> sean: let's go back to 2008. the barack obama against hillary clinton and bill clinton saying that the obama campaign is playing the race card. they planned it from the beginning. things got heated. lo and behold, hillary became secretary of state. i think we put too much emphasis, this is dividing the party. nobody parts the other candidate. obama has been a bat president and his record is abysmal and economy stinks. she weak on foreign policy. >> they will rally around because the republicans will support the nominee. the case that todd outlines against romney is real. the case that republicans have been making for a long time. >> sean: tell me how it's different from hillary versus obama?

>> hillary looked like the presumptive front-runner and then when obama beat her he looked like a giant killer. romney looks like the giant that can't beat the dwarf. >> i think people are pretty much decided and people that supported barack obama that his policies aren't working. in the end i think people will rally around the winner. >> i think a lot of people talking about it. g.o.p., the lot of conservatives true conservatives don't like him. if he does end up being the nominee, i'll still take romney over president obama. the one thing that makes me so angry, i deserve a second term. really, you deserve? excuse me. it makes me so angry. you don't deserve anything on what you've said in the last four years. that makes me angry when i hear things like that.
