here, will show up. >> we think all the witnesses will show up. our invitation is not about the one episode which has been highly covered but about the problems that gsa that go back to the previous administration. as you know. lorita dome was working hard to change the culture at gsa and probably the first to say it's hard to change culture of an organization that hasn't been held responsible. >> greta: are you going to look at yourselves, at congress? the fact is i look at these and i realize the run-up prices for lavish parties fall under two administrations. fall under two different parties running congress with power of oversight. a bit troubling that we see over and over again, whether the lawyers downloading the porn at the sec or the conflict of interest at the department of interior or this or something else. congress' job is to do oversight. we only, congress steps in and has hearings after the fact.

rather than to prevent it. >> you are right. there needs to be a beefing up in congress of the oversight that needs to happen. i don't want to say that we're under manned, but to give you an example. there are 80 people on my staff. the largest majority staff in the congress. a budget of couple million dollars. i.g.s alone represent 12,000 people and $2 billion. so, it's obviously a big job. we are never going to equal what the inspector general are due for the government but we need to look at the information much quicker, digest it. and make changes. >> greta: all right. brian d. miller is the inspector general on your list. what are you going to ask him? >> among other things we'll ask frankly, what he thought

he should have been able to do when 11 months ago he informed the administration not just the gsa administrator, but also the president liaison in that room of what was going on and as he continued to work on a final report was he surprised that the administration was essentially ignoring the scan scandal? >> greta: my thought, i'm revved up about this. i think it's appalling when i think of what $840,000 could do for important projects in the government or so many needs, veterans learning to work with amputated arms or whatever it is. i see this and i'm pretty revved up about it. 1 months. you see $800,000 spent on lavish party and it takes 11 months to figure out there is a problem? i see that as, you know, this -- what is someone drinking? how can it happen? it wouldn't take me 11 months. i hope it wouldn't take me 11 minutes. >> that is right.

you would have thought the administrator would have been doing everything to correct this, so by the time the final report came out 11 months later, she would be able to say yes, we understand but we fixed it. this is one of the areas, greta, that is so irritating. the administration wants to say they took quick action. but they have known about it for 11 months. took no action. until the press was about to get wind of it. >> greta: all right. before that, though, in 2008 was a democratic congress who should have been providing oversight. and a republican white house. $655,000 on a lavish party. two years earlier, $323,000. it realize it's much less money as the years go back but what are we spending a dime on lavish party for civil servants, people who work for the government when we have high unemployment, people don't have job or job security. what are we spending a dime on this stuff? >> you are exactly right on one of the most important things. there was a trend, direction, cultural shift to make this

more and more if you, will easy to do. by the time it came to the $800,000 party, the fact is that the damage had been going on for a period of time unchecked. and you make the most important point, which is congress has to be proactive. we have to see the trends coming. we have to have more direct relations with the i.g.s and with all the other parts of governments. in other words we need transparency to be part of the solution. whether an administration is ready to take action or not. >> greta: how do we get that? how do the american people get that? we watch congress fight over the budget. one side wants taxes raised. another side doesn't want the taxes raised. we look at the waste and fraud and we think to ourselves as taxpayers, maybe you ought to start doing your oversight and stop wasting stuff. maybe we don't need as much money. the american people are watching you guys, you -- i appreciate you copping here, but a lot of it, you know, really, you know, the problem is you members of congress and the white house are part of

the problem. big part of it. >> well, failure to do your job is something that congress should be held accountable for. we have failed to do our job of keeping after an ever growing bureaucracy, which is our responsibility. we shouldn't fund and then forget. senator coburn and myself are working on the modernization, what we call the data act. getting kind of reporting that would not only allow to us look better in government but allow the public to see it. these expenses should be transparent to the public. everyone in america should be able to know what happened in vegas. how many people were there and how much money was spent. you vu a right to know. we have a need to know. can we get both of those in a way in which essentially like a google search you'd be able to find out? we think the time has come to order that and make the

administration transparent. not because of this president but every president. >> greta: i shutter to think how many other part of government are having the parties. but i can't escape irony, i quoted senator tom coburn many times that he commissioned a study about waste and fraud in the government. a study that is a foot tall on my desk. been there for months. who did he commission to do the waste and fraud? the ones who are partying in vegas. you can't make this stuff up. it's appalling. i question that every american has how many other agencies of the government are having parties? do you have any other idea about this? >> i give you an example. when we were in the majority of 2005 and 2006, as sub committee chairman i worked on the mineral management service. mms. the parties they were having paid for by the oil companies that did business with the government in violation of all the laws. they in fact told us they thought it was necessary, they needed to have a close working

relationship with those they oversaw. fast forward and the gulf is filled with oil and too close relationship between regulators and regulated. it's not the only part there are lavish parties and only timeta government thought it was their right and entitlement. but when will congress start putting its assets in to making sure that we have transparency? that is a signature of my chairmanship, can i get this and the next administration to change their ways and become transparent? not just give it lip service. but provide the real online capability, not just for my committee but for crew. groups on the left and right who want to know about the waste in government. only way they will get that access is if we change how you access government records like this spending. >> greta: congressman, thank you, sir. look forward to watching your hearing on the 16th.

thank you. >> thank you, greta. ♪ ♪ >> greta: appalling enough is obama administration wasted $800,000 on government party in vegas but tonight they say they are not responsible. they are pointing the finger at the bush administration saying it never would have happened if the bush administration hadn't let the gsa party budget get out of control. lorita doen, the former administrator joins us. >> good to see you. >> greta: $800,000 and change, do you have any doubt that the number $840,000 and change is correct and reflect what is was spent on the party? >> i think it's accurate. it comes from the report published by the inspector general of the gsa. likely to be accurate. >> previous numbers from 2008, 2006, 2004. $655,000 in 2006.

2006, $323,000. 2004 is $93,000. when you were director was the 2006. $323,000. do you have any information, these numbers are supplied to the white house. do you have any indication that the numbers are correct? >> i don't. i would be wary of them. what i have seen with the obama white house they pick and choose which numbers they will represent. some of those numbers look fairly large, but they could represent a federal, state and local gathering of officials. most of the gsa conferences often have as many as 10,000 folks. whereas the event that was in las vegas only had 300. i believe, i know for a fact as much as you might like to want to try to blame president bush, in my time as the administrator i never approved the excess spending the waivers that must have been put in place in order to allow them to have the per diem or the special perks that appear

to have been to occurring in the $823,000 in las vegas. that requires circumventing the law. that is not right. >> greta: to understand the other numbers and make a fair analysis we would have to see what composed the 2004, 2006, 2008 to see if it compared to the largest one of 2010. >> yes. we have to show transparency on that. >> okay. now, why didn't the inspector general, 2010, $840,000, this seems to me like a no-brainer for a party in vegas. why doesn't the inspector general of the gsa or the then existing director know this before it happened so stop it? or he did, the inspector general and she the director did. >> it's curious because it's hard to believe they didn't, that someone in a senior leadership position didn't know it was happening. there are many checks and internal controls along the way at gsa. when you have a conference of this size, you put out public

bids. if you go to where the bids are, you will see there is a bid out there for this conference. there are proposals that have to be submitted. there is a budget that has to be established. it has to be signed off on by a series of leaders in gsa. a lot of different areas. when you exceed that, if one were to exceed that you have to get a waiver and explanation. justification. >> who has the waivers? inspector general or director of gsa? >> anyone from the regional director to the administrator. that is why it's very odd. further more, if you are having an investigation by the inspector general, the inspector general does the administration courtesy of coming to his or her office and explain the nature of the investigation is, as much as within their power. and then they proceed with the investigation. at the on set, before it begins the administrator is informed. >> greta: does that mean -- okay, the inspector general came out with a report. saying 11 months after the incident, report came out from

the inspector general. did the white house or inspector general know 11 months ago for? or learn after the report came out? >> it would be hard to learn after. >> so they learn when the investigation started? >> yes, they have to give information to review. expense report, bids, proposals to be reviewed. there will be the hotel records. there is all sorts of documents that can only be obtained from the agency, itself. >> greta: how much of a mess is this in government? spending and waste. >> i can't tell you how much this bothers me. what you worry about, you see at least it seems to me within the obama administration, it really does seem to be a culture of excess. when you see this kind of excess happening at one agency, you have to wonder is this is happening in other places? is this happening elsewhere in the administration? these are taxpayer dollars and it shows disregard for value

out on facebook and also on press release, senator moynahan got finished doing a scuba dive in florida. and driving back to do work. i saw a banner outside the gas station that said the ebt cards and snap cards are accepted here. if you do the research that my staff did, 1964, food stamp was created to help the low income families to get nutritional foods and help the agriculture industry. but now we find this nutrition assistance program, as well, as the electronic benefit transfers are used in many different businesses across the united states of america. we have seen this grow as a business from $156,000 to over 200,000. most importantly when you talk about the government waste and abuse we have seen increase in the electronic benefit transfers, food stamp benefits

month ago. what everyone is talking about is onerous tax policies. we have the greatest tax increase the country will see, january 2013. the regulatory environment is crushing business owners. last week i was speaking with twin v. boating. they produce five catamarans. and three years ago he had 100 employees. now he is down to 30. because of the tax policy and the regulatory policies he has to hire someone to help him decipher the epa regulations. the one person is regulatory consultant to take the place of three employees. >> greta: that would handle improving the unemployment perhaps if that is a solution. those are people that want jobs and would get jobs if they were available. enormous part of the population who reached despair. they have just given up. some of them may never want a

job but a lot of them would like a job. how do you reach those people? those people are being left behind. >> we have to look to indomnable spirit of the american people. from the public and the private sector and small businesses. this is about tax policy and regulatory policy an access to capital so the small community banks can reach out to small business owners who have an idea to hire americans. another thing, once upon a time, unemployment benefits were 26 to 27 weeks. in congress previous to the one i'm serving in, they were boosted up to 99 weeks. got them to back it down to 79 weeks. we are doing everything counterproductive to american citizenry getting out there and getting a good hardworking job. we are providing more in benefit to people who are sitting around getting

good to be with you. >> greta: vice president biden says it makes sense to do the buffett rule. why are you opposed to it? >> do the math. this year it would raise $1 billion to revenue for treasury. the deficit this year projected under obama to be $1,300,000,000. it would be $1,329,000 ,000 if the tax revenue is collected. so it doesn't do anything to help real problems that america faces. i would make things worse because it redirectly hits people who we are expecting to create new jobs. you saw a disappointing job numbers last friday. we are asking american people to hire more people. four out of five people subject to the new tax are the business owners. the people that we went to hire more workers.

>> what do we do about the tax code? ato cording to simpson-bowles, there are 30 million earmarks in it. lobbyist over 3300. this is enormously complicated tax code. everybody says we have to do something about it. when are we going do something about it and how do we make it "fair"? >> it can be made fair by broaden the base and reduce the rate. collect more or the same revenue if you want to. a general consensus on corporate side we should do that, because competitors abroad have lower corporate rate than the united states. we're at 35%. most countries we compete with 10 points lower than that. we could reduce the corporate rate to 25. on the individual side, there are a lot of deductions and credits and special provisions that everybody takes advantage of. not just the wealthy. home mortgage deduction, charitable deduction, not having to pay for the value of the health insurance provided by your employer.

they could be reduced in value and rates lowered to make a fairer and actually easier to administer tax code. it's not going to be done -- >> greta: not going to be done soon. if the goal is to, is to make it so we don't discourage corporations from creating more jobs, curious that the recent controversy over big oil. they had profits of 20 to $30 billion. not like they are making a little extra cash and we don't want them to do anything with it. they are making money and get big tax breaks. why do they get it when you don't give the small businessmen and women commensurate break? >> okay. let's be clear. when we talk about the buffett rule, the thing that the vice president was talking about, we are talking about the individual taxpayers. they don't pay as corporations do. your plumber and air

conditioning guy, contractor you hire. those people pay as individua individuals. the buffett rule directly applies to them. the four or five taxpayers hit by the buffett rule are the small business folks, entrepreneurs looking to hire the job. as for the corporate rate you talk about, it's incorrect to say that the oil and gas people get any special tax provision that isn't applicable to all other businesses. there is a section 199 of the tax code. i think you are well aware of this that applies to all companies. they can depreciate or expense value of things they use in production of whatever they make. oil and gas companies do that, but they only do it at two-third the level of others because we are already socking it to the oil and gas companies. >> greta: go back to the buffett thing. i strayed from buffett and corporate and back and it's

confusing but in terms of the buffett, it's unearned income, correct? or is that on millionaires who make that money? is it just millionaires that make the money then it's what we call unearned income. >> that is part of the trick. it's not just on your adjusted gross income like you and i would calculate income taxes. it's passive income of the corporate dividend, capital gain taxes and other taxes that are not, before you get to adjusted growth income. so it's higher tax than just applying the 2.3% additional amount is what i think it amounts to. this has been defeated six times in the senate in the congress. it's a show boat. it is not going to pass. the president knows that. it plays in the rhetoric dividing the society. he should be leading. what he should worry about is $4.5 trillion tax increase that gets every american january 1 if we don't do

two months. $500 million has it gone to i.r.s.? >> not all of it. $200 million has been sent that way in the past two years and $300 million is in the pipeline. >> greta: where is the money coming from? >> from a $1 billion general implementation fund included the healthcare law. money, not attached to any specific provision. just given to department of health and human services to do whatever it needed to do to implement this law. >> greta: what do they expect the torres do with the money? >> white house press secretary carney said it was used to administer small business tax credit, provision in place in the healthcare law. there is a lot that falls to the i.r.s. to implement, so they have put out a list of, quote/unquote tax changes. which can include the small business tax credit and that could include the mandate. >> greta: hiring more

people? >> that is an excellent question. yes, but hard to tell exactly how many. an how many they hire with this money that is transferred in this way affects how many new employees they are asking congress to fund. >> greta: what happens if the law and i know that you sat through three days of argue in the the supreme court, what happens if just the mandate is determined to be the unconstitutional worth? any money come back? >> well, probably not. this is money provided in the healthcare law. that would be one of the administration argument why they have gone ahead with the implementation ahead of the supreme court decision. >> greta: to beat the clock? >> to beat the clock. also, if they only strike down the mandate, they may not even do that much. even they just leave it there, there are still a lot of provisions that would still be left in place if that the i.r.s. could implement. >> greta: if they strike down the whole thing? $500 million is gone. >> yep.

and this year, the obama administration can't wait to shove half a billion dollars in the coffers of the i.r.s. because they are everything they can to get obama care up and running in case the supreme court decides to make it go away. >> greta: i am particularly annoyed about the way money is spent in washington. i'm curious, maybe you are not the right person to ask but this $500 million to implement the mandate and other things we don't know what will happen, the supreme court, how do they figure out the numbers? how do we not know it's $200 million or $700,000? how do they come up with the numbers? >> what is more profound when the obamacare legislation passed if you did the google search, you won't find one newspaper story about the $105,400,000 of implementatio
