>> mike: thank you. thank you very much. welcome to "huckabee" from the fox news studios in new york city. you know if i say anything nice about barack obama on this show some of you getting angry and you send me some very nasty e-mails. because you think we ought to never say a kind word about the man. well, i better warn you now, you might not like what i'm about to say. because i want to publicly thank president obama, you see he has single-handedly done more to unify and energize the republican party than all of the presidential candidates combined. [ applause ] because his decision a little over a week ago to force catholic hospitals and universities to provide contraceptive and abortion pills in direct conthick with the long standing physician of their faith went over about as well as michael moore at an nra convention.

i moon even loyal democrats and bona fide liberals were running from the exits. just to get away from him before he self combusted from the heat that he got, not just from catholics. while this issue was direct threat to religious liberty within the catholic church, it is an issue that is much bigger. it threatens the very essence of liberty by allowing government to dictate matters of individual discretion. even if there wasn't a direct and holy unconstitutional assault on the religious convictions of catholics and other christians, it is simply not the government's right to demand that i as an employer provide something that i don't want to give or my employees don't even want to have. now if the president can demand that i provide contraceptives or 'borrowing today then next he might demand unlimited mental health coverage or some other form of health coverage. he could then insist that employees be covered for dental work and cosmetic surgery.

maybe a feys lift for this old mug? might mean some improvement but i'm not sure that it's a necessary function of the president to demand it. the president's lame and laughable attempt to make things better by playing the shell game of moving from the cost of holy cross to blue cross is unacceptable. and it's not just about adding forced insured benefit for people it's about taking away the rights of self determination from people. no president has been granted that level of authority or power from the constitution, simply fails to meet the test of the consent of the goferred. i'm not even a catholic, but i am unmoveably pro life. and i, too, object to the notion that i would be required by the dictates of one branch of government without constitutional or legislative process to surrender the terms of my faith and freedom to satisfy left wing robbing life lunatics i just won't do it.

you know, nancy pelosi was right about at least one thing. >> but we have to pass the bill so that you can find out what is in it. >> well, they passed it. now we know. here's what i'd do. i call upon speaker boehner to put the tire obamacare bill back on the table for another vote this week. let's just find out who is willing to put his or her name on it now that we know what is in it. it's time for obama to repent and congress to repeal. that's my view. this so-called accommodation that the president mentioned yesterday. >> i think we're not completely satisfied we want to see more, hear more. it's important to say, governor that the catholic church has been very much supporter of national health insurance in sense of making sure that people need to be protected. we don't think health care we don't want to pay for it. when they say as president just said on your clip there that we'll have the insurance companies handle it, free isn't free. who is going to pay the premiums, we are. one way or another at catholic or any christian or person of faith still being asked to support something that we believe is morally repugnant to us. >> mike: i think your point is a very important one to make. there is a difference between consideration for what we would call health care, which is you're sick with cancer versus contraception. pregnancy not a disease .

as catholic institution you should be forced to provide something that goes against a religious spiritual and frankly common sense doctrine for not only catholics. hospitals and universities to promote sterilization just seems so ridiculously. just lack of respect for our religious principles. as you said in your introduction not just about catholics. it's like the old protestant said in world war i came from one group, they came to me there

was no one to help me stand. >> mike: that's one of the reasons yesterday when i was at cpac i made the comment, i never thought as young baptist boy growing up in the south, we're all catholics now. that is the way i feel. this is one of those times when people who are people of faith and particularly people who are pro life must stand together. you have had blow back. i want to you describe some of the sort of things that have been coming at you as a result of taking the stand that you had taken. >> it goes through i think our whole politics now as you know is very much divided. i think we have very respectable position saying we're not going to participate in the giving out of these drugs. we're not going to do it as catholic church. having said that and said it on fox news then calls came in, the e-mails, you people don't like obama, it's not about the president. he's a fine guy, intelligent guy, articulate guy. but on policy he's all wrong. sister kathleen heads up our catholic hospital said that as

matter of policy this is bad policy. as matter of morality needs to change. which is why i think the president for political calculation made his choice to have that press conference yesterday say, okay, we're backing off. but you still leave us responsible for helping to pay those insurance companies that in turn are going to take our money to pay for things that we object to morally. by the way this is not new, as you well know having been through state government. in knock state i as taxpayer am paying to 43,000 abortions through medicaid. i object to that as i object to federal policy trying to be mob dated. the onlying this i think american bishops will embrace is the idea that he rejects and turns back this mandate. there's no compromise on this. >> mike: i think that is important point. you mentioned that people say catholics just don't like obama. catholic voted voted overwhelmingly by nine point margin. in ten of the last elections the way that catholics voted tended to tip the election one way or the other. five times they voted overwhelmingly for democrats.

five times for republicans. but in every case it was a turning point for the election. will this have a big political impact on the president by november? >> i think what you saw yesterday was the president recognizing that he has opened up a wound. for the past couple of weeks we're allowed in church to speak about moral issues, not supposed to endorse particular candidates. that's what we've been doing. you need to know our government is trying to make us pay for service that we object to. some people say, yeah, lots of catholics use birth control that's not the point. as i said once before, many much my jewish friends are very mixed on israel unless they're on -- then on taxes they're all on board. you take away the rights and religious liberty going to hurt everyone. we have to stand together. yes, i think it does hurt president obama. he knows we've been talking about this. doesn't want to lose any votes this is certain cynicism in the administration, too. sebelius secretary of health, she's a catholic, but there's catholic and catholic. one thing she has done or said indicates that her faith is very important to her. >> mike: such a pleasure to have you here. it's important to mention that one thing if individual catholic is at odds with his or her church, but significant issue when the government is at odds with the church in direct violation of not the third, fourth or 10th amendment but the first amendment because it that was important to the founders to establish that government can neither prohibit nor can it prefer a religious practice. that's why this issue is important. several states have threatened to sue the obama administration on the earlier policy that would have forced catholic hospitals and universities to violate their church doctrine. will they still take the legal action. you're going to find out because i'm going to ask attorney general john bruning. >> mike: attorney general john bruning of -- sent a letter to health and human services -- joins me from nebraska. mr. attorney general, great to have you here i want to ask you why have you and your colleagues threatened to sue the obama administration, what is the legal basis for the potential lawsuit. >> well, it's a war on religion. this is a violation of the first amendment. freedom of religion is what this country was based upon. people that came over on boats and all the way from england so they could worship freely now you have federal government that is trying to tell people they have to violate their conscience when they provide insurance. this is very problematic. we will sue, nothing has changed in this so-called compromise.

>> mike: i think that was my next follow up because the president sort of walked a little of this back yesterday, i'm not sure that he did. but he appeared to be pushing it now off on insurance companies. you still think the legal issue remains. the basis of the lawsuit how will you approach this? >> well, think about, for example, a catholic diocese that self insured they put their money in a pool. they have whoever might be administer the pool but still their money. when you shift from the employer to the insurance company it's still their money. they're not going to use their money for something that they believe is immoral. nor should they have to. that's the basis of the first amendment. what about an insurance company like catholic mutual that is a catholic-based insurance company. under this new rule they're supposed to just shut down. it's very troubling. i met with couple of the bishops here we talked about this issue, they have so many services for the poor this they will be forced to shut down because they

will not violate their conscience. all those poor people have to be taken care of somewhere they will end up on the state medicaid rolls. this is a moras, is that i don't think the president had any idea about. if he did it's really unconscionable. >> mike: you've been joaned in the letter to the secretary from greg abbott of texas, allan wilson of south carolina, but i understand you have other states that have now joined with you in the potential lawsuits. how many attorneys general are part of your action? >> well, just couple days, we're at 12 states. this will be very similar to obamacare lawsuit which you know will be heard in the supreme court next month. we started that lawsuit in 2010 with 13 stacey we're now at 26. this lawsuit which similar because of group of states pushing back against federal governments over reaching starting with 12 now. it could be by the time we file the lawsuit here in a week or two it could be 15 or 20 states. who knows how many by the end.

>> mike: would you describe for our audience the difference between this lawsuit and original lawsuit against obamacare. some are going to say, i thought you were already suing the obama administration. what's unique? >> the obamacare lawsuit is based on congressional power under the commerce clause. can they mandate the perform of insurance, that is the obamacare lawsuit the heart of it. not just about health insurance about the breadth of congressional power. can they make us eat broccoli for breakfast because it's healthier than the donut. how far can congress go. that is the lawsuit. this lawsuit is also about congressional power but spoke focused on the first amendment and freedom of religion. you said it in the prior segment. there's reason, freedom of religion is in the first amendment not the 10th or 12th or 20th. there's nothing more important in this country than freedom to worship as you see fit. not be forced by the government to violate your conscience. this lawsuit when we're talking

about not about contraception or -- it's par of it. it's about government intersection in religion. the government needs to leave us alone allow us to worship as we see fit not force people to violate their conscience. that's what this lawsuit will be about. >> mike: i appreciate you're being here with us very much. i wish you could promise keep us posted on the progress we want to be following it. great interest to every american even if they disagree with my point of view truly a point that they got to be interested in thank you for joining us. [ applause ] >> mike: good old poll sticks pretty simple. you want to win at election you got to get voters motivated to come to the polls to vote for you. last saturday we spoke to "newsweek" as andrew romano about the very organized effort to elect president obama. how social media could be the key to victory. let's ask rnc chairman. great to have you with me today. he had been in the belly of the beast gone inside the obama operation to see some things that were pretty enlightening. here is one of the things he said i'll have you react to it.

>> they're really focus the on technology as way to turn out voters to get votes on election day. we saw some of this in 2008 but i think what would you going to see this year, this is a quote from the call maybe. weep make 2008 look prehis tore rib. now what you do sign in with facebook get access to all the information that you have use that to target their messages. instead of sending out a message to all your friends, they say send to your five friends in the swing district in pennsylvania who are really concerned about taxes. >> mike: it's obvious that there is a very sophisticated technological approach to this election from the obama campaign. are the republicans ready to match this sort of effort? >> absolutely. besides the money side, i know you're asking about our technology you have to also have the money and infrastructure to be able to put together that kind of massive operation whether it be social media or whether it be -- micro targeting

through the use of social media. but we've got the money to be able to do that this time around but more than that i think you know this, governor, it's about two things. one you've got to have the right message. and you have to have the infrastructure the republican national committee focusing on both of those things especially the infrastructure so that when it comes to our digital reach that we can compete. but i think that our message this time around, the message of liberty and freedom and big issues that are facing america, those are going to be the issues that are going to drive the electorate. if you don't have the message, they can talk all day long going to make 2008 look miniature in comparison, well if you are on the wrong side of the message you can have all the infrastructure in the world but not going to get you over the finish line. the key is to be able to do both. we've got the money, the people in place and infrastructure to be able to do it. but on top of it. the most important thing in politics in winning is being right on the message, that's where we're going to be that's why we're going to win. >> mike: it goes back to the old

story, company developed a wonderful dog food, had great technology, it was scientifically advanced they marketed successfully and effectively the company went out of business. because the dogs wouldn't eat the stuff. ultimately comes down to, will the american people eat this stuff that they're going to be served up by the obama machine. let's take a look at another comment that andrew made and we'll get you to refond it as well. >> it's a behemoth. about 50,000 square feet of office space, at the time more than 200 staffers in headquarters, for comparison romney's campaign biggest republican campaign had 98. you go back to bill clinton in '96 or george w. bush 10 or fewer at this point. they are really ramped up early. scope of it is really impressive mine when republicans hear this sort of thing see this huge staffing that the obama

organization has, look at the republican candidates, even romney who has most advanced operation is no where near that level of staffing. explain to people how the rnc does provide a infrastructure of staffing as the republican nominee eventually chosen. >> you bet. the first thing i think of, we've got a president that is just in love with campaigning. i wish he was 25% as in love with being president and leading this country as he is in campaigning. besides that -- [ applause ] i will tell you that the republican national committee is very unique under the law. we're the only organization in america that can take the money that we raise and legally combine it and coordinate it with the presidential nominee. we're prepared to do that. some of you might be surprised we actually have more cash in the bank then democratic national committee. as much as fundraising, the rnc is doing better. so we're proud of that. but just remember, i caution

big screen performance took her back to church "the preach are's wife" whatever whitney houston touched seemed to turn gold. in los angeles, william lajeunesse, fox news. >> harris: 48 years old, what a voice. singer whitney houston has died. we've been getting information in just in the last little while, her publicist apparently had first given news of this to the associated press. the cause of death location of death, not known at this point. but her publicist saying that at age 48 whit thee houston had passed away. it is interesting that this happened on the eve of the grammys she reigned really in hollywood as premiere voice and took the grammys by storm so many years ago. each year for a decade people would look forward to her winning awards and to her performances there. amazing singer and performer dead. whitney houston, we know in recent years had some health

problems. she had some drug use that were widely reported. reports of erratic behavior and tumultuous marriage to bobby brown, which broke up. they had a child together. but we've been following her career for decades and watching her just last few years. basically fell apart at the hands of drug use. then recently reports that she was making some kind of a comeback that she was doing somewhat better. we don't have all the details on what that entailed. but there were some hope among her fans around the world that whitney houston was on her way back. her biggest hits "how will i know" "saving all my love for you" "i will always love you" you heard some in the report. again, she won multiple grammys including album and record of the year. whitney houston. we are standing by now to include our reporters on the west coast as this news is breaking. at her peak houston of course

the golden girl of the music industry. then she ventured in to movies as well. "the bodyguard" was very popular with kevin costner many years ago. 5 5 million records sold here in the united states alone. she was one of the top selling artists in the pop music industry. branching in to movies, her records always hits. she seemed to be born in to greatness. whitney houston was the daughter of gospel singer sissj houston, cousin much the 1960 pop devoidee i don't know warwick and god daughter of aretha franklin. one of the questions that we will have of course is how did this happen, who was she with. was her family with her we are hoping to learn many more details but for right now the news of houston's death hitting blogs and twitter and facebook. i've been following it online

tonight. so many warm wishes that people have. so many questions about this actress and singer, whitney houston. i'm going to share some of that with you. we're also connected here on the internet. whitney houston, 48 years old. her publicist saying earlier this evening, the news was breaking just as we were ending fox report. that the singer had died. but no further details have come out. so as we wait to connect with our reporters on the west coast i know now that casey is joining us our fox news correspondent i'm about to sign ton twitter to read some of the messages for whitney houston i would imagine in hollywood this is -- they are just shell shocked. >> everyone is. let's face it. i just did a live report with you, what an hour ago on "the fox report" on that horrible tragedy that we've been covering all day up in washington state. obviously the grammys are taking

place here on the west coast tomorrow. this is one of the biggest nights in the music industry for sure and there's been some speculation in terms of whether whitney houston was in fact at her home in new jersey when this happened. or if she was out here in los angeles ahead of the big grammy celebration tomorrow. and we are starting to see these reports trickling in that she was seen here in l.a. on thursday at one of these pregrammy parties. that clive davis, one of the big music producers in the industry who is credited with finding whitney houston and making her wildly popular and famous he was holding a pregrammy party tonight. something that he does every year and we're trying to get confirmation on whether that event is even going to go forward tonight with this news breaking late this evening of whitney houston's death are they going to go forward. we have big entertainment unit

here in los angeles with producers, fox news producers that are sort of scrambling right now to get over to these events and try to get some reaction from the music world. this news absolutely shocking. the sad thing is, that some would say it's shocking others would not. let's face it, we've heard through the years of her battle with addictions and sort of hitting rock bottom if you will at times. the news is shocking and it's sad. some people would say it's not shocking and sad. sort of like the death of amy winehouse when that happened. but as you also know, we've talked about hearing reports that whitney was getting her life back on track. that she was trying to kick her addictions and what not. just trying to get some information at this hour as this news is coming in here. >> harris: you know, i had mentioned the timing of this on

the eve of the grammys we so so many people obviously who look up to her as a singer but there are some, christina aguilera who have named whitney houston the reason why they followed their dreams. she inspired so many people. at the height of her career "waiting to exhale" but the world will always remember that big voice, casey. >> absolutely. really doesn't matter how old you are or what color you are, everyone was drawn to that amazing voice. not only talented singer but you hit on the movies that she starred in. she was an accomplished actress as well. i want to pass along i'm getting information on my blackberry, it's blowing up here. with the l.a. county coroner's office has not been contacted at this point about going to this beverly hilton hotel where this preparty was happying.

this pregrammy party. that office saying that they have not heard any -- not received any request. but tm z is reporting as you can see that there is some type of a police crime scene vehicle outside of the beverly hilton hotel. that is not a good sign. it's looking that this may be in fact where 48-year-old whitney houston's life was cut tragically short tonight. >> harris: i'm seeing it now on twitter. i tweeted out for people to send me their messages, their feelings, their thoughts. so many people expressing how missed she will be how shocked they are. alex wasserman, lewis carroll so many others. i remember that interview she did with abc news diane sayw,r in 2002, bob bow brown was seated next to her. the biggest devil is me.

sometimes i'm either my best friend or my worst enemy. and she was facing questions from both diane sawyer and whole host of other people in and outside of her music industry about her drug use and about erratic behavior that was so documented. times on stage when she would perform couldn't finish performing. all much the questions about whether or not she'd be able to finish very expensive tours. go on tour there were always question, is she going to be ail to complete them. >> i think so many people also got a glimpse in to her life with that reality show that they did "being bobby brown" remember that? the cameras followed them and you saw a lot that have erratic behavior, the alleged drug use and everything that was sort of going on in the bizarre dynamic really between she and bobby brown. again it's one of those situations where we see some of these celebrities, i talked about amy winehouse earlier,

some of these celebrities that their drug use so highly publicized everyone is well aware of it. then news breaks that we've lost them way too soon. it comes as a shock, but if you look at the events leading up to the death itself, it's unfortunately not that at all surprising. it's so tragic, again on the eve of the grammys. >> harris: the premiere -- >> largest night. >> harris: i do want to say, associated press has been reporting, tm z report knowledge, fox news now confirming the death of whitney houston on twitter, casey, you and i communicate to each other like this a lot. casey, kathy johnson writing, what a wonderful voice and talent she will be missed. but now she will be in peace. others writing, we talked sunday about whitney getting it together with her remaking the movie sparkle. i'm so sad right now in tears.

you wonder what the show producers are doing at this point at this hour what they're sort of scrambling to do if they have to rearrange the show. i think that safe to say they're going to see a very different format of the grammys tomorrow night and virtually every singlary takes the podium and goes to the microphone will have something to say because as you alluded to, some of the more popular names now, christina aguilera a number of others say that it was in fact whitney houston that inspired them to get in to music. to make their own albums and what not. it's going to be a very touching and i'm sure -- very touching award show tomorrow and i think that it will sort of turn in to a memorial for whitney houston again with this news breaking on the eve before the big show. >> harris: you were out there reporting on this getting a good indication that that may happen. the music mogul clive davis

jackson death extensively he was so secretive with his children. would even put them in disguises when he would take them out in the public eye. there were very few images of his children, same can be said about whitney houston's child as well. it's absolutely difficult to wrap your mind around. also looking here on twitter, wanted to share some information saying that apparently whitney houston had been down there many times she did not have a star on the hollywood walk of fame. she was apparently selected to receive one a year ago but never set a dedication date. little tidbits, little facts like that are coming in that we're reading about but i want to again reiterate that our assignment desk here in los angeles has been on the phone with the l.a. county coroner's office. obviously that agency is one of the first agencies that would be dispatched. l.a. county coroner's office

the cause of death actually is. the coroner's office may or may not get involved if it is very clear how she died. >> harris: you know i'm curious to know how celebrities are treated differently out there. the rest of the world we look in through the glass and we wonder this sort of thing. how does her celebrity play role in what happens next? >> especially when you look in light of what happened with demi moore and release of 911 tapes. you can see that the most tragic and darkest times sometimes become played out in front of the media, you have 911 tape where people are in crisis needing medical help those become released to the public. there's no doubt that celebrities are treated differently. own so many levels including early in her history in terms of her drug use and domestic violence cases those very, very private issues become fodder for me and many people like me to talk about unfortunately.

>> harris: robin, i know that you worked for the l.a. district attorney's office. what sorts of things would they be working on right now? anything at all? we don't even know the circumstances of her death but with the death of michael jackson everybody was at the scene. >> that's right. you never know. when you have a death like this as clearly someone who is 48 years old, young, normal passing this is not death from elder just natural elder causes this is something that is either drug overdose, suspicious circumstances, medical break down as result of something draw mat particular. takes an interest makes sure there was no foul play to rule out that someone may have actually been responsible for this. we didn't even know that there was a conrad murray until many days later. >> harris: i've been including our viewers online via twitter -- twitter.

one writes, tragic loss. one of the most talented and beautiful performers of our lifetime. even those in the legal world and in the law enforcement world out in los angeles you guys are not immune to being fans of someone like this. what are your personal thoughts at this point? >> not at all. the second that i saw my ap report splash on my iphone i gasped i said, my god, hero of the '80s and '90s someone who publicly struggled with the issues that resonate with anybody in law enforcement. someone who no one wanted persecute. someone we all felt bad for for all of her struggles. i know as we sit here talk about her memory no one wants to talk about the darkest times. you can't help but to connect the dots wonder how we got here. what could have any of us as professionals could have done differently to intervene. >> harris: i'm going to haveo
