attorney general. darrell issa sending a 64-page draft order against the attorney general, calling his stonewalling over fast & furious inexcusable. but that's only part of it. tonight, the justice department is firing back. james cole writing a letter to congressman issa say that this committee has not taken sufficient steps to categorize the documents and its decision to issue a draft contempt citation appears to express a preference for confrontation over resolution. how close is attorney general holder to being held in contempt? dan burton is on the oversight committee. good evening. i have the 64-page draft from congressman issa. i am curious... how close is this to contempt? >> i think that if darrell could reach an agreement or understanding with the attorney general, i think we would hold

off. but he's been waiting and waiting and waiting. we have asked for 22 reports, dealing with fast & furious. i think we received 12 of them and those are only part -- partially complete. i think darrell's's been very, very patient. he has done everything possible to work with the justice department. but they are not complying. >> greta: all right. the reason they say they are not complying because there is an ongoing criminal investigation special they don't want to jeopardize the investigation by surrendering documents to you until it's over. you laugh? >> i laugh because when i was chairman of the government oversight and the attorney general then, the assistant to janet reno, we had the same problem getting documents. it's a constant response that you get. the fact of the matter is, the committee wants to make sure that they don't do anything to jeopardize a criminal investigation, but at the same time, the justice department

said one thing and 10 months later said another. and darrell issa, as i said, has been very patient as chairman. i think that we want to get to the bottom of this because we were seeing thousands of weapons, ak-47s and other things going across the border. one killed an american border agent special a lot of other people down there in mexico. we need to find out why this program started in the first place, who started it, why they started it. we have even had some of the agents like mr. alt who, testified and he was intimidated by the justice department a short time later over a minor infraction. and they're driving him drays because he was a whistle-blower. >> greta: well, in terms of the -- the -- when this first broke, they denied everything. and about 10 months later, they sent congressman a new letter, saying the previously written denial was sent in error. i am curious, is there any

time. i have spent a long time, working behind the scenes, trying to draw in people from the tea party, evangelical, social conservatives. we have to come together. everything'sae at stake. it's far different from the candidates. now it is about getting the country back on the right track. >> greta: but how do you inspire the evangelicals or the tea party, the people who have been very loyal to you for instance in this when it seems that i hear from you and speaker gingrich is that your support for governor romney, well, he's not as bad as the other guy. that doesn't seem inspiring. he's going to change things thid fix things. it's like, how inspiring is it to say he's not as bad as the other guy? >> the process of the primary makes the candidate so much stronger. of course, when each one of us were running, we had legitimate differences.

but now, they pale in comparison to what barack obama has done to the country for the last 3 1/2 years. i have full confidence in mitt romney's ability to be able to be our standard bearer for our party, more than just the republican party. i truly believe that he will appeal and reach out to independents and disaffected democrats because, after all, they don't want to pay 110% more for a gallon of gas at the pump. they want a job for their kids graduating from college. this is far more than partisan differences. i think it will be very easy for all factions to come together and get behind mitt romney. he is the guy that we can trust to put the economy back on track. >> greta: all right. jonathan carl reported that you told him that -- that governor romney can't beat -- this is obviously prior to today, that mitt romney can't beat barack obama because of the

massachusetts health care. has something changed since you told him that? have you rethought it? because that seems like a strong statement? >> it was a very strong statement. when i said that to jonathan carl, of course, it was in the primary election. something did change. let me tell you what it is. this was my major contribution to the presidential candidacy of the primaries. i have made obamacare a signature issue of mine because that was president obama's signature issue of his presidency. when governor romney began the primary process, he said that he was going to issue waivers to obamacare. and from my point of view, that didn't cut t. we need a full-scale repeal. today, i spoke to governor romney. he's fully behind full square repeal of obamacare and nothing less. that's a tremendous advancement in governor romney's view on obamacare. and i think this is exactly where the country is.

is standing full square behind the pro-life cause. he stands for life. he believes in marriage between one man and one woman. he stands for that. and also, he stands for the full repeal of obamacare. we have one chance to get rid of obamacare, the 2012 election. if governor romney is willing to stand behind the full-scale repeal of obamacare, that is a big get for everyone in this country. there are elements in our party for a social conservative that need obamacare repealed because it means for the first time in our country, taxpayers subsidized abortion, that's anathamma. it's the biggest job killer in the united states, not creating more jobs. this is a big get for our party. >> greta: suppose bithe end of june, the supreme court throws out the health care. that is -- that's what governor

romney -- many of his supporters are running on. suppose they throw that out. what you are running on july 1 to election day? >> well, that would be a wonderful advancement. i hope that the supreme court does declare obamacare unconstitutional because i firmly believe it is unconstitutional. and it's going to be anathamma for our economy. i am fully hoping they do that. if they do pull that down, there are so many issues to run on because obama has taken over other parts of the economy, with dod frank or the student loan industry. there is no shortage of issues to run on and the issue we talked about today inport -- in portsmouth is energy. many jobs can be created on energy. that's what governor romney is committed to doing. >> greta: congresswoman, thank you very much.

inside his southern california home on wednesday with a gunshot wound to the chest. his family is considering having his brain studied for football-related injuries. he played for the chargers, dolphin, as well as the patriots. i'm ainsley earhardt. we return to "on the record" with greta. and kickbacks. gsa isurn a criminal, not just a civil investigation. as if wasting tax dollars wasn't bad enough, the gsa employees did something worse now. did they break the law? byron york is here. byron, what's this investigation? >> you know, i think we should file this under the mystery category. we are not sure what happened. but there was a program, a bush-era program, passed in 2005, to encourage contractors to crosscourt energy-efficient buildings. it gave them a tax deduction. so this has been existing for a

while. in 2011, the obama administration adds a wrinkle to it, which is if you air contracteddor and you want to get this tax deduction, you need to write a check for 19% back to the gsa. now the gsa said that this money would be used to encourage the construction or updating of more energy-efficient buildings, but when republicans on the hill found out, they said, this sounds like a kickback. so they have asked the gsa and a bunch of questions. gsa came out with a statement today and said that, okay, we did have this program. it began in may of 2011. it ended by december of 2011. no contractors ever paid anything. so it's like, we never did it. but republicans want to find out exactly -- >> greta: it sounds like they are skimming off the deduction, taking a piece of it -- >> well, basically -- >> greta: first of all, they say they haven't done it. let's leave that open for investigation. >> the most suspicious scenario

>> i think most would say, this is a top 5 battleground state. we are truly purple, the last 10 cycles, we have had five republican governors and five democrats. i think it's a right of center state. the independent voters are leaning conservative. in 2008, the president ran a great campaign about hope and change. now it's recession and division is what the message has turned into. the last couple of cycle, republicans have made big gains. i won by 18. so i think it's an important battleground state. it's hard to imagine a real clear path for the republicans without virginia. >> reporter: how confident are you that you can return it back to the republican column? >> it won't be for lack of effort. we are working very, very hard. we have good organization, around the state. people are motivated. we just finished the inter-family battle for the republican nomination and mitt romney is clearly a nominee. we have a period of coalescing
