biggest cases of our lifetime. >> so, are you optmistic with your expectations high before the oral arguments begin? >> we firmly believe we are positive and believe it is unconstitutional. and the first day is going to be the antiinjunction act as to whether or not it is a tax and whether we can proceed. we are confident we will prevail. day two is the man date that is important to our constitution and rights and states. and on day three, we'll argue the severability issue. whether or not the entire act rises or falls if the man date is unconstitutional. it is so intertwined that without the man date they have to go back to the drawing board and we'll argue the medicaid expansion issue that is important to the state and

country. it will cost florida over well over a billion a year just to maintain this and what the material government is trying to do is force us. by saying, hey florida. if you don't participate in this program. we are going to pull every single penny of your medicaid funding and that medicaid funding is comprised of hard earned tax dollars by floridians and we'll vigorously defend. >> you mentioned paul clement. give us the since of the attorney he is and presentation. >> we are in constant contact with paul clement . he helped us to write the briefs and he argued pen times in front of the united states supreme court . the way i would like to describe paul if you can have the most brill yont lawyer without an ego, that is paul

board and sparked a major debate in congress. joining us now is congressman larry bushon. and ration health care to people and make decisions best left to doctors and patients, but would the panel have the authority to be involved in all aspects of health care? >> the president's health care plan 575 billion dollars from the medicare portion of what the government pays for seniors. the president also budget, in his budget proposed another 300 billion in cuts. what the independent advisory board's role would be, further cuts to the medicare program. they're fairly limited what they can do, other than further cutting and reimbursement to hospitals and providers and this is going to be a detrimental thing to seniors. eventually what will happen. significant access problems for seniors, and they won't be

able to find a doctor that will take medicare and in that way, that begins the ration services based on what the government will pay for. >> let me ask you this, is it true to they'll limit what all americans are legally allowed to spend for health care, even if it's their own money to hold it below he the rate of medical inflation? >> well, i don't think that that is true, i think the biggest issue is this is a panel of 15, unelekked washington d.c. bureaucrats appointed by the president, it could be this president or any president in the future that has the power to recommend cuts to the medicare program, which do not have any control on the congress. we would have the ability only to propose further cuts and we'd have to have a two-thirds majority to override their proposals for cuts. you see what happens, every time the so-called doc fix comes around when the proposed cuts to medicare is going to happen and he you see what

physician's groups do and congress overturns that. to give an unelected board to cut further from the medicare program is something we don't need and it's detrimental to american seniors. i don't think i've seen anything worse for american seniors than the 15 years i've practiced heart surgery. >> supporters are saying, that this panel will only step in if costs overhaul or exceeded the budget expenditures, what do you say to that. >> that's true. we need to drive down the overall costs so that doesn't happen. the other thing is, the medicare system needs to be restructured. house republicans proposed ways to do that and other proposals on the table. and we know that by 2030, double the number of seniors that we have today will require medicare services and we know it's on a fiscally unsustainable path. and the fact of the matter is,

if we do nothing, they'll he have to cut and have no choice because the costs are going to continue to go up based on sheer numbers. the people that are proposnts of this are short sighted and want to keep their heads in the sand and not look at what we really need to do. what we need to do is protect this program from seniors. >> quickly though, it passed the house and doesn't appear to be taken up in the senate. so is this a lost exercise by the house and do we expect it to be fully debated by the house and congress? >> well, look, the it was part of the senate bill as you probably know. there were members of the house, including a number of democrats that didn't think it was a good idea in the first place. democrats in the senate. some of which came out last week, and said that they were considering voting to repeal this. i think senator reid and the senate democrats to bring us something that has bipartisan support and let it have its
