scaling back on campaign appearances but said he's the best bet to challenge president obama and will remain through the convention at least which is august, remain in the race. as firefighters make progress battling deadly wildfires in colorado, we're seeing more pictures of how bad the destruction is there. take a look at this rubble. that's the house before the wildfire tore through this and this is a car before it was gutted by the blaze. the governor going up in the sky yesterday to get a first-hand look at the damage in jefferson county. over two dozen homes are either destroyed or damaged. crews are still racing to find a missing woman and we now know that some people who were supposed to get calls about evacuating never got them. this one hits close to home, guys. i know a woman, her parents lost their home in that blaze. >> wow. >> pranks for nothing? april fools day is this sunday and it's apparently a very stressful time for zoos. yes, zoos. the zoo in st. paul, minnesota, my home state, for example, installing four extra phone lines this year to deal with all

million dollars for george zimmerman dead or alive. and then you got spike lee tweeting out what he believed to be george zimmerman's address. it wasn't. 70-year-old people lived there and they were terrorized and then roseanne barr tweeted out the correct address for george zimmerman parents. and saying that if people don't go get him, she might have to. >> a lot of people are weighing in on the other side now. laura ingraham was on "the o'reilly factor" last night and she made an interesting analogy. with regard to spike lee tweeting out that wrong address for that elderly couple who now on to move out of their homes, laura ingraham compares spike lee's apology after that to another apology we've heard recently. see what you think. >> funny like when rush limbaugh apologizes for something, it's not meaningful but when spike lee apologizes and two innocent people are terrified, elderly couple, then everything is oh, that's fine. i'll forgive him. >> that's a great point. including guys like imus who

does a lot of apologizing himself. he was even critical of rush limbaugh. but that's pretty amazing, too, that a lot of people are weighing in including oprah winfrey. she weighed in on the entire event. she wasn't so much focused on what's happening now. it's how long did it take to get here and to have everyone look at this. listen. >> it is a tragedy. and it is a shame. that we're sitting here 33 days later and there hasn't been an arrest or questioning of actually what happened. it's a tragedy and it is a shame and we all know it. black people, white people, brown people, yellow people all over this country and all over the world are saying the same thing. it's a tragedy and it's a shame. and justice needs to be served. >> you know what oprah said before that i thought was significant, i'm reading twitter and reading blogs and saying nothing has changed in this country since the 1950's.

sees an address, goes to that house and kills somebody. then what happens? anyway, bill o'reilly was on with the trayvon martin family attorney last night and he had this observation. >> the special prosecutor is gonna see the tape. the special prosecutor is gonna listen to what you present to him. so why does oprah winfrey or msnbc have to convict zimmerman on television. why? it's unnecessary! >> i don't know if it's a conviction, they're calling for an arrest. there's a big difference between an arrest and a conviction. >> that's an interesting point. there is a huge difference between an arrest and a conviction. so, you know, i think the authorities are now looking into this. there's a special prosecutor assigned to it. but i think it gets dangerous in this age of technology with twitter and with the internet and all this kind of stuff where regular people are making a rush to judgment and we really don't know all the facts. and honestly on this couch, we have no idea what happened.

investments in fuel efficient cars and trucks. and energy efficient homes and buildings. that's the future. >> is he kidding? >> brian is having a meltdown. >> invest in wind? >> it is a little disingenuous based on the fact that a lot of the taxpayer money that's gone into companies like solyndra means we have companies that are belly up. >> since when do we have taxpayer giveaways to the oil companies? show me the check. show me the check. >> all companies in america when they invest in equipment get a tax break on that investment. the oil companies included. the president says that is a subsidy. it is not. it is not a payment of money from the treasury to an oil company. all that -- i mean, do you get a payment from the treasury when you have a break on your mortgage, on your interest? of course you don't. he's confusing everybody with this use of the word "subsidy". >> and here's the fact. oil companies pay an effective tax rate of 41.1% when the

average corporate tax's effective rate is 24%. they're already paying on average $86 million a day in taxes while hiring 9.2 million people. >> publicly, the president is beating up on the oil companies because he thinks it is politically popular and will win him votes in november. >> and he's right. because when people hear that, stuart. >> you shouldn't mislead people. >> of course you shouldn't. i'm telling you what he says may work. that may work. because here's what's gonna happen. he's going to beat up on the oil companies because most people don't dig deep to find out all the stuff that brian just said and when gas prices eventually go down before the election, he's going to be able to say look, i'll take credit for that. >> publicly, he's beating up on the oil companies. privately and quietly, he's planning with the french and the british and the japanese to release oil from strategic reserves around the world. put some more supply on to the market and get the price down. he's talking to the saudis. he's begging the saudis, please,

investments in clean energy technologies that have never been more promising. >> but when the president was a senator, he took a different tact about these tax breaks. >> thank you very much. >> why did the president vote for the energy bill in 2005 as a senator that had over $2 billion in tax breaks for the oil industry. they were making a lot of money then. >> what i can tell you, ed, is that the oil and gas companies in this country are making record profits. now. in 2012. the price at the pump is very high and that is plenty of incentives for these companies to continue to drill, to continue to explore and continue to develop energy sources here in the united states. and abroad. there is no reason for the american taxpayer to subsidize that activity. >> after all that, the democratically controlled senate couldn't pass the president's plan and beforehand, minority

in the next few days at vanderbilt university. it's called the all comers policy. the school says this is a nondiscrimination policy that will allow any person of any faith or any belief or any organization to join other organizations. so, for example, we've had people on the show before who run christian organizations on campus and what this policy would mean is that an atheist could actually be the leader of that organization and under the school's new policy, they deem that to be fair. some people might deem that to be crazy because why would an atheist want to lead a christian organization and what does this say the way in which political correctness has come into our society. >> what is he going to do? >> it's not just religious groups. i mean, if you are -- if you are a member of the young democrats, you could actually, according to their policy, the leader could actually be a young republican. and apparently, what happened last spring, allegations were made against against a fraternity where an openly gay

currently building in utah relatively secretly until "wired" magazine wrote about it. joining us right now is fox news senior judicial analyst judge napolitano. how do we end up with stories like this? >> i don't know, judge. this must drive you crazy when you heard about this. >> it does drive me crazy and it's a perfect storm of a bunch of unanticipated events. general petraeus revealed to us about two weeks ago that sort of new kitchen appliances that have computer chips in them when you connect them to your laptop, the c.i.a. and other entities of the government have software that allows them to know when you're using the entity. so do you want the government to know when you're in the kitchen? that's issue number one. number two, attorney general holder announced when the government gathers information about people, even innocent people, even people about whom it has no reason to suspect any wrongdoing is going on, they're going to keep that information for five years rather than use it or discard it. number three is this $2 billion construction project. it will use 10,000 construction workers and it will be the third

alternatives like solyndra, companies that went belly up. that's a real misuse of taxpayer dollars. these clean energy sources have not proven to be economically viable. they currently provide only 7% of our resources. we need fossil fuel -- >> to continue. >> exploration. >> let me ask you this, is he telling the full story? isn't it true that all companies that invest in machinery and equipment, that they get these tax subsidies so it's not just oil companies and don't they pay millions of dollars in taxes? 41%, i think, of their profits. >> yeah, i think most americans know that the real story here is we're all feeling pain at the pump and what we need to do is reduce demand on the oil supply and we need to explore alternative fuels and do things like the car leaf that's coming out of the big three automakers in detroit. we're going to reduce demand on oil. that's going to drive down the price of gas. that's what everybody wants. i don't know why we're giving tax subsidies to oil companies that make billions and trillions

of dollars and we give them tax subsidies and they take tax cuts, too. i don't think that's an economically feasible situation and not good for the revenue of the government and not good nor most americans. >> i got to get this in. i don't have time to play the whole thing. in 2005, president obama as a senator voted to continue the tax subsidies for oil companies and now he's saying he's against it. >> well, which proves that this is all kind of a political game here. i mean, i partly agree with ryan. i mean, i'd be more than happy to get rid of all of these -- all of these kinds of subsidies but if you're going to do that, if you're going to get rid of corporate subsidies, you'll have to do it comprehensively rather than just going after the big, bad oil boogie man which is what the president seems to be doing right now. >> which is my point, it's all companies that invest in equipment and machinery that get that kind of a tax subsidy. would you agree with that? >> yeah, why are we paying people, though, that are punishing us at the pump? you know, i think what we should do is make them a deal and say hey, if we're going to give you these tax subsidies, bring down

going to uphold this. everything is going to be constitutional. >> this law is constitutional. republicans used to support this law before they were against it and the fact is that the constitutionality of what they suggested back then still hasn't changed. the reality is that they're playing politics with millions of americans' lives who now have health care, children, 17 million children now have pre-existing condition coverage. women who had higher rates on insurance just for being a woman, meaning being a woman is a pre-existing condition. now that's going away. i think those are great things. the reality is in america, if an american is sick, they should be able to see a doctor. it's that simple. i don't know why conservatives and republicans are so opposed to that certain fact. >> i don't know many -- >> i believe all americans should get good health care and good coverage and there are ways to do it without putting the government in charge of everyone's care and taking their freedom away. the real issue before the court this week was if the federal government can force you to buy a health plan to solve the national problem, what can't the federal government force you to do or buy as the justices said, can the federal government force you to buy burial plots, can the

federal government force you to buy a g.m. car to prop up detroit or stocks and bonds to prop up wall street. there's no limit and that means no liberty left. >> is it a slippery slope? >> it is. i think it is a slippery slope but i mean, the question you ask, though, are liberals in kind of denial about what's going to happen? i mean, i think just the reaction that they saw from the tough questioning, that conservatives had for the solicitor general i think proves that liberals were shocked realizing the serious constitutional ramification specifically with the individual mandate on part of it. and i think there's a broad consensus among all the conservatives justices that that's going to go. the question, then, is, though, will the rest of the law be upheld as constitutional and that's about 50/50. >> i want to get all three of your opinions on this. political ramifications if the individual mandate or the whole thing is thrown out. >> i think actually if that happens, it will be a major gift to mitt romney. the way romney care was looked at as a weakness in the primary,

this becomes strong and he can now say i delivered health care in my state and i did it constitutionally and the constitutional law professor in the white house took a year and a half to push this law through and it turned out to be unconstitutional. powerful argument. >> three ramifications. when the constitution prevails, all americans are winners. number two, it's going to be a strong warning to mr. obama that in this country, the rule of law is king, not mr. obama. and it will be a warning to americans that if he gets a second term, lo and behold, who is he going to put on the court next? >> the political ramifications of this are very serious. it's that the supreme court's legitimacy is at stake. they're going to prove themselves to be radical right wing legislators from the bench who think it's their job to issue laws and legislate from the bench. that's not their job. their job is to apply the constitution to the laws of this kunlt. -- country. that's what they need to do in this instance. >> if justice kennedy votes with the conservatives, i don't think

organizations? >> well, i think a very well intentioned policy but unfortunately, it accomplishes the exact opposite of what it's meant to do. it's intended to be policy that prevents discrimination but in fact, it's discriminating against faith-based organizations. it's intended to be a policy that encourages diversity but, in fact, it's stifling diversity by not valuing voices who believe they have a message worth preserving. >> sure. >> it's very unfortunate that it's come to this and they're sticking with this policy but nonetheless, we're confident and moving forward with our ministry. >> p.j., if the organization not allowed on campus, you'll have to leave campus, perhaps, to observe your faith. >> well, in a way, we'll have to leave campus but also in another way, we'll still be very much present on campus. we're confident we can still be an active and vibrant student group on campus. our mission to propose jesus christ is not dependent on official university statous so we're going to face a lot of

business in old colorado city last year. i actually attended as a citizen and it was a little bit chaotic but hearing the feedback following the event is really where the shocker comes in. >> what do you mean? >> well, they had stories of parents actually jumping the rope to get in on the easter egg hunt. parents yelling at their kids to take eggs away from other children. and then, of course, the follow-up -- >> are you kidding? >> oh, yes. and then the organization that puts on the event received calls following the event from disgruntled parents saying my kids didn't get an egg and didn't get enough eggs and generally complaining about the event, really stripping the community spirit. out of the whole thing. >> it's not a scholarship is at stake. even that wouldn't have been an excuse. i heard it was so intense the whole easter egg hunt was over in a matter of minutes. >> it was. we were absolutely astonished looking on and we were watching from a little bit of a distance, i mean, there was an incredible

things? >> you stop making their bed, first of all. you require rent from them. you tell them that they have to pay for groceries. now, here it gets real simple. if they can pay you rent and they can pay you for groceries, they can pay somebody else rent and somebody else for groceries. don't allow your children and you are enabling them, don't allow them to steal your retirement from you in terms of your personal time, your space, and your money. you should have taught them better along the way. there comes a time they need to go away. i'm not convinced it's the job market or the recession that's causing this problem. not all these adult kids live at home because they have to. some of them live at home because they are allowed to. we need to stop allowing that. >> gretchen: that's interesting because we pointed to some of the statistics earlier. to me, it's such a huge percentage. do you believe that this has changed over time? >> of course it has. there was a time -- i know when
