but what i don't understand is, judge, if you review these grand jury minutes, why did you let it go to trial in the first place? the judge basically... >> gregg: because you always let the prosecution have their chance. >> not true. i dismissed cases when there was not sufficient evidence in the grand jury but what he could have done, could have let the jury make the decision as to what happened, but there were controversial issues and, here they are. number one, the judge would not let the victim's sister testify about what the accused murderer told her after the crime. that is highly unusual. number 2, the judge would not let the father talk about the fact that his daughter, the bride went to him before the honeymoon and said my husband wants me to increase my life insurance, five-fold and should i and the father said no, but tell him you did. that was right. >> gregg: really? >> hearsay. absolutely -- >> gregg: double hearsay.

>> she said she talked to her father and her father said what she said to incriminate the other guy. clearly he was right but there was an argument, what the defendant did was take this victim away from the group they were in for a reason that his watch was not working, dive watch was not working and the manufacturing company would have contradicted that and the argument the prosecution made was he was trying to get the victim away from the group and here's the clincher. he said i wasn't a rescue diver and the truth is he was certified in four areas, open water, advanced rescue, and he said i never brought anyone up from the bottom of the ocean and his team buddy said he was basically a liar, he said we practiced bringing unconscious people up from the ocean floor. >> gregg: in the louise woodward nanny trial the judge led it go to the jury which convicted her of murder charges and then the judge said, you know what? i disagree and set aside the verdict and reduced to it

manslaughter, set her free and back to great britain. that might have been a more palatable judicial decision, do don't you think. >> it would have been more palatable. the jurors said they wanted to render a verdict. >> gregg: let it go to the jury. >> because there was an argument but he was clashing with the prosecution from the beginning and it appeared there was something going on in the courtroom, but, at the end of the day, you accept the jury's verdict and... >> gregg: wasn't it a stretch? the events happened in australia, and you have all kinds of witness problems and communication problems and a lot of statements arguably incriminating, gathered by someone other than american authorities. >> but -- >> gregg: and you have double jeopardy. he pled guilty over there to a lesser charge. and now you are trying him all over again on the same charges. >> he pled to manslaughter in australia. which rendered -- he didn't render aid to her and therefore she died and that is different from his intentionally killing

monday. let's bring in scott rasmussen of rasmussen reports to comment. why do you think the reversal? >> heather, there was a debate in between those two polls and when you look at the pre- and post--debate numbers the first thing that jumps out is before the debate, rick santorum had a 35-point lead among key party voters over mitt romney. after the debate, that was down to 11 points. i think some of his comments about taking one for the team may have hurt a little bit. also, before the debate, 65% of michigan primary voters said they thought rick santorum could beat barack obama in november, afterwards it was down 6 points to 59%. once again, what you are seeing is mitt romney is not building his own base of support and not getting people more enthusiastic about him but raising doubts about the other challenger. >> gregg: let's talk about the other primary state. arizona, mitt romney is the clear leader, let's put it above with a nine-point lead over
