"america live" starts right now. >> reporter: we begin with a fox news alert as a plane bound for north carolina makes an unexpected stop after a passenger apparently makes a deadly threat. welcome to a brand-new hour of "america live." i'm shannon bream in t for megyn kelly. there are reports that one passenger may have threatened to blow up that plane throwing tsa and maybe the air guard into high alert. trace gallagher is live in los angeles with more. hi, trace. >> reporter: there are reports, shannon that this plane was met by air force traffic by fighter stkwrets t jets into bangor maine. from paris bound for charlotte, north carolina this is flight 787. it's a boeing 767 with 179 passengers on board, and nine

crew members, and now we're being told the plane is safely on the tarmac in bangor, maine but it's on a secluded tarmac and now the authorities apparently have met that plane. it's very unclear if the passengers have actually got even off. the reports are there was a woman, apparently on board this plane making some threatening remarks. you mentioned a bomb. that came from the scanner traffic between the airport as well as the police and first responders there, and we're being told that this plane actually came in to bangor pha*eupbg an maine, and the status was, this was an emergency aircraft. we called norad, they have not got even back to us as to whether or not fighter jets were in fact scrambled. as we get more information on the passengers and what happened on board this plane we will get back to you shannon. shannon: we can't wait to hear more. thank you. fox news alert on some ugly language in the explosive debate

over governor mitt romney's tenure at a private equity firm bai bain capital. congressman jim clyburn doubled down on the president's attacks on governor romney saying his work as an investor involved, quote, raping companies. that comes less than 24 hours after president obama used the nato stage to defend his kreut teak of governor romney's time at bain. take a listen. >> i think it's important to recognize that this issue is not a, quote, distraction, this is part of the debate that we're going to be having in this election campaign about how do we create an economy where everybody from top to bottom, folks on wall street and folks on main street have a shot at success? and the reason this is relevant to the campaign is because my opponent, governor romney, his

main calling card for why he this is he should be president is his business experience. yeah he's not going out there touting his experience in mass marks he' massachusetts, he's saying i'm a business guy, and i know how to fix it and this is his business. and when you're president, as opposed to the head of a private equity firm, your job is not simply to maximize profits. your job is to figure out how everybody in the country has a fair shot. shannon: a new poll from "the washington post" finds that a wide majority of adults don't believe that governor romney's past of buying and restructuring companies is a major reason to vote for or against him. so does the president's argument hold water and could it actually backfire on him? chris stirewalt is a host of fox business, we welcome both of you, gentlemen.

pat you are a pollster, you know how these things play out with the electiowith thewith the electorate. >> most people are looking for any answer, they are democrats, the others on the other side. the voting decision is a complex one. i found it somewhat amazing to hear barack obama attacking someone who has real world experience, because when he was running in 08 he made the case for the fact that he had no experience, basically, except a few years in the state senate voting present, in the illinois state senate. and two years in the u.s. senate, and some work as a community organizer was enough to be president. that has been a problem for him. but i do know why they are doing this. they are doing this not so much for bain, bob schlrum who did the advertising for ted kennedy against romney in 94 saying this

is how we did it it works, the internal campaign in chicago, the obama campaign is torn apart on what to do. this is their latest idea. i think it's a mistake for several reasons. the reason they are doing it is romney's numbers are so bad in terms of connecting with people. he's had this problem in the primary, he's had it since, what things he says he has yet to connect with those voters, and those are the voters that obama is in trouble with as chris can tell you, blue collar, democrats, independents, people who are working people, he's got real problems and romney has connection problems, this is an effort to blow that up. shannon: there have been a number of democrats that weighed in in various ways on these bain attacks. i want to play a little bit from senator clyburn and get your reaction. >> there is something about raping companies and leaving them in debt and setting up

swiss bank accounts in corporate businesses in the grand caymens, i have a real serious problem with that. shannon: chris, some people are going to have a real serious problem about that particular language. >> well the reason, shannon that you've heard mark warner, senator from virginia, corey booker,ed rendell, very prominent, influential moderate democrats cautioning the president against this line of attack is because that's writ goes, that is the problem with this for moderate democrats, is that it goes to where jim clyburn took it, which becomes this attack on the very practice of trying to turn these failing companies around and it becomes an indictment of those things. and for the president who is seen by a plurality of voters as too liberal he must not find himself associated with that kind of rhetoric. it would be absolutely poisonness to his chances for re-election. >> let me say that is what i felt was the problem in chicago, chris is exactly right,

yesterday. the president of the united states has been doing better the last week, because he was being commander-in-chief. yesterday he went back and became negative campaigner and chief using a forum for nato to attack his presumptive republican opponent in may. i don't think in american history that's every happen. every time he gets down being a hack, this is a man who was going to transform politics, he hurts himself in my opinion, number one, number two he has opened the door. if the romney people and the republicans were not so lame politically in terms of their campaigns they would have already had ads up like the bain stuff on the closing down of chrysler dealerships, people were laid off, there is so much. the other issue is when they get into these attacks on corporations the president's leading with his chin. he was here in new york last week at a hedge fund, fund-raiser, he is raising millions of dollars from wall street and these rich people, the very people easy tacking and

he's giving money awful it in somewhat corrupt ways, a lot of it i mean to green companies, to his donors. this is an issue -- let me tell you something, if i were doing that campaign he'd be in deep, deep trouble. shannon: chris i want to give you the final word here. >> just that, for the president it should not be surprising to democrats that he is using this line of attack because this is the same thing he did to hillary clinton. this is what he has done in the past, though what they need to hope is that he gets off it relatively soon, hope that it taints romney but he probably needs to get away from it because it will not wear well. shannon: chris stirewalt, pat ta del, thank you gentlemen. the governor also said that governor romney's background with bain capital is what the campaign will be all about. we're going to debate it, a fair & balanced debate on that in the next hour.

new numbers out on the housing market and for once it's not all bad news. home resales rising in april to the highest rate in nearly two years. the national association of realtors reports that existing home sales increased 3.4% to an annual rate of 4.62 million units last month. that is the highest that we've seen since may of 2010. experts say the market is showing some signs of life, that number is well below the nearly 6 million sales per year economists say we've got to have to get healthy markets. those numbers raising serious questions now for housing advocates launching new kreu criticism at the president's new task force to investigate mortgage fraud and what it has at the heart of its mission. jaigregg jarrett is explaining this. >> big promise else often get big resentment if it's not fulfilled. in an election year that could spell trouble. who in america hasn't been hurt by the housing crisis in

news about that plane bound for north carolina forced to tee tour to maine after some kind of security alert. we just got some of the exchange between air traffic control and the jet in question. trace gallagher its work bein is working the story from our breaking news decks. >> reporter: the north american air defense control has now confirmed that two f-15 fighter jets were scrambled from barnes air national guard in massachusetts. they intercepted the plane and trailed it all the way into bangor, maine. there were reports of a bomb threat on board. that is what the scanner traffic had. the plane has now been met by authorities. listen now to the exchange between the tower, and the pilot, play.

[inaudible] shannon: that off mike moment made interest national headlines for president obama as he spoke with the russian president about a controversial missile shield project. the first phase of the european defense shield has become quote provisionally operational now. that is not welcome news to

russia because it has previously gone so far as to threaten a preemptive strike if it believes its own nuclear deterrents are ever in jeopardy. here to talk about it is jack keane, former four-star general and fox news analyst. great to see you today. >> good to see you. shannon: what do you make of the word that nato is saying that despite russia's push back part of this missile defense shield is up and running. a u.s. ship that can serve as part of a shield? >> that is not the entire shield certainly, but part of it is truly complete. what is really happening here, shannon, is the world has changed. when we had the big five the you nighted states, the soviet union, the united kingdom, france and china, phaoul, then the weapons spread to israel, pakistan and india, and now to

north korea for certain and possibly iran around the corner, and that's what's got the europeans and the united states so concerned. that unpredictable irrational states would use those weapons for political reasons for destruction, their unpredictability. thus some of the shields we have in the pacific after the west coast of the united states. the russians don't like it and they are reacting to it. shannon: they are saying that these threats you're talking about, worries about other nuclear states, that it's over blown, it's not a legitimate threat and in some way the shield is going to be used against them. these what they are saying publicly. is that a rational thought? >> here is where the russians are coming from as best as we can tell. number one their conventional military is in terrible shape. they are a mere shadow of their former self, and putin and his predecessor are trying to

rebuild it. the security of russia depends on their nuclear deterrence. even though there is not a realistic threat against russia. nuclear deterrence is the way they would have to defend the country. they believe a nuclear shield in europe really unifies nato and makes it stronger than what it was. in their judgment it upsets the balance of power against them. and i think that really is at the heart of the issue here. and fundamentally we don't have good dialogue on this. the trust isn't what it should be. putin, who is back in pow per, he just had an election, and he blew off the g-8 meet things that were held at camp david here in the united states, and the fact of the matter is here have an election coming in november. i'm not certain there is going to be serious diplomatic progress made over this issue until our own election has taken place. shannon: general jack keane, always appreciate your insights, thank you sir. >> take care, shannon.

washington state of a 13-year-old boy trapped on the edge of a waterfall for more than eight hours. newly released video showing the teen desperately clinging to the side of a rock just on one false move standing between him and a 270-foot drop. trace gallagher has more. >> reporter: it is amazing shannon. 13-year-old william hick man was wading in the water upstream, he slip, fell an was pushed by the whitewater over a ten-foot waterfall. then he starts going down the rapids and he's getting near that 270-foot waterfall you're talking about. 270 feet is a hundred feet higher than niagara falls. he managed to grab onto this edge. look at the rescuer. the boy is behind him right there. see that at the bottom of the screen, that is over the falls, 270 feet. he held onto that edge eight and a half hours. 5:00 at night until 1:3030 in

the morning. they had to try and tie the boy up to all the lines to keep him secure again, eight and a half hours they finally lifted him. here is now one of the rescue team. >> he's a smart kid. he asked me if i had a plan. [laughter] >> and i said, yes, we have a plan and we're working on it, and a couple of seconds later he says, is your plan going to work? >> reporter: well the plan was to hook him up to the harnessess and get him and the ladder secure. the problem was the water began rising as they put that ladder across. they had to move fierce than they anticipated. they finally pulled him 0 offer onto a different, safer area and camped there overnight. the boy tried to keep his cool, you'll hear, but he knew he was in trouble. listen. >> trying to get everybody calm, so they could think and i was like, i'm safe.

shannon: more information now on breaking news on a plane bound for north carolina forted to detour to maine after some kind of security alert. we have the first images of the 767. it touched down in bangor, maine with a fighter jet escort. sources tell fox that a female passenger, quote, behaved in a surprising manner. we're told all the checks president bush done thaepb came uand they came up with nothing. she does nochecks were done and they found nothing. she does not appear to be an american citizen. we'll update you more when we get more information. shannon: just before the supreme court could issue a historic ruling on the healthcare law the feds have reached a $20 million

deal with the pr firm to promote the law to the american people, raising questions about why spending $20 million right now on a law that could be ruled unconstitutional any day makes sense. leslie marshal is a syndicated fox news host and fox news contributor. lars larson joins us also. we expect another round of opinions from the supreme court on tuesday. no clue whether the healthcare law will be included. they are going to make a raoufplgt with the chance that they could strike down part or all of the law, why spend the $20 million? >> well, honestly, i know lars is going to completely disagree with me, just because it's tuesday, right, lars? on this especially. >> you bet, i won't disappoint. >> one of the things i have to say and i've always said that the democrats really failed at doing was to present the information in a concise and understandable manner to the american people. i can't tell you how many times this issue comes up on my talk

show and people will call in and have completely misinformation, wrong ideas on what is in there. to spend the money to let the american people know, because i believe strongly that the supreme court is not going to throw the whole thing out. i mean if they consider the mandate unconstitutional. and how do you say to americans, oh, you know, if you have a preexisting condition, well, too bad. how do you say, let's plug up, let's put a hole back where we plugged up that hole in the doughnut for those seniors on medicare. so the american people need to know, especially because there is an election in november, not just for president, obviously for positions in the house and the senate. they need to be informed so that they get the correct information as opposed to a lot of the misinformation which i believe is the american people's misperception of the affordable care act. shannon: this money was built into the act to go ahead and pay for the pr to be out there. it's not a distinct, operate expenditure. it was already built into the

law. >> well, but what is foolish about this. and in this case what leslie is ignoring, the elephant, or in this case the donkey in the living room is that the supreme court is probably going to scrap this law, and if they scrap the mandate of course that she referred to they are going to scrap the whole law because there is no severability clause. without getting into the weeds. the reason the president wants to spend this $20 million right now instead of waiting a month or so, end of june we'll know one way or another is he doesn't want to be skapd. this is $20 million that will be used by a federal government agency, money from the tax bayers to promote president obama and his idea. the fact is leslie knows that it's members of her party who said, gosh we have to pass the law to find out what is inside of it. and, frankly, i don't think any of us know exactly how this law is going to roll in. there are going to be tons of unintended consequences. i think the president already knows, we saw in the speech he gave after the arguments, he's very angry about this. i think he's angry because somebody already slipped the

word to barack obama this law is dead in front of the supreme court. so if he doesn't start spending the money now to benefit his campaign then he's not going to be able to spend it at all when they scrap the whole law. shannon: lars you mentioned a possible leak there. i can tell you the supreme court is one of the titless places in washington, very tough to get information out of there. i know there is speculation that somehow the president has been tipped off but we certainly don't know for sure yet. i want to point to some fox polling that we had just after the arguments asking folks what they thought the supreme court should do. 66% of them said strike part or all of this law. do you think that is because they had misinformation about what is in it? >> i do. i honestly do. because i'm just amazed. first of all, lars, you know you say, they have to read it to know what is in it. one thing to be accurate, most congressional members and it's really sad don't read almost every piece of legislation that they vote on. >> that's not an excuse, leslie. >> it's not an excuse but it's a reality. if you want to say they don't

read this one let's talk about all the others that you guys tried to push through that they haven't read. when we deal with the perception, absolutely. the perception is that they have to lose the insurance they have now if they are happy witness. the perception is this they will have to pay more. >> they are, they are. >> taxes will be increase towed pay for it. the perception is that they will lose this business if this is passed. the perception is everything goes into effect tomorrow and jobs will be lost. the list goes on and on of information that is just not accurate. >> leslie, let me point out something to leslie that she is ignoring. i've already lost money and so has ever other american who had a flex plan, for example because obamacare puts the flex plans in half. that means an awful lot of americans who used those plans to pay for their kids braces or to pay forest specially for special needs families who have kids with special needs, they cut that thing in half. that already is a fiscal impact

on an average american family of $500 in additional taxes that they have to pay already. so when you say that is not going to happen, second issue is, we've already got companies that are discussing whether it makes more financial sense to pay a small fine and dump their health insurance, group insurance for all their employees, and throw people under the government healthcare insurance bus, and they are saying, this makes financial sense, we're going to have to do it that way, competition in the american marketplace will force them to. so, leslie, people are already losing t the healthcare that they loved, which shows one of the lies from president obama and it was a lie. and they already are paying this year more taxes. so those are two misunderstandings. i know if we were all as smart as liberals we would just love this thing to death. fortunately some of us can see through the baloney that comes from the white house on this and now the president wants to spend $20 million to promote baloney. shannon: a second left, leslie, a final quick word here.

shannon: police making a new arrest in the case of a missing california teen. 15-year-old sierra lemar vanished more than two months ago on her way to school. the police recovered her handbag and cellphone near her bay area home. detectives arresting a 21-year-old suspect on suspicion of kidnapping and murder. police say, quote, a lot of physical evidence ties the suspect to the case. we have an update now on a story we first brought to you yesterday right her on "america live." a north carolina teacher, caught on tape yelling and even threatening one of her students for criticizing president obama. now there is word that teacher

has been suspended. trace gallagher has the very latest from los angeles. >> reporter: in fact the teacher and the student are no longer at the school. the teacher suspended with pay until the investigation is done. the student, 17-year-old hunter rogers is now finishing his high school diploma at a community college, and the reason that he had his friend tape this conversation with the teacher is because he says this kind of stuff happens every week. listen. >> i've been taught all my life that nobody can take your opinion, or nobody can take your freedom of speech, and she was telling me that i could be arrested for slander, and i've been told all my life you'd have to threaten the president to get arrested. >> reporter: that was not the proper sound byte. he did make his point there. what he was going onto say earlier was the fact that look, every week she would challenge these students with her point of view and did not want to listen to theirs. this argument began when she said the fact of the day was that mitt romney was a bully back in high school, and one of

implanted surgically in her body. he says there was a group of doctors on board this airplane that apparently checked her out, and didn't find any scarring or any signs that she had recently had a surgery. and now fox news has confirmed that the authorities say this woman did not pose a threat. there you see the plane on the tarmac in bangor, maine. it's been pulled to the side. the passengers have left the plane. they are now being rebooked. this thing was actually intercepted by two f-15 fighter jets at 9:40 this morning when this bomb threat came over. it was escorted to bangor, maine. it is u.s. airways flight 787, it's a 767 with 179 passengers on board, and nine crew members, and now you see it on the ground there. i mean, clearly, this comes -- yeah i want to play this for you. we have the cockpit audio, listen.

shannon: new worries for the white house. president obama facing an historic challenge on a critical economic question. we have big polls on the economy from rasmussen reports and the "washington post." in this "washington post" poll 83% of voters say financially things have not gotten better for them the last four years. 53% say things are the same. those are the lowest marks of any of the last five administrations. democrats and republicans alike. and the president isn't getting high marks on his handling of the economy. in this rasmussen poll the majority of americans think the president is not doing a good job. 62% to 38% who think he's doing all right. here is stu varney and scott

rasmussen, independent pollster and author of "the people's money." stu, how worried should the white house be about these numbers? >> that question are you better off goes to the heart of the president's problem it's a question but, the man yib the spend power in your pocket, it's about the housing market. this is not some fansy wall street jargon, stocks and bonds and earnings per share. on those three issues you are not better off than you were four years ago. the spending power of the money in your pocket has gone down largely because of high energy and food prices. the rate of job creation is cut in half. there are half a million paychecks fewer than there were four years ago and as for your house, prices are down 30% from where we were four years ago. a quarter of the people with a

any president for the past five administrations all the way back to president reagan. when you ask people how are they doing compared to four years ago and the rest of the economy. this is the lowest number for president obama amongst five administrations. what do they do with that? >> they are going to focus on the trend and say the would have been worse if we weren't here. they will try and work their way out of this. but the reality is we are a nation where a majority of the americans say what recovery? majority told us every single night for four years the country is still in a recession. and that attitude has led people to think it's no longer a business cycle, something fundamentally has gone wrong. white house will try and say we are rebuilding and putting a foundation for something brighter. you have to look beyond the short term. mitt romney will say, do you think obama deserves four more years? do you think he will be better

we'll continue to think so until we have reason to believe otherwise. that she is out there. and we are going to find her. and people are eventually going to get sick of seeing us, because we are not going to stop until we find out where she is. megyn: there was so much attention on you by the police and the media, why come out now? you didn't get arrested. the case has been quite, you had to be a little fearful because the cops were looking aught and talking about you and failed polygraph, they later told joe that wasn't true. why come out now? >> she is still not home. >> that the point. the common sense thing to do if you are representing individuals who perhaps are guilty or you think might be involved would be

to bunker down and keep your head down. as each day pass it's less likely they would be charged if they were involved. from a defense attorney standpoint. megyn: didn't you tell them don't do this? >> no, i didn't tell them don't do this. it's not risky because they are innocent and more importantly i'm not representing them as a defense attorney. i'm representing them as a victim's advocate. they want answers and they want their baby. wild horses couldn't keep these two out of the national media for the purpose of keep can the attention on the recovery of this baby. megyn: she would be 18 months now. have you talked with any experts about what she would likely be doing? have you been working on getting a composite together? >> i'm told you are sported to wait until the child is 2 years -- you are supposed to wait until the child is two years of age but we are looking into it ourselves.

megyn: when we last spoke you had left her room intact. have you done anything since then? >> we had to go through and clean up from the house being destroyed on the police search. so we put it all back the way it was. and the on thing that's changed in her room is all the presents that everybody has gotten her for christmas and et cetera, and her birthday, we have it all situated on the floor there. but everything else is still where it was. and her high chair is still in the kitchen. >> it will stay that way until she comes home. megyn: every parent knows when you have a 10-month-old baby you are with her all day long, you get her out of her crib in the morning and you put her down at night. do you go in that room? >> all the time. megyn: what is that like? >> it's painful because i miss her. but it feels good because i know she'll come home and be back

there again. megyn: how do you explain to your boys the situation she has been gone for so long, jeremy. >> we keep promoting a positive -- to the boys, she is not home right now, but we are finding her, we are looking for her. everybody is looking for her. we are going to get her back. everything is going to be fine. and just try to keep them in their daily routine. they have been through a lot just not having their sister there. the on thing you can do is try to keep something normal for them, keep their lives as normal as possible. megyn: when you walk in a mall through a crowd ... >> i look at every single baby. by the time i leave a public place i'm so drained from staring at every kid, even the

boys. we don't know what they have her dressed lining. we don't know if her hair has been cut or if it was longer. i imagine she would have more teeth by now. megyn: does she have a birthmark? >> she has a small beauty mark on her right outer thigh. and it's noticeable because she is a baby and her legs are perfect. megyn: when you walk out in the crowd and you see these people, do they look at you differently? do you feel people have a recognition of you? and how do you think you stand with the american public? do you think they are looking aught as possibly having done something to your child? >> probably so. i mean -- we don't know where she is. we don't know whose got her. and there are people that do bad things to their children. so the whole point of it even if somebody is kind of -- you catch

a sideways glance at mall or supermarket. but it's even that is good because if they know who we are, then that means that they are keeping their eyes out for lisa. and that's what really matters right now. megyn: debra i want to give a chance to address if somebody is out there and has your baby and they are watching, what would you like to tell them? >> please do the right thing for lisa. she deserves to be home with her brothers and mom and dad. it's not right. you think you deserve her, but you don't. she deserves to be with us and we deserve her. there is still a $100,000 reward for anyone who knows anything. there is still a benefactor and none of us are going away until we get our daughter back. megyn: thank you very much.
