moment in france where there are brand new reports of three loud explosions outside that apartment building where the accused gunman and suspected terrorist has been under siege. it's been about 30 hours now. right now, authorities are saying muhammad murrah may have killed himself. word is they haven't heard from him since last night and at that point he was saying "he'd rather die with his weapons in his hands." all this as we get a very first look at him. this is him on the left, of course. a french television network releasing this undated screen grab of the 24-year-old accused much murdering three children, a rabbi and three paratroopers by the way in the last three weeks. while you were sleeping, police were setting off small explosions in and around his apartment to try to get him to come out. witnesses say these latest explosions were a lot bigger. rallies spreading from florida to new york protesting the shooting death of 17-year-old travaughn martin.

hundreds rallying in the streets of new york city last night. they gathered at union square. they're calling for the arrest of george zimmerman, that's not him. the neighborhood watch captain in florida accused of killing martin. martin was unarmed at the time, zimmerman is still a free man and not facing any charges right now because of a controversial state law that says a person can use force if they believe self-defense is necessary. later today, reverend al sharpton is holding a rally at a baptist church in sanford, florida. excuse me. a florida businessman accused of being a navy seal impostor. according to a new law, barry "bear" silverman falsely claimed to have navy seal training and then he offered to train his customers in weapons use and security deployment. the suit filed on behalf of a real navy veteran who runs a training business in virginia at a similar facility. check out this photo. there's an emerald up above.

prices. so the president has launched a two-day energy tour. there you can see him right there out in the nevada desert, copper mountain solar one plant. >> everybody knows that. >> he's going to new mexico, oklahoma and ohio. but what he's trying to do, brian, is he's trying to deflect republican accusations that he is responsible for the jump in oil prices. >> as opposed to reflect which is happening right behind him which is total doocyism and copper mountain solar one is an appropriate place to be because they've hired 10 people in that hiring boom. >> what? >> they've hired 10 people. >> in the entire state of nevada. >> exactly. 10 people, copper mountain, solar one. whole bunch of solar panels behind him. he wants to prove his point and move on to new mexico, oklahoma and ohio. here's what he said yesterday to those naysayers who think solar energy is a thing of the past. >> if some politicians have their way, there won't be anymore public investment in solar energy. there won't be as many new jobs

and new businesses. some of these folks want to dismiss the promise of solar power and wind power and fuel efficient cars. in fact, they made jokes about it. one member of congress who shall remain unnamed called these jobs phony. called them phony jobs. these guys were around when columbus set sail, they'd be charter members of the flat earth society. >> you just said temporary, more like it. this plant that he was standing in front of, it cranks out 58 megawatts per hour to power 17,000 homes. on a coal fire plant, typical coal fire plant, produces 600 megawatts. >> so there he was out in the desert talking not so much about energy as he was about jobs. and brian mentioned -- >> and politics. >> it's all about politics and brian mentioned a moment ago the number of jobs created in that state. >> in fact, you want to roll my

side? >> we don't have you but we have newt gingrich talking about just that. here he is! >> on greta. >> you know, he went to nevada to a site in which five people, five have full-time employment for an average cost of $10,800,000 a job. it's a solar power site. it's an absurdity economically. it has nothing to do with the price of gasoline which is the number one concern of the american people. he doesn't have a green energy policy. he has a greenback energy policy. he keeps shovelling out greenbacks to failing ideas and propping them up with our tax money and with our children's money. >> he has a membership card for the -- what did the president dae-- >> the flat earth society. >> out in the state that the president is appearing, by the way, crossroads which is that republican super pac. it's not a super pac. it is a super -- it's a pac, a political action committee. >> raises a lot of money.

>> very super. >> they're running a commercial right now where they're talking about the president on his watch, the cost of gasoline has doubled, that the administration has restricted oil production in the gulf, limited development of oil shale and how the president personally lobbied members of the senate to kill the keystone pipeline. he's going to be launching later today, the fact that they're going to open the southern leg of the keystone pipeline, just not the northern part that we really need. >> right. where the oil would actually come from so we have half a pipeline, the kids can play in it. it will be fun. a little ladder, they can go inside and knock and guess where they are. it will be fantastic. >> meanwhile, it's the anniversary week for obamacare. who is here to celebrate? the president is on a tour and then going to korea. the senate, you can't even hear. i don't know what the senate does. what about the house? >> yeah, what about the house? yesterday, in house, they were talking about house resolution 5 which would eliminate health care's independent payment

advisory board. also, attached to that, the republicans want to put in medical tort reform. nancy pelosi who helped jam obamacare through two years -- a couple of years ago. >> that's how she describes it, jam. that's what she did. >> she was on the floor of the u.s. house talking about how obamacare has really helped our founding fathers secure their vision. >> what our founders put forth in our founding documents which is life, liberty and the pursuit of happiness. and that is exactly what the affordable care act helps to guarantee. >> really? i guess she didn't mention the government overreach which would have driven our founding fathers nuts! >> or the 52% of the country opposed the law. 41% think it's great and the president of the united states hasn't barely put in the 17 minute video where you think it's a big bleeping deal.

>> what about the states that are suing the federal government? >> don't ruin this day for me. >> is america fair? there's a new poll and it says americans think the president -- here we go. >> you mean the president is talking about fairness? >> exactly. yeah. >> is the country fair? >> does president obama view society as fair and decent or unfair and discriminatory? 39% fair and decent. 46% of you say unfair and discriminatory. a huge number! >> yeah. about half of you say the president views society as fair and decent. here's the next one, look at this one and it's very telling. do you feel that america is fair and decent or unfair and discriminatory? 64% of you, i don't know what the president is talking about. 64% say that america is fair and decent. only a quarter say it's unfair and discriminatory. >> i think that quarter is a very high number. i never would have said it would be that high. >> only 26% say unfair.

and yet, you listen to the president, he's always talking about how unfair it is. >> what are you talking about? >> i've got a sound bite. you want to hear it? let me push this button. >> settle for a country where a shrinking number of people do really well while a growing number of americans barely get by. or we can restore an economy where everyone gets a fair shot and everyone does their fair share and everyone plays by the same set of rules. paying its fair share of taxes is not fair. fair play. and shared responsibility will help protect our people and our economy. pay our fair share of taxes. when americans talk about folks like me paying my fair share of taxes, it's not because they envy the rich. >> so what stands out there? >> fair! >> i was going to say the blue ties that both gentlemen in the back are wearing. >> fair, that's true, too. >> . when you look at the rasmussen poll despite what the president

ruling yesterday that michael and chantal sackett can challenge the e.p.a. in court. they claim the land is wetlands and they can't build on it. until now, the sacketts could not sue the e.p.a. it's a huge victory but now i think it's fair to say the real legal battle begins. michael and shantel join us from seattle. good to have you guys here. >> good morning. >> let's bring everybody back. you buy a piece of land. this is years ago. you're going to try to build your dream home on it. what happens? >> the e.p.a. and corps of engineers show up on our property and tell us they think, their opinion only, they think that we're building on wetlands. and now, here we are five years later. >> and five years later, the supreme court decided to take it and the victory has come out and you can actually sue the e.p.a. so you are getting ready to -- you'll be going to court with them. are you ready for that?

>> yep, we are definitely ready. we've come a long ways. we're not going to quit fighting until our house is built. >> it's a david and goliath situation many are calling it. >> yeah, it is. you know, it's the regular americans that actually got their day in court and that's all we ask for and that's what we got. >> so here's what the e.p.a. has to say about this whole thing. they have the state, they say the e.p.a. will, of course, fully comply with the supreme court's decision which the agency is still reviewing as we work to protect clean water for and future generations by using the tools provided by congress to enforce the clean water act. what are you hoping ultimately will come out of this? in the small -- the small victories for you and the larger victories for the rest of the country. >> well, this whole case has been about the due process and getting your day in court and that's all we ever asked for. we asked for it early on and the

e.p.a. denied us our day in court. that's all we want is for every american that owns property in this country. >> the land has been sitting there. you were ordered immediately to restore the land to its natural state or risk fines of up to thousands of dollars a day. how have you dealt with that? >> we've just sat and watched the weeds grow. and you know, the other thing is not only did they demand us not to do anything to our property, but if the e.p.a. had their way, we would have made our property wetlands because they wanted us to plant wetlands plants that were not native to that property. then asked for an after the fact permit that we most likely wouldn't have got after you made your property a wetland. >> i think a lot of folks out there are wondering how could this ever have happened? but you know, it's a frightening thing because it could happen to you and you're hoping obviously that it won't. what do you think your chances are? what are you hearing from your attorneys?

>> you know, it's -- it hasn't even been 24 hours. we've barely had a chance to even talk to our attorneys. you know, ultimately for everyone, we want the house to be built but we don't know what's going to happen at this moment as far as what is our next step. if we have to, if we have to continue to fight, we will. >> all right. we will follow that fight as we have been. thank you very much for joining us today. we appreciate it. >> thanks. >> coming up, dramatic video from afghanistan. an american military chopper crashes and the pilots manage to walk away. and as gas prices continue to soar, president obama taking his energy road show to oklahoma today where he's expected to proclaim victory. huh? how does that make any sense? we'll talk about it coming up.

>> under fire for soaring gas prices across the united states, president obama started yesterday a two-day, four state tour, you know, essentially all of the above energy tour. but what about the keystone pipeline that he turned down? >> did he? it turns out he's expected to announce plans to fast track the southern portion of the controversial pipeline that stretches from cushing, oklahoma, where he'll be visiting today to the gulf of mexico. of course, it's not going to connect to anything. joining us right now is the oklahoma congressman john sullivan. congressman sullivan represents the district adjacent to where the president will visit today. congressman, i have to tell you, one of your quotes really stood out with me yesterday because you compared what the president was doing in front of that portion of the keystone pipeline to what al gore claims to have

done. >> well, i think it is. it's very much like what al gore did, claimed he invented the internet. he didn't. the president is going to be standing in cushing, oklahoma, the intersection of the pipeline of the world and say that he wants to approve the southern part of the keystone pipeline from cushing down to the gulf. the problem with that is we don't need any presidential approval for that. it doesn't cross any international lines. that's going to be done by states, army corps of engineers and fish and wildlife and it's going to happen in spite of the president and i think this is nothing more than a con job that oklahomans don't appreciate very much, this photo opportunity that he's doing and i don't believe the american people are going to believe in this con job either. the president is going on this tour on air force one, spending millions of dollars of taxpayer money doing it and i don't think they're going to buy a little trip around for energy when he's not. >> right. >> he lobbied against this last week in the senate to stop it.

now he wants us to pay for half of it. >> he's for the southern half. what that will do by opening up the facility in cushing down to the refineries down to the gulf coast, it will eliminate that bottleneck. in the meantime, if we want all that oil in canada, we're going to have to ship it down either by truck or by train and when you look at who the main beneficiary is, if you have -- if you send all of it down by rail, that would probably be burlington northern sante fe railroad which is a warren buffet company. the president's favorite billionaire would benefit by the fact that the pipeline not built and they have to ship it down by train. >> that's right. you know, warren buffet would profit from this. shipping it by train is not an efficient way to do it. we certainly need the northern part of this pipeline, not only would we get almost two million barrels of oil fully implemented in tar sands from canada but we have up in north dakota and montana, there's tremendous amount of oil up there and we're

important stuff. new reports that police have just entered that apartment in toulouse, france, where suspected terror and accused serial killer mohammed merah has been holed up for more than 30 hours. police say they are taking it step by step through the apartment amid concern that he may have booby trapped it. right now, it is not clear whether or not he is dead or alive but looks like we could find out soon enough. merah seen here screen left for the first time in an undated screen grab from a french tv agency. word is he stopped speaking with negotiators late last night when he hinted he might take his own life. before that, police say he was boasting about murdering three kids and rabbi and three paratroopers over the last couple of weeks. he also reportedly told them he planned to kill again. he did tell somebody that he intended to die with a weapon in his hands. that may have happened. >> all right. we'll follow it. 28 minute before the top of the hour. more headlines.

dramatic new video of reportedly is an army helicopter crashing in eastern afghanistan barely missing people on the ground. watch. >> holy [beep]. >> oh my goodness! >> the apache reportedly went down on february 6th. incredibly, nobody was hurt. it's believed the pilot lost control while trying to perform a dangerous maneuver. >> unbelievable. a former prison guard accused in a foiled plot to help tennessee's only woman on death row escape from prison. she was found guilty of killing a fellow knoxville job corps student in 1995. police say donald on the left regularly made trips from new jersey to visit pike in prison. they say he recruited the guy on the right who used to work there to help plan the prison break. according to police, he took money and various gifts to go along with the plot. steve? >> meanwhile, a woman in

colorado who allegedly faked a mental illness to get out of jury duty caught bragging about it on a radio talk show. >> when they asked me about mental issues, i got up and said i have some mental issues and the judge said does anybody care she leaves? when i put on the lipstick, i put it on so bad. for about two weeks, every time me and my roommate thought about it or i told my clients, we would cry because we laughed so hard. >> really? really? as brian would say. not laughing is the judge who dismissed susan cole. he heard it and reported her. last june, she showed up for jury duty with mismatched shoes, lipstick all over her face and curlers in her hair. she faces perjury charges and she maintains she really does have a mental illness. she'll have to try to prove that. in court. >> i kind of maybe think she does. i don't know. picking your own lobster not a

and the jets get a seventh round back. the deal had to be done twice. there was an issue with the salary advances. it seems that the jets didn't read the contract. they think jets will improve the unrest in the locker room. nothing like a quarterback controversy to bring a team together, right, joel? as you are the jets fan in the building but they just signed mark sanchez to an extension and insist sanchez is still the starter unless, of course, he throws an incompletion which could happen. joe namath blasted the trade and said it's the wrong move for the wrong team but joe namath can't play anymore. the saints were running a bounty pool to intentionally hurt players. nfl hitting hard yesterday. head coach shawn peyton won't be on the sidelines. he's banned for a year suspended without pay. he's the first head coach suspended for any reason. commissioner roger goodell defending the unprecedented punishment. >> this is something as a head coach, you need to be held accountable for and responsible for because all of us are responsible for maintaining the integrity of the league and also

a debt mess we are in and exposed how treasury secretary tim geithner is somewhat embarrassed to answer the question because he doesn't want to admit that the president's own plan says we need another $9 trillion to be borrowed over the next 10 years. that's a huge amount of money. the administration doesn't want to admit it. >> don't you think americans expect that kind of answer whether it would be tim geithner or anyone else giving that answer? >> the big problem is do we need to raise the debt ceiling and borrow a few more trillion dollars before the election or after the election? is it an election issue before or kicked down the road to somebody else? >> it does sound like we're about to run out of money before the election which means tim geithner and the guys are going to have to go can we move the money from there over to there? >> we can borrow just over -- we're allowed to borrow just over $16 trillion. we're at $15 1/2 trillion now. we're getting awfully close to november and to the debt limit.

nothing like this. just in the past half-hour, a fuselage of ammo going into that apartment building where mohammed merah was holding out. we are told something like 300 cartridges expended from automatic rifles. also, gas used as police special forces finally said it's enough. we've been talking to him for hours and hours and hours. we want to get him. and they moved in. and yes, according to police sources reported by a wide variety of sources, he is dead although we are still waiting the official confirmation. also, injured, however, in that -- in that attack as you noted, three policemen. one seriously. again, this is the end of a long siege as police tried to get him alive. this situation has captured the nation of france and in fact, the world and it's believed that this man was responsible for, as you noted, the shooting death of

three children, a rabbi, three french soldiers and in those last hours, he was claiming that he wanted to kill more. more soldiers, more police officers and the only regret, perhaps his last regret, is that he didn't kill more. the police were certainly working on this very hard and they wanted to follow the orders of french president nicolas sarkozy who wanted to see justice done but at the end, our understanding is that communications between the police and the alleged killer broke down. the negotiations that had been going on for hours, he had said he was going to surrender and then he changed his mind. surrender. changed his mind. fell silent and that ended that and the decision was made to go in. just one more reminder of the gruesomeness of his crimes. in the past 24 hours here in this city, we have seen a memorial service for those three french soldiers killed and over in israel, the bodies of the four victims from the jewish

obamacare. four who will probably be against obamacare. and then maybe one deciding justice that will save the day for either side. >> let's take a look at the line-up. who is on the left? left field and the political left? >> political left, we've got i'm going to say these are all justices. kagan, sodermeyer, breyer, ginsburg on the left. >> no possibility they would come to the right? >> doubtful at this point. we have chief justice roberts who is the pitcher. justice alito, scalia and in the far right field, justice thomas. now, justice kennedy is kind of the wild card that a lot of the liberals and the liberal press are saying, listen, he's made some decisions that make it impossible for him to invalidate the commerce clause and to invalidate the constitutionality of obamacare and so there's been a lot of political pressure in the media to say, well, justice

kennedy, he's got to move to the left. now, there's also been some pressure even on justice scalia on the right and people are saying listen, no, he's written a couple of decisions about the necessary and proper clause of the constitution, the commerce clause of the constitution that makes him -- that mandates him to vote for obamacare. >> so the suggestion is scalia would go to the left field? >> that would be a 6-3 vote in favor of obamacare. so it's interesting how the political process is working out in what is supposed to be the most sacred process in american politics where these folks go behind closed doors and make a decision. >> right now, kennedy is kind of in the bleachers. >> kennedy and a lot of the briefs have gone citing cases that justice kennedy has decided. citing cases that justice scalia has decided. to say to them, you guys are the critical votes and we need to

influence you. >> ok. now from the left field, you got kagan and from the right field, you have thomas. there are some suggestions that they should recuse themselves. >> great point. they're not going to recuse themselves. justice kagan by some accounts involved in discussions with obamacare while in the government with president obama. allegations that his wife was involved with obamacare, justice thomas, neither are getting out and i don't think neither should. we have a full field of nine. there's more handicapping on this than the world series, the kentucky derby, the super bowl put together. and all of the predictions are going to be wrong, steve doocy. >> so what's your prediction real quickly? >> my prediction is that obamacare will be rendered unconstitutional and they'll say this is not a valid reading of the commerce clause. that you cannot regulate inactivity and i think that the conservative justices, scalia

keifer couldn't hear? >> they realized when he was very young at about 4 weeks old when he was in his foster family when they would walk into the room, him and one of his brothers who is also deaf wouldn't wake up like the other puppies did. >> so you had an idea. i'm going to teach this dog to communicate using sign language. >> there are hundreds of deaf dogs around the world but people don't realize it. and i joined a group of other deaf dog owners who said to me, just teach them sign language and that's all you have to do to communicate. >> that's incredible because then, of course, you now take keifer around and show how he responds to you in front of kids maybe with special needs to teach -- to quiche kids a life lesson. >> yes. >> give me some -- give me an example. i do not know sign language. give me a few signs. >> oh, when we're at home, he knows when we're outside, if i do this, he knows it's time to go inside. if we are inside and i want them to go out, i can just tell him go out. if i want him to get his ball, i can just do this and he'll get the ball his favorite thing is

's neighborhood watch captain in florida and he's accused of

executive order, issue a presidential memorandum to say his administration wants to move forward. republicans noting this plan is moving forward with or without the president. he doesn't really need to do that with the executive order, number one. number two, they're also saying he should have pushed through the broader keystone pipeline from the canadian borrowed. yesterday as well, republicans saying the president went to nevada and said despite the failure of solyndra and other solar company, he wants to double down on the federal government helping some of these renewable energy companies. republican presidential candidate newt gingrich among various republicans, saying that is not the way to lower gas prices right now. take a listen to the president and newt gingrich. >> if some politicians had their way, there won't be any more public investment in solar energy. there won't be as many new jobs and new business. >> he doesn't have a green energy policy. he has a green back energy policy.

he'd have said no, this is a rental property, i'm renovating it. i could show you the invoices from contractors. it's outrageous, but it's happening all over the country because a subjective decision is made, brian, by a lender to vacate -- that a homeowner abandoned the property. pick up the damn telephone and ask them. if you know where to call them when they're late on payments, call them to find out if they vacated the premises. >> brian: this is wachovia, owned by wells fargo. are they often in the middle of things like this? >> as a matter of fact, there is a case out of new york i found yesterday, brian, where this happened in 2010 and the higher courts in new york actually found that the actions of wells fargo was inappropriate. they did not act reasonably. the same thing. the people were on vacation. let's see mr. whitaker was sick in the hospital. let's say he was on vacation or let's say he went to europe or let's say one of his family members were sick and he was taking care of them for six

that is down from 351,000 the week before. economists were expecting 354,000. >> steve: what's it all mean? eric bolling from "the five." >> good number. it's about the fourth or fifth 350 ballpark number. i think this may be the first time or second time we've dropped below 350. again, 350 is the area where the economy starts to grow. starts to create jobs. 348,000 people walked into an unemployment office for the first time looking for benefits. a lot of people come on the unemployment line. a lot come off. 348,000 new ones. that number isn't an estimate. when you do the unemployment at the end of the first friday of every month for the prior month, that's an estimate. that's 60,000 homes that are called. they make kind of an estimate on who is working. that's actual people walking in for sure 'cause they're signing their name on the dotted line. >> steve: you say that's a good number. there is a potentially bad number out there, though. the price of gasoline is getting higher and higher. could be north of 4 bucks by summer. what i heard a lot of people say

is the economy is starting to creep out of things, but this gas price is a tax on everybody. every time you fill up, all those costs will be passed on to people buying stuff. next thing you know, things will slow down because of the high cost of gas. >> it's 3.88, national average. the highest price ever recorded is 4.11. the problem is that was in july of 2008. it was july, middle of the driving season. it hasn't even started yet and we're only 23 cents away from the all-time record. >> brian: obviously no up with saw me this weekend. i was on the road all weekend. >> steve: you must be rich! >> the reason why gas peaks is 'cause it's peak demand during the summer. we're not there yet. so this is an anticipation of even higher prices going forward. my guess is it will blow that number out of the water. president obama today at 30:55 is going to land in ohio. at 5:20 p.m., he'll talk at ohio state university. you know what the average price in columbus, ohio is right now?

morning after nearly 32 hour stand-off with police. france's minister talking about the raid. >> steve: and he says mehra was hiding in a bathroom when special forces stormed the apartment. that's when he, mehra, began shooting at police before jumping out of a window in an attempt to escape. officials say he was found dead on the ground, apparently he was shooting on the way down. he had reportedly spent much of the last two days boasting to cops about murdering two kids, a rabbi, and three paratroopers over the last few weeks. sarkozy now saying an investigation is underway into whether mehra had any accomplices. >> brian: now more from the scene in toulouse, france, right now. greg, what's happening? >> hey, brian. it has been a long night here, but it is all over after 32-hour siege, the self-proclaimed killer and terrorist, mohammed mehra is dead. he died in a massive shootout with police. we were here through the night.

we heard various sporadic gun fire, as well as explosions, blasts of stun grenades. but this morning, french time, about two hours ago, it was really big. first explosions and then at least four minutes of intense gun fire, 300 cartridges expended as police, special forces stormed the apartment where mohammed mehra was. apparently he came out of the bathroom where he was holed up with guns blazing and then tried to jump out of a window and he was met by that gun fire from police. he died when he hit the ground. they wanted him alive. they talked to him for hours and hours, but then when he went silent, that was the signal for the police, we are told, to move in. two police were injured in the attack this morning. the final raid this morning, one of them seriously. again, the suspected shooter, killer, he has claimed responsibility for the deaths that this region has seen in the past week and a half. it horrified the nation.

he's also claimed terror ties and the officials here are backing that up, that he has spent time in afghanistan and pakistan, a terror training camps along the border of those two countries. sarkozy was just on the air, a strong justice, a strong law and order message. his final words is that the republic stays together, solidarity, unity, we will be -- we will defeat the violence here. obviously he has a lot riding on this, too. he's in the middle of a very tough election campaign. again, the folks here, the neighbors we were talking to in the area, breathing a big sigh of relief. back to you. >> juliet: thank you. >> brian: it's going to be interested to have a lot of conversations to record and analyze before his death. thanks. more headlines and new video of what's reportedly an army helicopter, i believe it's an apache, crashing in eastern afghanistan, barely missing people on the ground.

it would have been nice, i would imagine, for mr. romney had mr. bush endorsed him before the florida primary, but here he is after the illinois primary. >> yeah. i don't know how that calculation works out. we have a process in place and we're going through it and there is some people i'm sure that would like for it to have been over after the iowa vote and there are others that are still in the hunt and fighting the good fight and laying out ideas and one of the reasons i not only support newt gingrich today, but will continue to is he is a clear proponent of the 10th amendment. he understands how to swim in that shark tank of washington, d.c. and be successful. i still like his principles and his philosophy and will continue to support newt as we go forward. >> steve: you know what, governor? there are some people who say the reason rick perry likes newt is 'cause i've heard that rumor, newt wants perry for his number two, his vp. any truth to that?

>> yeah, well, let me see. texas governor versus vp? the balance on that one isn't even close. i would suggest to you that's deep in the rumor category and i got a better gig where i am, thank you. >> steve: okay. let's talk a little bit about where you are and that is down in texas and i know your legislature passed rules where if you want to vote, you got to show some i.d let's face it, if you go to the drugstore to buy sudafed, you got to show i dirks, but the department of justice is saying that's discriminatory. you can't do that. what's going on? >> as a matter of fact, if you want to go in the department of justice building in washington, d.c. you have to show a voter i.d i think it's hypocritical position and this is a classic -- there are either six or seven other states that passed voter i.d. laws and this is going to go obviously texas decided appropriately to sue the federal government over their

encroachment into a state sovereign right to decide how to protect the sanctity of the voting booth. that's what we're doing here and democrats and republicans in the state of texas support the idea of having good, clean, transparent elections. that's what having a voter identification law is all about. this administration has gone after texas over women's health programs, voter i.d., clean air act. we're spending most of our time in courthouse suing the federal government and their encroachment of the 10th amendment rights of states. >> steve: governor, one of the things regarding the voter i.d. thing is they say that discriminates against latinos, and yet according to the department of justice, registered latino voters are twice as likely as nonlatinos

not to have a photo i.d so what are they talking about? >> well, this administration is not transparent on many things, but in this piece of legislation, or this effort to go after this piece of legislation, certainly they are. they're trying to play to a specific segment of our voting block and that's the hispanic vote in the state of texas and probably all across this country. they're not protecting the hispanic votes. as a matter of fact, i would suggest to you the hispanic voter in the state of texas understands whether they're democrat, republican, independent, they don't want their elections to be stolen or impacted by people who are voting and they're not legal to be voting in those elections. that's clearly all this does is if you're going to go to vote in the state of texas, we want you to be able to prove that you are who you say you are and it is your legal right to be vote not guilty that election. >> steve: we got the department of justice meddling in so many
