misspending. you know what? it isn't. it's so much more than that. here is a good example. david foley, gsa official who was captured on video joking about the agency spending at 2010 conference. he said he did not know the over-the-top expenses were paid for with the government money. who does he think was paying for that? >> clearly what we know now that neely and others in fact stole money. they used money that had to be used personally, implied to some people it was personal but used gsa credit cards for a number of expenses. the important thing here is what you saw, existing people on the full payroll, not answering questions or answering them as though they did nothing wrong. this is part of the culture that every president inherits that the reason we give political appointees the opportunity to work is they're supposed to bring about that change, control and reform. that is what hasn't happened in this agency for last three years. >> greta: jeffrey neely not

did he get $9,000 bonus he is on the payroll. >> he will make $179,000 a year until he is determinenated which could be a long time. >> greta: what does it take to terminate him? >> hopefully indictment and conviction. it seems short of that, this administrator and hopefully not the next implies you can't get rid of the people any other way. that is why we asked, in no uncertain terms are you going to be able to make changes or do we have to make changes in the statute? including the idea that somebody could absolutely, the proof is clear. this individual won't retire and in fact when we called him to testify, we the taxpayers pay for him to come from san francisco. because he still current employee. >> greta: it's probably at the ritz carlton, too, here in d.c. >> i hope that the gsa found the best rate and -- >> this is appalling. it's so appalling you laugh in horror. >> this is something. every member of my committee on my side of the aisle is a volunteer. every member of my committee

chose to be on our committee as the committee that oversees waste, fraud and abuse. greta you held me account able few days ago when you said why didn't you know? >> greta: what is the answer? >> because i.g. didn't inform us. the current statute doesn't require him to inform us, but historically we have been informed. >> greta: that doesn't make sense. okay, maybe hisser to click he doesn't have to tell you -- historically he doesn't have to tell you. but the inspector general, what is his job? hide it? >> the amazing thing is, the chief of staff robertson informed a lawyer at the white house in may of last year. so the problem was he informed staff who informed the white house who said they did quick action. very clearly a year passed and it wasn't until the eve of this becoming public they began taking action. >> i have here april 13, 2012, three letters. quick action. three days ago from the acting

commissioner, one is to robert peck saying he owe dollars 1,069 for a party he held in his room at the "m" resort. glenda carroll, the commissioner says it's unconscionable the taxpayers bear the cost her face personal party. one to jeffrey neely three days ago. the quick action was three days ago saying he owes $2 ,717.0 # fo717.09 for a party. another one for personal expenses at the resort. it took three days ago to figure it out? >> more importantly, this is a fraction. the buying of gifts and giving them to people. the so-called bicycle thing where they bought the bicycles and then proceeded to have a catered event to give them to the poor as though they were being given by the individuals rather than you, the taxpayers. i will tell you, mr. peck and others haven't seen the last of it. he will be before and his issues will be before the sub committee tomorrow with jeff

denham. i have to tell you. there is a lot more that has to be fixed at gsament we only had so much time. this is only the first of what will be many hearings. >> greta: are you going to make a call to the justice department to open a criminal investigation? >> we expect the i.g. referral to be acted on. i will tell you -- >> greta: the referral has been made to justice. >> the referral has been made. i.g. will follow up on it. so will we. we expect to have the criminal indictment. the i.g. has done a good job to make a case for number of items that go beyond the repayment. remember, the important thing is change. these individuals if we're lucky in a relatively short period of time will be dismissed. under the current law they will be dismissed for 30 years worth of retirement and go on to something else. how do we change this at 24 agencies? i wrote 23 additional letters to other agencies asking that they give us a breakdown similar to the gsa on their conferences. because this is one of many areas. >> greta: one way to change is handcuffs go on somebody.

we have the perp walk and you see someone -- i mean when you have -- look, you have an obligation not to steal taxpayers' money. you know, when it's so blatant when you do things that are so over the top. $820,000 for a party. we didn't even get to the fact they had one for the interns in palm -- some resort. >> for that matter five people flying out for five days for a five-minute ribbon cutting but enjoying their family vacation in hawaii. you know, one of the things, dreta, we have to be careful in congress. we were threatened by mr. neely's attorney that he was going to try to use the d.c. bars ethic rule against our counsel, who are members of the bar for "bringing somebody who asserted they would take the fifth." i made a decision -- >> greta: whose lawyer? >> mr. burton. but he made it clear that was part of it. we went through the details. i will tell you, the d.c. bar has to ask a question, if somebody simply threatens to take the fifth, are we to

ignore that in our investigation? >> greta: i wouldn't too worried about them right now. there are other bigger fish to fry than that. thank you, sir. >> thank you. >> greta: clown, mind readers, yearbook and commemorative coin. you heard of the gsa waste of your money in vegas. now you get to see it up close. >> this is one of those examples of gsa spending, misjohnson, under the leadership, includes the conference logo and everyone was given one of these. this is apparently i'm told a black jack dealers vest. so that everybody could feel as if they are in character when they get to the conference. in addition they were given participatory directory that has everybody's picture. in it, they are assigned characters and roles. on the page i opened here, one is assigned cher. one is assigned sammy davis junior, elvis and celine dion. additional items given to people who were there including a then and now book. on las vegas signed by mr. neely, himself.

thanking them for being there. this was printed in china. the vest was made in china. they were given other party favors while they were there. all gsa spending. the taxpayers' dollars spending. they were given a coin. a commemorative coin. call it a gambling chip for this aspect. it's a commemorative coin commemorating the stimulus. >> greta: the gsa mir under president bush joins us. good evening. your thoughts about today's hearing? >> it was appalling. absolutely shocking. but shocking maybe for different reasons to me than what other americans saw. i saw the question of competence, because you saw the leader of gsa, the administrator, the chief of staff, all saying they really didn't know what was going on. they really didn't think it was their responsibility to figure out what was going on. even though after they were told it was ao kay to award bonuses to folks they knew violated the public trust. >> greta: explain to me. if i'm a regional director and

i'm going to hold a conference, do i submit a budget in advance or a bill after the fact? >> i have to tell you, you should be submitting budgets and get approvals in advance. however, it's very clear after today's hearing that the current obama administration appointee at gsa have radically departed from the procedures that were put in place at least during my time in the bush administration. >> how high up is it signed off? two is the top one, is there a cfo? >> not only a cfo but it should be the administrator. because what i put in place is a procedure where budgets are reviewed every month within the region. the commissioners review, and the regional budget and the commissioners and the regional administrators sit down with the administrator in gsa. martha johnson to review the budget. you look at the budget at many levels and you should be catching any out of bounds spending. beyond that, like dog on the bone. that's what we were doing at gsa in the bush administration. >> greta: i was surprised that the former martha johnso

johnson, she said test run -- i'm paraphrasing, for the rest of her life she will always regret she lost the appointment or something to that effect. i thought that is the least of your regret. think of what this amount of money, this culture of theft from the american people, think about that money and what it could have done to people in the country whether it's a school or firefighters. we talk about the time about firefighters and teachers being cut. we wouldn't have to if we weren't throwing lavish parties. >> incredible waste of taxpayers' dollars and no realization across the group of those interviewed by the congressmen about the waste they caused. but what was more incredit to believe me is martha johnson is she didn't seem to understand that she had completely delegated away all of her responsibilities, her statutory responsibilities for financial management, sound financial management, person managemenpersonalmanagement and.

she didn't meet with her inspector general. >> greta: as the head of an organization you can't expect her to do every staff. >> but you do have accountability and responsibility for how it's performed. >> greta: tell me. this mr. neely, when he took the fifth amendment, any thought about him? >> what i saw was that you saw a lot of the congressmen looking for, they needed to circumstance the wagon. they needed to pin this on someone. by jeff neely, a career, senior executive service employee taking the fifth, that was the person they were going to pin it on. so to cordon off the white house from my blame. i don't think they succeeded because congressman issa did get to the point that the white house knew and knew for 11 months and took no action. >> greta: how do you get rid of a government employee? >> you have to be tough. you pick up the phone and call jon barry at the o.p.m., office of personal management

and say i have a employee out of control, career employ, so it's tough. but he violated the public trust, stolen taxpayers dollars and abused really the good reputation of the agency. here is i documented it. i need you to take action on this. i need it to be immediately. >> greta: all right. >> it's very hard. you will be blamed but it's the right thing to do. >> greta: on leave and getting paid. how do you stop somebody getting paid? is that possible or do you wait, sort of presumed innocent? which in my -- i think people should be presumed innocent, but this could go on forever he is on the payroll. could t another job, i guess. >> it could be 11 months to get the report, the report seems to be final. conclusive, there was abuses and his name is on it. they should be on leave without pay. government does have the option to make someone go on leave without pay. >> greta: who makes that option? >> administrator could do it. >> greta: at gsa? >> gsa. that may justify it to the personal management, i believe. >> greta: all right. so gsa, one who is the head of

gsa now, acting head is the one two decided he would be on leave with pay? >> no, i believe martha johnson may have done it, again, in my mind, another example of her delegating that responsibility. in other words, there is a lot of ducking and dodging going on here. at some point you have to stand tough. you have to say this is wrong. i will not tolerate it. bonus is a perfect example. >> greta: what took the inspector general so long? >> that is an excellent question. one would like to see if you were proactive on these things and alerted folks in advance you could stop the abuse from happening. stop the waste of taxpayer money. yes, they sent out letters to recover funds, but that is only few thousand dollars. when you talk about million that was wasted on one of them. by the way, what has happened in the subsequent 11 months? >> i would like to look at the inspector general. we're lucky the inspector general isn't a firefighter. the place would have burned down with a family inside by now with the speed of which this happened. >> i think we have to be concerned because he did say at one point, quietly, he did

excessive drinking and bringing prostitutes to their hotel. ed o'keeffe from the "washington post" joins us. what is the latest? >> we know 11 secret service agents had their security clearance revoked pending investigation of the situation. the pentagon now says at least five military officials who were part of this group that was putting together the summit are involved. and are probable more. they reviewed the surveillance tapes from wednesday night when it went down at a hotel in cartagena and now a few more are likely involved in the situation. you have an investigation ongoing. and lawmakers now saying that they will keep tabs on the investigation. and help to learn whatever happened. >> greta: the secret service traditionally has been one of the services we're most proud of. >> yep. >> greta: important job to protect the first family and other important jobs. it's appalling, both from the sense of security of the president and also the scandal in a foreign country that we look so essentially immoral. i realize prostitution is legal in colombia, but still, the idea that we look like

we're party animals. >> still, legal in colombia, but the secret service policy is when you are overseas as agent you follow the u.s. law. prostitution is illegal. they have broken the code of conduct, personal conduct. that is part of the reason why for now they are on leave. likely a few of the guys are going to lose their job. they jeopardized security. jeopardize security zone they were establishing for the president. they brought four nationals to their hotel rooms. they potentially exposed information. we just don't know that at this point. we learn tonight one of my colleagues down there stayed behind in colombia and has been able to speak to those involved and some agents paid $60 to owners of what is called a club, a strip club in the industrial part of cartagena to bring two women back to their rooms. in the morning, what set off the whole situation is that one of the women refused to leave without being paid an additional $170 by one of the agents who disputed payment. they had a bit of a disagreement. he eventually paid the woman.

she left the hotel and colombian police by their policy had to inform the embassy they had incident with the americans. >> greta: this is almost impossible to believe. i traveled with the president and first ladies and secretary of state. different force with the state department. but i have never seen, an organization more seriousness of purpose. and realizing how important the job is. and very serious. almost humorless when you travel with them they are so serious about their jobs. this is just -- it's unspeakable. >> it is. you know, talking to some of the lawmaker who are familiar with the agency who track the stuff say there is no excuse. this is a high stress job. >> that is absolutely absurd to use that. then don't do the job. you have the most important job to protect the most po powerful and important person in the world, i don't care it's stressful. i don't. >> i'm not here to defend them. >> greta: i can't believe any n any way they make that

as an excuse. >> overall they protect the president and former presidents. protect dignitaries when they come here. this appears to be right now isolated incident. there have been suggestions that there are wheel up party when a president leave a country, the advance team still there goes out to have a party. upring off. there is a culture of that in the secret -- >> wheels up? >> wheels up and off. they go out and party. >> you said there were five military officials. how high up are military officials? >> we don't know. they are part of the 7 command, u.s. military operations in latin america. but 200 military state department, secret service, white house officials, you know, other f.b.i., whatever, are all involved in advancing one of these big trips. there were 11 secret service agents, at least five members of the military. likely more now the pentagon said today. even staff chairman dempsey said we screwed up. >> greta: screwed up? it's more than that.

if you have travelled overseas people are looking to the united states for moral leadership, whether you agree with the president or not, we don't want to humiliate the president or put the president at risk because it reflects on the rest of us. >> the white house separated itself from this. but they must upset. they knew, but the president was going to colombia for two days and would be back today. the white house hoping we go to this conference, we don't really want it to be part of the agenda right now. clearly it's important but we have an economy to worry about. go to the conference, come back and go back to talk about the economy and get re-elected. now everybody knows he went to colombia. nobody knows what he did, there because the guys there before him screwed up now. there will be months, maybe years of investigation and fall-out from this. >> are they on leave, paid leave the -- >> the way it works, whether gsa or secret service career employee you are put on administrative leave pending an investigation. investigation is completed and

>> this is a fox news alert. i'm ainsley earhardt in new york. reports out of chili of a powerful earthquake. the 6.5 magnitude quake was centered in a heavily populated area, 70 miles northwest of the capital of santiago. no word on damage or injuries at this point. there are reports that the tremor swayed and shook buildings in santiago and a nearby town for nearly a minute. power and telephone service is out in parts of the capitol. we are told that a stretch of chili's south central coast area has been evacuated as a precaution, although no tsunamis are expected. chili is very prone to earthquakes. you might remember that 8.8 off-shore quake that hit the central region in 2010. 547 people perished in that disaster. to recap, a powerful earthquake has hit chili. we will keep you posted, i'm ainsley earhardt.
