that they want to wrap these people up with their observations that night which could have been if they are walking right by the window of the home was the screen off or pulled out. was the window open. did they hear anything? did they see anything? did they see any other pedestrians walking in the area, did they see a little girl walking by herself with a pedestrian. if they are not witnesses, they are trying to bracket the timeline a little tighter. >> judge jeanine: what do you make of the fact that the little girl are goes missing at 8:00 in the morning and the family, the mom and dad don't come out and talk about it until wednesday, your days later. you are a how man homicide det, how does that hit you? >> i would not have the family talk to the media unless it is a last ditch effort.

i think this is more complicated than just straight up or down strange came in or somebody in the house is involved. there seems to be a hint of something a little more complex with this investigation just the way that the police are tactically releasing the press conferences, their comments, their use of investigative style. there is just something a little more complex. >> judge jeanine: dr. baden, we heard this before, an open window, a screen pushed aside. what do you look for forensically if you hear this? >> there should be some kind of fingerprints on the window sill. there might be damage to the screen, if the screen is broken, skin or blood from the perpetrator. how high is the screen from the ground outside. in order for somebody to go through a screen they have to know where they are going. is it a bedroom, a kitchen, a

bathroom? this would as mark indicates somebody who knew the inside of the house, had worked there, been there, relative. posses, five people don't kidnap a child. and also interesting because the releases from the sheriff's department are hesitant to call it a kidnapping. they said it is a disappearance. >> judge jeanine: something about this is tweaking mark as well and obviously guys this is complicated by the fact that they are are close to the mexican border. >> that does raise adegreesal possibilities, yes. >> judge jeanine: mark, also, the mexican border, problem? >> i think it might be a reach unless there is some kind of nexus between this family and somebody that lives south of the border they might be in dispute with. we have another situation a mistaken residence. are there any residents in the area that have something going on that quite possibly a

residence was simply mistaken but dr. baden said something that was so crucial. you have to have knowledge that you are going to the right target location, the right window. there wasn't several windows, there was just one. somebody is either going to go in or convince the girl to come close enough to the window to pull her out. is that somebody that is known to her or somebody actually went in the window. both create an ingress and egress. another story, police just released a computer generated photo of what mad lin would look like today. joe morris is a consultant on 48 hours and he joins us now. ing thanks for being with us is. the uk please say it is quite possible tha madeleine mccann s

still alive. >> i do not believe that she is alive at this time. i believe the family has invested a lot of time and resources and their hopes are that mattie is still alive. unfortunately, that is where the investigation went wrong from the beginning. they never dealt with this investigation as if it was a crime originally and what happens is the parents didn't level and tell the whole truth to the police. >> judge jeanine: what to you mean they didn't investigate it as if it was a crime? it was a missing child in a foreign country. >> when the child went missing everybody thought that the child walked out the door. the child was left in the apartment unsupervised and they thought the child was in the compound which is a resort for families. they looked all over the place for the child. it wasn't until later on that the police came and realized that they had a crea crime on r hands. >> judge jeanine: joe, since you were throughout very quickly you sea the parents

could not see the apartment from where they were having dinner is that, correct? >> there was no way that they had a visual sight of the apartment so they couldn't have seen if someone grabbed the child and came back out. from the beginning they misled the police in the facts and that is how they became strong suspects in the case. >> judge jeanine: you have a couple here in a foreign country leaving kids alone in an -- in an apartment with an unlocked door. no babysitter. what does that tell you, mark fuhrman? you can't see the apartment. you are drinking heavily. >> i mean it is obvious they at that moment at least they weren't very good parents but they are on vacation. this whole investigation the portugal police seemed like they never investigated a crime against a person before. they floundered around and went everywhere they could to take the heat off at every press conference and failed to see

the obvious. first you look at the pear rents. you split them up and interview them separately and get statements and see where they conflict and actually try to break the case down before the forensics come back. when the forensics come back and now you know you have a child that was injure ared you have a problem. >> judge jeanine: dr. baden? >> the portugese police did a poor investigation just as the police in aru aruba did with natalee holloway. tourism is very important for these area and the first thing they want to say is it is safe to come here, there is no local people doing this. it is the parents. two doctors who had great trouble conceiving this child and they eventually the people had to pay libel fees.

>> pleasure. >> michael, you remember when arizona said it built pass. the justice department says it is unconstitutional, it is racial profiling. >> i don't think it is but it could lead to it. it leads to the opening of the flood gates where arizona will make a mosaic and say one tile should be this way and we see kansas and oklahoma and utah making pro immigration legislation because they need the crops picked throughout the country. this conservative court is actually going to allow the arizona law to go but it is going to change everything, judge. >> judge jeanine: i think in this case the flood gates are about people flooding into the country. >> you have been so gracious. i have to tell you this is concerned but this is a bad precedent if the court does this. >> judge jeanine: the

interesting thing is even the justice department after a year of saying this is racial profiling and the president saying he could be going for a cone of ice cream and they will come up to him and ask him for his papers now the solicitor general says we admit it is not about racial profiling and at this point it seems that the supreme court is sympathetic to arizona's request to pass its own quasiimmigration law. do you agree with that? >> i certainly agree. one of the things that happens here is, first of all, the law mirrors federal immigration law. there is already protocols how to establish alien experts people encountered by law enforcement officials. there is a big concern that other states are going to follow exactly what arizona is doing. >> judge jeanine: there is no question that they already indicated that. michael if the feds aren't doing their job and if the people of the state of arizona are suffering the cost of

education and hospitalization and social services for the illegals don't they have a right to pass a law that as we just heard mirrors the federal law? >> it doesn't. it is -- >> judge jeanine: how. >> the gentleman is arguing it is support of the bishops supplementmental to the federal laws. it will create an environment where other states want to do other things. the men and women are law enforcement are already taxed. >> doug: so leave the illegals alone? >> what happens, judge, is very honest they do not have the capability and forensics in the field to do the analysis. >> judge jeanine: even the supreme court said to the justice department what is the problem if arizona and i will draw this question to you, what is the problem if arizona simply calls the feds and says we have an illegal? is there something illegal about that? >> there is nothing wrong. as a matter of fact -- >> judge jeanine: let him answer. >> there are already protocols in place between the federal

government and local law enforcement officials to -- when an individual is taken into custody for a crim fall offense and they are charged and it is determined that they are not lawfully in the country i.c.e. is notified and a detainer it placed on the individual. >> sir, they are not going to remove the individuals. >> but there is a protocol where the individuals are take noon custody. the problem with arizona is that if arizona doesn't provide the training for the officers nor the facilities to detain anybody theyen counter illegal in the country i can assure you the federal agencies are are not going to increase their personnel to respond. >> which is a problem. >> judge jeanine: i got to wrap on that one. >> they don't have enough planes and aircraft to remove these individuals. >> judge jeanine: but we have enough money to pea for them to live here and that is the problem. the supreme court when they make this decision it will have a tremendous impact and other states are going to follow.

joins us. gentlemennion thank you for being here. now, sheriff, let me ask you a question. we have this woman who have an illegal alien driving a car without the permission of the owner. driving without a license. she is speeding. she hits a parked car and she leaves the scene of property damage is. leaves the scene of an accident where a death is involved. she makes bail. this is what cracks me up. pays crash, $50,000. makes bail. then is before a federal immigration judge who is giving her the ability to self-deport and if the d.a. didn't step up and say whoa, i want to oppose this, this woman could go back to guatamela. have you you had cases like this? >> this is frustrate people in america and in massachusetts. it is outrageous. imagine if an american citizen did the same thing and we said look we are not going to charge

you, we are going to give you a ride home. you can't say they will be exempted from the laws and punishments when they violate them. it cuts democracy from underneath us all. >> judge jeanine: unfortunately the poor family here is concerned who lost their son is concerned about whether or not they will be able to see justice done or have their day in court. you were an ins agent. have you seen this kind of thing happen before? >> i have. but the situation is that justice can be served here when this individual was charged before the state authorities actually she should have been placed on a no bond condition. i think there was a dependency on this individual being able to be held in custody of the immigration service. once she gets turned over to immigration the federal judge and our immigration system leaves no choice but to place her in removal proceedings. there are ways to have her taken back into custody and that is their responsibility to

do that. i know they will work closely with them. doesn't matter if the person is illegal in the country or legal in the country they should be punished for any crime that they commit. we don't have a double standard. we need follow the right process. >> judge jeanine: everybody agrees there should be no double standard but if they rule she can leave the country without standing trial after she has been indicted for all of these outrageous crimes, but for the d.a. jumping up with an order to show cause, michael, she could leave. >> the states and governors are now taking action. in this seth we are are frustrated the fact that people aren't working in concert between the federal government and state prosecutors. i think as fathers, gentlemen, former prosecutorsion i'm a former federal prosecutor i'm embarrassed that somebody would

not be punished before they were deported. we need to resurrect this thing and get it right. >> judge jeanine: this is about a defendant charged with vehiclear murder who is given a pass by an immigration judge. >> they will not be deported until they -- >> not yet. >> the immigration judge has not granted a pass. >> he said she is free to self-deport and if the d.a. did not have a hearing on monday she could self-deport. >> what makes is worse is that this judge actually sade that the reason he thought that should be done is because it is going to cost us too much money to have this person incarcerated. >> there is a program where they allow people of less crimes that are committed to be deported to save funds but here somebody died and it is uncon objectionable. >> how do we fix this kind of thing? you are a sheriff and you have seen this in your own jurisdiction. what do you you do about this?

>> i think what has to happen is i think as one said earlier we need to deal with the immigration laws once and for all. this can has been kicked down the road. i have been dealing with this since 1992 and we continue to see these kind is of things cropping up. innocent victims killed. families who are losing loved ones because in washington they just won't grab ahold of this thing, sit down, roll up their sleeves and put a good immigration law in place that everyone understands and murkowski the loopholes and peppal at thes don't exist. we are talking about somebody can kill somebody in our country and get away with it because they simple deport. >> he sends thousands of boot leg movies to our troops overseas and hollywood and the motion picture association isn't too happy about it.

president's schedule and his plans when is in a foreign country? >> he don't know, judge, you and i could have a good time in a foreign country. go out for a niece dinner, might have a bottle of wine. >> i wouldn't bring hookers back to my room and neither would you. >> maybe this is an argument that we need more women in senior positions in the secret service who have a some what different idea of blowing off steam. i don't think we have an epidemic here but i he really don't think boys will be bows when they are protecting the president when they are our ambassadors abroad. i think we have a right expect they behave in the way they behave in washington, d.c. and con fine blowing off steam to activities they would be willing to tell their wives about. >> judge jeanine: i think the complicating issue here, of course, is that if you you have a guy who is, you know, cavorting with prostitutes he is setting himself up to be

compromised in terms of someone giving information back home in terms of what he was doing. should mark sullivan given the fact that we now have two investigations going on involving the secre he the sec, should he be force resign? >> no. they have very tough responsibilities. their budget has gone up. the threats have gone up. i worked with these guys on capitol hill working on issues. it is a professional organization. i don't mean to suggest what happened downdoug i downsouth y way appropriate. we need to look at their track record of providing excellent service to the president and his team and the like and hopefully the new rules get the worst behavior out of the system. >> judge jeanine: i will ask you both these questions. do we really need these kinds

of rules saying you shouldn't drink alcohol in excess when you are in a person country planning for a visit from the president? isn't that a band aid remedy everybody feels better and they go home, susan? >> i think depends if you enforce the rules. i told my kids growing up i don't think in professional situations they need to be told again that drinking to excess is a bad idea no matter where you are. the point about mark sullivan is you have to judge him not by so much what happened because i assume this has happened before but by what he does about it now. he has moved swiftly and aggressively and made clear there isn't going to be any tolerance of this. setting the rules up quick le you can't have somebody come back and you know they are going to sea i'm going to sue, i have been wrongly discharged. i had no idea he wasn't supposed to cavort with

out. what do you think the chances are for the attorney general to be cited for contempt of congress? >> what is interesting about this and you are one of those former big shot federal prosecutors. this is on the eve of the general election. to be fair if the republicans were not in control but the democrats were it would be the same thing. but ultimately he is already -- he responded to documents. he has testified seven times, judge. he has had 12 officials made available to testify regarding the program. he has given -- >> judge jeanine: you are so good but you are wrong. >> he is great but he is wrong. when karl rove got cited i'm sure you weren't saying the same thing. congress has the right to issue a subpoena and they asked for documents and as a former federal prosecutor we don't let people who get subpoenas dictate the scope of what they are going to turn over. it doesn't work that way. >> 7500 documents. >> judge jeanine: here is the problem if you send in 5,000 documents is when 80,000 are

requested there is a problem. we going to move on. >> national security. >> nice try. >> no, this is a dead agent. >> dorian hansen came under fire when she sent the 7-year-old she' don'tedded back on a plane to russia alone. she says the boy was mentally unstable. russia now suing her for child support. she is suing to have the adoption aal annulled. she is looking to nullify the order of adoption. >> she puts him on an airplane with a note in his pocket like she bought him at amazon .com and wants to mail him back. the russian supreme court ruled that she should not have to pay child support. >> and prevailed for good reason. this is about misrepresentation. she was informed of all these things, the child is great and everything else. found out he had behavioral problems and he was psychotic

and couldn't take it. what is telling about this is because it is about child support. why not sue her to take child as the parent. >> the problem is the way she sent him back she is not a very sympathetic plaintiff. >> and complicated by the fact that you have two countries and seems there was tremendous disrespect and neglect of a young child and if he was psychotic flying alone from this country to russia. >> they will enforce the supreme court judgment in russia declared she would have no responsibility. three 8th grade girls are are expelled from school from a chat they had from home on facebook. it was about what students they would like to kill. now, the parents of the expelled girls are fighting back saying my daughter shouldn't be expelled for something she said at home. >> it doesn't matter. when the supreme court ruled on

this in 1969 they said as long as it is reasonably foreseeable it will affect the schools. the young children were talking about killing a classmate. if you are old enough to be on facebook you you are old enough to know what the bounds are. we had soo many killings -- we had too many killings in high schools and colleges not to take this seriously. >> i think you need to eval weight everything in context. they were children having banter. you know how they use the semi-colons and smiley faces. they were having a discussion that was light hearted. >> judge jeanine: how do you know when it is real or fake? >> because of the nature. when someone sends who are we going to kill. >> if the columbine guys had done that and then killed people it as different scenario. >> but the columbine was wholly different. evaluate everything in the context of what it occurs. there is no way we could take it seriously.

reporters who truly never had the chance to go to an actual prom. our chapperone for the evening is jimmy kimmel. who is perfect for the job since most of tonight's audience is in his key demographic, people who fall asleep during "nightline." jimmy not his start years ago

"the hunger games." some of you have seen it. a movery about people who court wealthy sponsors and then bruteally savege each other until only one contestant is left standing. i'm sure this was a really great change of pace for him. [ laughter ] >> i have not seen "the hunger games." not enough class warfare for me. of course, i know everybody is predicting a nasty election and thankfully we all agreed that families are off limits. dogs, however, are apparently fair game. and while both campaigns have had some fun with this, the other day i saw a new ad from one of these outside groups that frankly i think crossed the line. i know governor romney says he has no control over what his

super pacs do but can we show the add real quick? >> back in 1983, you took your irish setter sha shamus on a 12 hour road trip tied to the roof the your car in a kennel. >> he climbed up there regularly and enjoyed himself and my guess is he liked it a lot better new hampshire his kennel than he would have liked it inside. >> finally a candidate who will fight for a dog's ability to feel the fund in his fur. what about barack obama? man's best friend has been forced into government controlled automobiles. just imagine the european style dog socialism obama has planned for the next four years. more government handouts. a life of government dependency.

on twitter already. he had some good lines, too, that is okay. >> judge jeanine: like everything is wrong with washington is in this room tonight. steven, what did you think? >> i thought the president was funnier than jimmy kimmel. he had the standup b, c, a and get to the a material and finish strong. >> judge jeanine: is that how it works. >> that is how it works. he never got to the a material and one thing i notice out of everything was the journalists inability to laugh at themselves. i thought it was hilarious. and the fast and furious joke i thought it was funny. i don't think many people there knew what he was talking about. >> that is the one i wrote down where he says to the president jimmy kimmel says president, stick by your guns and if you don't have any call eric holder referencing fast and furious and the 2,000 guns that went down into mexico. what did you say? >> given how little most of the media has covered fast and

furious. 20 years guy when it was just, washington people and the press corps and the political community everyone would have gotten it but now it has all become h hollywoodized. >> in addition to the press corps people like and i was watching them on the red carpet. >> red carpet this is a bunch of hacks and journalists. really. >> you have kim kardashian and lindsay lohan and they kind of breezed right by because they didn't want to say anything. >> they don't even know why they are there. this is to entertain -- this is to entertain the people there who have them but it was not like that in the old days. a bigger question asked which is how does it affect the elections. that is a quick answer. none. zero. let me tell you where the impact comes the impact comes when a president and i thought president obama did fine tonight. but i have seen devastating ones where presidents or for

instance the gridiron when nancy regan got up and did a dance thing and mocked herself changed her entire image in washington with the press and people in the community. presidents are the best ones the most memorable ones the presidents so self-deprecate themselves. president obama makes is stretch when tries to. >> you don't think that is as genuine when wanted to come across. >> you have to read the facial muscles. that is why the videos are so much better. bill clinton was good and regan. who was really great is jimmy carter because everyone thought he was studious and he would make such fun of himself. the presidents and poll texs particularly want to get through the night with people they hate basically. i shouldn't say hate.

they basically would rather do without but have enough impact. now, the problem is everybody wants to be with the celebrities and this is amazing story. >> the tables. cbs is bringing this one and fox is bringing. >> i don't even want to discuss who we have because i like my job but i think the problem is that to me is the most interesting story is how this became hollywoodized. and why we would even be covering it or as all the cables, one because cable and you can do that. >> but now that it is hollywoodized as you say -- >> i was there for the first event. >> how does this rate with the other dinners? >> this is -- let me explain the hierarchy. the radio and tv correspondents dinner is much looser. kind of what i would describe as that is probably like the golden globes everyone has a good time. the white house correspondents' dinner is a notch above that maybe like the emmies. the oscar goes to the gridiron dinner which will never be allowed to be broadcast there

you have to wear whitetails and that is like a five hour event. it is like that is the -- that is the granddaddy. >> and at the end of the day here how do you think jimmy kimmel did? >> i don't know how you wen that the. it is like giving the response to the state of the union. i don't know how you win at this. there have been people i have seen who have been hysteric and i thought he was okay. some of the stuff worked, some didn't. it was too much. it was -- but i he once saw louis black do it and he was hysteric. he said he was scared wittless having to get up there. >> but i also think as we look at this, some of the humor was so real. how the president's age. >> that was great. the funny stuff. >> morgan freeman in another four year. >> that was great and the dog video. the video stuff usually works the best. >> and i think it did tonight. pat thanks for being with us
