refinance is own by fannie mae and you cannot have had a late mortgage payment in the last six months and only one late in the last 12 months. so if you meet those requirements, you can go ahead and explore that option. if you look at the numbers you have 11 million homeowners underwater on their mortgages which is nearly a quarter of all borrowers. of the 11 million, only four million of those loans are owned by fannie mae or freddie mac. of those four million they target 1.6 million people they can help which is more than 10 percent of all underwater borrowers so the question is, is this a political ploy? or a program that is aimed at actually helping eliminate the mortgage crisis. unfortunately, while i am happy there are some that can be helped i do not believe for a second this is going to actually make a significant impact on the north crisis.

just said? >> i think wal-mart is coming into town to do just the opposite of what grant is saying. wal-mart is coming to create jobs. they will create more pedestrian traffic on the street. and they will complete part of the hole in the donut that sits there as vacant land. >> alisyn: grant, you said that wal-mart will destroy businesses, i guess you mean mom and pop shops. do they make up for, let's say some mom and pop shops have to close if wal-mart takes away their business. does the fact at that they would employ 100 people make up for that? >> absolutely not. they're just seeking federal tax credits. they're getting brown field yesterday of 25 per person higher and. and they're going to fire hundreds of people half a mile away in the winwood garment district and selling the same goods that wal-mart is looking to sell and fire dozens of people in multiple neighborhoods working at small grocery stores, they're going

to fire the owners of those stores and they're going to depress the local economy for real estate and retail, all of those-- >> i hear you and i want frank's response. those are some really significant charges that you're levelling there. will, frank, in your experience, will wal-mart be the end of small grocery jobs and small retail jobs like grant is saying? >> i don't he see it that way. i see them coming and see them with those missing in that community. whether it locates in midtown or several locations within the city, but i think it's necessary that this type business come to our community, that it offer the jobs and they're able to compete, along with the small mom and pops that are able to compete and many people that participate or patronize these small shops are going to continue to patronize them.

we have small jobs along biscayne where i live and because wal-mart is there we're not going to stop going to the businesses. >> you say you have a solution that wal-mart should just relocate to a more mass transit area, how would that help? >> well, everybody that i've spoken do, who does not own a car and lives in the mid town edge water district of miami, east side north of downtown, all of them asked me why isn't wal-mart locating along the train station? we have a train station that just got made into a switch station for the new airport line. it would be the switch station for the proposed orange line, or excuse me, running 27th avenue to the stadium alongside a major highway and that air is really depressed, there's nothing there. wal-mart is a huge draw, absolutely and we could build a huge highway and benefit the community without destroying

>> the dreaded time of year again, can you smell it? it's tax time. that's what smells. while your taxes may be due in a month. what if we told you billions of dollars in available tax funds may be going to illegal aliens, not only is it true? our tax code allows for it. here is shed light is news editor, katie, nice to see you this morning. >> great to see you, too. >> explain this to me. what is going on here? >> essentially, the way this works, is in the united states, if you're not-- there are a lot of people not authorized to work here, illegal aliens and work visas, and foreign investors. what the irs does, they still require you, even if you're not authorized to work in the united states to file a tax return, so they give you an

individual taxpayer identification number. what that enables is illegal aliens to file a return whether they're paying income taxes or not and receive what's called the child taxpayer refund. instead of paying taxes in the system irs is allowing them to gain a tax refund although they're not surprised to work in the united states and they're also not authorized to really even in the first place, file a return because they're not supposed to be working in the first place and earning an income. >> clayton: amazing. here are the numbers behind this thing, additional tax credit that folks have been receiving, illegals and i don't know how many is going to illegal. 924 million n 2010, up to 4.2 billion dollars for that child tax credit. do we know how much of that is going to illegal immigrants? >> well, the problems is that they think that a lot of it going to illegal immigrants, but because the irs isn't exactly keeping track of who they're handing out the individual taxpayers numbers

to, they can't really keep track of who is supposed to be getting the tax credit, why are these people filing a return in the first place, and another aspect of this, that's pretty alarming, the irs is turning the other way when it comes to illegal immigrants applying for the tax credit with social security numbers of legal workers or u.s. citizens. >> clayton: remarkable and the here is the response from the irs, ne say any suggestion that the irs shouldn't be paying out the credit under current law to itin holders is incorrect. the irs administers the law and if the law were changed. the irs would change its programs accordingly. what do you say to that? >> i would say the irs is right on this one, that the tax return loophole requirements and to get this tax refund were loosened in 2001. and the regulations were boosted in 2009 with a stimulus, so it's behind the
